Understanding And Problematizing Contractual Tort Subrogation, Brendan S. Maher, Radha A. Pathak

The modern incarnation of tort subrogation allows an insurer to force its insured to turn over the litigation proceeds independently obtained by the insured against a third-party tortfeasor, even if the insured has not been made whole by such litigation. This Article demonstrates that such a result is the product of a subrogation-as-contract paradigm that has taken hold in the federal system, most notably by the United States Supreme Court in Sereboff v. Mid-Atlantic Services, 547 U.S. 356 (2006). Mammalian Hazards At Small Airports In Indiana: Impact Of Perimeter Fencing, Travis Default, Jacob Kubel, David Glista, Olin E. Rhodes Jr.

United States Department of Agriculture Wildlife Services: Staff Publications

Fences are used at many airports and small airfields to exclude wildlife from entering critical areas. However, not all fences exclude hazardous mammals reliably, and effective fences can be too expensive for small airports to purchase and maintain. In this study, we evaluated fencing at 10 small airports in Indiana and documented the presence and relative abundance of wildlife within airport boundaries using remote cameras and spotlight surveys. From Pulp Hero To Superhero: Culture, Race, And Identity In American Popular Culture, 1900-1940, Julian C. Chambliss, William L. Svitavsky

Adventure characters in the pulp magazines and comic books of the early twentieth century reflected development in the ongoing American fascination with heroic figures. As established figures such as the cowboy became disconnected from everyday experiences of Americans, new popular fantasies emerged, providing readers with essentialist action heroes whose adventures stylized the struggle of the American everyman with a modern, industrialized, heterogeneous world. Popular characters such as Tarzan, Conan, the Shadow, and Doc Savage perpetuated the individualistic archetype Americans associated with the frontier cowboy and the struggles of manifest destiny while offering the fantastic adventure, exoticism, and escapism that modernity …

The circadian and neurobehavioral effects of light are primarily mediated by a retinal ganglion cell photoreceptor in the mammalian eye containing the photopigment, melanopsin. Nine action spectrum studies using rodents, monkeys, and human for these responses indicate peak sensitivities in the blue region of the visible spectrum ranging from 459 nm to 484 nm, with some disagreement in short wavelength sensitivity of the spectrum. The aim of this work was to quantify the sensitivity of human volunteers to monochromatic 420 nm light for plasma melatonin suppression. This Article calls for the recognition of a comparative fault defense in contract law. Part I sets the framework for this defense and suggests the situations in which it should apply. These situations are sorted under two headings: cases of non-cooperation and overreliance. Part II unfolds the main argument for recognizing the defense. It recommends applying the defense only in cases where cooperation or avoidance of over-reliance is low-cost.

Mine Risk Education (MRE) has been implemented in Cambodia since 1993 with the aim of encouraging people to adopt mine/UXO risk avoidance behaviours to prevent mine/UXO injures. Mine Risk Education is coordinated by the MRE Unit of the Cambodian Mine Action and Victim Assistance Authority (CMAA) and implemented through both government and non-government service providers. Cravath By The Sea: Recruitment In The Large Halifax Law Firm, 1900-1955, Jeffrey Haylock

The traditional view is that regularized, meritocratic hiring in Canadian law firms had to wait until the 1960s, with the rise in importance of Ontario university law schools. There was, however, more regional variation than this view allows. After an overview of the rise of large firms in the U.S. and Canada, and of the modern hiring strategies (the "Cravath system") that developed in New York in the early twentieth century, the author considers whether Halifax firms were employing these strategies between 1900 and 1955. Based on extensive preclinical data, glycogen synthase kinase-3 (GSK-3) has been proposed to be a viable drug target for a wide variety of disease states, ranging from diabetes to bipolar disorder. Since these new drugs, which will be more powerful GSK-3 inhibitors than lithium, may potentially be given to women of childbearing potential, and since it has controversially been suggested that lithium therapy might be linked to congenital cardiac defects, we asked whether GSK-3 family members are required for normal heart development in mice. We report that terminal cardiomyocyte differentiation was substantially blunted in Gsk3b(-/-) embryoid bodies. While GSK-3alpha-deficient mice …

On January 14, 2008, social networking Web site MySpace.com announced an agreement with the Attorneys General of forty-nine states and the District of Columbia aimed at increasing the safety of children online. MySpace.com and the Attorneys General created a “Joint Statement on Key Principles of Social Networking Sites Safety,” which sets forth various principles and goals for improving online safety for children through new online safety tools, design and functionality changes, education tools, and law enforcement cooperation. Over the past several years scholars have wrestled with how property rights in items created in virtual worlds should be conceptualized. Regardless of how the property is conceptualized and what property theory best fits, most agree the law ought to recognize virtual property as property and vest someone with those rights.
