In Good Times And In Debt: The Evolution Of Marital Agency And The Meaning Of Marriage, Marie T. Reilly Jan 2008

In Good Times And In Debt: The Evolution Of Marital Agency And The Meaning Of Marriage, Marie T. Reilly

Nebraska Law Review

This Article explores the historical and modern role of marital agency law in defining a critical aspect of what it means to be married -- the scope of spouses' imputed liability for each other to third parties. Part II explains how the emergence in the nineteenth century of married women's legal capacity was driven in part by demand for a reliable legal mechanism to shield assets invested in marriage from the claims of husbands' creditors. Part III considers the scope of marital agency and shared liability under the modern view of marriage as a voluntary partnership among equals, terminable at …

Inside Looking Out: An Application Of International And Regional Linguistic Protections To The U.S. Spanish-Speaking Minority, Marina A. Torres Jan 2008

Inside Looking Out: An Application Of International And Regional Linguistic Protections To The U.S. Spanish-Speaking Minority, Marina A. Torres

Nebraska Law Review

Not since the collapse of the Soviet Union have the subjects of minority and linguistic rights enjoyed such prominence in discussions of the international community. Various legal commentators have suggested several reasons explaining the renewed interest in the subject: the emergence of a multi-polar world politic, the large-scale reappearance of civil and ethnic conflicts, and even the awareness of cultural differences resulting from globalization. The atrocities that came to light after World War II in particular made it painfully clear to the international community the harm that had been committed against individuals because of their membership in a particular group. …

A Tale Of Two Waivers: Waiver Of The Jury Waiver Defense Under The Federal Rules Of Civil Procedure, Jarod S. Gonzalez Jan 2008

A Tale Of Two Waivers: Waiver Of The Jury Waiver Defense Under The Federal Rules Of Civil Procedure, Jarod S. Gonzalez

Nebraska Law Review

The thesis of this Article is that the Federal Rules of Civil Procedure, most specifically Rule 8(c), should be interpreted to require the jury waiver defense to be pled early on in the pretrial stage of litigation. The failure to plead the defense risks waiver. Part II of this Article expands upon the legal issues previously raised regarding the enforceability of a pre-dispute contractual jury waiver. Part III summarizes the basic rules regarding demanding a jury trial and defending against that demand under the Federal Rules of Civil Procedure. Part IV presents and explains the novel argument regarding the early …

Competence Development Of Synchronously Coached Trainee Teachers In Collaborative Learning., Ralph W. Hooreman, Piet A. Kommers, Wim M. Jochems

Australian Journal of Teacher Education

The need to make trainee teachers more prepared to coach collaborative learning effectively is increasing, as collaborative learning is becoming more important. One complication in this training process is that it is hard for the teacher trainer to hear and understand the students’ utterances and those of the coaching trainee teacher. Besides, it is essential that the teacher trainer does not intervene with the students directly. This constraint is a strong plea for facilitating the direct whispered suggestions by an earpiece to the trainee teacher. In this study, first of all an instrument for measuring the quality of the teacher …

Australian Journal of Teacher Education

At a regional Australian university, a Learning Circle approach was implemented with a small group of first year education students who identified themselves as “at risk” of failure in the tertiary context. As part of their participation in weekly meetings, the students engaged in discussion, reflection and problem-solving related to their transition to university study. They also participated in a visual research inquiry which included the construction of photographic images and research conversations about being university students and dealing with study demands. Through the privileging of interactions and relationships, the students were able to make connections to other Discourses from …

A total of 240 students from government and non-government schools in the South West of Western Australia were interviewed in small groups. They offered a diversity of responses and insights related to their views of teachers and teaching. Results indicate that what these young people needed from their schools was enough flexibility and choice to cater for this diversity, not only in terms of …

Will They Know Enough?: Pre-Service Primary Teachers’ Knowledge Base For Teaching Integrated Social Sciences, Mallihai Tambyah Jan 2008

Will They Know Enough?: Pre-Service Primary Teachers’ Knowledge Base For Teaching Integrated Social Sciences, Mallihai Tambyah

Australian Journal of Teacher Education

A significant issue in primary teacher education is developing a knowledge base which prepares teachers to teach in a range of subject areas. In Australia, the problem in primary social science education is compounded by the integrated nature of the key learning area of Studies of Society and Environment (SOSE). Recent debates on teaching integrated social sciences omit discussions on the knowledge base for teaching. In this paper, a case study approach is used to investigate primary pre-service teachers’ approaches to developing a knowledge base in designing a SOSE curriculum unit. Data from five teacher-educators who taught primary SOSE curriculum …

Cast Out: Vagrancy And Homelessness In Global And Historical Perspective, A. L. Beier, Paul Ocobock

Ohio University Press Open Access Books

Throughout history, those arrested for vagrancy have generally been poor men and women, often young, able-bodied, unemployed, and homeless. Most histories of vagrancy have focused on the European and American experiences. Cast Out: Vagrancy and Homelessness in Global and Historical Perspective is the first book to consider the shared global heritage of vagrancy laws, homelessness, and the historical processes they accompanied.

In this ambitious collection, vagrancy and homelessness are used to examine a vast array of phenomena, from the migration of labor to social and governmental responses to poverty through charity, welfare, and prosecution. The essays in Cast Out represent …

The Teaching And Learning Cycle: Integrating Curriculum, Instruction, And Assessment, Donna L. Jones Jan 2008

The Teaching And Learning Cycle: Integrating Curriculum, Instruction, And Assessment, Donna L. Jones

Christian Perspectives in Education

The philosophies of educators and government entities guide the teaching and learning cycle of curriculum, instruction, and assessment. The educator’s worldview plays an important part in developing these concepts which is demonstrated throughout history. Studying the history of the educational philosophers reveals their beliefs about curriculum, instruction, and assessments and the effects on education today. It shows the importance of integrating all three concepts in the educational process creating the teaching and learning cycle.

Second Class Delivery: The Elimination Of Birthright Citizenship As A Repeal Of "The Pursuit Of Happiness", Sara C. Barnhart Jan 2008

Second Class Delivery: The Elimination Of Birthright Citizenship As A Repeal Of "The Pursuit Of Happiness", Sara C. Barnhart

Georgia Law Review

In recent years, immigration has been at the forefront of political debate in the United States. In response to concerns over undocumented immigrants, some members of Congress have proposed the elimination of birthright citizenship. Eliminating birthright citizenship means that citizenship at birth would be based on the citizenship of one's parents rather than one's birth in U.S. territory. This Note demonstrates the historical nature of this U.S. immigration controversy by tracing similar movements throughout history. It documents the roots of the common law doctrine of birthright citizenship, followed by a discussion of the protection of citizenship status the Fourteenth Amendment's …
