Bringing Clarity To Title Clearing: Tax Foreclosure And Due Process In The Internet Age, James J. Kelly Jr. Jan 2008

Bringing Clarity To Title Clearing: Tax Foreclosure And Due Process In The Internet Age, James J. Kelly Jr.

Journal Articles

The foreclosure of property tax liens performs an essential economic function by reconnecting underutilized properties to the real estate market. To clear title in an efficient and just manner, local jurisdictions foreclosing on tax liens require clear, balanced procedures for the provision of notice to affected parties. In its 2006 decision in Jones v. Flowers, the U.S. Supreme Court found that the foreclosing jurisdiction's lack of direct follow-up on returned notice mailings denied the addressee due process because the foreclosing party did not take steps that would be chosen by one desirous of actually informing the property owner. In subjecting …

Children's Beliefs And Family Law, Margaret F. Brinig Jan 2008

Children's Beliefs And Family Law, Margaret F. Brinig

Journal Articles

In a recent series of opinions authored by Justice Stevens, the Court has recognized that children may have independent religious rights, and that these may be in conflict with their parents'. The questions for this piece are whether considering children's rights independently is a good thing whether it is warranted by children's actual religious preferences and whether children's religious activities actually do anything measurable for the children.

I do not advocate that the Supreme Court become more involved with family law than it has been since the substantive due process days of Meyer and Pierce. I am also not one …

Real-Time Implementation Of A Statcom On A Wind Farm Equipped With Doubly Fed Induction Generators, Wei Qiao, Ganesh K. Venayagamoorthy, Ronald G. Harley Jan 2008

Real-Time Implementation Of A Statcom On A Wind Farm Equipped With Doubly Fed Induction Generators, Wei Qiao, Ganesh K. Venayagamoorthy, Ronald G. Harley

Electrical and Computer Engineering Faculty Research & Creative Works

Voltage stability is a key issue to achieve the uninterrupted operation of wind farms equipped with doubly fed induction generators (DFIGs) during grid faults. This paper investigates the application of a static synchronous compensator (STATCOM) to assist with the uninterrupted operation of a wind turbine driving a DFIG, which is connected to a power network, during grid faults. The control schemes of the DFIG rotor- and grid-side converters and the STATCOM are suitably designed and coordinated. The system is implemented in real-time on a real time digital simulator. Results show that the STATCOM improves the transient voltage stability and therefore …

A Localist Reading Of Local Immigration Regulations, Rick Su Jan 2008

A Localist Reading Of Local Immigration Regulations, Rick Su

Journal Articles

The conventional account of immigration-related activity at the local level often assumes that the "local" is simply a new battleground in the national immigration debates. This article questions that presumption. Foregrounding the legal rules that define local governments and channels local action, this article argues that the local immigration "crisis" is much less a consequence of federal immigration policy than normally assumed. Rather, it can also be understood as a familiar byproduct of localism: the legal and cultural assumptions that shape how we structure and organize local communities, provide and allocate local services, and define the legal relationship of local, …

Dublin Core Metadata Harvested Through Oai-Pmh, Amy S. Jackson, Myung-Ja Han, Kurt Groetsch, Megan Mustafoff, Timothy W. Cole

University Libraries & Learning Sciences Faculty and Staff Publications

The introduction in 2001 of the Open Archives Initiative Protocol for Metadata Harvesting (OAI-PMH) increased interest in and awareness of metadata quality issues relevant to digital library interoperability and the use of harvested metadata to build "union catalogs" of digital information resources. Practitioners have offered wide-ranging advice to metadata authors and have suggested metrics useful for measuring the quality of shareable metadata. Is there evidence of changes in metadata practice in response to such advice and/or as a result of an increased awareness of the importance of metadata interoperability? This paper looks at metadata records created over a six-year period …

Social And Cultural Diversity In Distance Education, Charlotte Nirmalani Gunawardena, Deborah Lapointe Jan 2008

Social And Cultural Diversity In Distance Education, Charlotte Nirmalani Gunawardena, Deborah Lapointe

University Libraries & Learning Sciences Faculty and Staff Publications

With the expansion of global telecommunication networks and the worldwide demand for higher education, distance education has the potential to reach out internationally to enhance learning for diverse learners and increase intercultural awareness and communication. By definition, distance education is borderless (Latchem, 2005), although differences in sociocultural contexts, values and expectations of diverse educational systems and learners may prove to be its greatest challenge (Hanna, 2000). While distance education programs proclaim an international focus with international content and learners, instructional design and methods frequently carry Eurocentric Western bias. Distance educators need to be sensitive to social, cultural and educational differences, …

Accelerated Exchange Of Exon Segments In Viperid Three-Finger Toxin Genes (Sistrurus Catenatus Edwardsii; Desert Massasauga), Robin Doley, Susanta Pahari, Stephen P. Mackessy, Manjunatha Kini Jan 2008

Accelerated Exchange Of Exon Segments In Viperid Three-Finger Toxin Genes (Sistrurus Catenatus Edwardsii; Desert Massasauga), Robin Doley, Susanta Pahari, Stephen P. Mackessy, Manjunatha Kini

Biological Sciences Faculty Publications

BACKGROUND: Snake venoms consist primarily of proteins and peptides showing a myriad of potent biological activities which have been shaped by both adaptive and neutral selective forces. Venom proteins are encoded by multigene families that have evolved through a process of gene duplication followed by accelerated evolution in the protein coding region. RESULTS: Here we report five gene structures of three-finger toxins from a viperid snake, Sistrurus catenatus edwardsii. These toxin genes are structured similarly to elapid and hydrophiid three-finger toxin genes, with two introns and three exons. Both introns and exons show distinct patterns of segmentation, and the insertion/deletion …

Collaboration: Faculty Perspective, William D. Woody Jan 2008

Collaboration: Faculty Perspective, William D. Woody

SPS Faculty Publications

From the chapter introduction: Over the past decade and a half, I have worked with many undergraduates as teaching assistants, research assistants on my projects, and advisees who conduct research for honors or other advanced programs. However, in very few cases have I had the special opportunity to genuinely collaborate with a student on research. The materials that follow define collaboration and set it apart from other modes of working with undergraduates, discuss selection processes, goals, challenges, and advantages of collaboration, and provide examples from my work with an outstanding undergraduate student, Joseph Hamm. I conclude this chapter with specific …

Perceived Barriers To Organizational Creativity: A Cross-Cultural Study Of British And Egyptian Future Marketing Managers, Aa El-Masry, M Mostafa Jan 2008

Perceived Barriers To Organizational Creativity: A Cross-Cultural Study Of British And Egyptian Future Marketing Managers, Aa El-Masry, M Mostafa

Plymouth Business School

Purpose – The overall purpose of this research is to further the understanding of how future marketing managers in Egypt and the UK perceive creativity barriers. The paper also examines the construct validity of the barriers to creativity scale in an Arab non-Western context. Design/methodology/approach – A sample of 125 respondents was used to achieve the research purpose. Respondents completed a 17-item instrument designed to assess barriers to creativity in business organizations. Findings – Discriminant analysis results showed that Egyptians differ from British with respect to their attitudes towards organizational creativity barriers. t-test procedure confirmed also that gender and age …
