Why We Do The Things We Do? The Role Of Ethics In Water Resource Planning, Amy Hardberger Jan 2008

Why We Do The Things We Do? The Role Of Ethics In Water Resource Planning, Amy Hardberger

Faculty Articles

Water provides a natural framework in the role of ethics because ethical issues are present in every facet of water management. The value of water and the creation of ethics dictate decisions regarding water resource management. Value can be assessed from factors including happiness, well-being, or intrinsic value. Once a value is assessed, obligations that dictate actions regarding this issue are generated, and an ethic is created.

Various domestic and international policies have, both explicitly and implicitly, called for a human right to water. The presence of domestic and international policies that recognize or protect a person’s right to water …

Panel: Ethics-Based Decision-Making In Societal Water Management, Amy Hardberger Jan 2008

Panel: Ethics-Based Decision-Making In Societal Water Management, Amy Hardberger

Faculty Articles

There is an ethical overlay to water-related decision-making and management, frequently drawing on personal experiences with water and the ubiquitous need for water. The modern South African Bill of Rights, ensuring its people’s access to water; the movement towards recognizing water as a basic human right; and even occurrences in Texas, including the passage of “environmental flows legislation” and the efforts to preserve and protect the Edwards Aquifer, reflect the presence of ethics in decision-making with respect to water management. Ethics are a part of water management decision-making.

Corruption In Education: A Global Legal Challenge, Vincent R. Johnson Jan 2008

Corruption In Education: A Global Legal Challenge, Vincent R. Johnson

Faculty Articles

In every educational institution, in every country and generation, there is a struggle between corrupt practices and the continuing quest for high ethical standards. An educational institution is poorer if its members engage in corrupt practices. Such misfeasance wastes limited resources, demoralizes participants, and adversely affects productivity. The nature of this corruption is multi-faceted, and observes no geographic boundaries. It exists in every culture.

In some of these cases, educational corruption can be quite subtle. This is true where conduct that is neither criminal, fraudulent, nor a breach of fiduciary duty nevertheless undercuts the moral foundations of the educational enterprise. …

Overcoming Lochner In The Twenty-First Century: Taking Both Rights And Popular Sovereignty Seriously As We Seek To Secure Equal Citizenship And Promote The Public Good, Thomas B. Mcaffee

University of Richmond Law Review

Professor McAffee reviews substantive due process as the textual basis for modern fundamental rights constitutional decision-making. He contends that we should avoid both the undue literalism that rejects the idea of implied rights, as well as the attempt to substitute someone's preferred moral vision for the limits, and compromises, that are implicit in and intended by the Constitution's text. He argues, moreover, that we can largely harmonizethe variousgoals of our constitutionalsystem by taking rights se- riously and by understanding that securing rights does not ex-haustthe Constitution'spurposes.

A Search For Balance In The Discovery Of Esi Since December 1, 2006, Douglas L. Roger Jan 2008

A Search For Balance In The Discovery Of Esi Since December 1, 2006, Douglas L. Roger

Richmond Journal of Law & Technology

An explosion in the amount and discovery of electronically stored information (ESI) threatens to clog the federal court system and make judicial determination of the substantive merits of disputes an endangered species. It is interesting that this information discovery explosion has skipped over Rule 1 of the Federal Rules of Civil Procedure, which provides in part that the federal rules “shall be construed and administered to secure the just, speedy, and inexpensive determination of every action.”

Patenting Part-Human Chimeras, Transgenics And Stem Cells For Transplantation In The United States, Canada, And Europe, Gregory R. Hagen, Sébastien A. Gittens Jan 2008

Patenting Part-Human Chimeras, Transgenics And Stem Cells For Transplantation In The United States, Canada, And Europe, Gregory R. Hagen, Sébastien A. Gittens

Richmond Journal of Law & Technology

The perceived need for part-human materials – considered to be biological materials containing human genetic material for the purposes of this paper – is at least twofold. First, given the continued shortage of human organs and other human biological materials suitable for transplantation, thousands of persons will suffer illness and death each year.

Road safety cameras can photograph your car running red lights. Some bars record information on driver’s licenses to establish that their patrons are old enough to drink. The Recording Industry Association of America (RIAA) uses automated web crawlers to try to find illegal copies of mp3s, and iTunes embeds personal identifying information in the tracks of every song you buy.

Hidden Costs Of The Wireless Broadband Lifestyle: Comparing Consumer Protections In The United States, Canada, And The European Union, Renee Dopplick

Richmond Journal of Law & Technology

Spurred by relatively inexpensive and widely available retail equipment and increased residential Internet penetration, consumer demand for more wireless broadband options continues at a rapid rate. Now, with consumers increasingly looking for mobile Internet interconnectivity over greater distances and with greater flexibility, technology companies are pushing the next generation of wireless broadband technologies with the promise of freeing consumers from location-based Internet access. These newer technologies can provide robust video and audio capabilities, such as digital television, on-demand video, and VoIP on a variety of digital devices. Yet, the rise of wireless

broadband networks and the roll-out of new technologies …

Retail Investor Remedies Under Rule 10b-5, O'Hare Jennifer Jan 2008

Retail Investor Remedies Under Rule 10b-5, O'Hare Jennifer

Faculty Publications

This paper assesses the private remedies available under Rule 10b-5 to retail investors who have been defrauded by false corporate disclosures. After comparing the treatment received by retail investors to the treatment received by institutional investors, I identify several areas in which the federal securities laws disfavor retail investors who have been defrauded by false corporate disclosures, including the creation of a two-tiered system of investor remedies for securities fraud. Institutional investors are permitted to pick and choose which law and forum offers them the most attractive chance for recovery, but retail investors typically do not have this opportunity. They …

Mathematics and Statistics Faculty Publications and Presentations

Researchers of mathematics education are increasingly interested in a teacher's discursive moves, which refer to deliberate actions taken by a teacher to participate in or influence debate and discussion in the mathematics classroom. This study explored one teacher's discursive moves in an undergraduate inquiry-oriented mathematics class. The data for this study come from four class sessions in which students investigated initial value problems as represented by the phase portrait of a system of differential equations. Through the analysis and a review of the literature, we identified four categories of a teacher's discursive moves: revoicing, questioning/requesting, telling, and managing. This report …

Analysis Of Resonating Microcantilevers Operating In A Viscous Liquid Environment, Cyril Vančura, Isabelle Dufour, Stephen M. Heinrich, Fabien Josse, Andreas Hierlemann Jan 2008

Analysis Of Resonating Microcantilevers Operating In A Viscous Liquid Environment, Cyril Vančura, Isabelle Dufour, Stephen M. Heinrich, Fabien Josse, Andreas Hierlemann

Civil and Environmental Engineering Faculty Research and Publications

The characteristics of resonant cantilevers in viscous liquids are analyzed. Various rectangular cantilevers geometries are studied in pure water, glycerol and ethanol solutions of different concentrations, and the results are described in terms of the added displaced liquid mass and the liquid damping force for both, the resonance frequency and the quality factor (Q-factor). Experimental results using a set of magnetically actuated resonant cantilevers vibrating in the out-of-plane (“weak-axis bending”) mode are presented and compared to theoretical calculations. The importance of the study is in the use of resonant cantilevers as biochemical sensors in liquid environments.

Design And Evaluation Of A Greenhouse Interface For Climate Control Programming And Networking, G. Diaz, S. F. Kelly, Ilhami Yildiz

BioResource and Agricultural Engineering

At Cal Poly the motto is “Learn by Doing”. In the College of Agriculture, this is especially true and many of the labs provide an opportunity for students to implement this philosophy. Updated climate controls were installed in a series of greenhouses on the top floor of the Agricultural Science building that are used for student and faculty research projects. A Programmable Logic Controller (PLC) was installed to actuate the various vents, shading, heating, cooling and irrigation. A control program was developed to control and log temperatures and other operating parameters to monitor the greenhouse. An easy to use computer …

Examination Of Preferred Coaching Behaviors As Predicted By Athlete Gender, Race, And Playing Time, Glenn Parrish Burdette Jan 2008

Examination Of Preferred Coaching Behaviors As Predicted By Athlete Gender, Race, And Playing Time, Glenn Parrish Burdette

College of Graduate Studies: Theses & Dissertations

The Multidimensional Model for Sport Leadership (MML) (Chelladurai, 1980) states that athlete performance and satisfaction are functions of the congruency between the preferred leadership of student-athletes, the required behavior of the coach as dictated by the situation, and the actual behavior of the coach. The model was developed nearly 30 years ago and while research outside of sport has indicated that leadership preferences have changed with generations, the MML is still the most widely accepted model for sport leadership. As such, research in sport should examine how appropriate the model is to todays athletic culture. Gender, one member characteristic, has …

Comparison Of Career Statistics And Season Statistics In Major League Baseball, Mark Joseph Ammons Jan 2008

Comparison Of Career Statistics And Season Statistics In Major League Baseball, Mark Joseph Ammons

College of Graduate Studies: Theses & Dissertations

This is a comparison of statistics for some of the best seasons and careers of players from Major League Baseball; using data collected on batting average, at bat to homerun ratio, and earned run average. Two teams were created, composed of season leaders and career leaders, chosen for their outstanding offensive and pitching abilities, and were pitted against one another to determine superiority. These two teams also compared against a team from each era of major league baseball. The season and career leaders challenged, the 1918 Boston Red Sox, 1927 New York Yankees, 1955 Brooklyn Dodgers, 1961 New York Yankees, …
