Erastian And High Church Approaches To The Law: The Jurisprudential Categories Of Robert E. Rodes, Jr., M. Cathleen Kaveny

Journal Articles

It is a great honor for me to have been asked to contribute to this issue of the Journal of Law and Religion focusing on the work of my colleague and friend, Robert E. Rodes, Jr. In June 2006, Professor Rodes celebrated his fiftieth anniversary as a member of the faculty of Notre Dame Law School. His long career has marked him as a founding father of interdisciplinary scholarship at the intersection of faith, law, and morality—the very sort of scholarship which this journal is dedicated to fostering and preserving.

The topics that Professor Rodes has considered over the years …

From Family To Individual And Back Again, Margaret F. Brinig Jan 2007

From Family To Individual And Back Again, Margaret F. Brinig

Journal Articles

Loving v. Virginia has been thought of in many ways: as an important step toward full equality for African-Americans, as, more generally, a statement about the suspect classification of race, as a declaration about the fundamental nature of marriage, and as a critical addition to the construction of the right to privacy (as well as, of course, exemplified in the validation of the Lovings' own marriage).

In my contribution to the first Loving symposium, I wrote about the increasing tendency of the Supreme Court, following the 1967 decision, to treat the rights of intimacy as belonging to the individual adults …

Addressing Urban High-Poverty School Teacher Attrition By Addressing Urban High Poverty School Teacher Retention: Why Effective Teachers Perservere, Sueanne E. Mckinney, Robert Q. Berry, Daniel L. Dickerson, Gloria Campbell-Whately

Teaching & Learning Faculty Publications

Recruiting and retaining quality teachers specific for high-poverty schools in urban areas is a national concern, especially in light of the "No Child Left Behind" federal legislation. The educational realities, detrimental effects of poverty, and human despair that often depress low-income communities can prove to be quite overpowering for many teachers new to the profession and significantly contribute to high levels of teacher absenteeism, attrition rates, and teacher shortages. Examining this issue through a new lens, that being through the eyes of effective urban high-poverty school educators, has the potential to spark spirited conversations and debates among policy makers and …

Struggling To Give Meaning To The Concept Of Meaningful Interference: The Eighth Circuit Announces A New Rule, Joshua C. Devine Jan 2007

Struggling To Give Meaning To The Concept Of Meaningful Interference: The Eighth Circuit Announces A New Rule, Joshua C. Devine

Missouri Law Review

This Note examines United States v. Va Lerie, a recent Eighth Circuit case involving law enforcement interference with property entrusted to Greyhound, a third-party common carrier. In Va Lerie, the Eighth Circuit established a new test for determining when property entrusted to third-party common carriers is seized within the meaning of the Fourth Amendment. This Note argues that the Eighth Circuit's new test fails to comport with the holding of Jacobsen. As such, the Eighth Circuit should have adhered to a line of precedent that distinguishes between the touching of property by law enforcement officials and a more detailed inquiry …

Viewpoint Discrimination In Law School Clinics: Teaching Students When And How To Just Say No, Jason A. Kempf Jan 2007

Viewpoint Discrimination In Law School Clinics: Teaching Students When And How To Just Say No, Jason A. Kempf

Missouri Law Review

In 1996, the American Bar Association ("ABA") amended its law school accreditation standards and required that all ABA-approved law schools offer "live-client or other real-life practice experience. '' In doing so, the ABA confirmed the increasingly important role of law school clinics in legal education. This unique teaching environment moves students and professors out of the classroom and into real-world courtrooms. As these "student-lawyers" work on behalf of live clients, they "experience the legal ethics issues lawyers face every day, such as client confidentiality, conflict of interest, and competency issues." Not surprisingly, with these ethical issues come difficult decisions for …

Supreme Court Cordially Invited You To Sue In Federal Court: Hope You Don't Mind Waiting, The, Evan F. Fitts

Missouri Law Review

Congestion in the federal judiciary is so prevalent that it has become an afterthought. From the outset of their introductory Federal Civil Procedure course, most law students learn that any attorney who brings an action in a federal court better be prepared to wait. A recent report by the Federal Judicial Center indicated that the average time between filing and adjudication of issues in federal district courts was approximately two years. It can reasonably be asserted that this length of time is directly proportional to the amount of cases on the federal docket. Therefore, any step to reduce the caseload …

Effects Of The Youth Fit For Life Protocol On Physiological Factors, Mood, Self-Appraisal, Voluntary Physical Activity, And Fruit And Vegetable Consumption In Children Enrolled In Ymca After-School Care, James J. Effects Of The Youth Fit For Life Protocol On Physiological Factors, Mood, Self-Appraisal, Voluntary Physical Activity, And Fruit And Vegetable Consumption In Children Enrolled In Ymca After-School Care, James J. Annesi, Avery D. Faigenbaum, Wayne L. Westcott, Alice E. Smith, Gayle M. Dixon

Journal of Social, Behavioral, and Health Sciences

Changes associated with the Youth Fit For Life physical activity intervention were assessed with 5- to 12-year-old children in after-school care ( N = 477). Body mass index (BMI), strength, and flexibility significantly improved over 12 weeks. Initial BMI was negatively related to observed changes, r = -.29, p < .001. Significant within-group improvements in tension, vigor, and physical self-concept scores, and levels of voluntary moderate-to-vigorous physical activity/week were also found in the 9- to 12-year-olds (n = 91). Multiple regression analysis indicated that changes in physical self-concept, exercise self-efficacy, and general self scores explained a portion of the variance in changes in voluntary physical activity that approached significance, R2 = .08, F = 2.55, p = .06. Revisions and extensions of the protocol were suggested.

Relations Of Changes In Self-Efficacy, Exercise Attendance, Mood, And Perceived And Actual Physical Changes In Obese Women: Assessing Treatment Effects Using Tenets Of Self- Efficacy Theory, James J. Annesi, Jennifer L. Unruh, Ann C. Whitaker Jan 2007

Relations Of Changes In Self-Efficacy, Exercise Attendance, Mood, And Perceived And Actual Physical Changes In Obese Women: Assessing Treatment Effects Using Tenets Of Self- Efficacy Theory, James J. Annesi, Jennifer L. Unruh, Ann C. Whitaker

Journal of Social, Behavioral, and Health Sciences

Obese and sedentary women ( N = 76) initiated an exercise and nutrition program based on self-efficacy theory. Significant within-group improvements in body fat, waist size, and body mass index were found over 6 months. Changes in Physical Self-Concept (task self-efficacy) and Exercise Self-Efficacy (self-regulatory efficacy) scores, together, accounted for a significant portion of the variance in exercise session attendance, R2 = .24, F = 11.67, p < .001, with both significantly contributing to the overall explained variance. Exercise attendance was significantly related to changes in Body Areas Satisfaction (β = .39) and Total Mood Disturbance (β = -.27) scores. Findings suggested a path from increased self-efficacy, to exercise attendance, to improvements in body satisfaction and overall mood. Suggestions for replication and extensions were given.

Herbal Products And Dietary Supplements: A Survey Of Use, Attitudes, And Knowledge Among Older Adults, Jacqueline S. Marinac, Colleen L. Buchinger, Lincoln A. Godfrey, James M. Wooten, Chao Sun, Sandra K. Willsie

Faculty and Staff Publications

Context: Tens of millions of Americans use herbal products and/or dietary supplements, yet scant data are available regarding the purity, safety, or efficacy of these substances. A better understanding of usage trends and patient attitudes toward self-initiated supplementation is vital to obtaining accurate and complete medical history data.

Objective: To survey Americans aged approximately 60 years and older regarding their use of herbal products and dietary supplements and their attitudes and knowledge regarding the safety of these popular substances.

Methods: A face-to-face, 35-item survey was administered to 267 men and women residing in the Kansas City, Mo-metropolitan area. Researchers documented …

Secrecy And Access In An Innovation Intensive Economy: Reordering Information Privileges In Environmental, Health, And Safety Law, Mary L. Lyndon Jan 2007

Secrecy And Access In An Innovation Intensive Economy: Reordering Information Privileges In Environmental, Health, And Safety Law, Mary L. Lyndon

University of Colorado Law Review

This article examines the law concerned with access to information that is commercially valuable when it is kept secret but is also essential to environmental, health, and safety (EHS) risk evaluation. EHS law stimulates sustainable economic activity, including new technologies, and thus complements intellectual property law. Access to EHS information is essential to risk management, but current disclosure obligations are unclear, as the law is a patchwork of familiar but ill-fitting concepts and entitlements. The article discusses the current law that affects disclosure, taking into account recent changes in the technological and economic landscape. It also describes the contrasting uses …

Post A Message And Go To Jail: Criminalizing Internet Libel In Japan And The United States, Salil K. Mehra

University of Colorado Law Review

In the United States, criminal libel is all but dead. American law professors only write about it to denounce the continued existence of rarely enforced criminal libel statutes. In Japan, however, criminal libel laws have become vital tools in policing injurious speech on the Internet. Defamatory posts lead to police intervention and even arrest. Because the United States is considering regulation of online speech, potentially including criminal penalties, we can learn from the experience of Japan. From a positive perspective, this Article explains why Japan applies such laws to the Internet. From a normative perspective, the Article addresses why broadly …

Arrested Development: An Alternative To Juveniles Serving Life Without Parole In Colorado, Gail B. Goodman Jan 2007

Arrested Development: An Alternative To Juveniles Serving Life Without Parole In Colorado, Gail B. Goodman

University of Colorado Law Review

More than 100 years ago, reformers established a separate juvenile court system meant to protect and rehabilitate delinquent children. However, several U.S. Supreme Court cases in the 1960s and 1970s slowly eroded the special features that distinguished the juvenile court from the criminal court. In addition, newly enacted legislation has facilitated the transfer of juvenile cases to the adult system. As a result, more juveniles are being tried in adult courts and the goals furthered by the juvenile court system are being ignored. Recent Supreme Court decisions and studies regarding adolescent brain development indicate that the current system for treating …

Climate Change And The Poorest Nations: Further Reflections On Global Inequality, Ruth Gordon Jan 2007

Climate Change And The Poorest Nations: Further Reflections On Global Inequality, Ruth Gordon

University of Colorado Law Review

This article considers climate change from the perspective of the Third World and more particularly from the vantage point of the poorest nations in the international system. It concludes that those nations that are the most geographically and economically vulnerable will also have the least impact on mechanisms to halt the progress of this impending disaster. Hence, climate change is examined as yet another chapter in Third World powerlessness. Despite the fact that low-income nations participate in international deliberations, they do so from an exceedingly weak position that puts them in the untenable position of being on the receiving end …
