To Disclose Or Not To Disclose: Duty Of Candor Obligations Of The United States And Foreign Patent Offices, Gina M. Bicknell

Chicago-Kent Law Review

Many patent offices around the world have rigorous prior art disclosure requirements. U.S. patent applicants not only must meet each individual country's criteria for disclosure, but also must contend with allegations of inequitable conduct from patent infringers which may render their patents unenforceable. This article argues that the new prior art disclosure rules promulgated by the USPTO unfairly shift the burden of examining patent applications onto patent applicants, and create a situation ripe for allegations of inequitable conduct. This article also examines how other countries handle disclosure obligations, and recommends several alternative systems that would meet the USPTO's objectives of …

The need for this project was identified through the ESD Risk Assessment workshops held for the Shark Bay and Exmouth Gulf trawl fisheries in May and October 2001. Bycatch issues in the Shark Bay and Exmouth fisheries were identified as a moderate risk through an Ecological Risk Assessment workshop. A better understanding of the faunal composition and habitat preferences of bycatch species in both trawled and untrawled areas has assisted in determining the level of risk to bycatch species. Until recently, studies of Jewish religious practices in Imperial Russia have focused on major movements such as Hasidism and mitnagdism as well as the challenges that Haskalah presented to traditional Judaism. Few scholars have scrutinized transformations in everyday religious practices such as the observance of Sabbath and other holidays, synagogue attendance, and liturgical practices. However, new political, social, and economic realities had generated subtle changes in religious practices even in earlier periods and it comes as no surprise, therefore, that religious practices among Jews during the tsarist period, especially in Kiev, were neither monolithic nor static. School District Enrollment Forecast Reports

The Amity School District (ASD) experienced enrollment growth during the late 1980s and early 1990s, but reached a peak of 945 K-12 students in Fall 1994. In the 12 years that followed, enrollment fell by 143 students, or 15 percent. This year’s enrollment of 822 represents an increase of 20 students (2.5 percent) from Fall 2006, the largest increase since 1994. The long period of decline initially had its greatest impact on elementary grades, followed by middle school and more recently high school. Millions of sensors around the globe currently collect avalanches of data about our world. The rapid development and deployment of sensor technology is intensifying the existing problem of too much data and not enough knowledge. With a view to alleviating this glut, we propose that sensor data, especially video sensor data, can be annotated with semantic metadata to provide contextual information about videos on the Web. In particular, we present an approach to annotating video sensor data with spatial, temporal, and thematic semantic metadata. Usage Of Credit Cards Received Through College Student-Marketing Programs, John M. Barron, Michael E. Staten

This article provides benchmark measures of college student credit card usage by utilizing a pooled sample of over 300,000 recently opened credit card accounts. The analysis compares behavior over 12 months of account history for three groups of accounts: those opened by young adults through college student marketing programs; those opened through conventional marketing channels by young adults ages 18-24; and those opened through conventional channels by older adults. Results indicate that student marketed accounts have smaller balances, lower credit limits, and lower utilization rates than accounts opened by the other groups. There is limited information regarding native range, habitat requirements, life histories and biological interactions between crayfish species. In order to examine the relationship between lotic crayfish assemblages and environmental variables at both the watershed and reach scales, data were collected from 46 stream segments in the Upper Green River Basin of Kentucky, U.S.A. This present study examined the use of Discrete Trial Training, Picture Exchange Communication System, Social Stories, Structured Teaching, and Video Self-Modeling by special education teachers with students with ASD. A questionnaire was completed by 91 special education teachers from the Green River Region Educational Cooperative, which encompasses 17 different school districts in the area of western and south central Kentucky. Many believe community-based ecotourism (CBE) can assist in conservation efforts and community development; however, little research has been done to assess the potential of CBE in a specific region. As part of a large, long-term, international research project, I define three problematic areas that may impede successful CBE efforts in the Kasigau location of southeast Kenya: bushmeat utilization, community attitudes and wildlife abundance. Fishes are capable of regenerating sensory hair cells in the inner ear after exposure to excessive noise. However, a time course of auditory hair cell regeneration has not been characterized for zebrafish, nor has gene expression following noise exposure. To establish a time course of hair cell regeneration, adult zebrafish were exposed to a 100 Hz pure tone at 179 dB re 1 |u.Pa RMS for 36 hours, and then allowed to recover for 0 to 14 days before morphological analysis. Rural areas are often more susceptible to high concentrations of ground-level ozone (O3) than urban areas. However, rural populations are, for the most part, unaware of this problem. Currently the rural areas of Kentucky have no daily forecast for O3. While previous criminological research has identified a negative relationship between the levels of social capital and victimization within neighborhoods, these studies often used different conceptualizations of social capital. The synthesis of cyclopenta[c]thiophenes is sparsely found in literature due to the several difficulties of their synthesis. Our research has shown that we could modify a previously known route to 1,3-disubstituted cyclopenta[c]thiophenes using traditional Grignard chemistry. Along the way we discovered the synthetic route we were using had several omissions. Therefore, we were required to completely fill in missing experimentals in order to obtain each cyclopenta[c]thiophene intermediate, in high purity and good yield. The current study incorporates trait anxiety and obsessive-compulsive features into an etiological model of MD in the hopes of establishing them as reliable predictors of such MD symptomatology as drive for muscularity, social physique anxiety, and negative body attitude (self). As the bandwidth of networks is increasing exponentially, the computational cost to simulate such type of networks is also growing in a similar fashion. This paper presents a scalable simulation method, called time-adaptive numerical simulation, which can be used to represent dynamics of high-speed networks using fluid-based models. The new method dynamically adjusts the size of a time step for a numerical solver which solves a system of differential equations representing dynamics of protocols and nodes' behaviors. Modern Westerners are supposed to embrace a notion of unfettered personal agency. An analysis of public commentary (interviews, editorials, and online message boards) in the United States about the Columbine school shootings shows that the voluntarist cultural model of persons as autonomous agents, while certainly very important, is just one of a number of cultural models Americans use to explain human action and has particular political and interpersonal uses. We might think that conceptions as basic as those of personhood and agency would be hegemonic: both singular and internalized as unexamined, taken for‐granted assumptions. The envelope glycoprotein of the Junin arenavirus (GP-C) mediates entry into target cells through a pH-dependent membrane fusion mechanism. Unlike other class I viral fusion proteins, the mature GP-C complex retains a cleaved, 58-amino-acid signal peptide (SSP) as an essential subunit, required both for trafficking of GP-C to the cell surface and for the activation of membrane fusion. SSP has been shown to associate noncovalently in GP-C via the cytoplasmic domain (CTD) of the transmembrane fusion subunit G2. A Fast Image Super-Resolution Algorithm Using An Adaptive Wiener Filter, Russell C. Hardie

A computationally simple super-resolution algorithm using a type of adaptive Wiener filter is proposed. The algorithm produces an improved resolution image from a sequence of low-resolution (LR) video frames with overlapping field of view. The algorithm uses subpixel registration to position each LR pixel value on a common spatial grid that is referenced to the average position of the input frames. The positions of the LR pixels are not quantized to a finite grid as with some previous techniques. The output high-resolution (HR) pixels are obtained using a weighted sum of LR pixels in a local moving window. Using a …
