Cyber-Libeling The Glitterati: Protecting The First Amendment For Internet Speech, Abbey L. Mansfield Jan 2007

Cyber-Libeling The Glitterati: Protecting The First Amendment For Internet Speech, Abbey L. Mansfield

Vanderbilt Journal of Entertainment & Technology Law

Celebrity gossip is disseminated on the Internet not only by profitable publications and Internet tabloids with professional writers and sophisticated legal teams, but also by countless numbers of "blogs" posted by ordinary individuals, often with nothing more than a dial-up connection. Americans posting speech on the Internet must be aware of the implications of the Gutnick decision and recognize that they could be dragged into court and held liable for defamation abroad. This note explores theoretical changes to the law that should be adopted to protect the First Amendment as it applies to Internet speech. Additionally, this note discusses various …

First, this part describes briefly how the Internet works, to the extent that such a description is necessary to advance the argument presented in this note. Second, concentrating on Europe, the United States, and China, Part I describes the diverging preferences of countries regarding Internet regulation, the approaches they have taken, and the problems they have encountered due to the international nature of the Internet. Third, this part addresses the major attempt at international …

All In, But Left Out: How The Unlawful Internet Gambling Enforcement Act Seeks To Eradicate Online Gambling In The United States, Benjamin C. Wickert Jan 2007

All In, But Left Out: How The Unlawful Internet Gambling Enforcement Act Seeks To Eradicate Online Gambling In The United States, Benjamin C. Wickert

Vanderbilt Journal of Entertainment & Technology Law

In recent years, gambling on the Internet has evolved into a multi-billion dollar enterprise. The industry has been particularly entrenched in the United States, whose citizens at one time accounted for up to one-half of all Internet gambling revenues. However, the landscape of Internet gambling in the United States changed drastically in 2006, when President George W Bush signed into law the Unlawful Internet Gambling Enforcement Act (UIGEA). The crucial provision of the UIGEA is its prohibition of the acceptance of payments, made by United States banks and creditors, to purveyors of unlawful Internet gambling enterprises. By targeting United States …

Addressing The Incoherency Of The Preemption Provision Of The Copyright Act Of 1976, Joseph P. Bauer Jan 2007

Addressing The Incoherency Of The Preemption Provision Of The Copyright Act Of 1976, Joseph P. Bauer

Vanderbilt Journal of Entertainment & Technology Law

Section 301 of the Copyright Act of 1976 expressly preempts state law actions that are within the "general scope of copyright" and that assert claims that are "equivalent to" the rights conferred by the Act. The Act eliminated the previous system of common law copyright for unpublished works, which had prevailed under the prior 1909 Copyright Act. By federalizing copyright law, the drafters of the statute sought to achieve uniformity and to avoid the potential for state protection of infinite duration.

The legislative history of § 301 stated that this preemption provision was set forth "in the clearest and most …

Deciding Death, Corinna Barrett Lain Jan 2007

Deciding Death, Corinna Barrett Lain

Law Faculty Publications

When the Supreme Court is deciding death, how much does law matter? Scholars long have lamented the majoritarian nature of the Court's Eighth Amendment "evolving standards of decency" doctrine, but their criticism misses the mark. Majoritarian doctrine does not drive the Court's decisions in this area; majoritarian forces elsewhere do. To make my point, I first examine three sets of "evolving standards" death penalty decisions in which the Court implicitly or explicitly reversed itself, attacking the legal justification for the Court's change of position and offering an extralegal explanation for why those cases came out the way they did. I …

Mechanical Integrity And Behavior Of Thin Films And Their Applications In Mems, Gang Duan Jan 2007

Mechanical Integrity And Behavior Of Thin Films And Their Applications In Mems, Gang Duan

Doctoral Dissertations

"Electric actuated thin films are widely used in micro-electromechanical systems (MEMS) such as radio frequency switches (RF-switches), micro-pumps and valves, and electrostatic actuators. This dissertation will focus on the operation of a MEMS-RF-switch. In a typical MEMS-RF-switch, a mechanically suspended 1-D rectangular or 2-D axisymmetric thin film is pulled by an electrostatic voltage (V₀) applied to an electrode-pad directly underneath. When V₀ exceeds a certain "pull-in" threshold, V₀*, the thin film makes direct contact with the pad so that either an "on" or "off" signal is induced, and when the voltage is removed, the thin film resumes its original undeformed …

On July 24, 2001, Olaia Kastresana, a twenty-two year old woman from the Basque Country who had once dreamed of becoming a school teacher, was killed by an explosion of more than ten kilos of dynamite on the southeastern coast of Spain. Her death would undoubtedly have been more widely mourned had she not been an agent of ETA who, through either clumsiness or ignorance, accidentally detonated the bomb that she was trying to put together.1 One detail of the story that several news sources at the time could not resist reporting was that the blast, which took place in …

The Faith Of Christ, Gaye Strathearn Jan 2007

AT THE 1988 MEETING OF THE Pauline Theology Group, a debate exploded that had been slowly percolating since the time of Martin Luther.¹ The debate focused on the translation and associated theological implications of eight passages (Romans 3:22, 26; Galatians 2:16, 20; 3:22, 26; Ephesians 3:12; Philippians 3:9).² Each of these passages consists of a phrase with the Greek word pistis (“faith”) in a genitive construction with a title for Jesus.³ Paul uses seven of them in his discussions of justification, showing how a believer is “made righteous.” The eighth passage, Ephesians 3:12, uses the genitive construction to describe how …

On Computing Shannon’S Sphere Packing Bound And Applications, Mz Ahmed, Ma Ambroze, M Tomlinson

School of Engineering, Computing and Mathematics

A new method to numerically evalu- ate Shannon’s lower bound is presented in this pa- per. This new method is based on the Incomplete Beta function and permits the exact evaluation of the Sphere Packing Bound for a large range of code sizes, rates and probability of error. Comparisons with cur- rent standards (DVB–RCS, DVB–S2 and 3GPP) are also presented and discussed. It is shown that cur- rent standard coding schemes are about 0.6dB from the Shannon Limit corrected for Binary Signalling.

Nbs1 Mediates Atr-Dependent Rpa Hyperphosphorylation Following Replication-Fork Stall And Collapse, Karoline C. Manthey, Stephen Opiyo, Jason G. Glanzer, Diana Dimitrova, James Elliott, Gregory G. Oakley

Department of Agronomy and Horticulture: Faculty Publications

Post-translational phosphorylation of proteins provides a mechanism for cells to switch on or off many diverse processes, including responses to replication stress. Replication-stress-induced phosphorylation enables the rapid activation of numerous proteins involved in DNA replication, DNA repair and cell cycle checkpoints, including replication protein A (RPA). Here, we report that hydroxyurea (HU)-induced RPA phosphorylation requires both NBS1 (NBN) and NBS1 phosphorylation. Transfection of both phosphospecific and nonphosphospecific anti-NBS1 antibodies blocked hyperphosphorylation of RPA in HeLa cells. Nijmegen breakage syndrome (NBS) cells stably transfected with an empty vector or with S343A-NBS1 or S278A/S343A phospho-mutants were unable to hyperphosphorylate RPA in DNA-damage-associated …

Influence Of Planting Date And Weed Interference On Sweet Corn Growth And Development, Martin M. Williams Ii, John L. Lindquist Jan 2007

Influence Of Planting Date And Weed Interference On Sweet Corn Growth And Development, Martin M. Williams Ii, John L. Lindquist

Department of Agronomy and Horticulture: Faculty Publications

Crop planting date and canopy density influence interactions between weeds and sweet corn (Zea mays L.); however, little is known about sweet corn growth response to weed interference. Field studies were conducted in 2004 and 2005 near Urbana, IL, to quantify the influence of planting date and weed interference on growth of sweet corn height, leaf area, aboveground biomass, and phenological development. Crop growth response to weed interference (presence or absence) was determined for sweet corn planted early May (EARLY) and late June (LATE). Dominant weed species included barnyardgrass [Echinochloa crus-galli (L.) Beauv.], common lambsquarters (Chenopodium album …

Department of Agronomy and Horticulture: Faculty Publications

Roughstalk bluegrass (Poa trivialis L.) is a troublesome weed on golf courses, home lawns, and athletic fields from the Midwest to the mid-Atlantic states. Bispyribacsodium and sulfosulfuron have recently been labeled for roughstalk bluegrass control, but their use needs to be refined. Our objective was to determine the most effective herbicide strategies for control of roughstalk bluegrass. Initial studies were conducted during 2005 in Illinois and Indiana and follow-up studies in 2006 in Indiana, Illinois, South Dakota (partial shade and full sun), and Wisconsin. Applications starting in the warmer temperatures of late May and June 2005 were more effective …
