Integrating Investment Treaty Conflict And Dispute Systems Design, Susan Franck Nov 2007

Integrating Investment Treaty Conflict And Dispute Systems Design, Susan Franck

Scholarly Articles in Law Reviews & Journals

With the debate on the renewal of the Trade Promotion Authority Act, the proper terms of investment treaties - including dispute resolution provisions - have become an issue of public scrutiny. In a so-called litigation explosion, investors resolve disputes against host governments through international arbitration mechanisms in investment treaties; and there is little evidence of reliance on other processes like mediation. This escalation has lead to a teething period where parties and non-parties have expressed divergent views as to the efficacy, efficiency and fairness of the dispute resolution process. With billions of dollars and sovereignty at stake, the dispute resolution …

Virtual Servers In A Data Center Environment, Terry Yerkan Nov 2007

Virtual Servers In A Data Center Environment, Terry Yerkan

Masters Theses & Doctoral Dissertations

Virtualization entails taking a physical hardware server and emulating several servers via software. This allows the consolidation of several servers to run on one single hardware platform, eliminating the need to have several independent hardware machines. This project entails the research of server virtualization and implantation of virtualization into a data center environment where hundreds of physical servers are running. The problem today is that hardware for servers are not being utilized. The hardware has become so advanced that the average day to day activities just don't need to power of today's computing. Hardware servers are taking up room, power …

School of Integrative Biological & Chemical Sciences (Formerly Dept. of Biology)

The siphonaceous green alga Penicillus capitatus Lamarck is a common macroalga of the Carribean and Gulf of Mexico (Littler & Littler 2000). This shaving brush-shaped macroalga was a common inhabitant of the Lower Laguna Madre Texas (LLM) until about 40 years ago when the population was decimated following a salinity decline in the fall of 1959, another salinity reduction due to Hurricane Carla in 1961, and finally a severe freeze in 1962 (Sorensen 1963). Since that time, there have been no reports of P. capitatus in the LLM. During a reconnaissance trip in July 2006, a small population was found …

Electromagnetic Radiation From Temporal Variations In Space-Time And Progenitors Of Gamma Ray Burst And Millisecond Pulsars, Preston Jones

Publications

A time varying space–time metric is shown to be a source of electromagnetic radiation even in the absence of charge sources. The post-Newtonian approximation is used as a realistic model of the connection between the space–time metric and a time-varying gravitational potential. Rapid temporal variations in the metric from the coalescence of relativistic stars are shown to be likely progenitors of gamma ray burst and millisecond pulsars.

Chemistry Faculty Research & Creative Works

The Mössbauer spectra of monodispersed iron oxide nanoparticles with diameters of 4, 7, 9, and 11 nm have been measured between 4.2 and 315 K and fitted within the formalism for stochastic fluctuations of the hyperfine Hamiltonian. In this model, the hyperfine field is assumed to relax between the six ±x, ±y, and ±z directions in space with a distribution of relaxation rates that is temperature dependent. Muon spin relaxation measurements have been carried out on the 9 nm particles between 4.2 and 295 K. Both techniques reveal three regimes in the magnetic dynamics of these nanoparticles. In the low-temperature …

Physics Faculty Research & Creative Works

We report on measurements of transfer excitation in collisions of 0.3-1.3 MeV protons with spatially oriented H2 molecules. Evidences of two center interference are found in the angular distribution of the molecule after a transfer excitation process and directly in the projectile angular scattering distributions. These features can be explained in a way which is analogous to that for the interferences in Young's classical double slit experiment: The fast projectiles preferentially capture electrons close to either of the molecular nuclei, and thereby they change their momenta and de Broglie wavelengths. The waves emerging from the two 'slits' of the …

The Zeeman line components of the magnetic-dipole (M1) 1s2 2s2 2 P1/2 -2P3/2 transition in boronlike Ar13+ were experimentally resolved by high-precision emission spectroscopy using the Heidelberg electron beam ion trap. We determined the gyromagnetic (g) factors of the ground and first-excited levels to be g1/2 =0.663(7) and g3/2 =1.333(2), respectively. This corresponds to a measurement of the g factor of a relativistic electron in a bound non- S state of a multielectron ion with a 1.5 parts-per-thousand accuracy. The results are compared to theoretical calculations by means of the configuration …

Department of Medicine

Migration inhibitory factor (MIF), a critical proinflammatory mediator in sepsis, has a profound affect on cardiovascular function. Our animal studies show that the lungs release MIF into the systemic circulation during late sepsis. MIF released in this way has direct and immediate access to cardiac cells. The purpose of our study was to assess the lung as a source of MIF in human septic shock patients and to further study the MIF-associated pathways involved in cardiovascular depression.

Forward jet cross sections have been measured in neutral current deep inelastic scattering at low Bjorken-x with the ZEUS detector at HERA using an integrated luminosity of 81.8 pb-1. Measurements are presented for inclusive forward jets as well as for forward jets accompanied by a dijet system. The explored phase space, with jet pseudorapidity up to 4.3 is expected to be particularly sensitive to the dynamics of QCD parton evolution at low x. The measurements are compared to fixed-order QCD calculations and to leading-order parton-shower Monte Carlo models. © 2007 Springer-Verlag / Società Italiana di Fisica.

Friends With Benefits?, Laura A. Rosenbury Nov 2007

Friends With Benefits?, Laura A. Rosenbury

Michigan Law Review

Family law has long been intensely interested in certain adult intimate relationships, namely marriage and marriage-like relationships, and silent about other adult intimate relationships, namely friendship. This Article examines the effects of that focus, illustrating how it frustrates one of the goals embraced by most family law scholars over the past forty years: the achievement of gender equality, within the family and without. Part I examines the current scope of family law doctrine and scholarship, highlighting the ways in which the home is still the organizing structure for family. Despite calls for increased legal recognition of diverse families, few scholars …

Offsetting Risks, Ariel Porat Nov 2007

Offsetting Risks, Ariel Porat

Michigan Law Review

Under prevailing tort law, an injurer who must choose between Course of Action A, which creates a risk of 500 (there is a probability of .1 that a harm of 5000 will result), and Course of Action B, which creates a risk of 400 (there is a probability of.] that a harm of 4000 will result), and who negligently opts for the former will be held liable for the entire harm of 5000 that materializes. This full liability forces the injurer to pay damages that are five times higher than would be necessary to internalize the risk of 100 that …

Suburbs As Exit, Suburbs As Entrance, Nicole Stelle Garnett Nov 2007

Suburbs As Exit, Suburbs As Entrance, Nicole Stelle Garnett

Michigan Law Review

Most academics assume that suburbanites are "exiters " who have abandoned central cities. The exit story is a foundational one in the fields of land-use and local-government law: exiters' historical, social, and economic connections with "their" center cities are frequently used to justify both growth controls and regional government. The exit story, however no longer captures the American suburban experience. For a majority of Americans, suburbs have become points of entrance to, not exit from, urban life. Most suburbanites are "enterers "-people who were born in, or migrated directly to, suburbs and who have not spent time living in any …

Trolling For Trolls: The Pitfalls Of The Emerging Market Competition Requirement For Permanent Injunctions In Patent Cases Post-Ebay, Benjamin H. Diessel

Michigan Law Review

In eBay v. MercExchange, a unanimous Supreme Court announced that a new four-factor test should be employed by district courts in determining whether to award an injunction or damages to an aggrieved party whose intellectual property has been infringed. In the context of permanent injunctions in patent cases, district courts have distorted the four-factor test resulting in a "market competition requirement." Under the new market competition requirement, success at obtaining an injunction is contingent upon a party demonstrating that it is a market competitor After consistent application in the first twenty-five district court cases post-eBay, the market competition requirement …

Exclusion Confusion? A Defense Of The Federal Circuit's Specific Exclusion Jurisprudence, Peter Curtis Magic Nov 2007

Exclusion Confusion? A Defense Of The Federal Circuit's Specific Exclusion Jurisprudence, Peter Curtis Magic

Michigan Law Review

Specific exclusion has become a controversial limitation on the doctrine of equivalents, which is itself an essential and controversial area of patent law. The doctrine of equivalents allows a patentee to successfully claim infringement against devices that are outside of the literal reach of the language used by the patentee in her patent to describe what she claims as her invention. The Supreme Court has prescribed some of the outer limits of the doctrine of equivalents and articulated the underlying policy concerns that inform its analysis-noting that courts should balance protection of the patentee's intellectual property with the public's reasonable …
