English Language & Third Generation Programming Language Pedagogical Practice Analysis, Vincent Falbo Jan 2008

English Language & Third Generation Programming Language Pedagogical Practice Analysis, Vincent Falbo

Theses

In an effort to provide better computer programming instruction to more students at an introductory level, pedagogical methods could be improved using a paradigm of instruction based on the same strategies used to teach students spoken languages. Although many different methodologies of instruction have been explored in the past, this document identifies relationships between spoken languages and computer languages that encourage the exploration of the best practices of teaching English Language Arts so that they could be applied to computer programming instruction. Those with backgrounds in mathematics and science initially completed programming tasks. Much literature about the problem solving aspects …

Changing The Rules Of Establishment Clause Litigation: An Alternative To The Public Expression Of Religion Act, Christopher D. Tomlinson Jan 2008

Changing The Rules Of Establishment Clause Litigation: An Alternative To The Public Expression Of Religion Act, Christopher D. Tomlinson

Vanderbilt Law Review

In 2004, the American Civil Liberties Union ("ACLU") threatened to sue the city of Redlands, California, if it did not remove a small cross from its city seal.' The cross represented the city's religious heritage and its history as a city of churches. Instead of facing the possibility of litigation and the more daunting risk of losing in court and being forced to pay the ACLU's attorneys' fees in addition to its own, the Redlands City Council agreed to change the seal. The City of Redlands not only could ill afford the risk of paying the ACLU's attorneys' fees; it …

The Roles Of Standardization, Certification And Assurance Services In Global Commerce, Margaret M. Blair, Cynthia A. Williams, Li-Wen Lin Jan 2008

The Roles Of Standardization, Certification And Assurance Services In Global Commerce, Margaret M. Blair, Cynthia A. Williams, Li-Wen Lin

All Faculty Publications

In this article we examine the rapid emergence and expansion of standardized product and process frameworks and a private-sector compliance and enforcement infrastructure that we believe may increasingly be providing a substitute for public and legal regulatory infrastructure in global commerce. This infrastructure is provided by a proliferation of performance codes and standards, many of which define acceptable social and environmental behavior, and a rapidly-growing number of privately-trained and authorized inspectors and certifiers that we call the third-party assurance industry. We offer reasons for this development, evidence of its scope and scale, and then describe the phenomenon in more detail …

Listening To Their Voices: Women Prisoners And Access To Justice In Manitoba, Debra Parkes, Kathy Bent, Tracey Peter, Tracy Booth Jan 2008

Listening To Their Voices: Women Prisoners And Access To Justice In Manitoba, Debra Parkes, Kathy Bent, Tracey Peter, Tracy Booth

All Faculty Publications

The existing research into effective accountability and oversight of Canadian prisons has considered the situation of federally sentenced prisoners (that is, those serving sentences of two years or more) and has raised serious questions about their ability to access justice in the sense of having adequate and accessible means to ensure that their treatment and conditions of confinement are just and in compliance with the law. Relatively little is known about the state of oversight and legal review processes at the provincial level, where jail terms are short and prisoners’ rights litigation is rare. This paper attempts to begin filling …

Proportionate Securities Regulation: The Potential For Scaled Treatment Of Junior Issuers, Janis P. Sarra Jan 2008

Proportionate Securities Regulation: The Potential For Scaled Treatment Of Junior Issuers, Janis P. Sarra

All Faculty Publications

Particular features of Canada’s capital market inform our consideration of moving towards a more proportionate regulatory system. Specifically, Canada has a large number of small public companies; its market cap is concentrated largely in four provinces; it has a particular focus on mining, resources and technology; and a significant number of issuers are cross-listed on US exchanges. Canadian securities regulators have already recognized some measure of proportionate regulation in their national instruments, based on the type of listing. The paper suggests that a number of overriding principles or considerations should be taken into account in respect of a further move …

How Not To Incorporate Voluntary Standards Into Smart Regulation: Iso 14001 And Ontario's Environmental Penalties Regulations, Stepan Wood, Lynn Johannson Jan 2008

How Not To Incorporate Voluntary Standards Into Smart Regulation: Iso 14001 And Ontario's Environmental Penalties Regulations, Stepan Wood, Lynn Johannson

All Faculty Publications

In June, 2007 the province of Ontario, Canada, released environmental penalties (EPs) regulations. EPs (or administrative penalties, as they are called in the US) are the environmental equivalent of speeding tickets for facilities that violate pollution laws. They are found in numerous jurisdictions and are widely understood as part of a move toward smart regulation. The Ontario regulations offer reduced EPs to facilities with an environmental management system (EMS) that meets the requirements of ISO 14001 or the chemical industry's Responsible Care initiative. We argue that non-governmental, consensus-based standards such as ISO 14001 can and should play a constructive role …

Phylogenetic Analyses Of Two Mitochondrial Metabolic Genes Sampled In Parallel From Angiosperms Find Fundamental Interlocus Incongruence, Melvin R. Duvall, J.W. Robinson, J.G. Mattson, A. Moore Jan 2008

Phylogenetic Analyses Of Two Mitochondrial Metabolic Genes Sampled In Parallel From Angiosperms Find Fundamental Interlocus Incongruence, Melvin R. Duvall, J.W. Robinson, J.G. Mattson, A. Moore

Faculty Articles, Papers, and Other Scholarship

Plant molecular phylogeneticists have supported an analytical approach of combining loci from different genomes, but the combination of mitochondrial sequences with chloroplast and nuclear sequences is potentially problematic. Low substitution rates in mitochondrial genes should decrease saturation, which is especially useful for the study of deep divergences. However, individual mitochondrial loci are insuffi ciently informative, so that combining congruent loci is necessary. For this study atp1 and cox1 were selected, which are of similar lengths, encode components of the respiratory pathway, and generally lack introns. Thus, these genes might be expected to have similar functional constraints, selection pressures, and evolutionary …

Claims To Information Qua Information And A Structural Theory Of Section 101, Kevin Emerson Collins Jan 2008

Claims To Information Qua Information And A Structural Theory Of Section 101, Kevin Emerson Collins

Articles by Maurer Faculty

In this article, I start from the premises that claims to inventive information qua information are not and should not be patentable, and I pursue two lines of inquiry. First, I argue that a structural theory of Section l0l of the Patent Act provides a policy-driven, conceptually coherent and statutorily justified interpretation that explains why claims to inventive information qua information should be excluded from the realm of patentable subject matter. In brief, patentable subject matter must be restricted in this manner to preserve the duality of claiming and disclosing upon which the entire patent regime is constructed.

Second, I …

Experimental Study Of A Foam Flow In Horizontal Pipes: Two Flow Regimes And Its Implications, Miodrag Bogdanovic Jan 2008

Experimental Study Of A Foam Flow In Horizontal Pipes: Two Flow Regimes And Its Implications, Miodrag Bogdanovic

LSU Master's Theses

Although foam has been widely used in many scientific and engineering applications, the current understanding of foam rheology in pipes is still very limited because of its complex nature. This experimental study, for the first time, investigates the flow rheology of foams in pipes by placing a special emphasis on two distinct foam flow regimes. A wide range of experimental conditions are examined in this study, which include five different surfactant formulations (Cedepal FA-406, Petrostep CG-50, Stepanform 1050, Aquet TD-600, and Ultra-Palmolive), three different surfactant concentrations (0.1, 1, and 5 wt %), two different pipe diameters (0.5 and 1 inch …

The Madden-Julian Oscillation And Tropical Cyclone Frequency Variability, Stephen Caparotta Jan 2008

The Madden-Julian Oscillation And Tropical Cyclone Frequency Variability, Stephen Caparotta

LSU Master's Theses

Recent years have seen a dramatic increase in monetary losses from hurricanes along the U.S. coastline. The vast majority of the damage resulted from major hurricanes (Category 3-5), with 2005’s Katrina, Rita, and Wilma producing an estimated $60 billion in insured losses alone (Insurance Information Institute, 2008). In light of these record damages, it is crucial to have a better understanding of the atmospheric and oceanic conditions that produce the most powerful hurricanes. Prior research has focused on interseasonal variability in tropical cyclones, but much less attention has been devoted to intraseasonal variability. Maloney and Hartmann (2000a) showed that hurricanes …

An Embarrassment Of Riches: The Enzymology Of Rna Modification, Dirk Iwata-Reuyl Jan 2008

An Embarrassment Of Riches: The Enzymology Of Rna Modification, Dirk Iwata-Reuyl

Chemistry Faculty Publications and Presentations

The maturation of transfer RNA (tRNA) involves extensive chemical modification of the constituent nucleosides and results in the introduction of significant chemical diversity to tRNA. Many of the pathways to these modified nucleosides are characterized by chemically complex transformations, some of which are unprecedented in other areas of biology. To illustrate the scope of the field, recent progress in understanding the enzymology leading to the formation of two distinct classes of modified nucleosides, the thiouridines and queuosine, a 7-deazaguanosine, is reviewed. In particular, recent data validating the involvement of several proposed intermediates in the formation of thiouridines are discussed, including …

Design, Fabrication, And Testing Of A Micro Fuel Injection Swirler For Lean Premixed Combustion In Gas Turbine Engines, Anthony Louis Giglio Jan 2008

Design, Fabrication, And Testing Of A Micro Fuel Injection Swirler For Lean Premixed Combustion In Gas Turbine Engines, Anthony Louis Giglio

LSU Master's Theses

Due to growing energy demands and the need for increased fuel consumption efficiency, environmental protection agencies are imposing more stringent emissions regulations on gas turbine combustion systems with emphasis on NOx emissions reduction. Emerging technological combustion schemes to reduce NOx commonly employ lean premixed combustion. Decreases in NOx are globally obtained by flame temperature decrease and locally improved by homogeneity of the reacting mixture. A new micro fuel injection swirler, capable of providing efficient and rapid mixing over a short distance, is presented in this thesis. The conception of the Micro Fuel Injection Swirler (MFIS) was motivated by the need …

In-Situ And Nondestructive Test Methods Applied To The Design And Construction Of Pile Foundation Projects In Coastal Louisiana, Jesse Gerard Rauser Jan 2008

In-Situ And Nondestructive Test Methods Applied To The Design And Construction Of Pile Foundation Projects In Coastal Louisiana, Jesse Gerard Rauser

LSU Master's Theses

Construction projects in coastal Louisiana often require pile foundations as a result of the soft soils present, which complicate cast‐in‐place foundation construction and provide minimal support to shallow foundations. During a driven pile project, the engineering phase will require soil characterization and pile capacity determination, while construction will require quality assurance. These three elements, soil characterization, capacity determination, and quality assurance, are commonly accomplished using in‐situ and nondestructive testing. In this thesis, the application of some of these in‐situ and nondestructive methodologies to a project in Coastal Louisiana are examined. The Louisiana Transportation Research Center (LTRC) has released computer software …

The Consensual Assessment Technique As A Measure Of Creativity In Children's Musical Compositions Motivated By Visual And Verbal Stimuli, Katie Elizabeth Toups Jan 2008

The Consensual Assessment Technique As A Measure Of Creativity In Children's Musical Compositions Motivated By Visual And Verbal Stimuli, Katie Elizabeth Toups

LSU Master's Theses

ABSTRACT The purposes of this study were: 1) To compare the relationship between the degrees of creativity shown in musical compositions of third grade students (N=163) when they were exposed to either a visual or verbal stimulus, and 2) to examine inter-judge reliability for creativity ratings using the Consensual Assessment Technique (CAT) with instrumental group compositions. Throughout a nine-week teaching unit, all subjects participated in regular music classes where they learned compositional techniques and concepts. They worked in small cooperative learning groups of 3 to 6 students throughout the unit to compose several “mini” compositions and two large-scale compositions. For …

Pacifism And War: What Are The Ethical And Theological Limitations On The Use Of Violence?, John Tracy Thames Jan 2008

Pacifism And War: What Are The Ethical And Theological Limitations On The Use Of Violence?, John Tracy Thames

LSU Master's Theses

This project seeks to develop an understanding of the ethically permissible and theologically justifiable use of violence, especially as it manifests itself in war. The issue is approached through exegesis of the New Testament texts concerning violence in order to discern a biblical, ethical position. After secularizing the resulting position, it is set against two modern, secular versions of the just war theory; the prevailing contemporary conception of morality in war. Due to disparities that arise between the normative New Testament position and the best moral theorizing about war, the task shows itself to be a theoretical, theological endeavor to …

Alcohol Use, Negative Consequences, And Readiness To Change In Mandated And Volunteer College Student Heavy Drinkers Before And After A Brief Alcohol Intervention, Meredith A. Terlecki Jan 2008

Alcohol Use, Negative Consequences, And Readiness To Change In Mandated And Volunteer College Student Heavy Drinkers Before And After A Brief Alcohol Intervention, Meredith A. Terlecki

LSU Master's Theses

The current study tested the efficacy of a brief intervention designed to reduce alcohol use among high-risk college students who have been mandated to treatment for an alcohol policy violation relative to a brief wait-list control group and volunteer high-risk sample. Thirty-nine mandated students and forty high-risk student volunteers were randomly assigned to receive either a brief alcohol intervention or were assigned to a brief wait-list control (WLC) group. Participants were assessed at baseline and at a 4-week post-test on measures of alcohol consumption, alcohol-related problems, and readiness to change. Of the participants who had completed follow-up (N = 39), …

Ex Parte Domestic Violence Orders Of Protection: How Easing Access To Judicial Process Has Eased The Possibility For Abuse Of The Process, David H. Taylor

Faculty Articles, Papers, and Other Scholarship

This article explores how state domestic violence statutory schemes that grant temporary ex parte orders have inadvertently lead to the abuse of orders of protection. Part I introduces how domestic violence statutes came to be, and describes how the typical statutory scheme works when it comes to granting ex parte orders. Part II examines the problems that occur when ex parte relief is easily obtained. Part III looks at the factors that contribute to the ability to misuse orders of protection. Part IV discusses due process and ex parte orders of protection. Part V is a survey of the state …

Exploring Effective Co-Teaching Models, Lien M. Nguyen

School of Education and Leadership Student Capstone Theses and Dissertations

The research question addressed in this project was, what is an effective co-teaching model between mainstream and special education teachers and the impact on the kindergarten classroom environment? It documents one teacher's exploration of the five models of co-teaching. The author documents the benefits of co-teaching and full inclusion. She documents details of the surveys, lesson plans, and outcomes of the three models of co-teaching that were used in two kindergarten classrooms. She concludes that: (1) it is important to gather background information from participating colleagues, (2) students with disabilities and at risk learners benefit most from co-teaching, and (3) …

Computer Simulation Of The Role Of Groundwater Seepage In Forming Martian Valley Networks, W. Luo, A.D. Howard Jan 2008

Computer Simulation Of The Role Of Groundwater Seepage In Forming Martian Valley Networks, W. Luo, A.D. Howard

Faculty Articles, Papers, and Other Scholarship

The role of groundwater in forming Martian valley networks is simulated in a computer model as seepage erosion by contributing to surface runoff and as seepage weathering by causing accelerated weathering of bedrock, which makes its subsequent erosion and removal easier. Simulation results show that seepage erosion cannot mobilize large grain size sediment and is marginally effective at generating integrated valley networks with realistic rates of aquifer recharge. On the other hand, seepage weathering may play a major role in forming Martian valley networks. Seepage weathering combined with fluvial runoff creates stubby deep canyons with abrupt headwalls that are similar …

Collaborative Family Law, The New Lawyer, And Deep Resolution Of Divorce-Related Conflicts, Pauline H. Tesler Jan 2008

Collaborative Family Law, The New Lawyer, And Deep Resolution Of Divorce-Related Conflicts, Pauline H. Tesler

Journal of Dispute Resolution

Unlike many of the contributions to this Symposium issue, mine is a speculative, idiosyncratic opinion piece. I want to explore what we know, what we think we know, what we do not know, and what we need to know about Collaborative Law and interdisciplinary team Collaborative Divorce Practice as they presently exist in the field of family law, in two respects: what these processes offer to clients (the "deep resolution" part of my title) and what effect the practice of these processes has on lawyers (the "new lawyer" part of my title). Instead of citing to authority, this essay draws …

Practical Insights From An Empirical Study Of Cooperative Lawyers In Wisconsin, John Lande Jan 2008

This article proceeds as follows. After Part II describes the research methodology, Part III depicts DCI members' general orientation toward cooperation and their reactions to litigation-oriented and Collaborative Practice. This Part highlights the distinctions between the three types of practice. Not surprisingly, DCI members' interest in Cooperative Practice reflects some dissatisfaction with both litigation-oriented and Collaborative Practice. Part IV describes DCI members' accounts about Cooperative Practice, including their goals, how they define Cooperative cases, their views about appropriateness of Cooperative Practice, how cases are initiated, the number and characteristics of these cases, and the procedures used in Cooperative Practice. It …

Ethics Of Collaborative Law, The, Scott R. Peppet Jan 2008

Ethics Of Collaborative Law, The, Scott R. Peppet

Journal of Dispute Resolution

This article argues that Collaborative Law can be permissible under the current rules of legal ethics. At the same time, it contends that this is not a foregone conclusion, and that certain Collaborative Law contracts or arrangements are more suspect than others. In short, it argues that collaborative lawyers need to be extremely careful in how they go about their practice if they wish to withstand ethical scrutiny.

Rejecting The Intertwining Doctrine: Favoring Adr While Hindering Judicial Efficiency And Economy, Michael Bekesha Jan 2008

Rejecting The Intertwining Doctrine: Favoring Adr While Hindering Judicial Efficiency And Economy, Michael Bekesha

Journal of Dispute Resolution

Often the scope of arbitration clauses does not include all potential claims. When the provision fails to provide for all disputes, courts may proceed in one of two ways to resolve both arbitrable and nonarbitrable claims: enforce the arbitration clause with respect to arbitrable claims, or ignore the private contract and litigate all issues at once. The Colorado Supreme Court, in Ingold v. AIMCO, chose the former - rejecting the intertwining doctrine. In doing so, Colorado aligned itself with the position that the United States Supreme Court embraced over twenty years ago. This casenote will discuss whether the Colorado Supreme …

Expanding The Power Of U.S. Courts In Private International Arbitration - Moderation Loses To An Extreme, Amy Moore Jan 2008

Expanding The Power Of U.S. Courts In Private International Arbitration - Moderation Loses To An Extreme, Amy Moore

Journal of Dispute Resolution

Since its inception, 28 U.S.C. § 17822 has been the subject of revisions, amendments, and much debate. This history is symptomatic of the evolving nature of United States presence in the international legal and business world; however, the statutory changes have not always been clear in purpose or application. In 2004, the Supreme Court granted certiorari for Intel Corp. v. Advanced Micro Devices, Inc., in order to solidify interpretation of § 1782's latest rendition, a 1964 congressional revision. Unfortunately, in expanding the accepted scope of § 1782, the Court created new ambiguity, especially in how the statute should relate to …

Interest Arbitration Clauses In Sec. 8(F) Pre-Hire Agreements: Effective For Achieving Genuine Collective Bargaining Or Enabling Parties To Underhandedly Gain Majority Bargaining Power, Thomas Riske Jan 2008

Interest Arbitration Clauses In Sec. 8(F) Pre-Hire Agreements: Effective For Achieving Genuine Collective Bargaining Or Enabling Parties To Underhandedly Gain Majority Bargaining Power, Thomas Riske

Journal of Dispute Resolution

In Sheet Metal Workers' International Ass'n, Local Union No. 2 v. McElroy's Inc., the United States Court of Appeals for the Tenth Circuit considered whether an employer was required to submit to interest arbitration with a union under the pre-hire agreement entered into by the parties. The applicability of the statutory standards for pre-hire agreements to bargained-for labor and employment contracts is an essential element of this case. When interpreting federal statutory law, the majority of jurisdictions permit unilateral repudiation upon the expiration of a pre-hire agreement and a small minority of jurisdictions allow for the agreement to be repudiated …

From Odious Debt To Odious Finance: Avoiding The Externalities Of A Functional Odious Debt Doctrine, Christiana Ochoa Jan 2008

From Odious Debt To Odious Finance: Avoiding The Externalities Of A Functional Odious Debt Doctrine, Christiana Ochoa

Articles by Maurer Faculty

This Article looks at the generally agreed upon characteristics of the odious debt doctrine and considers the unintended consequences and externalities that would ensue if this doctrine were ever made regularly operative. The enlivened scholarly debate surrounding the odious debt doctrine assumes that debt is the sole finance vehicle for despotic governments. This is simply not the case.

Debt is not the sole finance vehicle; despots are able to raise funds through a wide variety of other methods. These include the pillaging of the nation's natural resources, property, and other valuable asset as well as the exploitation of the nation's …
