Reflections On The Nature Of Legal Scholarship In The Post-Realist Era, Marin Roger Scordato Jan 2008

Reflections On The Nature Of Legal Scholarship In The Post-Realist Era, Marin Roger Scordato

Scholarly Articles

This article presents a tightly organized and closely reasoned analysis of legal scholarship in the current post-realist era. Secure and well-defined within the formalist legal world of the nineteenth century, the practice of legal scholarship has been profoundly affected by the realist revolution of the early twentieth century and the instrumentalist view of law that now prevails in the twenty-first century. In response, legal scholars have been forced to dramatically alter the focus, the materials and the basic methods of their study. The practice of legal scholarship is currently occupied in a prolonged struggle to adapt to these changes and …

The Preferential Option For The Poor: An Opportunity And A Challenge For Environmental Decision Making, Lucia A. Silecchia Jan 2008

The Preferential Option For The Poor: An Opportunity And A Challenge For Environmental Decision Making, Lucia A. Silecchia

Scholarly Articles

The doctrine of 'the preferential option for the poor' has deep roots in Catholic social thought. It proposes that the needs of the poorest and most vulnerable be given priority when creating and evaluating public policies, actions, and attitudes. More recently, the obligation to care for natural environment in an ethical way has been gaining more attention both in the secular world as well as among Catholic scholars who seek to explore the scope of human responsibility for the created world. This paper explores the intersection of the preferential option for the poor and environmental ethics. After a general discussion …

Social Justice And Health Care Management: An Elusive Quest?, George P. Smith Ii Jan 2008

Social Justice And Health Care Management: An Elusive Quest?, George P. Smith Ii

Scholarly Articles

Contemporary debate on health care resource management is tied to a central moral issue: namely, how to achieve an optimum level of reasonable or appropriate treatment based on the medical condition of each patient. Failing to tackle and resolve this issue in a confident and forthright manner assures the present approach to health care decision making to continue in a state of indecisiveness if, indeed, not lethargy.

Undergirding this moral issue is the foundational economic dilemma of controlling costs while limiting access to health care resources. Finding a just solution to an equitable distribution of finite health care resources is …

Faith In The Rule Of Law, Marc O. Degirolami Jan 2008

Faith In The Rule Of Law, Marc O. Degirolami

Scholarly Articles

For all but the most unflinching consequentialist, "instrumentalism" tends to draw mixed reviews. So it does from Brian Tamanaha. His book, Law as a Means to an End: Threat to the Rule of Law, documents with measured diffidence the ascendancy and current reign of "legal instrumentalism," so entrenched an understanding of law that it is "taken for granted in the United States, almost a part of the air we breathe." Professor Tamanaha shows that in our legal theorizing, our approaches to legal education, our understanding of legal practice, and our perception of judges, legislators, and legal administrators, law is widely …

Reconstituting Japanese Law: International Norms And Domestic Litigation, Timothy Webster

Michigan Journal of International Law

This Essay proceeds in four parts. Part I situates these lawsuits in the context of Japan's growing ethnic diversity. Part II analyzes a decade of racial discrimination lawsuits in Japan, ultimately synthesizing the elements of a compensable act of racial discrimination under current Japanese law. Part III begins with a brief examination of the role of international law in Japan before turning to discussions between the Japanese government and U.N. bodies regarding the proper treatment of foreigners in Japan and the desirability of anti-discrimination laws. Part IV then discusses several failed attempts by national and local lawmakers to pass anti-discrimination …

Dr. Maximillian Schmidt's 1884 Review Of The Growth Rates Of Asian Elephants, Robert H.I. Dale, Fred Yaniga Jan 2008

Dr. Maximillian Schmidt's 1884 Review Of The Growth Rates Of Asian Elephants, Robert H.I. Dale, Fred Yaniga

Scholarship and Professional Work - LAS

Rarely is there a scientific article of such creativity, insight and importance that it is fascinating even 125 years after it was written. The following article by Max Schmidt, translated in English for the first time, as far as we know, is one of these. As in the original article, an illustration precedes the text.

Dr. Schmidt addressed a topic of considerable interest in recent times (for example, Sukumar, 2003, Appendix 2): The growth curves of elephants. He combined data on multiple elephants from several sources to generate a table of shoulder heights from birth to the age of 34 …

History: The Birth Of "America" In 1882, Robert H.I. Dale

Scholarship and Professional Work - LAS

This article concerns a New York Times story about the birth of the female Asian elephant calf, named America, at the winter headquarters of the "Greatest Show on Earth" in Bridgeport, Connecticut on February 2, 1882. Phineas T. Barnum, one of the owners of the show, and one prone to self-aggrandizing bluster, claimed that America was the second elephant ever born in captivity. America was born only to months before the arrival in New York of the most famous circus elephant of all time, Jumbo, on Easter Sunday, 1882, and only two years before the origin of a small wagon …

Calf Development: Most Births At Night, Robert H.I. Dale Jan 2008

Calf Development: Most Births At Night, Robert H.I. Dale

Scholarship and Professional Work - LAS

For many years, field researchers studying both African (Loxodonta africana) and Asian (Elephas maximas) elephants have indicated that they have observed relatively few births in situ, suggesting that most elephant dams give birth at night. For example, according to Cynthia Moss, "Possibly the majority of births occur at night and perhaps those that do take place in the daytime happen in secluded places" (1988, p. 151). Others, for example, Clive Spinage, have referred to "the old beliefs that the cows retreated to 'calving grounds' or that birth took place at night." (Spinage, 1994, p. 90). Although …

Innocent Initiations: Female Agency In Eroticized Fairy Tales, Jeana Jorgensen Jan 2008

Innocent Initiations: Female Agency In Eroticized Fairy Tales, Jeana Jorgensen

Scholarship and Professional Work - LAS

Bawdy folktales have generated controversy and scholarship for centuries, and their literary, sexually explicit descendants, eroticized fairy tales, are also deserving of attention. Marketed in short story collections as erotica, eroticized fairy tales use fairy-tale characters, plots, and themes as the setting for sexual adventures. Some of these tales focus on a naïve heroine’s initiation into sexual pleasure without her knowing precisely what is going on. I have termed these “innocent initiation” tales. Their use of traditional fairy-tale motifs contributes to discourse about female sexuality, agency, and objectification.

Rapid Bursts Of Androgen-Binding Protein (Abp) Gene Duplication Occurred Independently In Diverse Mammals, Christina M. Laukaitis, Andreas Heger, Tyler D. Blakely, Pavel Munclinger, Chris P. Ponting, Robert C. Karn Jan 2008

Rapid Bursts Of Androgen-Binding Protein (Abp) Gene Duplication Occurred Independently In Diverse Mammals, Christina M. Laukaitis, Andreas Heger, Tyler D. Blakely, Pavel Munclinger, Chris P. Ponting, Robert C. Karn

Scholarship and Professional Work - LAS

Background

The draft mouse (Mus musculus) genome sequence revealed an unexpected proliferation of gene duplicates encoding a family of secretoglobin proteins including the androgen-binding protein (ABP) α, β and γ subunits. Further investigation of 14 α-like (Abpa) and 13 β- or γ-like (Abpbg) undisrupted gene sequences revealed a rich diversity of developmental stage-, sex- and tissue-specific expression. Despite these studies, our understanding of the evolution of this gene family remains incomplete. Questions arise from imperfections in the initial mouse genome assembly and a dearth of information about the gene family structure in other rodents …

Redeeming Indian ‘Christian’ Womanhood?: Missionaries, Dalits, And Agency In Colonial India, Chad M. Bauman Jan 2008

Redeeming Indian ‘Christian’ Womanhood?: Missionaries, Dalits, And Agency In Colonial India, Chad M. Bauman

Scholarship and Professional Work - LAS

This study of dalit Christians in colonial North India suggests that women who converted to Christianity in the region often experienced a contraction of the range of their activities. Bauman analyzes this counterintuitive result of missionary work and then draws on the work of Saba Mahmood and others to interrogate the predilection of feminist historians for agents, rabble-rousers, and gender troublemakers. The article concludes not only that this predilection represents a mild form of egocentrism but also that it prevents historians from adequately analyzing the complexity of factors that motivate and influence human behavior.

Effect Of Pre-Breeding Weight And Mga Supplementation On Heifer Performance, Jeremy L. Martin, Kelly W. Creighton, Jacqueline A. Musgrave, Terry J. Klopfenstein, Richard T. Clark, Don C. Adams, Richard N. Funston Jan 2008

Effect Of Pre-Breeding Weight And Mga Supplementation On Heifer Performance, Jeremy L. Martin, Kelly W. Creighton, Jacqueline A. Musgrave, Terry J. Klopfenstein, Richard T. Clark, Don C. Adams, Richard N. Funston

Nebraska Beef Cattle Reports

Developing heifers to reach a target weight of 50% of mature body weight at the beginning of the breeding season is an effective method for reducing heifer development cost. Net costs to produce a bred yearling heifer and 2-year-old cow were lower when heifers were developed to 50% rather than 55% of mature body weight, regardless of breeding season length. Administration of oral progestin to heifers developed to 50% mature body weight prior to breeding did not affect reproductive performance during the first breeding season when heifers were exposed to bulls 13 days after the end of progestin treatment.

Effect Of Wintering System And Nutrition Around Breeding On Gain And Reproduction In Heifers, Daniel M. Larson, Jeremy L. Martin, Richard N. Funston Jan 2008

Effect Of Wintering System And Nutrition Around Breeding On Gain And Reproduction In Heifers, Daniel M. Larson, Jeremy L. Martin, Richard N. Funston

Nebraska Beef Cattle Reports

Replacement heifers were developed using corn stalks (Experiments 1 and 2), winter range (Experiment 1), or a dry lot (Experiment 2) with or without a high energy supplement around breeding. Corn stalk development reduced ADG and the percentage pubertal prior to breeding; however, neither first service conception nor pregnancy rates were affected. High energy supplemental nutrition around breeding tends to improve first service conception. Corn stalk development does not appear to negatively impact reproduction, although it resulted in lighter calf birth weight compared to winter range.

Pre And Peri-Pubertal Feeding Of Melengesterol Acetate (Mga) Alters Testis Characteristics In Bulls, Racheal G. Slattery, Shantille G. Kruse, Jeremy L. Martin, Michelle M. Baltes-Breitwisch, Debra T. Clopton, Karl V. Moline, Jeffrey W. Bergman, Andrea S. Cupp Jan 2008

Nebraska Beef Cattle Reports

Bulls were fed 1 mg/head/day of MGA from 5.5 to 6.5 months ; 6.5 to 9; or fed a control diet. Body weight, scrotal circumference, combined testis weight, testis composition, and testosterone concentration were measured. Feeding MGA prior to puberty increased scrotal circumference and decreased testosterone concentration at 12 months compared to controls. Thus, feeding MGA prior to puberty can alter testis characteristics in bulls.
