Branch Mathematics and Statistics Faculty and Staff Publications

This volume is a collection of six papers on the use of auxiliary information and a priori values in construction of improved estimators. The work included here will be of immense application for researchers and students who employ auxiliary information in any form. Below we discuss each paper: 1. Ratio estimators in simple random sampling using information on auxiliary attribute. Prior knowledge about population mean along with coefficient of variation of the population of an auxiliary variable is known to be very useful particularly when the ratio, product and regression estimators are used for estimation of population mean of a …

Federal Rules Update: How Rules Are Made: A Brief Review, David A. Schlueter

Faculty Articles

In June 2007, the Standing Committee on the Federal Rules of Procedure and Evidence authorized publication for comment on a number amendments to the rules of criminal procedure. The amendment to Criminal Rule 7 would delete subdivision (c)(2) because it is covered in Rule 32.2(a). The change to Criminal Rule 32 would provide that the presentence report should state whether the government is seeking forfeiture of property. Amendments to Criminal Rule 32.2. would change a number of procedures related to criminal forfeiture. Criminal Rule 41 would create a two-step process for seizing and reviewing electronic storage media. Amendments to the …

Texas Annual Survey: Securities Regulation, George Lee Flint Jr Jan 2007

Texas Annual Survey: Securities Regulation, George Lee Flint Jr

Faculty Articles

With respect to easing registration requirements, the State Securities Board (“Board”) had the opportunity to lead both state and federal securities regulatory bodies through rule changes for finders--those who assist issuers in finding purchasers. The Board also issued no-action letters for nonregistration of securities issued in connection with various reorganizations involving a Massachusetts business trust, a demutualization of an insurance company, and an exchange of private shares for public American Depository Receipts.

Other than considering the availability of the in pari delicto defense for litigation-funding agreements, the courts generally avoided the interesting issues. Such issues include whether a seller’s fraud …

Standardized Tests, Erroneous Scores, And Tort Liability, Vincent R. Johnson Jan 2007

Standardized Tests, Erroneous Scores, And Tort Liability, Vincent R. Johnson

Faculty Articles

Tort law offers an appropriate vehicle for handling the increased prevalence of standardized testing in the wake of the No Child Left Behind Act and the potential miss-scoring problems that arise with standardized tests. This incentivizes the use of reasonable care in scoring standardized tests and justly compensates for miss-scoring harms when doing so does not unduly burden testing agencies. Neither contract law nor the existing Truth-in-Testing law adequately affords the sort of remedies and protections the issue of standardized testing and miss-scoring pose.

The ability for tort liability to adequately hold testing agencies accountable for miss-scoring errors and afford …

Comment: The Ninth Amendment: A Constitutional Challenge To Corporal Punishment In Public Schools, David R. Hague Jan 2007

Comment: The Ninth Amendment: A Constitutional Challenge To Corporal Punishment In Public Schools, David R. Hague

Faculty Articles

The Supreme Court's refusal to resolve the conflict over corporal punishment in public schools perpetuates the uncertainty over children and parents' legal rights. The use of corporal punishment in public schools unconstitutionally abridges parents' right to direct the upbringing of their children because it forces parents to accept the emotional and physical marks that corporal punishment leaves on their children. In 1977, the Supreme Court addressed the constitutionality of corporal punishment in Ingraham v. Wright. The Court held that the cruel and unusual punishment clause of the Eighth Amendment applied only to criminal punishments and thus provided no protection against …

Categorical Exclusions From Capital Punishment: How Many Wrongs Make A Right?, Dora W. Klein Jan 2007

Categorical Exclusions From Capital Punishment: How Many Wrongs Make A Right?, Dora W. Klein

Faculty Articles

The two categorical exclusions of age and mental capacity will impact not only those offenders who are excluded from the death penalty, but also those offenders who remain subject to this punishment. The Supreme Court’s decisions in Roper v. Simmons and Atkins v. Virginia raise the issue that a capital-punishment-limiting decision possesses wrongs of its own. Both decisions limit the death penalty—Roper excludes from this punishment offenders who committed their crimes before they were eighteen years old and Atkins excludes offenders who are mentally retarded. But in both cases, the Supreme Court overstated the uniformity and universality of traits associated …

Threading The Eye Of The Erisa Needle: Erisa Preemption And Alternative Legal Schemes To Fill The Regulatory Vacuum,, Bernard D. Reams Jr., Michael P. Forrest Jan 2007

Threading The Eye Of The Erisa Needle: Erisa Preemption And Alternative Legal Schemes To Fill The Regulatory Vacuum,, Bernard D. Reams Jr., Michael P. Forrest

Faculty Articles

Popular consensus suggests that the Employee Retirement Income Security Act (“ERISA”) is a mess, and one of historic proportions. ERISA’s comprehensive reach to protect employer-provided benefits has in practice produced unintended, if not contradictory, results.

Congress passed ERISA over thirty years ago to protect the rights of employees who benefit from employer pension and welfare benefit plans. It did so with a series of regulations that promote uniformity in litigation across the various states through “strong preemption language.” The goal of uniformity arguably benefits workers by imposing regular standards of conduct which lend predictability to the scope of litigation, or …

Invisible Green, Amanda Sauer Jan 2007

Invisible Green, Amanda Sauer

Theses and Dissertations

How is nature conceived today, a generation into the environmental movement? Many contemporary artists grapple with how to reconcile our inheritance of both a precarious natural world and the culture that created it. My work investigates the subtle intricacies of our relationship with nature. I use photography to develop a way of seeing that points to the often-unnoticed nature in front of us. In particular, my work recognizes and re-imagines nature's deep connections in the context of our ecologically changed world.

Beyond The Threshold: Allusions To The ÒrìsÀ In Ana Mendieta's Silueta Series, Latricia M. January Jan 2007

Beyond The Threshold: Allusions To The ÒrìsÀ In Ana Mendieta's Silueta Series, Latricia M. January

Theses and Dissertations

The Cuban-born artist Ana Mendieta (1948-1985) created the Silueta Series during the 1970s and ‘80s. It consists of earth-body works in situ featuring the silhouette of the artist's body fashioned from mud, plants, rocks, gunpowder and other materials. Underlying the creation of the Silueta Series is Mendieta's belief that the elements are sentient and powerful beings. This perception is particularly strong in the Afro-Cuban religion Santeria, a creolized form of the Òrìsà tradition of the Yoruba of West Africa introduced to the Americas during the trans-Atlantic slave trade. While scholars have noted Mendieta's incorporation of Santeria in her art, a …

Cradle To Cage: Confronting The Premature Institutionalization Of The Children Of The Incarcerated, Jen Fell Jan 2007

Cradle To Cage: Confronting The Premature Institutionalization Of The Children Of The Incarcerated, Jen Fell

Theses and Dissertations

American prisons are swollen and distended. Over 2 million Americans sit in jail or prison today. About 2/3 of the incarcerated are parents. They parent approximately 2 million children in America today who are separated from mom or dad because of incarceration. Their children suffer from poverty, inconsistency in caregivers, separation from siblings, reduced opportunity to health and education and increased risk for substance abuse, alcoholism and incarceration themselves. Children of the incarcerated are seven times more likely than their peers to become incarcerated as adults. Many of these children are unable to visit their parents. Over half the mothers in …

Changes In Bmi Among First Semester College Students, Rachel L. Walker Jan 2007

Changes In Bmi Among First Semester College Students, Rachel L. Walker

Theses and Dissertations

The transition to college has been identified as a critical period for weight gain; however, only a limited number of studies have examined this phenomenon. The college setting may promote weight gain, thus the purpose of the present study was to quantify changes in BMI in first year students during their first semester of college and to understand factors associated with weight gain, such as eating behaviors, physical activity, and body shape ideals. Significant changes in weight were detected between Time 1 and 2 with a mean weight gain of 1.24 kg. The majority of participants (73.1 %) gained weight …

Residential Outcomes Of Hope Vi Relocatees In Richmond, Va, Lallen Tyrone Johnson-Hart Jan 2007

Residential Outcomes Of Hope Vi Relocatees In Richmond, Va, Lallen Tyrone Johnson-Hart

Theses and Dissertations

In 1997 the Richmond Redevelopment and Housing Authority received a HOPE VI grant from the U.S. Department of Housing and Urban Development in the amount of $26.9 million to revitalize the Blackwell scattered site public housing community. The mixed income approach of HOPE VI calls for a reduction of public housing units, thus requiring all households to relocate to other neighborhoods. This research analyzed socioeconomic data to examine the relocation of households, assess whether they moved to better neighborhoods, and compare them to other poor households. Over half of all households moved to other distressed neighborhoods in the Northside, East …

Self-Care And Quality Of Life In Patients With Heart Failure, Chantira Chiaranai Jan 2007

Self-Care And Quality Of Life In Patients With Heart Failure, Chantira Chiaranai

Theses and Dissertations

Although it is well known that self-care reduces the frequency of hospital admissions and exacerbations and enhances quality of life (QOL) in heart failure (HF) patients, little is known about self-care in this population. Therefore, the study purpose was to examine relationships among selected individual characteristics (demographics, severity of illness, comorbidities, and social support), self-care strategies, and QOL using Reigel's Model of Self Care in Patients with Heart Failure as the guiding framework. In this descriptive correlational study, self-care was measured using the Self-Care of Heart Failure Index (SCHFI), which measures self-care maintenance (SC-Mt), self-care management (SC-Mn), and self-care self-confidence …

Visual Contributions To The Vestibulo-Ocular Reflex During Balance Recovery Tasks, Mark D. Diehl Jan 2007

Visual Contributions To The Vestibulo-Ocular Reflex During Balance Recovery Tasks, Mark D. Diehl

Theses and Dissertations

Introduction: The Vestibulo-ocular reflex (VOR) is quantified by computing the ratio of head angular velocity and eye angular velocity (VOR Gain). This measure only includes head angular movements; linear translations are not accounted for. These investigations postulate an alternative method of VOR quantification, one that assesses retinal image stability during head angular and linear movements (Foveal fixation (FF)). This method was used to assess the role of vision in balance reactions. Methods: Experiment 1 : Ten Young subjects were fitted with an eye tracker linked to an EM kinematic recording system. This allowed for the recording of head, trunk and …

Development And Validation Of A Computational Musculoskeletal Model Of The Elbow Joint, Justin Paul Fisk Jan 2007

Development And Validation Of A Computational Musculoskeletal Model Of The Elbow Joint, Justin Paul Fisk

Theses and Dissertations

Musculoskeletal computational modeling is a versatile and effective tool which may be used to study joint mechanics, examine muscle and ligament function, and simulate surgical reconstructive procedures. While injury to the elbow joint can be significantly debilitating, questions still remain regarding its normal, pathologic, and repaired behavior. Biomechanical models of the elbow have been developed, but all have assumed fixed joint axes of rotation and ignored the effects of ligaments. Therefore, the objective of this thesis was to develop and validate a computational model of the elbow joint whereby joint kinematics are dictated by three-dimensional bony geometry contact, ligamentous constraints, …

Lucidity, Sarah Rebekah Byrd Mizer Jan 2007

Lucidity, Sarah Rebekah Byrd Mizer

Theses and Dissertations

This thesis focuses on space, the in-between-ness that exists amidst mental and physical experience. Pith explains personal attachments and rooting systems. The thesis continues with Blessing, narrating love then loss, and finishes with a recipe for making a tomato sandwich. Blessing is followed by Materialize, a collective view of cyclical learning and meandering paths. Finally, the paper concludes with a quirky Women and Swarovski encrusted skulls, which matter-of-factly lists artists (all of whom happen to be women) whose works I find particularly compelling; and also notes on general trends in art I find interesting in a much less obvious manner. …

Theoretical Investigation Of The Structure And Vibrational Frequencies Of Water And Methanol Complexes, John Michael Craig Jan 2007

Theoretical Investigation Of The Structure And Vibrational Frequencies Of Water And Methanol Complexes, John Michael Craig

Theses and Dissertations

Water and methanol are common solvents used in liquid chromatographic (LC) separations. It is highly desirable to model .the interactions of these solvents in order to better understand the nature of analyte solvation and its effect on retention. Therefore, structure and frequencies of complexes of these solvent molecules have been studied from a theoretical perspective as a first step in this direction. Specifically, cluster structures have been optimized at the RHF and MP2 levels in various flexible basis sets and with the counterpoise correction for basis set superposition error, and trends in the structure and binding energies of several clusters …

Structure Of Aggression Among Urban Youth: Competing Factor Models Of Subtypes Of Physical And Relational Aggression, Sarah W. Helms Jan 2007

Structure Of Aggression Among Urban Youth: Competing Factor Models Of Subtypes Of Physical And Relational Aggression, Sarah W. Helms

Theses and Dissertations

Aggression has been demonstrated to pose a serious threat to the adaptive development of youth, with decades of research demonstrating the negative associations between aggression and other problem behaviors, both concurrently and predictively. However, despite this body of research, the current psychological literature continues to suffer from a lack of an overarching organizational framework from which to structure the construct(s) of aggression. Furthermore, existing discrepancies across the literature, particularly in the definitions of and outcomes associated with non-physical forms of aggression (e.g., relational aggression, social aggression), exacerbate the complexities facing prevention and intervention specialists. Insofar as research can isolate the …

Life In An Occupied City: Women In Winchester, Virginia During The Civil War, Laura Jane Ping Jan 2007

Life In An Occupied City: Women In Winchester, Virginia During The Civil War, Laura Jane Ping

Theses and Dissertations

This thesis examines the homefront experience of middle class, white women living in Winchester, Virginia during the Civil War. The experience of women in Winchester was unique because of Winchester's proximity to both the Union and Confederate capitals. Although the majority of Winchester's women were Confederate supporters a significant minority of the population remained loyal to the Union. Winchester citizens' divided status was further complicated by numerous occupations of the town by both armies. This thesis argues that in order to cope with wartime hardships women's concepts of patriotism changed as homefront morale waned. While early in the war women's …
