More Than "Just A Hunch", Sheela Celeste Dominguez Jan 2008

More Than "Just A Hunch", Sheela Celeste Dominguez

Electronic Theses and Dissertations 2000 - 2009

The rise in popularity of the female sleuth television programs makes it important to explore representations of gender and knowledge. This investigation analyzes interpretations of intuition in the television sleuth genre and relevant paratexts, examines gendered public and private spheres and raises broader questions about gendered knowledge in the series Medium, Crossing Jordan, Law and Order: Criminal Intent, Veronica Mars, Monk, The Profiler and True Calling. Rooted in feminist cultural studies, historical and sociological analysis, television and film theory and work on the detective genre, this investigation establishes common frames, or filters, through which the television sleuth genre represents intuition …

Mechanisms Of Protection Against Ischemic Damage In The Heart, Ian Moench Jan 2008

Mechanisms Of Protection Against Ischemic Damage In The Heart, Ian Moench

Electronic Theses and Dissertations 2000 - 2009

Heart disease including ischemic heart disease is the highest contributor to death and morbidity in the western world. The studies presented were conducted to determine possible pathways of protection of the heart against ischemia/reperfusion. We employed adenovirus mediated over-expression of Methionine sulfoxide reductase A (MsrA) in primary neonatal rat cardiac myocytes to determine the effect of this enzyme in protecting against hypoxia/reoxygenation. Cells transfected with MsrA encoding adenovirus and subjected to hypoxia/reoxygenation exhibited a 45% decrease in apoptosis as compared to controls. Likewise total cell death as determined by levels of Lactate Dehydrogenase (LDH) release was dramatically decreased by MsrA …

1,8-Naphthridine Based Receptors For Selective Monosaccharide Binding In Aqueous Media, Alfred Kwesi Addo-Mensah Jan 2008

1,8-Naphthridine Based Receptors For Selective Monosaccharide Binding In Aqueous Media, Alfred Kwesi Addo-Mensah

Electronic Theses and Dissertations 2000 - 2009

In this dissertation the synthesis, characterization, and binding properties of carbohydrate receptors 34-38 was described. Macrocyclic receptor 34 and macrobicyclic receptor 35 bind monosaccharides in aqueous media through combination of hydrophobic, electrostatic and hydrogen bonding interactions. The dissociation constants (Kd) for the complexes between 1 ,8-naphthyridine receptors 34, and 35 with a variety of neutral and negatively charged monosaccharides in aqueous media were determined by fluorimetric and UV /vis titration. The observed values are in the range from ~0.3 to >10 mM, within the Kd range reported for lectin/monosaccharide complexes. However, among monosaccharide substrates tested receptor 34 showed the strongest …

Electronic Theses and Dissertations 2000 - 2009

Linda Hogan's Power and Gregory Maguire's Wicked are two works of literature that encompass a process of raising and transforming consciousness about humans' relationships with each other and with the Earth and elemental energies. Both can be considered prayers to and for the world. The goal of this thesis is to highlight and explore themes of spirituality, ecofeminism, environmental justice, anti-colonialism, indigenous philosophies regarding sense of place, human and animal rights, and feminist critical theories of race and gender through the artistic, creative and powerful writing of these authors. These works both reflect and participate in ongoing processes of political …

Age Of William A. Dunning, Kathleen P. Barsalou Jan 2008

Age Of William A. Dunning, Kathleen P. Barsalou

Electronic Theses and Dissertations 2000 - 2009

Stripped of the intent of its author, L. Frank Baum, the children's fairy tale The Wonderful Wizard of Oz was left to be understood only within a changing cultural construct. Historian Hayden White, arguing that the similarities between a novel and a work of history were more significant than their differences, insisted that history was preeminently a subsection of literature. According to White, historical narratives were manifestly verbal fictions, and the only acceptable grounds upon which the historian should choose his historical perspective were the moral and the aesthetic. White conflated historical consciousness with myth and blurred the boundary that …

An Alternative Enlightenment: The Moral Philosophy Of Jeanne Marie Le Prince De Beaumont (1711-1780), Margaret P. Schaller Jan 2008

An Alternative Enlightenment: The Moral Philosophy Of Jeanne Marie Le Prince De Beaumont (1711-1780), Margaret P. Schaller

Electronic Theses and Dissertations 2000 - 2009

The ceuvre of Jeanne Marie Le Prince de Beaumont, the public intellectual whose pedagogical journals and epistolary novels were routinely shelved in private eighteenthcentury libraries alongside the works of the period's most famous philosophes, today remains virtually unknown. Beyond the scant available studies limited to her pedagogy and fairy tales, it is time to explore the theoretical aspects of those and other of her texts as significant alternatives to traditional Enlightenment discourse as epitomized in the contemporary philosophes. Through her personal roles of governess to British and French aristocracy, editor of a French-language periodical featuring such contributors as Voltaire and …

Analyses Of Neuronal Replacement In The Neuron-Depleted Olfactory Systems In Adult Mice, Huan Liu Jan 2008

Analyses Of Neuronal Replacement In The Neuron-Depleted Olfactory Systems In Adult Mice, Huan Liu

Electronic Theses and Dissertations 2000 - 2009

New neurons are continuously generated in the olfactory system of adult mice, including olfactory sensory neurons (OSNs) in the olfactory epithelium (OE) and interneurons, produced in the subventricular zone (SVZ) and migrated toward olfactory bulb (OB) along rostral migratory stream (RMS). The present study observed the effects of target neuron loss on the life-span and maturation of adult-born OSNs in the OE and on the proliferation, migration and differentiation of SVZ stem cells in the forebrain after eliminating bulb neurons. We found the life-span of newborn neurons in the absence of synaptic targets was shortened, but the timing of maturation …

Assessment Of Genetic Population Structure, Promiscuity, And Paternity In Free-Ranging Atlantic Spotted Dolphins, Stenella Frontalis, In The Bahamas, Michelle L. Green

Electronic Theses and Dissertations 2000 - 2009

This study investigated a resident community of Atlantic spotted dolphins (Stenella frontalis) on Little Bahama Bank (LBB) in the Bahamas utilizing a noninvasive molecular approach. Genetic template material was collected and extracted from fecal material of S. frontalis. Fine-scale population structure was found within LBB according to mitochondrial DNA (mtDNA) and microsatellites (Fst = 0.25317, P < 0.0001 and Fst = 0.04491, P < 0.0001, respectively). Three main social clusters (North, Central, South/Roam) exist on LBB and all clusters were found to be genetically distinct according to microsatellite analyses. Mitochondrial haplotypes revealed North and South/Roam were not differentiated, but Central was different from both. When separated by sex, males were less genetically structured than females. Males showed no evidence of structure according to Ost or Rst.

Behavioral Sensitization To Nicotine In The Novelty-Seeking Phenotype And Hippocampal Mossy Fiber Morphology, Amrinder S. Bhatti Jan 2008

Behavioral Sensitization To Nicotine In The Novelty-Seeking Phenotype And Hippocampal Mossy Fiber Morphology, Amrinder S. Bhatti

Electronic Theses and Dissertations 2000 - 2009

In this thesis I studied propensity for behavioral sensitization to nicotine in the LRHR phenotype and associated plasticity in the hippocampal mossy fiber morphology. I also investigated therapeutic effects of bupropion and a cannabinoid receptor antagonist on behavioral and morphological indices in adolescence and adulthood. Male rats were classified into high responders (HR) and low responders (LR) based on their locomotor response to a novel environment. LRHR animals underwent behavioral sensitization to nicotine and after one week of abstinence were challenged with a low dose of nicotine. HRs expressed behavioral sensitization to nicotine and showed an increase in hippocampal mossy …

Choosing And Using Tools, Amy K. Gardiner Jan 2008

Choosing And Using Tools, Amy K. Gardiner

Electronic Theses and Dissertations 2000 - 2009

Two and 3 year-old children's understanding of tool affordances was investigated by measuring their tool choice decisions and tool use behaviors. Children attempted six toy retrieval tasks of three different levels of structural complexity. Children were assigned to one of four conditions in which exposure to task materials varied according to the way in which the information was presented: no experience / no observation, experience only, observation only, and experience and observation. Three year- olds consistently made more correct choices and used more working tools successfully than 2-year-olds. Tool choice was affected primarily by task difficulty and age. Tool use …

Constraints Of Landscape Level Prey Availability On Physiological Condition And Productivity Of Great Egrets And White Ibises In The Florida Everglades, Garth Herring Jan 2008

Constraints Of Landscape Level Prey Availability On Physiological Condition And Productivity Of Great Egrets And White Ibises In The Florida Everglades, Garth Herring

Electronic Theses and Dissertations 2000 - 2009

Life history strategy suggests long lived bird species will adjust their nesting effort according to current conditions, balancing the costs of reproduction with their long-term needs for survival and future reproduction. The habitat conditions that produce these responses may differ between species, even within the same ecosystem, producing different nesting and population trends. I traced the pathway by which food availability influences the physiological condition of pre-breeding great egrets and white ibises through to reproductive measures, and the physiological condition of chicks. I focused on these two species with contrasting foraging strategies, in relation to foraging and habitat conditions to …

Garbage Pails And Puppy Dog Tails: Is That What Katz Is Made Of?, Aya Gruber Jan 2008

Garbage Pails And Puppy Dog Tails: Is That What Katz Is Made Of?, Aya Gruber

Publications

This Article takes the opportunity of the fortieth anniversary of Katz v. U.S. to assess whether the revolutionary case's potential to provide broad and flexible privacy protection to individuals has been realized. Answering this question in a circumspect way, the Article pinpoints the language in Katz that was its eventual undoing and demonstrates how the Katz test has been plagued by two principle problems that have often rendered it more harmful to than protective of privacy. The manipulation problem describes the tendency of conservative courts to define reasonable expectations of privacy as lower than the expectations society actually entertains. The …

Real Property And Peoplehood, Kristen A. Carpenter Jan 2008

Real Property And Peoplehood, Kristen A. Carpenter

Publications

This Article proposes a theory of real property and peoplehood in which lands essential to the identity and survival of collective groups are entitled to heightened legal protection. Although many Americans are sympathetic to American Indian tribes and their quest for cultural survival, we remain unable to confront the uncomfortable truth that the very thing Indian peoples need is their land, the same land that the U.S. took from them. This is especially the case with regard to the sacred sites of Indian peoples, whose religions and cultures are inextricably linked to those sites. Federal law permits the United States …

American Indians, Climate Change, And Ethics For A Warming World, Sarah Krakoff Jan 2008

American Indians, Climate Change, And Ethics For A Warming World, Sarah Krakoff

Publications

Developing a sense of ourselves that would properly balance history and nature and space and time is a more difficult task than we would suspect and involves a radical reevaluation of the way we look at the world around us. Do we continue to exploit the earth or do we preserve it and preserve life? Whether we are prepared to embark on a painful intellectual journey to discover the parameters of reconciling history and nature is the question of this generation.

The Measure Of Government Speech: Identifying Expression's Source, Helen Norton Jan 2008

The Measure Of Government Speech: Identifying Expression's Source, Helen Norton

Publications

States and other governmental bodies increasingly invoke the government speech defense to First Amendment challenges by private parties who seek to alter or join what the government contends is its own expression. These disputes involve competing claims to the same speech: a private party maintains that a certain means of expression reflects (or should be allowed to reflect) her own views, while a public entity claims that same speech as its own, along with the ability to control its content.

In suggesting a framework for approaching these problems, this Article starts by examining the theoretical and practical justifications for insulating …

The N400 Erp: Semantic Vs. Evaluative Incongruities, Jennifer Hilda Taylor Jan 2008

The N400 Erp: Semantic Vs. Evaluative Incongruities, Jennifer Hilda Taylor

Open Access Theses & Dissertations

The objective of this research was to utilize both behavioral (response times) and psychophysiological measures (ERPs - N400 & Pre-response Positivity) to uncover the cognitive mechanism responsible for the evaluative priming effect (spreading activation vs. response competition) by controlling for semantic influences. This research project examined the evaluative incongruity effect by controlling for semantic influences in two separate studies. The first study kept semantic associations among word pairs completely random, while the second study controlled for semantic associations by either pairing words from the same semantic category (e.g., animal-animal) or from different semantic categories (e.g., animal-person). Participants completed an evaluative …

Pastoral Profits Guide, A Paddock Guide To Achieving Sustainable Livestock Productivity, Mark Alchin, Jim Addison, Valarie Shrubb, Zac Cockerill, Matthew Young, Tim Johnson, Greg Brennan

All other publications

Most pastoralists appreciate the need to deliver an economic, environmental and social 'profit' from their business. Achieving these profits can be a real challenge given the comparatively low productive potential and the substantial seasonal variation in the WA Southern Rangelands region. This guide was written to assist pastoralists to meet their specific livestock production, financial and range condition objectives through the better alignment of feed demand (stocking rate) to feed supply (carrying capacity). We provide nine basic steps that simplify the process of managing the feed supply, equipping pastoralists with the tools to make· decisions and to critically assess the …

Writing Resistance Into International Law, Ruth Buchanan Jan 2008

Writing Resistance Into International Law, Ruth Buchanan

All Papers

This essay considers the problem of theorizing resistance within international law through a close reading of two recent contributions to the TWAIL literature. It is concerned less with their critiques of contemporary developments, than with how these scholars map the possible spaces for resistance of third world states and peoples to international legal institutions and discourses. Do they argue that third world resistance has the potential to transform international law, and move us in the direction of a more just international order? If so, how is that process of change envisioned? While the answers to these questions are, not surprisingly, …

The Legal Profession: From The Revolution To The Civil War, Alfred S. Konefsky Jan 2008

The Legal Profession: From The Revolution To The Civil War, Alfred S. Konefsky

Contributions to Books

Published as Chapter 3 in The Cambridge History of Law in America, Volume II, The Long Nineteenth Century (1789–1920), Michael Grossberg & Christopher Tomlins, eds.

The American legal profession matured and came to prominence during the century prior to the Civil War. Before the Revolution, across some 150 years, lawyers in different colonies underwent different experiences at different times. By the beginning of the eighteenth century, more lawyers were entering professional life. After the revolution and the defection by the Tory lawyers, the remaining quickly burnished their images in the glow of republican ideals while grasping new market opportunities. For …

Do Churches Matter? Towards An Institutional Understanding Of The Religion Clauses, Richard W. Garnett Jan 2008

Do Churches Matter? Towards An Institutional Understanding Of The Religion Clauses, Richard W. Garnett

Journal Articles

In recent years, several prominent scholars have called attention to the importance and role of First Amendment institutions and there is a growing body of work informed by an appreciation for what Professor Balkin calls the infrastructure of free expression. The freedom of expression, he suggests, requires more than mere absence of government censorship or prohibition to thrive; [it] also require[s] institutions, practices and technological structures that foster and promote [it]. The intuition animating this scholarship, then, is that the freedom of expression is not only enjoyed by and through, but also depends on the existence and flourishing of, certain …

Free Speech And The Case For Constitutional Exceptionalism, Roger P. Alford Jan 2008

Free Speech And The Case For Constitutional Exceptionalism, Roger P. Alford

Journal Articles

Excerpts from the Article

Embodied in the Universal Declaration of Human Rights is the evocative proposition that [e]veryone has the right to freedom of opinion and expression. But beneath that level of abstraction there is anything but universal agreement.

This book review argues that the dissonance between countries need not be challenged in pursuit of uniformity. Indeed, in those cases in which the differences reflect an appropriate balance of competing goods, it should be celebrated. Constitutional exceptionalism recognizes and celebrates each country's attempt to optimize the general welfare of that country by balancing competing goods in a manner consistent with …

Judicial Enforcement Of The Establishment Clause, Richard W. Garnett Jan 2008

Judicial Enforcement Of The Establishment Clause, Richard W. Garnett

Journal Articles

This paper is the author’s contribution to a roundtable conference, held in October of 2008 at Notre Dame Law School, devoted to Prof. Kent Greenawalt’s book, Religion and the Constitution: Establishment and Fairness. It is suggested that Greenawalt’s admirably context-sensitive approach to church-and-state questions might lead us to think that the best course for judges is to find (somehow) some bright-line, on-off “rules” and “tests”, constructed to identify and forbid the most obvious violations of the Religion Clause’s core (whatever that is), and to give up on -- or, perhaps, “underenforce” -- the rest.
