Rights Over Borders: Transnational Constitutionalism And Guantanamo Bay, David Cole Jan 2008

Rights Over Borders: Transnational Constitutionalism And Guantanamo Bay, David Cole

Georgetown Law Faculty Publications and Other Works

This essay argues that the most profound implications of the Supreme Court’s decision in Boumediene v. Bush may lie not in what it says about the place of law in the war on terror, but in what it reflects about the Supreme Court’s altered conceptions of sovereignty, territoriality, and rights in the globalized world.

Boumediene was groundbreaking in at least three respects. For the first time in its history, the Supreme Court declared unconstitutional a law enacted by Congress and signed by the president on an issue of military policy in a time of armed conflict. Also for the first …

Privacy, Visibility, Transparency, And Exposure, Julie E. Cohen Jan 2008

Privacy, Visibility, Transparency, And Exposure, Julie E. Cohen

Georgetown Law Faculty Publications and Other Works

This essay considers the relationship between privacy and visibility in the networked information age. Visibility is an important determinant of harm to privacy, but a persistent tendency to conceptualize privacy harms and expectations in terms of visibility has created two problems. First, focusing on visibility diminishes the salience and obscures the operation of nonvisual mechanisms designed to render individual identity, behavior, and preferences transparent to third parties. The metaphoric mapping to visibility suggests that surveillance is simply passive observation, rather than the active production of categories, narratives, and, norms. Second, even a broader conception of privacy harms as a function …

Review Of The Examination Processes For Membership And Fellowship Of The Australian College Of Veterinary Scientists, Gabrielle Matters Jan 2008

Review Of The Examination Processes For Membership And Fellowship Of The Australian College Of Veterinary Scientists, Gabrielle Matters

Monitoring Learning

This paper deals with examinations administered by the Australian College of Veterinary Scientists (ACVSc) (herein referred to as ‘the College’) to veterinarians at two levels – membership and fellowship. Membership examinations are set at a level that denotes an above-average level of expertise of the candidate in a particular field, signifying advisory status but no specialist status. Fellowship examinations are set at a very high standard and are intended to signify specialist status. The system of examinations administered by the College involves two components –written and oral/practical. Candidates, for both memberships and fellowships, sit the written examination in early June …

Seasonal Changes In Diel Cycling Of Dissolved Iron Species In A Coal Mine Drainage Impacted Creek, Daniel B. Harris Jan 2008

Seasonal Changes In Diel Cycling Of Dissolved Iron Species In A Coal Mine Drainage Impacted Creek, Daniel B. Harris

Graduate Theses, Dissertations, and Problem Reports (ETD)

Diel fluctuations of pH, specific conductance and Fe species have been documented in Dillan Creek, a small coal mine-impacted tributary to Deckers Creek, WV. Samples were collected hourly over 16-20 hour periods and analyzed for dissolved Fe(II) and dissolved total Fe using a Hach DR2800 spectrophotometer. Fe(II) concentrations increased during the day and decreased at night during late winter sampling. Sampling conducted in the summer shows an opposite trend with Fe(II) increasing at night and decreasing during the day. Discrepancies between timing of cycles indicate a seasonal variation of controlling mechanisms. In winter, iron cycles are likely controlled by photoreduction …

An Bhuil Gaeilge Agat?: Perspectives On The Irish Language In Ireland, Georgia Katherine Fyke Jan 2008

An Bhuil Gaeilge Agat?: Perspectives On The Irish Language In Ireland, Georgia Katherine Fyke

Honors Theses

The future of Irish as a living language is uncertain, and some fear it will vanish completely. In this paper I explore how the main language of Ireland shifted from Irish to English and discuss the perspectives of the Irish themselves toward the Irish language. Chapter 1 summarizes the history of the language from its introduction to the island by the earliest Celts to its current secondary role. Chapter 2 reviews the concepts of language death and revitalization both generally and as they apply to Irish, using models by David Crystal and Joshua Fishman. The final chapter is an analysis …

The Impact Of Short-Term Missions On The Participants Of The Berkshire Mission Group, Garold Ray Wagner Jan 2008

The Impact Of Short-Term Missions On The Participants Of The Berkshire Mission Group, Garold Ray Wagner

Doctor of Ministry Projects

Problem

The face of missions is changing. While regular mission service (long-term) is still very much needed and extant, it no longer dominates the missions landscape. Fewer people are being sent to third-world or developing countries from North America to serve long term for positive reasons. There has been, however, an explosion in the number of people traveling to other countries for short terms and very short terms. While focus has shown that teens and young adults are positively impacted, no study has shown the impact on people of all age groups who go for this type of service.

Method …

"Now For A Clean Sweep!": Smiley V. Holm, Partisan Gerrymandering, And At-Large Congressional Elections, Benedict J. Schweigert

Michigan Law Review

The 1930 Census reduced Minnesota's apportionment in the U.S. House of Representatives from ten to nine, requiring the state to draw new congressional districts. The Republican-led state legislature passed a gerrymandered redistricting bill in an attempt to insulate its nine incumbents in the state's delegation from the party's expected loss of the statewide popular vote to the insurgent Farmer-Labor Party. When the Farmer-Labor Governor, Floyd B. Olson, vetoed the redistricting bill, the legislature claimed the bill could take effect without the governor's signature. In Smiley v. Holm, the U.S. Supreme Court decided that the veto was effective and that …

Evaluation Of An Oral Vaccination Program To Control Raccoon Rabies In A Suburbanized Landscape, Jason R. Boulanger, Laura L. Bigler, Paul D. Curtis, Donald H. Lein, Arthur J. Lembo Jr. Jan 2008

Evaluation Of An Oral Vaccination Program To Control Raccoon Rabies In A Suburbanized Landscape, Jason R. Boulanger, Laura L. Bigler, Paul D. Curtis, Donald H. Lein, Arthur J. Lembo Jr.

Human–Wildlife Interactions

We evaluated the efficacy of an oral rabies vaccination (ORV) program conducted in Erie County, New York, from July through September, 2002–2005. Ingress of the raccoon (Procyon lotor) rabies variant first occurred along the southern border of Erie County, New York, during 1992 and began to spread northward at a velocity of 31 km/year. Fixed-wing aircraft dropped ORV baits in rural landscapes; helicopters, hand baiting, and bait stations distributed baits in suburban landscapes (x̄ bait densities ranged 59–118 baits/km2). Our study objectives were to quantify rabies case densities, evaluate efficacy of intervention efforts, and determine biological, …

A Bulwark Against Anarchy: Affirmative Action, Emory Law School, And Southern Self-Help, William B. Turner Jan 2008

A Bulwark Against Anarchy: Affirmative Action, Emory Law School, And Southern Self-Help, William B. Turner

UC Law Journal of Race and Economic Justice

This article demonstrates that Pre-Start, Emory Law School's affirmative action program from 1966 to 1972, provides a useful case study for refraining the current debate around affirmative action in law school admissions. The author performs post-hoc strict scrutiny on Pre-Start, showing that it meets and exceeds the standard set in the leading affirmative action case, Grutter v. Bollinger. The historical context for Pre-Start demonstrates how similar the current arguments against affirmative action in law school admissions are to the arguments used against racial integration of public schools in the first half of the twentieth century. This analysis provides valuable historical …
