Law, Responsibility, And The Brain, Owen D. Jones, Hakwan C. Lau, Dean Mobbs, Christopher D. Frith
Law, Responsibility, And The Brain, Owen D. Jones, Hakwan C. Lau, Dean Mobbs, Christopher D. Frith
Vanderbilt Law School Faculty Publications
This article addresses new developments in neuroscience, and their implications for law. It explores, for example, the relationships between brain injury and violence, as well as the connections between mental disorders and criminal behaviors. It discusses a variety of issues surrounding brain fingerprinting, the use of brain scans for lie detection, and concerns about free will. It considers the possible uses for, and legal implications of, brain-imaging technology. And it also identifies six essential limits on the use of brain imaging in courtroom procedures.

Endowment Effects In Chimpanzees, Owen D. Jones, Sarah F. Brosnan, Susan P. Lambeth, Mary Catherine Mareno, Amanda S. Richardson, Steven Schapiro
Vanderbilt Law School Faculty Publications
Human behavior is not always consistent with standard rational choice predictions. The much-investigated variety of apparent deviations from rational choice predictions provides a promising arena for the merger of economics and biology. Although little is known about the extent to which other species also exhibit these seemingly irrational patterns of human decision-making and choice behavior, similarities across species would suggest a common evolutionary root to the phenomena.
The present study investigated whether chimpanzees exhibit an endowment effect, a seemingly paradoxical behavior in which humans tend to value a good they have just come to possess more than they would have …

Age Identity And Adjustment Patterns In Later Life : A Qualitative Study Of Retired Secondary School Teachers And Manual Workers In Hong Kong, Kit Ying, Connie Yong
Age Identity And Adjustment Patterns In Later Life : A Qualitative Study Of Retired Secondary School Teachers And Manual Workers In Hong Kong, Kit Ying, Connie Yong
Lingnan Theses
With escalating heterogeneity of the older population due to extending healthy life expectancy, chronological age is decreasingly likely to be an appropriate discriminator of social groups among the diverse population. It may be more fruitful to understand how older people actually feel and live their lives than merely using chronological age as a categorizing variable. Therefore, the present research investigates individual age identity which may provide a more realistic indicator of ageing in the life course. It may also underpin many behavioral phenomena.
Age identity focuses on how an individual perceives himself or herself in terms of age. Previous studies …
Democracy And The Death Of Knowledge, Suzanna Sherry
Democracy And The Death Of Knowledge, Suzanna Sherry
Vanderbilt Law School Faculty Publications
This essay was presented as the 2006 William Howard Taft lecture at the University of Cincinnati College of Law. It suggests that the conflation of politics and law - the view that judges are not legal experts but rather legislators in robes - is part of a deeper and more worrisome trend. We do not see judges as legal experts because we no longer believe in expertise. We have, in other words, begun to conflate politics and knowledge. We are moving toward a world in which the creation of knowledge is not the province of experts, but is instead produced …
Regulating Settlement: What Is Left Of The Rule Of Law In The Criminal Process?, Nancy J. King
Regulating Settlement: What Is Left Of The Rule Of Law In The Criminal Process?, Nancy J. King
Vanderbilt Law School Faculty Publications
Consider what plea bargains would be like if legal rules were taken more seriously than they currently are. A court would recognize a defendant's willingness to be convicted of an offense only when certain conditions were met: (1) the defendant actually committed the crime; (2) the defendant was punished with the penalty authorized by law for that crime; (3) all government actors involved in the investigation, prosecution, defense, and adjudication of the case had complied with the law governing the criminal process; and (4) the settlement agreement did not relieve any of them of the duty to comply with the …
Race And Wealth Disparity: The Role Of Law And The Legal System, Beverly I. Moran, Stephanie M. Wildman
Race And Wealth Disparity: The Role Of Law And The Legal System, Beverly I. Moran, Stephanie M. Wildman
Vanderbilt Law School Faculty Publications
Many believe that the legal system has achieved racial neutrality because statutes and regulations do not mention race. They do not view law and the legal system as one way that American society polices race and wealth disparities. Because American law seems removed from race and wealth concerns, legal workers see no place for such considerations in their education or practice.
Although the legal system has aspired to neutrality and equality, racialized wealth inequality has resulted and continues. This article considers the aspiration and shows how equality and neutrality can veil existing wealth inequality. Using examples from judicial decisionmaking and …
Alternative School Administrators And Teachers Perception Of Effective School Correlates In The Organizational Culture And Operation Of Alternative Schools, C.W. Gardenhire
Theses and Dissertations
The purpose of the study was to examine whether alternative schools incorporate effective school correlates in their organizational culture and operation as these same elements are typically identified in the traditional effective school research. A quantitative descriptive study method was selected to conduct the study. The sample consisted of administrators and teachers actively involved in alternative schools. Further the sample was geographically located in the Mid-South, specifically Arkansas, East Texas, Northern Louisiana, North West Mississippi, and Western Tennessee. The study concluded that effective school correlates — clear school mission, frequent monitoring of students, and instructional leadership — were perceived to …
Characteristics And Offending Patterns Of Juvenile Female Sex Offenders, Antonela Tomic
Characteristics And Offending Patterns Of Juvenile Female Sex Offenders, Antonela Tomic
Theses and Dissertations
Although there has been an increasing interest in juvenile female sex offenders, existing research is limited. This thesis examines the demographic characteristics of juvenile female sex offenders, their victims, and their offense characteristics using a national sample of 172 juvenile female sex offenders who were arrested for sex offenses in 2001. The typical offender was a 14-year-old white female and was arrested for forcible fondling. The majority of the victims were white females who knew their offenders. Most of the offenses were committed at a residence. The use of force, as well as use of alcohol and/or drugs at the …
Differentiating Between Women In Hard And Soft Science And Engineering Disciplines, Amanda Gail Camp
Differentiating Between Women In Hard And Soft Science And Engineering Disciplines, Amanda Gail Camp
Theses and Dissertations
The intent of the study was to investigate how women in hard (engineering, mathematics, computer science, physical science) and soft (social, psychological, life sciences) sciences differ from each other among a set of variables known to influence educational attainment and to evaluate how well Weidman's undergraduate socialization model explains higher education's influence on women in science and engineering fields. Using the Beginning Postsecondary Students Longitudinal Study (1996-2001), descriptive discriminant analysis and multivariate analysis of variance were used to identify differences among the women, and structural equation modeling was used to evaluate Weidman's model. Results indicated that women who went into …
Undergraduates’ Perceptions Of Ideal Learning Environments, June Hetzel, Keith Walters
Undergraduates’ Perceptions Of Ideal Learning Environments, June Hetzel, Keith Walters
International Christian Community of Teacher Educators Journal
Four hundred and fifty three undergraduate students were surveyed at one CCCU institution regarding perceptions of what “exists” and what they “value” related to university pedagogy, learning activities, assessments, and learning relationships. Researchers ranked students’ values and examined gaps in students’ perceptions of what students say exists at the university as compared to what they value. The highest ranked values primarily related to learning relationships, including “demonstrates Christian ethics in interactions with others” and “integrates Christian worldview in the teaching of course content.” The factor that most explained satisfaction with teaching practices was the “Methods Factor” and the single item …

A Stylistic Approach To The God Of Small Things Written By Arundhati Roy, Wing Yi, Monica Chan
A Stylistic Approach To The God Of Small Things Written By Arundhati Roy, Wing Yi, Monica Chan
Lingnan Theses
This thesis presents a creative-analytical hybrid production in relation to the stylistic distinctiveness in The God of Small Things, the debut novel of Arundhati Roy. Roy’s text drew the world’s gaze after winning the Booker Prize in 1997. Many studies have been written on diverse aspects of the book, and much has been said regarding the writer’s style. However, those studies rarely focus on the minutiae of Roy’s writing and this thesis provides a greater degree of detailed analysis. The objective is to achieve a deeper understanding of the relationship between style and literary aesthetics in The God of Small …
A Corpus-Based Synchronic Comparison And Diachronic Interpretation Of Lexicalized Emotion Metaphors In English And Chinese, Shixiong, George Wu
A Corpus-Based Synchronic Comparison And Diachronic Interpretation Of Lexicalized Emotion Metaphors In English And Chinese, Shixiong, George Wu
Lingnan Theses
This study is a corpus-based contrastive study of the cross-language diachronic changes and synchronic variations of lexicalized emotion metaphors (LEMS) in English and Chinese within the framework of cognitive linguistics. Since it is based on a series of basic assumptions of the Lakoffian Conceptual Metaphor Theory (CMT), it is also expected to prove or improve them by making this cross-cultural comparative study of LEMS in English and Chinese. Therefore this study aims at not only the diachronic changes and synchronic variations of LEMS but also the cultural factors underlying them. By applying CMT in the analysis of the corresponding data …
Factors That Influence Transfer Of Hazardous Material Training: The Perception Of Selected Fire-Fighter Trainees And Supervisors, Divya Bhati
Electronic Theses and Dissertations
This study examined the influence of factors on transfer of training and was based on the work of Broad and Newstrom (1992). For the purpose of this study the Broad and Newstrom (1992) transfer of training barriers are rephrased into positive statements. The nine transfer of training factors are: (1) reinforcement on the job; (2) little interference from immediate (work) environment; (3) supportive organizational culture; (4) trainees' perception of training programs being practical; (5) trainees' perception of relevant training content; (6) trainees' being comfortable with change and associated effort; (7) trainer being supportive and inspiring; (8) trainees' perception of training …

The Popular Images Of John Brown And Thomas "Stonewall" Jackson, Sarah Clark
Electronic Theses and Dissertations
This study examines the evolution of the popular images of John Brown and Thomas "Stonewall" Jackson. It begins by analyzing the historiography of each man. The second and third chapters are biographies of each man. The fourth, fifth, and sixth chapters examine the popular images of the two men in print media, visual media, and monuments. This thesis concludes with appendices which contain reproductions of songs, photographs, and paintings referred to in the chapters. This study finds that the myth of the Lost Cause has kept Thomas Jackson's popular image consistently positive and heroic since his death in 1863. At …
An Examination Of The Relationships Among Perceived Gender Discrimination, Work Motivation, And Performance, Jessica M. Cornejo
An Examination Of The Relationships Among Perceived Gender Discrimination, Work Motivation, And Performance, Jessica M. Cornejo
Electronic Theses and Dissertations
Gender discrimination and work motivation are two important constructs for employers to consider. Changing workforce trends towards a more diverse workforce make understanding discrimination in the workplace more important than ever. And, established direct relationships between motivation and performance make understanding motivation key to organizational success. The purpose of this study was to examine the relationships among perceived gender discrimination at work, work motivation, and performance. Although much theory and research exists regarding motivation and performance, this study uses a new measure of motivation based on the Pritchard and Ashwood (2007) theory of work motivation. It was hypothesized that perceived …
An Investigation Of The Relationship Between Counseling Self-Efficacy And Counselor Wellness Among Counselor Education Students, Jennifer Curry
An Investigation Of The Relationship Between Counseling Self-Efficacy And Counselor Wellness Among Counselor Education Students, Jennifer Curry
Electronic Theses and Dissertations
Recent research in counselor training has focused on the difficulties and challenges facing counseling practitioners that result in high stress, burnout, compassion fatigue, vicarious trauma, and counselor impairment. The American Counseling Association's (ACA) Code of Ethics has addressed the ethical issues inherent in counselor impairment. Further, the Council for Accreditation of Counseling and Related Educational Programs (CACREP) has focused on the development of counselors that will assist them in being resilient to workplace stressors. Wellness is a theoretically based construct that holds much promise for bolstering the resilience of pre-service counselors. In addition, counselor self-efficacy has been linked to greater …
A Relationship Between Career Decision And Motivation To Persist, Patricia Ann Ferguson
A Relationship Between Career Decision And Motivation To Persist, Patricia Ann Ferguson
Electronic Theses and Dissertations
During the past few decades, research on student retention has been primarily focused on the constructs of social integration, lack of financial support and academic under-preparedness (Astin, 1975; Bean & Metzner, 1985; Cabrera, 1993; Pascarella,1982; Tinto, 1975). This study examined the phenomenal occurrence of low retention due to "lack of major and career direction." The Career Decision Scale and the Achievement Motivation Profile assessments were administered to 105 students at a comprehensive community college. Six linear regressions were conducted to determine if there were statistical relationships between:(a) career decision and the motivation to persist and; (b) career indecision and the …
Attitudes Towards Seeking Professional Counseling: The Role Of Outcome Expectations And Emotional Openness In English-Speaking C, Wendy-Lou Greenidge
Attitudes Towards Seeking Professional Counseling: The Role Of Outcome Expectations And Emotional Openness In English-Speaking C, Wendy-Lou Greenidge
Electronic Theses and Dissertations
Purpose: The college environment is documented as a universally stressful period where students face many challenges (Baysden, 2002; Pandit, 2003). In addition to these potential stressors, international students face other unique challenges such as loss of support network, feelings of isolation, economic hardship, coping with oftentimes competing cultures, and anxiety which emanates from unfamiliarity (Kim & Omizo, 2003; Rounds & Kline, 2005). Unsuccessful resolution of these challenges can negatively impact the acculturation process, their mental health, and their academic programs (Roysircar, 2002). Despite these many challenges, research consistently shows that international students are less likely than their US counterparts to …
The Emergence Of The Maya Tlaloc: A Late Classic Religious Icon, Amanda Toyie Groff
The Emergence Of The Maya Tlaloc: A Late Classic Religious Icon, Amanda Toyie Groff
Electronic Theses and Dissertations
Iconography has the capability to memorialize and guarantee one's place in history; iconography can also provide powerful insight into human culture, and explore social and cultural values in a visual manner. Iconography can incorporate information about group identities, allegiances, religious affiliations, propaganda, and acceptance within both modern and ancient societies. By studying a specific iconographic figure, the Central Mexican god Tlaloc, as a visual representation of a belief or identity, we can glean a greater understanding of the cultural transmission of iconographic symbols. The substantial use of this icon, in both Central Mexico and the Maya region, reveals iconography as …
The Mediating Role Of Motivation And Job Satisfaction In Work Environment-Outcome Relationships, Melissa Guzman
The Mediating Role Of Motivation And Job Satisfaction In Work Environment-Outcome Relationships, Melissa Guzman
Electronic Theses and Dissertations
Research that links various aspects of the work environment to important work outcomes can be traced back almost seventy years. Despite the history and proliferation of these studies, firm conclusions have not been reached regarding the ways through which the work environment impacts these outcomes. For example, mediating variables such as motivation and job satisfaction have been proposed as affective and cognitive states that could impact the environment-outcome relationships but have received little attention. Additionally, organizational and contextual moderators such as group size and demographics that could impact the relationships have been called for but have yet to be studied. …

The Importance Of Addressing Acculturative Stress In Marital Therapy With Hispanic American Women, Mary Hammons
Electronic Theses and Dissertations
The purpose of this study was to examine the relation between acculturative stress and marital distress among Hispanic American women and to explore the potential mediating roles of variables believed to be important to marital functioning among ethnic minorities and immigrants (e.g., acculturation, ethnic identity, social support, etc.). Based on data from 103 Hispanic American married women, pressure to acculturate toward the dominant culture of the U.S. was found to significantly correlate with the amount of distress the women reported in their marital relationships. Two variables were found to partially mediate the correlation. Perceived social support and recent stressful life …

Death Penalty Knowledge, Opinion, And Revenge: A Test Of The Marshall Hypotheses In A Time Of Flux, Gavin Lee
Electronic Theses and Dissertations
This thesis tests the three hypotheses derived from the written opinion of Justice Thurgood Marshall in Furman v Georgia in 1972. Subjects completed questionnaires at the beginning and the end of the fall 2006 semester. Experimental group subjects were enrolled in a death penalty class, while control group subjects were enrolled in another criminal justice class. The death penalty class was the experimental stimulus. Findings provided strong support for the first and third hypotheses, i.e., subjects were generally lacking in death penalty knowledge before the experimental stimulus, and death penalty proponents who scored "high" on a retribution index did not …
