One of my central goals in teaching law is to help students find ways to apply their emerging analytical powers and professional skills to promote the public interest.A related goal is to create an engaging learning experience in which students see each other—and other members of the legal community—as key resources in their education.

Feral swine are defined as free roaming animals of the genus Sus that are not being held under domestic management or confinement. Swine have spread from Europe and Russia to habitats around the world via human introduction. Currently, feral swine populations are established on every continent except Antarctica. Unlike other large mammal invaders, swine have a high reproductive capacity and are omnivorous, which allows for a quick assimilation into most habitats. Once a breeding population is established in an area, the population can quickly increase and negatively impact the ecosystem. A successful invasion of feral swine is difficult, and sometimes …

Four introduced, invasive species of Spartina (cordgrass) have been present in estuarine areas of the U.S. west coast for over a century. These Spartina species are ecological engineers- they cause severe alternations in the hydrology and food webs of invaded estuaries that are detrimental to native wildlife and commercial and recreational uses. Oregon has been relatively free of these weeds, with only two known infestations. One infestation was eradicated by Oregon Department of Agriculture and the other is currently under eradication by The Nature Conservancy.

Demonstrations supporting human and civil rights, while often romanticized as a phenomenon of the past, are becoming more pervasive today, reflecting the continued forms of discrimination and oppression undocumented workers, individuals, and families experience. In the past few years, Utah residents have been engaged in their own battle to determine the level of support the state is willing to extend students of color interested in attending institutions of higher education. "Medical tourism" is the phrase used to describe the phenomenon whereby patients travel to a foreign country to consume medical services. This practice has gained momentum in recent years, largely due to accessibility and affordability issues plaguing the U.S. healthcare system. Notably, medical tourism has progressed from being only an option considered by uninsured or under-insured individuals to an option considered by employers as a means of reducing the cost of employee health benefits. This Article examines the current confused state of the law that applies to the private enforcement of restricted charitable gifts, and describes the first steps toward a tailored legal regime that appears in the American Law Institute's draft project on Principles of the Law of Nonprofit Organizations,for which this author is reporter. That regime addresses not only standing, but also proposals for notification of the attorney general, time limits on private (but not attorney general) enforcement, and a circumscription of appropriate remedies in order to protect the charity. Several of the issues, however, will likely require a legislative solution.

Internet Protocol Television (IPTV) is a new technology that promises to revolutionize the cable television industry. IPTV combines digital video technologies decades in development with the many advantages of Internet delivery, including cost and interactivity. The characteristics of IPTV that distinguish it from conventional cable television raise many regulatory questions. It is clear, however, that the decades-old cable franchising system, along with other cable-specific regulations, are a poor fit for IPTV. Wholesale application of these regulations could stifle the deployment of IPTV technology. This Article identifies and critiques the collateralization of intellectual property, revealing the complexity of intersecting secured transaction law, namely Article 9 of the Uniform Commercial Code, and doctrinal intellectual property laws such as patent law, copyright law, and trademark law. The inquiry challenges the silence surrounding the pervasive use of intellectual property as collateral in secured financing and suggests changes to the existing framework on secured financing law.

The Health Care Choice Act of 2005 (HCCA) aims to reform perceived problems in the individual market, and is touted as part of the solution to the problem of the uninsured. It purports to allow individuals who are not eligible for or cannot afford group coverage to purchase an individual policy in and from any state. If passed, the HCCA would allow health insurers to offer individual policies of insurance from any state without being required to comply with the laws of the insured's own state. In June 2001, the Justice System Reform Council ("Reform Council" or "Council") issued its final report. The Council's recommendations included several proposed reforms to the judiciary, intended to insure the judiciary would "meet the expectations of the people." This essay examines a number of those recommendations and the resulting reforms.

Storytelling is one of humanity's oldest art forms and an enduring educational method. Stories can spark social change. Although storytelling is tacitly recognized in diverse social science domains as a communication medium used to powerfully transmit leadership vision and ideas, little empirical research has been reported about how a teller constructs and tells a story. Through qualitative, arts-based methods, this heuristic study examines and describes the lived experience of a storyteller composing and performing a tale on issues of peace, justice, and social change. While some organizations die when trauma erupts, others do not succumb. They live and even thrive. The purpose of this study was two-fold: 1. To learn from leaders their perspectives about key conditions that allow organizations to withstand and heal from organizational trauma; and, 2. To inform practice about building and strengthening these conditions in organizations. Participants were leaders who led their organizations during an organizational trauma or who came into programs after the trauma occurred to facilitate recovery. Using Live Modeling To Train Preservice Teachers To Integrate Technology Into Their Teaching, Charles R. Graham, Richard E. West

One method underutilized in training teachers to use technology is to use live modeling sessions. This study qualitatively investigates how the use of modeling sessions impacted students. In this study we found that modeling was perceived by most students to be effective at teaching technology skills and ideas for integrating technology as teachers. However, we identified several breakdowns in the ability of students to transfer their understanding of technology integration to their own situations. We explain this difficulty of transfer of learning and describe five situations when these breakdowns were likely to occur. Implications include the benefits of using live …

Clustering Streaming Music Via The Temporal Similarity Of Timbre, Jacob Merrell, Bryan S. Morse, Dan A. Ventura

We consider the problem of measuring the similarity of streaming music content and present a method for modeling, on the fly, the temporal progression of a song’s timbre. Using a minimum distance classification scheme, we give an approach to classifying streaming music sources and present performance results for auto-associative song identification and for content-based clustering of streaming music. We discuss possible extensions to the approach and possible uses for such a system.

Context: Some researchers have suggested that an alteration of stretch perception could be responsible for the success of the contract-relax (CR) stretch, a stretch technique derived from proprioceptive neuromuscular facilitation (PNF). Objective: This study was conducted to determine if the alteration of the stretch perception is a possible explanation for the range of motion (ROM) gains of the CR stretch. Participants: Eighteen subjects performed two stretches in randomized order: the slow stretch and the CR stretch. Main Outcome Measure: The stretch intensity was controlled. A 2001 study of 1,000 young women attending four-year colleges and universities across the United States conducted by Norval Glenn and Elizabeth Marquardt found that “dating” has all but disappeared from American college campuses. Only half of the women reported they had been asked on six or more dates during their entire college career. In fact, one-third of the women had two or fewer dates during the same four years. Instead of dating, college students now “hang out” in mixed groups in a variety of settings including apartments, dormitory rooms, student centers, pizza parlors, coffee shops, and bars. This study on HIV/AIDS-education programs was conducted with the Uganda Ministry of Education and Sports in a national sample of 76 secondary schools in Uganda. Participants included secondary students (N=883) who critiqued their formal and informal school curricula and offered youth perspectives regarding what teaching mediums and programs of HIV/AIDS prevention are most effective. Results indicated that HIV/AIDS education is not taught in their respective school curricula. Students report on informal ways that are helpful in learning about AIDS, recommend changes to their school's curriculum, and report that reactions from various groups in their lives to HIV/AIDS education in their …
