History And Fiction In The Acts Of Thomas: The State Of The Question, James F. Mcgrath Jan 2008

History And Fiction In The Acts Of Thomas: The State Of The Question, James F. Mcgrath

Scholarship and Professional Work - LAS

The Acts of Thomas has not yet received as much attention as the Gospel associated with the same individual, and this is understandable. Current students of this early Christian work, however, are in danger of missing out on the discussions and differing perspectives long offered by scholars of the Indian church and Indian history on this work. The current study suggests that, while the Acts of Thomas is almost certainly a work of novelistic fiction, this should not lead us to ignore the instances of confirmable historical information embedded therein, as in many other works of historical fiction. The Acts …

A. Lincoln, Philosopher: Lincoln’S Place In 19th-Century Intellectual History, Allen C. Guelzo

Civil War Era Studies Faculty Publications

The nineteenth century in Europe and America was an era of second thoughts. Those second thoughts were largely about the Enlightenment, which had been born in the mid-1600s as a scientific revolution and blossomed into the Age of Reason in the 1700s, when it seemed that no puzzle was beyond the grasp of scientific rationality. That blossom was snipped all too quickly by the French Revolution, which drowned rationality in human politics in a spray of Jacobin-terrorized blood, then by the revulsion of European art and music from the Enlightenment’s canons of balance and symmetry in favor of the Romantic …

Writing, Cognition, And The Nature Of The Judicial Function, Chad M. Oldfather Jan 2008

Writing, Cognition, And The Nature Of The Judicial Function, Chad M. Oldfather

Faculty Publications

Prior commentators, including many judges, have observed that writing provides an important discipline on the judicial decisionmaking process. Those commentators have uniformly assumed that the effect will always be positive - that is, that a decision rendered pursuant to a process that includes a written justification will always be better (however better is to be measured) than a decision unaccompanied by writing. According to this view, we should always, all things being equal, prefer a decision accompanied by an opinion to one without. All things are not equal, of course, and there are many situations in which the costs of …

New Approaches To The Founding Of The Sierra Leone Colony, 1786–1808, Isaac Land, Andrew M. Schocket

History Faculty Publications

This special issue of the Journal of Colonialism and Colonial History consists of a forum of innovative ways to consider and reappraise the founding of Britain’s Sierra Leone colony. It originated with a conversation among the two of us and Pamela Scully – all having research interests touching on Sierra Leone in that period – noting that the recent historical inquiry into the origins of this colony had begun to reach an important critical mass. Having long been dominated by a few seminal works, it has begun to attract interest from a number of scholars, both young and established, from …

The New Racial Preferences, Devon W. Carbado, Cheryl I. Harris Jan 2008

The New Racial Preferences, Devon W. Carbado, Cheryl I. Harris

Faculty Articles

Michigan's Proposal 2 and California's Proposition 209 explicitly prohibit their state governments from discriminating or granting "preferential treatment . . . on the basis of race." Proponents of both ballot initiatives specifically employed this language to eliminate state promulgated race-based affirmative action programs. For advocates of Proposal 2 and Proposition 209, affirmative action is the quintessential example of a preference on the basis on race. They reasoned that the policy benefits blacks and Latinos and burdens whites and, in some formulations, Asian Americans. This Article neither defends affirmative action nor critiques anti-affirmative action initiatives. Instead, we take Proposition 209 and …

Wind Scour Of Navajo Sandstone At The Wave (Central Colorado Plateau, U.S.A.), David B. Loope, Winston M. Seiler, Joseph A. Mason, Marjorie A. Chan Jan 2008

Wind Scour Of Navajo Sandstone At The Wave (Central Colorado Plateau, U.S.A.), David B. Loope, Winston M. Seiler, Joseph A. Mason, Marjorie A. Chan

Department of Earth and Atmospheric Sciences: Faculty Publications

At the Wave, a photogenic landform on the Utah–Arizona border, modern, southwesterly, sand-carrying winds abrade the Navajo Sandstone. Abundant trains of centimeter-scale, transverse, upwind-facing treads and risers cut sedimentary structures at a high angle. Central to the formation of these erosional steps are crusts produced by microbes lying just beneath exposed sandstone surfaces. Treads and risers are present on the walls of smoothly curved troughs at the Wave, on the walls of nearby circular scour pits, and on bedrock domes found at the center of scour pits. Because of their locations and orientations, the large-scale troughs and scour pits could …

A Tale Of Two Maps: The Limits Of Universalism In Comparative Judicial Review, Adam M. Dodek Jan 2008

A Tale Of Two Maps: The Limits Of Universalism In Comparative Judicial Review, Adam M. Dodek

Comparative Research in Law & Political Economy

The explosion of scholarship in comparative constitutional law in the last decade tends to overshadow the traditional suspicion that comparative law exhibited towards public law. For the greater part of the 20th century, the dominant paradigm in comparative public law was particularism and strong skepticism towards universalist features and possibilities in public law, especially constitutional law. With the rise of judicial review after World War II and especially in Eastern Europe after the collapse of the Soviet Union, comparative judicial review has begun to flourish. This paper is a comment on a paper by Professor Miguel Schor entitled "Mapping Comparative …

Diverse Persuasion(S): From Rhetoric To Representation (And Back Again To Rhetoric) In International Human Rights Interpretation, Craig Scott

Comparative Research in Law & Political Economy

This article proceeds from a way of thinking about legal-rights reasoning that is grounded in the rhetorical tradition. In light of questions of political legitimacy and personal ethics, a central premise of the article is that the rhetorical enterprise must situate itself within a paradigm of dialogic communication in which mutual persuasion is the orientation to argument and the quest for intersubjective validation of claimed premises, lines of argument, and conclusions is the purposive mode. The first step in the article is to move from a general conception of law as a field of rhetoric to an account of how …

Transnational Law, Peer Zumbansen Jan 2008

Transnational Law, Peer Zumbansen

Comparative Research in Law & Political Economy

This chapter traces the development of the concept of Transnational Law since Philip Jessup's Storrs Lectures at Yale Law School in 1955. Jessup had famously challenged the doctrinal and conceptual boundaries of both public and private international law to suggest that another concept be more adequately suited to capture the myriad normative and transactional relations across national borders. "I shall use", Jessup wrote, "the term 'transnational law' to include all law which regulates actions or events that transcend national frontiers. Both public and private international law are included, as are other rules which do not wholly fit into such standard …

Process Before Product: A New Federal-Provincial Logic For A New Century, Irvin Studin Jan 2008

Process Before Product: A New Federal-Provincial Logic For A New Century, Irvin Studin

Comparative Research in Law & Political Economy

In this article, Irvin Studin of Osgoode Hall Law School and formerly of the Privy Council Office, notes with concern the increasing rarity of formal Canadian first ministers' meetings and argues that the growing complexity of the Canadian federation requires a standing first ministers' forum and a robust supporting intergovernmental bureaucratic infrastructure in order to drive meaningful, sustained advances in the multiple policy areas that transcend constitutional jurisdiction.

Exploring Interdisciplinary Prayer Research In A Health Context, E. James Baesler Jan 2008

Exploring Interdisciplinary Prayer Research In A Health Context, E. James Baesler

Communication & Theatre Arts Faculty Publications

Communication, Psychology, and Sociology are three leading academic disciplines engaged in the social scientific study of prayer, the spiritual communication between a believer(s) and God, but rarely do these disciplines collaborate in interdisciplinary prayer scholarship. Possibilities for interdisciplinary prayer research in a health context are explored through a review of the literature and academic interviews. Interdisciplinary linkages in the prayer-health context are organized in an integral "all-quadrant" theoretical model, and an assessment of the viability of interdisciplinary prayer-health research is considered.

Ho'oponopono: Assessing The Effects Of A Traditional Hawaiian Forgiveness Technique On Unforgiveness, Matthew B. James Jan 2008

Ho'oponopono: Assessing The Effects Of A Traditional Hawaiian Forgiveness Technique On Unforgiveness, Matthew B. James

Walden Dissertations and Doctoral Studies

This study expanded on the existing empirical research on forgiveness and specifically ho'oponopono, a traditional Hawaiian forgiveness process. An extensive literature review revealed that while forgiveness has gained in popularity among researchers and clinicians, few therapeutic process-based models have been researched. Furthermore, ho'oponopono has not been studied as a process-based approach to forgiveness. Therefore, the purpose of the present between-groups, within-groups, repeated measures study was to assess the effects of the application of ho'oponopono (focused on a specific transgressor) on levels of unforgiveness, as measured by the Transgression-Related Interpersonal Motivations Inventory (TRIM). The participants (N = 79) were randomly divided …

Remedying Our Fragmented Governmental Structures To Deal With Our Nation-On-Edge Problems, Jeffrey G. Miller Jan 2008

Remedying Our Fragmented Governmental Structures To Deal With Our Nation-On-Edge Problems, Jeffrey G. Miller

Elisabeth Haub School of Law Faculty Publications

The argument against crafting federal regulations for problems stemming from development in disaster-prone areas (nation-on-edge problems) assumes that these types of problems are essentially local problems requiring unique local solutions. In this Article, Jeffrey G. Miller challenges this assumption, reasoning that a flexible framework of federal regulations would indeed be effective at remedying these problems. He suggests that such a framework could be modeled after the Clean Water Act's (CWA's) point source pollution control regime. A permitting system similar to that set out in the CWA would promote best management practices while still allowing local entities the freedom to determine …
