Citizen's Arrest Or Police Arrest? Defining The Scope Of Alaska's Delegated Citizen's Arrest Doctrine, Lael Harrison May 2007

Citizen's Arrest Or Police Arrest? Defining The Scope Of Alaska's Delegated Citizen's Arrest Doctrine, Lael Harrison

Washington Law Review

When a citizen witnesses the commission of a misdemeanor, Alaska law allows that citizen to arrest the offender on the spot. A citizen making such an arrest may request assistance from a police officer rather than physically subduing the offender alone. However, Alaska law does not clearly define how much assistance police may give before the citizen's arrest becomes a warrantless police arrest. That distinction is particularly important in misdemeanor arrests because Alaska follows the common law rule that citizens and officers may make warrantless misdemeanor arrests only for those misdemeanors committed in their presence. Officers may not make warrantless …

Return Of The Native? An Assessment Of The Citizenship Renunciation Clause In Hamdi's Settlement Agreement In The Light Of Citizenship Jurisprudence, Saad Gul May 2007

Return Of The Native? An Assessment Of The Citizenship Renunciation Clause In Hamdi's Settlement Agreement In The Light Of Citizenship Jurisprudence, Saad Gul

Northern Illinois University Law Review

The article examines the circumstances under which Yasser Hamdi, an American born detainee in the War on Terror, renounced his U.S. citizenship. The article analyzes Supreme Court jurisprudence on the loss of citizenship since Afroyim v. Rusk. Through the prism of the historically competing considerations of national security and sacrosanct nature of citizenship, it evaluates the conditions under which Hamdi undertook his action, and their effect on its legal validity. Given the factual background of the case, and the jurisprudential contours of past citizenship doctrine, it concludes that Hamdi can probably regain his citizenship should he ever seek to do …

The Challenge Of Implementing Atkins V. Virginia: How Legislatures And Courts Can Promote Accurate Assessments And Adjudications Of Mental Retardation In Death Penalty Cases, Richard J. Bonnie, Katherine Gustafson

University of Richmond Law Review

Our goal in this paper is to assist state courts and legislatures as they try to carry out the task that Atkins requires of them promoting fairness and accuracy in the assessment and adjudication of mental retardation. After addressing the definition ofmental retardation in Part I, we focus on its assessment in Parts II and III, highlighting several key requirements of a scientifi-cally and clinically adequate assessment.

Part II addresses the assessment of deficits in intellectual functioning, particularly on the measurement of intelligence as represented by an intelligence quotient. Appropriate IQ tests must be used, and the scores must be …

The Origins Of Truth And Reconciliation Commissions: South Africa, Sierra Leone, And Peru, Ashley Deminck May 2007

The Origins Of Truth And Reconciliation Commissions: South Africa, Sierra Leone, And Peru, Ashley Deminck

Sociology Honors Projects

The recent propagation of Truth and Reconciliation Commissions around the world marks the beginning of a shift from retribution and war tribunals to reconciliation and restorative justice. What factors have lead to this remarkable transition? This study looks to answer this question by employing a comparative-historical research method to examine recent TRCs in South Africa, Sierra Leone, and Peru. Grounding this research in popular theories of state policy making, this study looks to distill the influence of both international and domestic actors on the state’s creation of a TRC. The research demonstrates the varied influence of both international actors, who …

Blocks & Robbers: An Analysis Of The Frequency Of Robbery On Public Housing Blocks And On Blocks Adjacent To Public Housing Blocks In Omaha, Nebraska, Liddie M. Thompson

Student Work

This research replicates the earlier work of Roncek, Bell, and Francik (1981) that found public housing blocks in Cleveland, Ohio had higher index crime rates than non-public housing blocks and that these blocks affected crime rates of blocks throughout the entire city. The current thesis utilizes t-tests for differences of means and regression analysis to determine whether similar results can be found in Omaha, Nebraska with respect to the crime of robbery. The research is framed within the social disorganization perspective and the routine activities theory. The findings indicate public housing blocks in Omaha have higher incidences of robbery than …

Experiences Of Women War-Torture Survivors In Uganda: Implications For Health And Human Rights, Helen Liebling-Kalifani, Angela Marshall, Ruth Ojiambo-Ochieng, Nassozi Margaret Kakembo

Journal of International Women's Studies

This paper will describe the resulting long-term health needs of women war-torture survivors of the civil war years in Luwero District, Uganda. To do this sections of case studies from interviews carried out in Kikamulo Sub-County, Luwero, are utilised. The effects of gender-based violence and torture and its long term, severe and enduring impact on women’s health will be highlighted. In 1994, the Centre for Health and Human rights at Harvard University led the first international conference on health and human rights. This recognised that human rights are an essential pre-condition for physical and mental health. Women’s resulting health needs …

Foreword, Shanish M. Aloor May 2007

Foreword, Shanish M. Aloor

San Diego International Law Journal

The impact of international law has reached past foreign policy and has now extended into every part of U.S. government. Our last issue emphasized the increasing importance of globalization on domestic issues such as national elections. In the past decade, international laws have had a practical effect upon the interpretation of United States domestic law. Influential jurists such as former Justice Sandra Day O'Connor have expressed "that with time [the judiciary] will rely increasingly on international and foreign law in resolving what now appear to be domestic issues, as we both appreciate more fully the ways in which domestic issues …

Retrying The Acquitted In England, Part I: The Exception To The Rule Against Double Jeopardy For New And Compelling Evidence, David S. Rudstein May 2007

Retrying The Acquitted In England, Part I: The Exception To The Rule Against Double Jeopardy For New And Compelling Evidence, David S. Rudstein

San Diego International Law Journal

More than 240 years ago, Sir William Blackstone, perhaps the most important commentator on the English common law, wrote that when a man is once fairly found not guilty upon any indictment, or other prosecution, before any court having competent jurisdiction of the offence, he may plead such acquittal in bar of any subsequent accusation for the same crime. This plea of autrefois acquit (a former acquittal), Blackstone explained, is based upon the principle that no man is to be brought into jeopardy of his life, more than once for the same offence, which he called a universal maxim of …

Indexing Techniques For Fingerprint And Iris Databases, Rajiv Mukherjee May 2007

Indexing Techniques For Fingerprint And Iris Databases, Rajiv Mukherjee

Graduate Theses, Dissertations, and Problem Reports (ETD)

This thesis addresses the problem of biometric indexing in the context of fingerprint and iris databases. In large scale authentication system, the goal is to determine the identity of a subject from a large set of identities. Indexing is a technique to reduce the number of candidate identities to be considered by the identification algorithm. The fingerprint indexing technique (for closed set identification) proposed in this thesis is based on a combination of minutiae and ridge features. Experiments conducted on the FVC2002 and FVC2004 databases indicate that the inclusion of ridge features aids in enhancing indexing performance. The thesis also …

One Stop, No Stop, Two Stop, Terry Stop: Reasonable Suspicion And Pseudoephedrine Purchases By Suspected Methamphetamine Manufacturers, Andrew C. Goetz May 2007

One Stop, No Stop, Two Stop, Terry Stop: Reasonable Suspicion And Pseudoephedrine Purchases By Suspected Methamphetamine Manufacturers, Andrew C. Goetz

Michigan Law Review

This Note attempts to inject some clarity into courts' reasonable suspicion calculus for cold medicine purchases. It argues that the key factor in analyzing such purchases is whether the purchaser or purchasers appear to be circumventing pseudoephedrine purchasing restrictions in order to obtain inordinately large quantities of pseudoephedrine. Part I provides a general background on the domestic manufacture of methamphetamine in small, clandestine laboratories. Part II then examines the interplay between outward innocence and reasonable suspicion under the Supreme Court's Fourth Amendment jurisprudence. Finally, Part III establishes a framework for identifying purchasing strategies that methamphetamine manufacturers commonly use to circumvent …
