What We Have Here Is A Failure To Communicate: Using A Model To Explain Textbook Representations Of Human Evolutionary Theory, Ben Winegard Jan 2008

What We Have Here Is A Failure To Communicate: Using A Model To Explain Textbook Representations Of Human Evolutionary Theory, Ben Winegard

McNair Scholars Journal

In this paper we develop a general model to explain the hostility toward, and ignorance of, human evolutionary theory (ET) in the social sciences. We first provide relevant theoretical background explaining the basics of ET. We then briefly describe the history of, and reasons for, social science attacks against ET. After providing this background, we turn to our study of social science textbooks, describe the logic of our model, and specify four explicit predictions derived from it. Finally, we present the results of our study and discuss the significance of our findings.

Duress, Demanding Heroism, And Proportionality, Luis E. Chiesa Jan 2008

Duress, Demanding Heroism, And Proportionality, Luis E. Chiesa

Vanderbilt Journal of Transnational Law

This Article discusses the Erdemovic case in order to examine whether duress should be a defense to a crime against humanity. Although the Article contends that the arguments in favor of permitting the defendant to claim duress weaken as the seriousness of the offense charged increases, the Article also argues that the duress defense should usually succeed if it can be proved that the actor could not have prevented the threatened harm by refusing to capitulate to the coercion.

After balancing the competing considerations, the Author concludes that the defendant in Erdemovic should have been able to claim duress as …

Indigenous Sovereignty: A Reassessment In Light Of The Un Declaration On The Rights Of Indigenous Peoples, Siegfried Wiessner Jan 2008

Indigenous Sovereignty: A Reassessment In Light Of The Un Declaration On The Rights Of Indigenous Peoples, Siegfried Wiessner

Vanderbilt Journal of Transnational Law

This Article explores the concept of "indigenous sovereignty" against the backdrop of the resurgence of indigenous peoples as actors in international and domestic law and policy. The Author starts with the traditional Western notion of sovereignty and its dynamization via the principle of self-determination, cabined by the exclusionary concepts of "terra nullius" and "uti possidetis." The next Part delineates the global indigenous renascence occurring since the 1970s and the resulting state practice that has led to treaties and to the development of customary international law in the field. The Article proceeds to analyze the scope and legal effect of the …

Management Faculty Research and Publications

We introduce management and spirituality scholars to the “knack” passages from the c. 4th century B.C.E. text, the Zhuangzi. The knack passages are parables about low status figures, such as wheelwrights, furniture makers and cooks, whose actions offer insights into the spirituality of ordinary work and, we argue, of entrepreneurship. Such non-corporate settings are lesser-studied domains for spirituality. Ancient Chinese writings have been noticed by spirituality and management writers but we call for deeper scholarly textual attention. We seek also to model more attention to the renaissance in scholarship on classical China. More ambitiously, we hope to show that these …

It's About Time: The Need For A Uniform Approach To Using A Prior Conviction To Impact A Witness., Robert F. Holland Jan 2008

It's About Time: The Need For A Uniform Approach To Using A Prior Conviction To Impact A Witness., Robert F. Holland

St. Mary's Law Journal

In Texas, no uniform approach exists in determining whether to admit evidence of a prior conviction as a technique to impeach a witness. This lack of uniformity leads to significant consequences for the parties and poses a potential prejudicial effect on the truthful character of a witness. Furthermore, there is currently no bright-line judicial standard when evaluating the admissibility of certain prior convictions. Although the Texas Court of Criminal Appeals in Theus v. State provided a non-exhaustive set of factors for trial judges to consider, the court has yet to clarify particular aspects of how to properly apply Texas Rule …

Photofragmentation Of Sif4 Upon Si 2p And F 1s Core Excitation: Cation And Anion Yield Spectroscopy, Maria Novella Piancastelli, Wayne C. Stolte, Renaud Guillemin, A. Wolska, Dennis W. Lindle Jan 2008

Photofragmentation Of Sif4 Upon Si 2p And F 1s Core Excitation: Cation And Anion Yield Spectroscopy, Maria Novella Piancastelli, Wayne C. Stolte, Renaud Guillemin, A. Wolska, Dennis W. Lindle

Chemistry and Biochemistry Faculty Research

We have studied the fragmentation dynamics of core-excited SiF4 by means of soft-x-ray photoexcitation and partial positive and negative ion yield measurements around the Si L2,3-shell and F K-shell ionization thresholds. All detectable ionic fragments are reported and we observe significant differences between the various partial ion yields near the Si 2p threshold. The differences are similar to our previous results from CH3Cl showing more extended fragmentation in correspondence to transitions to Rydberg states. At variance with smaller systems, we observe negative ion production in the shape resonance region. This can be related …

Perceptions Of Doctoral Graduates On The Usefulness Of Written Reflections As An Instructional Strategy, Esther Swink Jan 2008

Perceptions Of Doctoral Graduates On The Usefulness Of Written Reflections As An Instructional Strategy, Esther Swink

International Christian Community of Teacher Educators Journal

One of the goals of the Ed.D. in Leadership and Professional Practice at Trevecca Nazarene University is for candidates to be reflective practitioners. Since the inception of the program in 1999, written reflections as an instructional strategy has been encouraged by the administration and used by several professors. This focus is supported by the conceptual framework that informs all courses and programs in the School of Education and includes the national standards adopted by INTASC (Interstate New Teacher Assessment and Support Consortium) which calls for teacher education candidates to be reflective practitioners who plan, implement, and evaluate effectively. This standard …

Experimentalism, Relativity And Quantum Mechanics At A Land Grant Institution: West Virginia University, 1920-1960., Eric S. Wright Jan 2008

Experimentalism, Relativity And Quantum Mechanics At A Land Grant Institution: West Virginia University, 1920-1960., Eric S. Wright

Graduate Theses, Dissertations, and Problem Reports (ETD)

This thesis details the response of a land-grant university to the development of quantum mechanics and relativity across a forty-year period. Concurrently with this, it traces the pattern of normal research at the university to show how the development of new physical theories impacted a representative physics department. The Physics department at West Virginia University at first paid little attention to relativity then after 1924 rejected its theoretical underpinnings. Wholesale acceptance of the theory did not occur until after the replacement of the pre-World War II generation of physicists. Quantum mechanics did not make significant inroads at West Virginia University …
