Innovation And National Economic Strategy, Andres C. Salazar Jan 2007

Innovation And National Economic Strategy, Andres C. Salazar

Electrical & Computer Engineering Faculty Publications

In the formulation of a national economic policy today the need to compete in a global knowledge economy has been recognized. The importance of the knowledge services sector now rivals that of materials and products and their associated processing, manufacturing and distribution sub-sectors. A policy component common to both knowledge services and businesses handling tangible assets is a country’s investment and support for innovation as part of a national science and technology (S &T) strategy. Innovation can play a major role in creating new business opportunities, in retaining and perhaps expanding current business dominance, and in transitioning a country’s assets …

Enhancing Diversity In An Appointive System Of Selecting Judges, Leo M. Romero Jan 2007

Enhancing Diversity In An Appointive System Of Selecting Judges, Leo M. Romero

Faculty Scholarship

Any system for selecting judges must be legitimate, and it will not be perceived as legitimate if it excludes certain members of the bar or if it makes it difficult for different groups to get its members on the bench. For an appointive system1 to be perceived as legitimate, it must ensure that diversity is considered in nominating candidates and in appointing judges. This Article will examine the different measures that states, with a particular focus on New Mexico, have adopted in order to enhance diversity in their appointive systems and then propose ways to structure an appointive system that …

Unpacking Pandora's Box: Innovative Techniques For Effectively Counseling Asylum Applicants Suffering From Post-Traumatic Stress Disorder, Carol M. Suzuki Jan 2007

Unpacking Pandora's Box: Innovative Techniques For Effectively Counseling Asylum Applicants Suffering From Post-Traumatic Stress Disorder, Carol M. Suzuki

Faculty Scholarship

Many asylum seekers are denied relief in the United States because the asylum officer or immigration judge evaluating the case does not believe the asylum applicant is telling the truth. The applicant may appear not to be credible because his story of persecution lacks sufficient detail and is inconsistent. A victim of severe and often prolonged trauma may develop post-traumatic stress disorder (PTSD), which profoundly affects his ability to tell a consistent and detailed story of past persecution. Thus, an asylum seeker suffering from PTSD as a result of traumatic experiences, desperately in need of a safe haven, may be …

Provision Of Library And Information Services To The Visually Challenged Students In University Of Ghana, Legon, Efua Mansa Ayiah Mrs

Library Philosophy and Practice (e-journal)

Visually Challenged students (VCS) in University of Ghana, Legon face various constraints in accessing library and information services. The study was based on Ranganathan’s five principles of librarianship. Literature was reviewed on provision and access to library and information services. The researcher adopted case study, since the sample size was small they were all included in the study. Descriptive data analysis technique was used to analyze data. Tables and graphs were used to display information. Findings of the study indicated that there is no program for VCS, they were aware of technological developments in information communication technologies (ICT), access to …

Quantization In Astrophysics, Brownian Motion, And Supersymmetry, Florentin Smarandache, Victor Christianto Jan 2007

Quantization In Astrophysics, Brownian Motion, And Supersymmetry, Florentin Smarandache, Victor Christianto

Branch Mathematics and Statistics Faculty and Staff Publications

The present book discusses, among other things, various quantization phenomena found in Astrophysics and some related issues including Brownian Motion. With recent discoveries of exoplanets in our galaxy and beyond, this Astrophysics quantization issue has attracted numerous discussions in the past few years. Most chapters in this book come from published papers in various peer-reviewed journals, and they cover different methods to describe quantization, including Weyl geometry, Supersymmetry, generalized Schrödinger, and Cartan torsion method. In some chapters Navier-Stokes equations are also discussed, because it is likely that this theory will remain relevant in Astrophysics and Cosmology While much of the …

A Unifying Field In Logics: Neutrosophic Logic. Neutrosophy, Neutrosophic Set, Neutrosophic Probability And Statistics - 6th Ed., Florentin Smarandache

Branch Mathematics and Statistics Faculty and Staff Publications

It was a surprise for me when in 1995 I received a manuscript from the mathematician, experimental writer and innovative painter Florentin Smarandache, especially because the treated subject was of philosophy - revealing paradoxes - and logics. He had generalized the fuzzy logic, and introduced two new concepts: a) “neutrosophy” – study of neutralities as an extension of dialectics; b) and its derivative “neutrosophic”, such as “neutrosophic logic”, “neutrosophic set”, “neutrosophic probability”, and “neutrosophic statistics” and thus opening new ways of research in four fields: philosophy, logics, set theory, and probability/statistics. It was known to me his setting up in …

Auxiliary Information And A Priori Values In Construction Of Improved Estimators, Florentin Smarandache, Rajesh Singh, Pankaj Chauhan, Nirmala Sawan

Branch Mathematics and Statistics Faculty and Staff Publications

This volume is a collection of six papers on the use of auxiliary information and a priori values in construction of improved estimators. The work included here will be of immense application for researchers and students who employ auxiliary information in any form. Below we discuss each paper: 1. Ratio estimators in simple random sampling using information on auxiliary attribute. Prior knowledge about population mean along with coefficient of variation of the population of an auxiliary variable is known to be very useful particularly when the ratio, product and regression estimators are used for estimation of population mean of a …

Experimental Investigation Of Temperature And Tool Wear In High Speed End-Milling Of Titanium Alloy, Benjamin Nwakile Oguejiofor

Masters Theses

"This thesis presents the results of experimental investigation of temperature and tool wear in high speed end-milling of titanium alloy. The investigation of cutting parameters on temperature in high speed end-milling of thin-walled titanium structure was conducted on Cincinnati Milacron Sabre 750 Vertical Machining Center using a 1/2 Fractional Factorial Design of Experiment with 3 factors at 2 levels each. Data logging of temperature data was carried out using VI logger software. Tool tip temperature at the comers and center of the pocket was estimated. All the factors investigated were found to have a significant effect on workpiece temperature. Radial …

Standardized Tests, Erroneous Scores, And Tort Liability, Vincent R. Johnson Jan 2007

Standardized Tests, Erroneous Scores, And Tort Liability, Vincent R. Johnson

Faculty Articles

Tort law offers an appropriate vehicle for handling the increased prevalence of standardized testing in the wake of the No Child Left Behind Act and the potential miss-scoring problems that arise with standardized tests. This incentivizes the use of reasonable care in scoring standardized tests and justly compensates for miss-scoring harms when doing so does not unduly burden testing agencies. Neither contract law nor the existing Truth-in-Testing law adequately affords the sort of remedies and protections the issue of standardized testing and miss-scoring pose.

The ability for tort liability to adequately hold testing agencies accountable for miss-scoring errors and afford …

Urban Law School Graduates In Large Law Firms, David Wilkins, Ronit Dinovitzer, Rishi Batra Jan 2007

Urban Law School Graduates In Large Law Firms, David Wilkins, Ronit Dinovitzer, Rishi Batra

Faculty Articles

Two major trends have dominated the American legal profession in recent years. First, "the legal profession has seen a striking growth in the largest firms during the latter part of the last century." In 1960, Shearman Sterling & Wright (now called Shearman & Sterling) was the largest firm in the country - and therefore the world. It had 125 lawyers. By the close of the century, there were more than 250 firms larger than Shearman & Sterling had been forty years before, with the largest ten topping the scales at 1000 lawyers or more. Today, in order to make the …

Categorical Exclusions From Capital Punishment: How Many Wrongs Make A Right?, Dora W. Klein Jan 2007

Categorical Exclusions From Capital Punishment: How Many Wrongs Make A Right?, Dora W. Klein

Faculty Articles

The two categorical exclusions of age and mental capacity will impact not only those offenders who are excluded from the death penalty, but also those offenders who remain subject to this punishment. The Supreme Court’s decisions in Roper v. Simmons and Atkins v. Virginia raise the issue that a capital-punishment-limiting decision possesses wrongs of its own. Both decisions limit the death penalty—Roper excludes from this punishment offenders who committed their crimes before they were eighteen years old and Atkins excludes offenders who are mentally retarded. But in both cases, the Supreme Court overstated the uniformity and universality of traits associated …

The Court Of Appeals For The Fifth Circuit: A Legal Analysis And Statistical Review Of 2005-2006 Insurance Decisions, Willy E. Rice Jan 2007

The Court Of Appeals For The Fifth Circuit: A Legal Analysis And Statistical Review Of 2005-2006 Insurance Decisions, Willy E. Rice

Faculty Articles

he Fifth Circuit Court of Appeals decided and published twenty-four insurance-related appeals between June 2005 and May 2006 from cases originating in seven federal district courts. Like petitioners in prior years, the overwhelming majority of the 2005-2006 appellants petitioned the court of appeals to reverse or vacate district courts' adverse summary judgments as well as the lower courts' allegedly questionable interpretations of various insurance contracts. Most of the controversies involved familiar procedural and substantive questions of law, but the Fifth Circuit also decided many questions of fact. Furthermore, several preemption questions and disputes over subject matter jurisdiction appeared among the …

Threading The Eye Of The Erisa Needle: Erisa Preemption And Alternative Legal Schemes To Fill The Regulatory Vacuum,, Bernard D. Reams Jr., Michael P. Forrest Jan 2007

Threading The Eye Of The Erisa Needle: Erisa Preemption And Alternative Legal Schemes To Fill The Regulatory Vacuum,, Bernard D. Reams Jr., Michael P. Forrest

Faculty Articles

Popular consensus suggests that the Employee Retirement Income Security Act (“ERISA”) is a mess, and one of historic proportions. ERISA’s comprehensive reach to protect employer-provided benefits has in practice produced unintended, if not contradictory, results.

Congress passed ERISA over thirty years ago to protect the rights of employees who benefit from employer pension and welfare benefit plans. It did so with a series of regulations that promote uniformity in litigation across the various states through “strong preemption language.” The goal of uniformity arguably benefits workers by imposing regular standards of conduct which lend predictability to the scope of litigation, or …

The Storm Between The Quiet: Tumult In The Texas Supreme Court, 1911-21, Michael S. Ariens Jan 2007

The Storm Between The Quiet: Tumult In The Texas Supreme Court, 1911-21, Michael S. Ariens

Faculty Articles

The Texas Supreme Court from 1911–1921 is best known not for the law it made or the opinions it wrote, but for its failure to decide cases. Although the supreme court’s difficulty in clearing its docket existed before 1911, the number of outstanding cases exploded during the second decade of the twentieth century.

Arguably, the issue of statewide prohibition and the divergent views held on that issue by members of the Texas Supreme Court was the driving force behind the disharmony and dysfunctionality of the court during this decade. Statewide prohibition explains why elections of candidates to the court were …

Invisible Green, Amanda Sauer Jan 2007

Invisible Green, Amanda Sauer

Theses and Dissertations

How is nature conceived today, a generation into the environmental movement? Many contemporary artists grapple with how to reconcile our inheritance of both a precarious natural world and the culture that created it. My work investigates the subtle intricacies of our relationship with nature. I use photography to develop a way of seeing that points to the often-unnoticed nature in front of us. In particular, my work recognizes and re-imagines nature's deep connections in the context of our ecologically changed world.

Beyond The Threshold: Allusions To The ÒrìsÀ In Ana Mendieta's Silueta Series, Latricia M. January Jan 2007

Beyond The Threshold: Allusions To The ÒrìsÀ In Ana Mendieta's Silueta Series, Latricia M. January

Theses and Dissertations

The Cuban-born artist Ana Mendieta (1948-1985) created the Silueta Series during the 1970s and ‘80s. It consists of earth-body works in situ featuring the silhouette of the artist's body fashioned from mud, plants, rocks, gunpowder and other materials. Underlying the creation of the Silueta Series is Mendieta's belief that the elements are sentient and powerful beings. This perception is particularly strong in the Afro-Cuban religion Santeria, a creolized form of the Òrìsà tradition of the Yoruba of West Africa introduced to the Americas during the trans-Atlantic slave trade. While scholars have noted Mendieta's incorporation of Santeria in her art, a …

Life In An Occupied City: Women In Winchester, Virginia During The Civil War, Laura Jane Ping Jan 2007

Life In An Occupied City: Women In Winchester, Virginia During The Civil War, Laura Jane Ping

Theses and Dissertations

This thesis examines the homefront experience of middle class, white women living in Winchester, Virginia during the Civil War. The experience of women in Winchester was unique because of Winchester's proximity to both the Union and Confederate capitals. Although the majority of Winchester's women were Confederate supporters a significant minority of the population remained loyal to the Union. Winchester citizens' divided status was further complicated by numerous occupations of the town by both armies. This thesis argues that in order to cope with wartime hardships women's concepts of patriotism changed as homefront morale waned. While early in the war women's …

In Search Of The Ooey Gooey Good, Lauren Ashley Clay Jan 2007

In Search Of The Ooey Gooey Good, Lauren Ashley Clay

Theses and Dissertations

This thesis explores ideas of everydayness, the mundane, and the repetitive emptiness of consumer culture. It looks at the malaise that plagues everyday life and examines several attempts throughout history to break from its grips which revolve around a search for a more ideal state. This research includes utopias of modernism, the transcendental, the communal living of Shakers and Early Christians, ascetic monks and The Desert Fathers. These ideas have shaped my studio practice as I construct installations based on worlds which allude to the eternal, the otherworldly, and the fragility of our physical world when compared to more eternal …

"Shut It Down, Open It Up": A History Of The New Left At The University Of Virginia, Charlottesville, Thomas M. Hanna

Theses and Dissertations

This thesis is a history of social and political activism in Charlottesville during the 1960s focusing on new left student organizing at the University of Virginia. It is a work of social history that establishes a community that has been generally ignored in traditional histories of the new left as one of the most influential centers of new left activism in the South and asserts that this prominence was due to years of activism by local liberals, civil rights advocates, and students during the city's unique experiences on the front lines of the southern desegregation, civil rights, and anti-war struggles. …

Roles And Attitudes Of Males And Females In The Anarchist Punk Community, Donna M. Manion Jan 2007

Roles And Attitudes Of Males And Females In The Anarchist Punk Community, Donna M. Manion

Theses and Dissertations

Sexism is a widespread social problem that exists throughout the world today. It persists within the dominant culture, as well as in various subcultures, including the punk subculture (Daugherty 2002; Leblanc 1999; McRobbie 1991; Rosenberg and Garofalo 1998). Nijole Benokraitis and Joe Feagin's (1995) theory of sexism posits that subtle sexism is the unequal and harmful treatment of women that is typically less visible than blatant sex discrimination. This particular type of sexism may often go unnoticed, as society has internalized subtle sexist behaviors. Empirical research on subtle sexism has been conducted in various settings, such as the employment, academic, …
