What Limits Fire? An Examination Of Driver's Of Burnt Area In Southern Africa, Sally Archibald, David P. Roy, Brian W. Van Wilgen, Robert J. Scholes

GSCE Faculty Publications

The factors controlling the extent of fire in Africa south of the equator were investigated using moderate resolution (500 m) satellite-derived burned area maps and spatial data on the environmental factors thought to affect burnt area. A random forest regression tree procedure was used to determine the relative importance of each factor in explaining the burned area fraction and to address hypotheses concerned with human and climatic influences on the drivers of burnt area. The model explained 68% of the variance in burnt area. Tree cover, rainfall in the previous 2 years, and rainfall seasonality were the most important predictors. …

Beyond Rationalism And Instrumentalism: The Case For Rethinking U.S. Engagement With International Law And Organization, Peter G. Danchin Jan 2008

Beyond Rationalism And Instrumentalism: The Case For Rethinking U.S. Engagement With International Law And Organization, Peter G. Danchin

Faculty Scholarship

This Essay advances an argument for rethinking the current terms of engagement of U.S. foreign policy with international law and institutions so as to avoid the current two extremes of power politics and imperial moralizing. First, it is necessary to distinguish between force and the status of political domination on the one hand, and consensus and the status of normative meaning on the other. While it may be possible for a superpower to exercise factual authority and control over foreign states and peoples through sheer assertions of force and will, the attainability of such a situation should not be confused …

Conversations On "Community Lawyering:" The Newest (Oldest) Wave In Clinical Legal Education, Karen Tokarz, Nancy L. Cook, Susan Brooks, Brenda Bratton Blom

Faculty Scholarship

This Article explores the pedagogical and professional challenges and rewards of community lawyering and clinical legal education. The authors are clinical law faculty who self-identify as community lawyers and teachers of community lawyering clinics. They have gathered in recent years with a larger group of similarly engaged colleagues to discuss what is meant by community lawyering, how it is taught, and how it is practiced. This Article seeks to capture some of those conversations, crystallize some of the ideas that have arisen out of the discussions, and examine the implications of these ruminations for future directions in clinical legal education.

Federal Search Commission? Access, Fairness, And Accountability In The Law Of Search, Oren Bracha, Frank Pasquale Jan 2008

Federal Search Commission? Access, Fairness, And Accountability In The Law Of Search, Oren Bracha, Frank Pasquale

Faculty Scholarship

Should search engines be subject to the types of regulation now applied to personal data collectors, cable networks, or phone books? In this article, we make the case for some regulation of the ability of search engines to manipulate and structure their results. We demonstrate that the First Amendment, properly understood, does not prohibit such regulation. Nor will such interventions inevitably lead to the disclosure of important trade secrets.

After setting forth normative foundations for evaluating search engine manipulation, we explain how neither market discipline nor technological advance is likely to stop it. Though savvy users and personalized search may …

Phylogeography Of Smallmouth Bass (Micropterus Dolomieu) And Comparative Myology Of The Black Bass (Micropterus, Centrarchidae), William Calvin Borden Jan 2008

Phylogeography Of Smallmouth Bass (Micropterus Dolomieu) And Comparative Myology Of The Black Bass (Micropterus, Centrarchidae), William Calvin Borden

ETD Archive

Biogeographic patterns were investigated within a single species and among its congenerics. Smallmouth bass (Micropterus dolomieu) were characterized by portions of the cytochrome b gene and the control region although bass in Lake Erie were also evaluated using eight nDNA microsatellites. Overall, little population structure was observed among sites in Lake Erie which was surprising given that most male smallmouth bass exhibit nest site fidelity. But, these lake bass were divergent from bass residing in nearby tributaries indicating that lacustrine bass are reproductively isolated from riverine bass even though both groups may spawn in the same rivers. Adjacent riverine populations …

Machi: Neighborhood And Small Town—The Foundation For Urban Transformation In Japan, Carola Hein Jan 2008

Machi: Neighborhood And Small Town—The Foundation For Urban Transformation In Japan, Carola Hein

Growth and Structure of Cities Faculty Research and Scholarship

The term machi, signifying both neighborhood and small town, is a key element for understanding Japanese urban form and city planning. After tracing the origins of the term, this article explores the historic and contemporary significance of the concept and its particular spatial and socioeconomic forms. The article then argues that the concept of machi influenced the ways in which Japanese planners picked up foreign concepts through the nineteenth and particularly the twentieth century, absorbing some ideas and rejecting others. Building on their perception of the city as composed of urban units that allowed for planning in patchwork patterns, leading …

Investigating West Virginia Students' Perceptions Of The Factors Affecting Their Educational Aspirations, Kimberly S. Cowley

Theses, Dissertations and Capstones

The purpose of this study was to investigate the perceptions of West Virginia students about factors affecting their educational aspirations and to determine whether these factors differed significantly over time, by gender, or by parents‟ college history. Research questions included: (1) To what extent will constructs emerging from West Virginia student data parallel the eight constructs identified as supporting student aspirations by the University of Maine‟s National Center for Student Aspirations? (2) To what extent do students‟ perceptions of these factors differ over time, from seventh to ninth grade? (3) To what extent do students‟ perceptions of these factors differ …

The Geography Of Open Dumps In Rural Appalachia, Bj Jones Jan 2008

The Geography Of Open Dumps In Rural Appalachia, Bj Jones

Theses, Dissertations and Capstones

The dumping of waste into the environment has plagued the mountains of Rural Appalachia for decades. Tire, cars, appliances, and drug producing materials routinely are illegally disposed of via open dumps. The purpose of this research is to reveal the motives of the damaging open dumpsites that damage the beauty of the Appalachian Mountains. The states of Kentucky and West Virginia were analyzed through the use of GIS and descriptive statistics. The distance to refuse centers and application of disposal fees are the leading factors that result to the use of open dumps.

Small Town Urban Revitalization: The Effect Of Pullman Square On Downtown Huntington, West Virginia, Amy R. Blankenship

Theses, Dissertations and Capstones

After many years of being the center of shopping, business and entertainment, the downtown began to decline nationally. This decline began after the end of WWII and ran concurrent to the beginning of suburbanization and the emergence of large, indoor shopping malls. Many cities began to realize the importance of a healthy downtown and implemented strategies to revitalize their downtown. This thesis focuses on the emergence of Pullman Square in Huntington, WV, its effect on the downtown, and how it has spawned other retail development and revitalization strategies throughout the city center.

Factors That Influence The Distribution Of Antibiotic Resistant Bacteria In The Mud River, Wv, Timothy Shaun Dotson Jan 2008

Factors That Influence The Distribution Of Antibiotic Resistant Bacteria In The Mud River, Wv, Timothy Shaun Dotson

Theses, Dissertations and Capstones

Background: Prior studies of the Ohio and Mud Rivers have shown that fecal contamination alone does not explain the distribution of antibiotic resistant bacteria (ARB) in surface waters. The objectives of this study were to determine effects on the distribution of ARB in the Mud.

Methods: Water samples and physical parameters were collected twice per season in spring through fall at 12 sites on the Mud River. Aliquots were plated on R2A agar and R2A agar plus individual antibiotics for the enumeration of total cultivable bacteria, and cultivable bacteria resistant to ciprofloxacin, virginiamycin, or tetracycline respectively. The IDEXX Quanti-Tray/2000™ method …

Entrepreneurship And Urban Success: Toward A Policy Consensus, Zoltan J. Acs, Edward L. Glaeser, Robert E. Litan, Lee Fleming, Stephan J. Goetz, William R. Kerr, Steven Klepper, Stuart S. Rosenthal, Olav Sorenson, William C. Strange Jan 2008

Entrepreneurship And Urban Success: Toward A Policy Consensus, Zoltan J. Acs, Edward L. Glaeser, Robert E. Litan, Lee Fleming, Stephan J. Goetz, William R. Kerr, Steven Klepper, Stuart S. Rosenthal, Olav Sorenson, William C. Strange

Economics - All Scholarship

Like all politics, all entrepreneurship is local. Individuals launch firms and, if successful, expand their enterprises to other locations. But new firms must start somewhere, even if their businesses are conducted largely or exclusively on the Internet. Likewise, policymakers at local and state levels increasingly recognize that entrepreneurship is the key to building and sustaining their economies' growth. Although this is a seemingly obvious proposition, it represents something of a departure from past thinking about how local, state, or regional economies grow. Historically, state and local policymakers have put their energies into trying to attract existing firms from somewhere else, …

Genworth Financial: A Company In Transition, Roger R. Schnorbus, Littleton M. Maxwell Jan 2008

Genworth Financial: A Company In Transition, Roger R. Schnorbus, Littleton M. Maxwell

Robins School of Business White Paper Series, 1980-2022

In 2008, Genworth Financial sought to transition itself from being primarily an insurance company to a provider of financial security. The mechanism to achieve this transition was Genworth's "Next Act" strategy. Of prime concern to Genworth was implementing this strategy in its Retirement and Protection segment. To do this, a significant effort was required by the various business units in this segment.

Fire And Climate In The Inland Pacific Northwest: Integrating Science And Management, Rachel Clark Jan 2008

Fire And Climate In The Inland Pacific Northwest: Integrating Science And Management, Rachel Clark

Joint Fire Science Program Briefs (2007-2012)

Climate is a vital force shaping much of life on Earth. People have long suspected a link between climate and susceptibility of forests to fire. But measuring such a relationship has been challenging without tools capable of taking into account climate, forest structure through space and time, and other variables. Managers and planners who make decisions to maintain forest health need an accurate understanding of how climate is linked to fire regimes, as well as tools to help them do it. Such tools would take complex information and allow it to be accessed in a straightforward and effective way. Don …

Beetles And Severe Fire: Who’S On First? A Century Of Disturbance In Colorado’S Subalpine Forests, Marjie Brown Jan 2008

Beetles And Severe Fire: Who’S On First? A Century Of Disturbance In Colorado’S Subalpine Forests, Marjie Brown

Joint Fire Science Program Briefs (2007-2012)

Forests have evolved with and depend on natural cycles of wildfire, insect outbreaks, disease, and extreme weather for periodic rejuvenation. The subalpine forests of northwestern Colorado experienced an unusual sequence of disturbances in succession over the past 125 years. Severe wildfi res in 2002 were preceded by stand-replacing fi res a century before. These were followed by a record setting wind blowdown, subsequent salvage logging, and two separate bark beetle infestations. This study by University of Colorado researchers was the first to collectively analyze how a century of disturbances interacted with each other to shape ecosystem patterns and processes with …

The Cone Fire: A Chance Reckoning For Fuel Treatments, Lisa-Natalie Anjozian Jan 2008

The Cone Fire: A Chance Reckoning For Fuel Treatments, Lisa-Natalie Anjozian

Joint Fire Science Program Briefs (2007-2012)

In late September 2002, an accidental fire ignited on Blacks Mountain in the dry pine forest of the Cascade Range of northeastern California. The fire burned through the Blacks Mountain Experimental Forest where a large-scale, long-term study was already underway to test ecological responses to two different stand structures the scientists had created using various treatments: high diversity, with and without prescribed fire, and low diversity, with and without prescribed fire. The study was not originally designed to test the effects of severe wildfires. The Cone Fire created an opportunity to evaluate the effects of different treatments on tree survival …

Geochemical Processes Contributing To The Contamination Of Soil And Surface Waters In The Rio Conchos Basin, Mexico, Melida Gutierrez, Carlos Martinez-Pina, Jun Luo, Kevin L. Mickus Jan 2008

Geochemical Processes Contributing To The Contamination Of Soil And Surface Waters In The Rio Conchos Basin, Mexico, Melida Gutierrez, Carlos Martinez-Pina, Jun Luo, Kevin L. Mickus

College of Natural and Applied Sciences

A geochemical characterization of the middle Rio Conchos basin is presented based on two contaminants, salts (Ca and Na) and toxic metalloids (As and Sb). Their content in surface water and sediment samples was determined, and their spatial distribution was mapped to show the relationship to each other, to the geology and hydrology, and to other potential factors affecting their distribution (i.e., prevailing winds). Correlation analyses between salts, toxic metalloids, and associated elements, and their spatial distribution aided in determining their sources, which included mines, rock outcrops, urban centers, irrigation waste water, and agricultural runoff. The salinity of the Rio …

Reconfiguring Law Reports And The Concept Of Precedent For A Digital Age, Peter W. Martin Jan 2008

Reconfiguring Law Reports And The Concept Of Precedent For A Digital Age, Peter W. Martin

Cornell Law Faculty Publications

Adherence to the “rule of law” entails a strong commitment to consistency - a belief that throughout a jurisdiction and across time judges should treat like cases alike. For over a century, the U.S. judiciary's pursuit of this aim has relied principally upon print law reports. With unsettling rapidity, digital technology has dislodged that system, in practical fact, if not yet in the way lawyers and judges talk and think about case law. This article explores gains one might hope for from a “judicial consistency” system liberated from the constraints of print, likely effects on concepts of precedent, as well …
