In The Spirit Of Ubuntur. Enforcing The Rights Of Orphans And Vulnerable Children Affected By Hiv/Aids In South Africa, John D. Bessler Jan 2008

In The Spirit Of Ubuntur. Enforcing The Rights Of Orphans And Vulnerable Children Affected By Hiv/Aids In South Africa, John D. Bessler

UC Law SF International Law Review

The author discusses the traditional African concept of ubuntu, which is frequently cited in South African jurisprudence, and analyzes South Africa's violation of the human rights of orphans and vulnerable children affected by HIV/AIDS. South Africa's Constitution explicitly protects children's rights and various socio-economic rights of concern to children. The Constitutional Court of South Africa has held such rights to be justiciable, yet the rights of South African children have continually been violated. The author discusses how the existence of these rights may assist orphans and vulnerable children as well as those advocating on their behalf, and identifies legal strategies …

Money Ruins Everything, John Quiggin, Dan Hunter Jan 2008

Money Ruins Everything, John Quiggin, Dan Hunter

UC Law SF Communications and Entertainment Journal

The statement, "it's hard to compete with free," encapsulates the most important recent developments in intellectual property policy and some of the most significant social trends of our time. Because amateur creators produce content for the love it and are prepared to work for free-or even to lose money to feed their desire to create-their existence threatens the economic assumptions of commercial providers of content. As a result, the rise of amateurism calls into question some fundamental assumptions we have about the public policy of innovation, the way that innovation occurs within society, and the incentives necessary to produce valuable …

Reformulating Urban Landscapes: Figure-Ground Maps, Cesar Torres Bustamante Jan 2008

Reformulating Urban Landscapes: Figure-Ground Maps, Cesar Torres Bustamante

Landscape Architecture

A type of map traditionally used in the analysis of urban form is figure‐ground, a drawing that traditionally depicts the buildings as figures against a visually contrasting ground. It finds certain antecedents in Gestalt psychology, as both drawings rely on the perceptible difference between figure and ground. However an unwanted extrapolation from Gestalt is the imposition of hierarchies, indispensable for visual segregation of figure and ground, but detrimental for the potential of figure‐ground as mapping. Mapping is a creative and cognitive activity, ruled by processes of selection and schematization. The potential of the figure‐ground map to reveal new relationships and …

The Boundaries Of A Trans-National Survey Of Asian Architectural And Urban History, Christopher Yip Jan 2008

The Boundaries Of A Trans-National Survey Of Asian Architectural And Urban History, Christopher Yip

Architecture

In constructing a survey of the architectural and urban history of traditional Asia, how would one define the edges of the region under study? This paper will argue that such a study can reasonably exclude Western Asia (also referred to as the Middle East, or the Ancient Orient), modern Siberia, much of the Indonesian Archipelago, the Philippines, Australia, and most of the Pacific Islands for various reasons, including geographic isolation, climate, and more reasonable inclusion in another architectural historical cluster. This is in part due to the definition of the core of such a study, and to the nature of …

Teacher-Involved Conversations With Young Children During Small Group Activity, Tonia Renee Durden, Julie Rainer Dangel Jan 2008

Teacher-Involved Conversations With Young Children During Small Group Activity, Tonia Renee Durden, Julie Rainer Dangel

Nebraska Center for Research on Children, Youth, Families, and Schools: Faculty Publications

This qualitative study examines the conversations of two preschool teachers with two- and three-year-old children during small-group activity settings in two high-quality child development centers. Using interviews, observations and videotaping of small-group activities, the conversations are characterized in terms of the kind and function of language, the usage of cognitive demands and the reciprocal nature of these conversations. The findings indicate that teachers use declarative statements primarily to manage instruction and encourage language development. While teachers control most conversations, teacher–child reciprocity is evident and more genuine in authentic, teacher-guided activities. In both classrooms, the language during small-group activities is characterized …

Direction Of The Play/Musical: Suessical, Ellicia M. Mertens Jan 2008

Direction Of The Play/Musical: Suessical, Ellicia M. Mertens

Graduate Student Projects

Seussical is a compilation of many of Dr. Seuss' beloved story books. The Cat in the Hat serves as the emcee for the evening, taking the audience through the stories of Horton Hears a Who, The Better Butter Battle Book, The Grinch Who Stole Christmas, Oh! The Places You'll Go, and many others. All of these stories are given an intertwining story line, with Horton serving as the protagonist. Horton has to overcome two main obstacles in the play; first, he needs to save the planet of Who, and secondly, he needs to save the egg abandoned by Mayzie LaBird. …

National Board Certification: A Scholarly Endeavor, Kathryn Loveless Jan 2008

National Board Certification: A Scholarly Endeavor, Kathryn Loveless

All Graduate Projects

If today's students are going to succeed they need quality teachers. To atiract and retain those teachers, we need to have a system to recognize and reward those teachers. The National Board for Professional Teaching Standards (NBPTS) was created to fill that need. This study presents the historical development of the Natio1ial Board Teacher Certification program, research on its effects on student learning, and the personal certification experience of a teacher practitioner. The high standards set by the NBPTS are commendable and worthy of being replicated in teacher training programs. These standards set the ground work for what teachers should …

Angels And Demons: Christina Rossetti’S Goblin Market As A Social Critique Of The Victorian Ideal Of The “Angel In The House” And The Pre-Raphaelites’ Response To That Ideal, Melissa Adams Jan 2008

Angels And Demons: Christina Rossetti’S Goblin Market As A Social Critique Of The Victorian Ideal Of The “Angel In The House” And The Pre-Raphaelites’ Response To That Ideal, Melissa Adams

Theses and Dissertations

Christina Rossetti’s poem Goblin Market presents a subversive critique on the socially constructed dichotomy of Angel versus Demon as depicted in Pre-Raphaelite artwork, Dante Gabriele Rossetti’s poetry, and Coventry Patmore’s poem Angel in the House. An analysis of Goblin Market in relation to Patmore’s poem and the Pre-Raphaelite paintings The Annunciation, Ophelia, Lady Lilith, Circe Offering the Cup to Ulysses, and Sibylla Palmifera and Dante Gabriele Rossetti’s poems “Soul’s Beauty” and “Body’s Beauty” illustrate the ways in which Rossetti presents a counter-image that breaks down this socially constructed dichotomy. This is additionally supported by an exploration …

A Distributed System For Parallel Simulations, Mengxia Zhu, Nanda K. Yadav Jan 2008

A Distributed System For Parallel Simulations, Mengxia Zhu, Nanda K. Yadav

Computer Science Publications

We presented the technologies and algorithms to build a web-based visualization and steering system to monitor the dynamics of remote parallel simulations executed on a Linux Cluster. The polynomial time based algorithm to optimally utilize distributed computing resources over a network to achieve maximum frame-rate was also proposed. Keeping up with the advancements in modern web technologies, we have developed an Ajax-based web frontend which allows users to remotely access and control ongoing computations via a web browser facilitated by visual feedbacks in real-time. Experimental results are also given from sample runs mapped to distributed computing nodes and initiated by …
