Order Without (Enforceable) Law: Why Countries Enter Into Non-Enforceable Competition Policy Chapters In Free Trade Agreements, D. Daniel Sokol

UF Law Faculty Publications

There has been an explosion in the past ten to fifteen years of bilateral and regional free trade agreements in Latin America (together, preferential free trade agreements or PTAs). The purpose of PTAs is to increase trade, regulatory, and investment liberalization. As trade liberalization requires more than just a reduction of tariffs, PTAs include "chapters" in a number of areas of domestic regulation. These chapters that address domestic regulation create binding commitments to liberalize domestic regulation that may impact foreign trade. Among chapters that address domestic regulation, many of the Latin American PTAs include a chapter on antitrust or competition …

The Irs' Classification Settlement Program: Is It An Adequate Tool To Relieve Taxpayer Burden For Small Businesses That Have Misclassified Workers As Independent Contractors, Judson D. Stelter Jan 2008

The Irs' Classification Settlement Program: Is It An Adequate Tool To Relieve Taxpayer Burden For Small Businesses That Have Misclassified Workers As Independent Contractors, Judson D. Stelter

Cleveland State Law Review

This Note argues that the timely filing of informational tax forms should not be a condition of an IRS Classification Settlement Program (CSP) settlement offer; the CSP should incorporate more settlement options; and the CSP should make settlement offers mandatory. Part II of this Note will discuss the legal history behind worker classification. Part III will demonstrate the unique situation of the small business owner in classifying workers. Part IV will explain § 530, a safe harbor provision for small business owners who have incorrectly classified workers. Part V will introduce the CSP in detail and explain its applications. Part …

Theses and Dissertations

This thesis explores the history of the Rush Creek Mining District from 1886 to 1918. The Rush Creek Mining District is located in the southeast corner of Marion County in north central Arkansas. During the 32 year period from 1886 to 1918 approximately 26,000 tons of zinc ore concentrates were mined from the district, making it the largest producer of zinc in northern Arkansas. During these years the community of Rush grew from a tiny mining camp to a town of approximately 1,500 to 2,000 people during the height of the mining boom during World War I. A review of …

Historical Comparative Case Study Of Emerging Hegemonic Behavior: Perspectives On The Peoples Republic Of China, Samuel Achinonu Onyegam Jan 2008

Historical Comparative Case Study Of Emerging Hegemonic Behavior: Perspectives On The Peoples Republic Of China, Samuel Achinonu Onyegam

Theses and Dissertations

Will the future of hegemonic politics resemble the past? In the post-Cold war world, emergence of new actors will likely reshape hegemonic politics and potentially reconfigure the balance of power. As the world shifts from one era to another, the behavior of emerging actors like China will have far reaching implications. As the post-Cold war world's emerging hegemonic power, China presents the most challenging questions for scholars of international politics. This study draws from historical patterns detected from the behavior of two key hegemonic powers of the past fifty to a hundred years—Germany 1866-World War II and the United States …

Memories Of Home: Reading The Bedouin In Arab American Literature, Anissa J. Wardi, Katherine Wardi-Zonna Jan 2008

Memories Of Home: Reading The Bedouin In Arab American Literature, Anissa J. Wardi, Katherine Wardi-Zonna

Ethnic Studies Review

In an urban neighborhood with a large Jewish population near my home, there is an Arabic restaurant. Name, menu and ownership mark its ethnic identification, yet its politics are otherwise obscured. An American flag, permanently placed in the restaurant's window since 9/11, greets American customers with a message of reconciliation. I am one of you, it says: come; eat; you are welcome here. In a climate where "Arabs, Arab-Americans and people with Middle Eastern features, everywhere are struggling to merely survive the United States' aggressive drive to 'bring democracy to the Middle East'" (Elia 160) and where the hostility toward …

The Relationship Of Participatory Democracy To Participatory Law Formation, Christiana Ochoa Jan 2008

The Relationship Of Participatory Democracy To Participatory Law Formation, Christiana Ochoa

Indiana Journal of Global Legal Studies

While the traditional doctrinal formulation of customary international law (CIL) has focused exclusively on state practice and opinio juris, in the modern age, it is undeniable that individuals and non-state collectives of individuals are increasingly becoming relevant to this process. It is thus useful to analyze individual participation based on the model of participatory democracy, and also in contrast to representative democracy. By doing so, the nuanced relationship between participatory law formation and democratic participation in lawmaking is brought into relief.I n light of larger modern trends within international law, the participation of individuals in law formation requires further examination …

Securing The Global City: Crime, Consulting, Risk, And Ratings In The Production Of Urban Space, Katharyne Mitchell, Katherine Beckett Jan 2008

Securing The Global City: Crime, Consulting, Risk, And Ratings In The Production Of Urban Space, Katharyne Mitchell, Katherine Beckett

Indiana Journal of Global Legal Studies

The last decade has witnessed the rise of private transnational institutions that increasingly influence the organization and management of urban space. Two institutions are especially powerful in this regard: bond-rating agencies and global security firms. Bolstered by a discourse of risk and the need to securitize cities, these institutions have garnered enormous amounts of power with respect to urban social and spatial control. They are implicated in the imprisonment and displacement of marginalized populations, the intensification of gentrification, and general shifts in municipal funding priorities. The authors illustrate these themes through a case study of New York City, followed by …

Global Panopticism: States, Corporations, And The Governance Effects Of Monitoring Regimes, Larry Catá Backer Jan 2008

Global Panopticism: States, Corporations, And The Governance Effects Of Monitoring Regimes, Larry Catá Backer

Indiana Journal of Global Legal Studies

Regulatory power has become fractured. Its assertion both by public and private bodies is well known. Less well recognized is that the expression of this regulatory power has been fracturing as well. No longer confined to positive regulation or judicial decision, the techniques for enforcing regulation are substituting for regulation itself. This paper examines surveillance as a mechanism through which power is asserted and regulation effected in a world of shared public/private governance. For this purpose, understanding the nature of surveillance as a technique of governance, and as a substitute for governance itself, is a key element for understanding political …

Reconstructing Contemporary Democracy, Jan Aart Scholte Jan 2008

Reconstructing Contemporary Democracy, Jan Aart Scholte

Indiana Journal of Global Legal Studies

Democratic practice varies historically, and transformations of the societal context require accompanying reconstructions of democracy if "rule by the people" is to remain meaningful. Contemporary society is witnessing particularly profound changes in underlying structures of space, governance, and identity. Fundamental reconsideration of democracy is therefore also needed. This article first develops a generic understanding of democracy; next elaborates on currently unfolding transformations of geography, regime, and community; and then develops a five-faceted reconstruction of democracy to meet these changed circumstances. This prescription entails: (1) reconceptualizing democracy, shifting away from obsolete assumptions of territorialists pace, statist regulation, and nationalist identity; (2) …

Unprofitable Lending: Modern Credit Regulation And The Lost Theory Of Usury, Brian Mccall Jan 2008

Unprofitable Lending: Modern Credit Regulation And The Lost Theory Of Usury, Brian Mccall

Faculty Articles

With almost daily news stories about the crisis in our credit markets, it seems inevitable that a new political and academic debate about credit regulation is commencing. With Americans paying billions of dollars in finance charges every year and some loosing their homes, it is time to ask fundamental questions about the liberality of credit supply and terms. Rather than readjusting usury limits or tinkering with disclosure requirements, it is time to reassess America’s philosophy of lending. Although the current socio-economic belief that more credit is better has held dominance for several centuries, history offers an alternative theory. Surprisingly, a …

The Elastic Tournament: The Second Transformation Of The Big Law Firm, William D. Henderson, Marc Galanter Jan 2008

The Elastic Tournament: The Second Transformation Of The Big Law Firm, William D. Henderson, Marc Galanter

Articles by Maurer Faculty

In 1991, Galanter and Palay published 'Tournament of Lawyers: The Transformation of the Big Law Firm', which documented the regular and relentless growth of large U.S. law firms. The book advanced several structural and historical factors to explain these patterns, centering on the adoption of the promotion-to-partnership tournament. Systemic changes in the marketplace for corporate legal services in the intervening years suggest the need for an updated account of the modern large law firm. Using 'Tournament of Lawyers' as a starting point, we propose to fill this void in the literature. Marching through a wide array of empirical evidence covering …

Theses, Dissertations and Culminating Projects

This master’s thesis examines and analyzes how gender and race, as represented in literature during the eighteenth and early nineteenth centuries, impact the development of the female character. Race specifically affects the woman’s perception of her own self as a foreigner, and this self-perception relates to the development of her character. The subjects of this thesis, Lettres d’une Péruvienne by Françoise de Graffigny and Ourika by Claire de Duras, contain female protagonists who are of foreign origin living in France.

The analysis begins in Chapter I, which explores the possible reasons for the different conclusions of the two novels, one …

Happy Law Students, Happy Lawyers, Nancy Levit, Douglas O. Linder Jan 2008

Happy Law Students, Happy Lawyers, Nancy Levit, Douglas O. Linder

Faculty Works

This article draws on research into the science of happiness and asks a series of interrelated questions: Whether law schools can make law students happier? Whether making happier law students will translate into making them happier lawyers, and the accompanying question of whether making law students happier would create better lawyers? After covering the limitations of genetic determinants of happiness and happiness set-points, the article addresses those qualities that happiness research indicates are paramount in creating satisfaction: control, connections, creative challenge (or flow), and comparisons (preferably downward). Those qualities are then applied to legal education, while addressing the larger philosophical …
