The Two-Step Evidentiary And Causation Quandary For Medium- Specific Laws Targeting Sexual And Violent Content: First Proving Harm And Injury To Silence Speech, Then Proving Redress And Rehabilitation Through Censorship, Clay Calvert Mar 2008

The Two-Step Evidentiary And Causation Quandary For Medium- Specific Laws Targeting Sexual And Violent Content: First Proving Harm And Injury To Silence Speech, Then Proving Redress And Rehabilitation Through Censorship, Clay Calvert

Federal Communications Law Journal

This Article argues that legislators today that want to suppress First Amendment-protected images of sexual and violent conduct conveyed on a specific medium face a steep two-step evidentiary burden. First, they must prove actual harm caused by the speech in question as it is conveyed on a specific medium--not the aggregate injury from viewing all media generallythat is sufficient to overcome free-speech rights. Second, even if sufficient harm from viewing violent or sexual content on a particular medium is proven by social science research, the government then must prove that its legislative remedy-its censorship of the harmful expression conveyed via …

Ecology Of The Missouri River: Missouri River Creel Survey, Bellevue Bridge To Camp Creek, 31 March Through 12 October 2007. Supplement I, Gerald Mestl

Nebraska Game and Parks Commission: White Papers, Conference Presentations, and Manuscripts

This report describes Missouri River activities and results related to a channelized Missouri River creel survey conducted from 29 March through 10 October 2003. This is the fourth of a planned annual creel survey to be conducted on alternating sections of the channelized Missouri River to measure changes in recreational fishing activity, especially those changes due to large scale habitat restoration efforts. Future reports will contain additional analyses of these data.

Anglers spent over 30,000 hours fishing the Missouri River from Camp Creek (rk 883.5) to the Kansas state line (rk 790.2) during the survey period. Effort peaked during the …

‘The Despair Of His Tutor’: Latin As Socioeducational Marker In Les Trois Mousquetaires, Emily A. Mcdermott Mar 2008

‘The Despair Of His Tutor’: Latin As Socioeducational Marker In Les Trois Mousquetaires, Emily A. Mcdermott

Classics & Religious Studies Faculty Publication Series

A significant motif in Les Trois Mousquetaires is to communicate the four heroes’ differing natures through their differing relationships with the Latin language. The separate academic pedigrees thus suggested for the three actual musketeers, Porthos, Athos and Aramis, each represent one of the major education models of early 17th century France: the courtly academy, private tuition, and the Jesuit collège. In the case of the up-and-coming d’Artagnan, by contrast, Dumas proffers less a type of 17th century education than an updating of the social values of that period to coincide with those of his own time. The successes of this …

Technoconstructivism And The Millennial Generation: Creative Writing In The Foreign Language Classroom, Edwina Spodark Mar 2008

Technoconstructivism And The Millennial Generation: Creative Writing In The Foreign Language Classroom, Edwina Spodark

Dimensions

The Millennial Generation is different from the generations of foreign language students who have preceded them. In the classroom, Millennial students prefer collaborative learning, the use of technology, a peer review/support/connection, structure, hands-on learning, and opportunities for personal creativity. This contemporary generation needs teachers to adopt a more relevant methodology to reflect their understanding of and respect for the information mindset that students bring to the classroom. Given these traits, the most effective methodology for their learning environment is one that blends the pedagogical practices advocated by social constructivism with the benefits of educational technology that speaks directly to the …

Legal Writing: Did Harvard Get It Right?, Laurel Currie Oates Mar 2008

Legal Writing: Did Harvard Get It Right?, Laurel Currie Oates

Mercer Law Review

For most law students, there is a moment when, in frustration or exhaustion, they throw up their hands and scream, "There must be a better way." While many of the cases in the casebooks are interesting, learning the law one case at a time seems, at best, inefficient, and at worst, just plain stupid. Wouldn't it be much easier, and better, if law schools used the same pedagogy that is used in many other disciplines: reading assignments, lectures, and exams that test whether students have learned the information set out in those textbooks and lectures?

When students question law school …

Money Or Nothing: The Adverse Environmental Consequences Of Uncompensated Land Use Controls, Jonathan H. Adler Mar 2008

Money Or Nothing: The Adverse Environmental Consequences Of Uncompensated Land Use Controls, Jonathan H. Adler

Faculty Publications

The conventional wisdom holds that requiring compensation for environmental land use controls would severely limit environmental protection efforts. There are increasing reasons to question this assumption. Both economic theory and recent empirical research--focused primarily on the Endangered Species Act but potentially applicable to other environmental regulations that create similar incentives--demonstrate that failing to compensate private landowners for the costs of regulation discourages voluntary conservation efforts and can encourage the destruction of environmental resources. The lack of a compensation requirement also means that land use regulation is "underpriced" as compared to other environmental protection measures for which government agencies must pay. …

Promoting Social Interactions Between Students With Autism Spectrum Disorders And Their Peers In Inclusive School Settings, Jamie S. Owen-Deschryver, Edward G. Carr, Sanja I. Cale, Audrey Blakeley-Smith

Peer Reviewed Articles

This study evaluated the impact of a peer training intervention on social interactions among three students with autism spectrum disorders (ASD) and their typical peers. Two second graders and one fourth grader with ASD participated. For each student with ASD, two to four typical peers participated in training sessions that targeted increased social interactions. Data collected during lunchtime and recess showed that the peer training intervention generally resulted in increased initiations by trained peers as well as increased initiations and responses by students with ASD. Unexpectedly, untrained peers also showed increased initiations. Future research directions are discussed, including characteristics of …

Teaching International Intellectual Property Law, Peter K. Yu Mar 2008

Teaching International Intellectual Property Law, Peter K. Yu

Faculty Scholarship

Intellectual property law was in the backwater only a few decades ago. The Section on Intellectual Property Law of the Association of American Law Schools was not even founded until the early 1980s, and the creation of intellectual property specialty programs has been only a recent phenomenon. As senior legal scholars reminisce, early in their career, they would have been lucky to find a school that would allow them to teach a class on intellectual property law. Although intellectual property law teaching has come of age in the past decade, international intellectual property law courses remain nonexistent in more than …

Globally Optimal Grouping For Symmetric Closed Boundaries By Combining Boundary And Region Information, Joachim S. Stahl, Song Wang Mar 2008

Globally Optimal Grouping For Symmetric Closed Boundaries By Combining Boundary And Region Information, Joachim S. Stahl, Song Wang

Faculty Publications

Many natural and man-made structures have a boundary that shows a certain level of bilateral symmetry, a property that plays an important role in both human and computer vision. In this paper, we present a new grouping method for detecting closed boundaries with symmetry. We first construct a new type of grouping token in the form of symmetric trapezoids by pairing line segments detected from the image. A closed boundary can then be achieved by connecting some trapezoids with a sequence of gap-filling quadrilaterals. For such a closed boundary, we define a unified grouping cost function in a ratio form: …

Exogenous Agmatine Has Neuroprotective Effects Against Restraint-Induced Structural Changes In The Rat Brain, Meng Yang Zhu, Wei P. Wang, Zheng W. Cai, Soundar Regunathan, Gregory A. Ordway Mar 2008

Exogenous Agmatine Has Neuroprotective Effects Against Restraint-Induced Structural Changes In The Rat Brain, Meng Yang Zhu, Wei P. Wang, Zheng W. Cai, Soundar Regunathan, Gregory A. Ordway

ETSU Faculty Works

Agmatine is an endogenous amine derived from decarboxylation of arginine catalysed by arginine decarboxylase. Agmatine is considered a novel neuromodulator and possesses neuroprotective properties in the central nervous system. The present study examined whether agmatine has neuroprotective effects against repeated restraint stress-induced morphological changes in rat medial prefrontal cortex and hippocampus. Sprague-Dawley rats were subjected to 6 h of restraint stress daily for 21 days. Immunohistochemical staining with β-tubulin III showed that repeated restraint stress caused marked morphological alterations in the medial prefrontal cortex and hippocampus. Stress-induced alterations were prevented by simultaneous treatment with agmatine (50 mg/kg/day, i.p.). Interestingly, endogenous …

Of Magicians And Masculinity: Merlin And The Manifestation Of The New Man, Jennie Morton Mar 2008

Of Magicians And Masculinity: Merlin And The Manifestation Of The New Man, Jennie Morton

UNIversitas: Journal of Research, Scholarship, and Creative Activity

As the Arthurian legends have continued to respond over time to fit specific cultural needs, the role of Merlin has evolved from mere sage to powerful wizard. In one of his most recent reincarnations, Merlin takes center stage as narrator and protagonist in a 1998 self-titled made-for-TV movie. While the story is a mixture of various Merlin traditions, hidden under the fantasy and special effects is a subtle cultural critique of masculinity. In this contemporary manifestation, Merlin, as both a man of action and emotion, embodies turn-of-the-century ideals for modern masculinity. Often at odds with what he considers his duty …

Disarming The Shout Of Doom: Chopra’S Alkahest, Nicola Wilson Clasby

UNIversitas: Journal of Research, Scholarship, and Creative Activity

Whilst researching for manifestations of the Arthurian “legend” in popular culture, I discovered threads of connection with my interest in art and interdisciplinary study, leading me, somewhat circuitously, through alchemy to the field of psychology, and in particular, “New Age” self-help psychology. Arthurian legend has been referenced, adapted and utilized fairly extensively in this field, with titles ranging from Crossing to Avalon: A Woman’s Midlife Pilgrimage1 to The Return of King Arthur: Completing the Wholeness, Inner Strength, and Self-Knowledge. 2 However, based on my research to date, I have found these works have received little acknowledgement by serious …
