Counting And Sampling Paths In Graphs, T. Ryan Hoens Jan 2008

Counting And Sampling Paths In Graphs, T. Ryan Hoens

Theses

Since Euler began studying paths in graphs, graph theory has become an important branch of mathematics. With all of the research into graph theoretic problems, however, counting – exactly or approximately – the number of simple paths in finite graphs has been neglected. This thesis investigates an approximation technique known as Markov chain Monte Carlo (MCMC) for the specific purpose of approximating the number of simple paths in graphs. Due to the paucity of research into the subject, the thesis will make the conjecture that this cannot be done exactly in an efficient manner (assuming that the longstanding conjecture P …

English Language & Third Generation Programming Language Pedagogical Practice Analysis, Vincent Falbo Jan 2008

English Language & Third Generation Programming Language Pedagogical Practice Analysis, Vincent Falbo

Theses

In an effort to provide better computer programming instruction to more students at an introductory level, pedagogical methods could be improved using a paradigm of instruction based on the same strategies used to teach students spoken languages. Although many different methodologies of instruction have been explored in the past, this document identifies relationships between spoken languages and computer languages that encourage the exploration of the best practices of teaching English Language Arts so that they could be applied to computer programming instruction. Those with backgrounds in mathematics and science initially completed programming tasks. Much literature about the problem solving aspects …

Biologically Inspired Object Categorization In Cluttered Scenes, Theparit Peerasathien Jan 2008

Biologically Inspired Object Categorization In Cluttered Scenes, Theparit Peerasathien

Theses

The purpose of the thesis, Biologically Inspired Object Categorization system, is to provide an automatic system to classify the real-world images into categories. Generally, computer algorithms classify objects with much lower efficiency than human. Furthermore, some images with complex features such as cat and dog faces are difficult to be classified by ordinary computer algorithms. Therefore, the simulation of the structure and process of a mammalian’s visual cortex is created, which functions similarly to a human’s visual cortex, by using a computer. In this paper, I am presenting a biologically inspired neural network system which processes the images in a …

An Overview Of Packaging Sustainability Topics, Alexandros Astropekakis Jan 2008

An Overview Of Packaging Sustainability Topics, Alexandros Astropekakis

Theses

This thesis presents the global challenges behind the need of sustainable development. It links packaging to this need and describes the way packaging can positively contribute to this process. It presents industry examples of "green packaging" that claim to or may actually contribute to sustainable development. It monitors the understanding of packaging professionals for what is called "packaging sustainability" through a custom made on-line survey. Finally it presents a comparison of environmental impacts for different polymer materials used for the production of rigid containers (HDPE, PP, PET, PVC and PLA) through an analysis of Life Cycle Inventory (LCI) data for …

Something Old, Something New: Civic Virtue And The Case For Same-Sex Marriage, Tiffany C. Graham Jan 2008

Something Old, Something New: Civic Virtue And The Case For Same-Sex Marriage, Tiffany C. Graham

Scholarly Works

In 1993, the Supreme Court of Hawaii issued a decision that forced the question of same-sex marriage from the hinterland of academic speculation to the front pages of newspapers all over the country. The nation was stunned when the court in Baehr v. Lewin held that same-sex marriage might be compelled by the state constitution of Hawaii. Since the Baehr decision, same-sex marriage has received a significant amount of attention. Many states have passed “baby DOMAs,” all of which limit marriage to the union of a man and a woman. In addition, several states have passed constitutional amendments that accomplish …

Prosecution Of Process Crimes: Thoughts And Trends, Allison Caffarone, Karen Patton Seymour, Stephen R. Peikin Jan 2008

Prosecution Of Process Crimes: Thoughts And Trends, Allison Caffarone, Karen Patton Seymour, Stephen R. Peikin

Scholarly Works

The United States Department of Justice has come under attack in recent years because of its increased attention to, and prosecution of, crimes committed during the course of its investigations — obstruction of justice, perjury, and making false statements. These crimes have been labeled “cover-up” or “process crimes,” and the charging prosecutors have been criticized as bringing such charges only against high-profile defendants as to whom there is insufficient evidence to charge the “more serious” underlying offenses that prompted the initial investigation. Some critics have gone so far as to label these prosecutions “vindictive.” Much of this criticism is misplaced. …

Automated Grazing Management, Gregory J. Von Pless Jan 2008

Automated Grazing Management, Gregory J. Von Pless

Theses

Management-intensive grazing is a grazing management strategy that relies on careful monitoring of animals at pasture and frequent relocation of animals between various regions of the pasture, or paddocks, in order to maximize the nutrients and sustenance the animals obtain through grazing. When applied successfully, this approach to grazing management yields higher animal production, while cutting feed costs; however, a great deal of overhead is introduced in monitoring and moving the animals throughout the pasture, making this approach very difficult to implement at a large scale. Recent successes in the field of dynamic virtual fencing have demonstrated the feasibility of …

Hiv-1 Tat And Aids-Associated Cancer: Targeting The Cellular Anti-Cancer Barrier?, Giuseppe Nunnari, Johanna A Smith, René Daniel Jan 2008

Hiv-1 Tat And Aids-Associated Cancer: Targeting The Cellular Anti-Cancer Barrier?, Giuseppe Nunnari, Johanna A Smith, René Daniel

Department of Medicine Faculty Papers

The acquired immunodeficiency syndrome (AIDS) is accompanied by a significant increase in the incidence of neoplasms. Several causative agents have been proposed for this phenomenon. These include immunodeficiency and oncogenic DNA viruses and the HIV-1 protein Tat. Cancer in general is closely linked to genomic instability and DNA repair mechanisms. The latter maintains genomic stability and serves as a cellular anti-cancer barrier. Defects in DNA repair pathway are associated with carcinogenesis. This review focuses on newly discovered connections of the HIV-1 protein Tat, as well as cellular co-factors of Tat, to double-strand break DNA repair. We propose that the Tat-induced …

Changing The Rules Of Establishment Clause Litigation: An Alternative To The Public Expression Of Religion Act, Christopher D. Tomlinson Jan 2008

Changing The Rules Of Establishment Clause Litigation: An Alternative To The Public Expression Of Religion Act, Christopher D. Tomlinson

Vanderbilt Law Review

In 2004, the American Civil Liberties Union ("ACLU") threatened to sue the city of Redlands, California, if it did not remove a small cross from its city seal.' The cross represented the city's religious heritage and its history as a city of churches. Instead of facing the possibility of litigation and the more daunting risk of losing in court and being forced to pay the ACLU's attorneys' fees in addition to its own, the Redlands City Council agreed to change the seal. The City of Redlands not only could ill afford the risk of paying the ACLU's attorneys' fees; it …

The Trademark Use Requirement In Dilution Cases, Stacey Dogan, Mark A. Lemley Jan 2008

The Trademark Use Requirement In Dilution Cases, Stacey Dogan, Mark A. Lemley

Faculty Scholarship

The trademark use doctrine plays a critical role in ensuring that trademark law serves its proper purpose of encouraging market exchange and lowering consumer search costs. As we have explained in detail elsewhere, the doctrine ensures that trademarks do not become a weapon used to suppress speech or to interfere with rather than promote the efficient operation of the marketplace.

Those goals are even more important in the context of trademark dilution. Unlike a normal cause of action for trademark infringement, trademark dilution gives broader rights to a few famous mark owners to prevent even non-confusing uses in order to …

Open Code Governance, Danielle K. Citron Jan 2008

Open Code Governance, Danielle K. Citron

Faculty Scholarship

Automated information systems offer an opportunity to improve the democratic legitimacy of the administrative state. Today, agencies transfer crucial responsibilities to computer systems. Computers gather and interpret important information. For instance, electronic machines record and calculate votes. Automated systems execute policy and render decisions about important individual rights, such as a person's eligibility for public benefits. Computer systems store sensitive personal information. These systems' closed architecture, however, shields vital agency decisions from view. No one can see how a system operates without a software program's source code. Closed code hides programming errors that disenfranchise voters, under-count communities for the census, …

Technological Due Process, Danielle K. Citron Jan 2008

Technological Due Process, Danielle K. Citron

Faculty Scholarship

Distinct and complementary procedures for adjudications and rulemaking lie at the heart of twentieth-century administrative law. Due process required agencies to provide individuals notice and an opportunity to be heard. Agencies could foreclose policy issues that individuals might otherwise raise in adjudications through public rulemaking. One system allowed focused advocacy; the other featured broad participation. Each procedural regime compensated for the normative limits of the other. Both depended on clear statements of reason.

The dichotomy between these procedural regimes has become outmoded. This century's automated decision-making systems collapse individual adjudications into rulemaking while adhering to the procedural safeguards of neither. …

A Positive Theory Of Strict Liability, Keith N. Hylton Jan 2008

A Positive Theory Of Strict Liability, Keith N. Hylton

Faculty Scholarship

In spite of its tenure as the prevailing economic theory of strict liability, the proposition that strict liability should be preferred to negligence when it is desirable to reduce injurers' activity levels rather than victims' activity levels raises a few questions. First, when should we prefer to reduce injurers' activity levels rather than victims'? Second, why should we not hold both victim and injurer strictly liable? This paper provides a model that answers these questions more effectively than the prevailing economic model. The model presented here offers specific predictions that are consistent with the detailed law on strict liability and …

Asbestos And Mass Torts With Fraudulent Victims, Keith N. Hylton Jan 2008

Asbestos And Mass Torts With Fraudulent Victims, Keith N. Hylton

Faculty Scholarship

Deterrence and compensation goals should be distinguished, and compensation priorities should change in response to the deterrence goal. This has immediate implications for the problem of handling marginal and fraudulent claims in asbestos litigation. Where the deterrence goals come to the forefront, for example in instances of reckless exposure, it may be desirable for courts to require defendants to pay damages that are not transferred to any claimants. Where the deterrence goals are less compelling, as in instances of ordinary negligence, the importance of weeding out marginal and fraudulent claims becomes paramount. I consider optimal penalties for attorneys who bundle …

Preemption And Products Liability: A Positive Theory, Keith N. Hylton Jan 2008

Preemption And Products Liability: A Positive Theory, Keith N. Hylton

Faculty Scholarship

In a large number of products liability lawsuits, sellers assert that plaintiffs' claims should be rejected because their products fall under some federal regulatory regime, and that the regulatory statute takes precedence over or preempts state tort law. This paper is an attempt to set out a positive theory of the doctrine on preemption of products liability claims. The federal case law is largely consistent with an approach that seeks to minimize the costs of erroneous decisions to preempt tort lawsuits. In particular, two factors explain many of the outcomes of the preemption cases in federal courts: agency independence and …
