Particularisation Of Child Abuse Offences: Common Problems When Questioning Child Witnesses, Martine B. Powell, Kim P. Roberts, Belinda Guadagno Jul 2007

Particularisation Of Child Abuse Offences: Common Problems When Questioning Child Witnesses, Martine B. Powell, Kim P. Roberts, Belinda Guadagno

Psychology Faculty Publications

Prosecuting child abusers is often difficult due to lack of particularising details. Two possible ways of addressing this difficulty are: (a) to change the justice system to better serve prosecution for repeated offences (i.e., allow generic testimony), and (b) to bolster children's testimony. As this article has illustrated, there is still considerable potential for increasing (b). Given the low prosecution rates of child abuse offences, the need for exceptional interviewer training programs coupled with resources for ongoing supervision is now critical. While there have been some major improvements in child witness investigative interviews over the past two decades, there are …

Immigrants’ Experiences In America: Toward Understanding Organized Crime, Charles B.A. Ubah Jul 2007

Immigrants’ Experiences In America: Toward Understanding Organized Crime, Charles B.A. Ubah

African Journal of Criminology and Justice Studies

Using the emergence of Sicilian Mafia in the United States of America as the focal condition, this article investigates why the emergence of organized crime in the United State of America is widely misunderstood. The author aims to provide a renewed theoretical analysis of the social problem. Central to this analysis are two contradictory perspectives on the emergence of organized crime in the United State of America. These perspectives are: a) an importation model, and b) a deprivation model. Unlike most studies on the subject, this article raises important, but previously undiscussed questions, makes greater efforts to address the questions, …

Criminology & Criminal Justice Theses - Archive

The purpose of this study is to examine perception and knowledge of Criminology/Criminal Justice and Political Science majors. University of Texas at Arlington students were asked to identify scenarios related to actions taken by both Palestinians and Israelis as they pertain to terrorism. The data in this study were obtained from a sample of UTA students enrolled in both Criminology/Criminal Justice and Political Science courses. These findings revealed that both CRCJ and Political Science respondents share a similar propensity towards identifying terrorist acts. Additionally, the findings revealed a general lack of knowledge and familiarity with the Palestinian-Israeli conflict and an …

Illegal Immigrants And Crime: A Perception Study Through The Lenses Of Majority And Minority Criminology/Criminal Justice Students, Robyn D'Amberly Rivera

Criminology & Criminal Justice Theses - Archive

The purpose of this study is to examine the perceptions and attitudes of CRCJ majority (White/Caucasian) college students and minority (Black, Mexican American/Hispanic, American Indian, Asian/Pacific Islander or Other) towards illegal immigrants and crime in the United States. An administered survey was given to criminology/criminal justice university students that surveyed their perception and knowledge of illegal immigration and their impression on whether illegal immigration and crime are correlated. It is anticipated that the students' overall answers to the survey will show that they do not perceive that illegal immigration is related to crime in the United States.

Privacy Versus Antidiscrimination, Lior Strahilevitz Jul 2007

Privacy Versus Antidiscrimination, Lior Strahilevitz

Coase-Sandor Institute for Law & Economics Research Paper Series

This essay argues that there is often an essential conflict between information privacy protections and antidiscrimination principles. Where information privacy law or practical obscurity deprives an employer of pertinent information about a job applicant, the employer often will rely more heavily on distasteful statistical discrimination strategies. For example, the existing empirical evidence suggests that criminal background checks may benefit African American male job applicants as a whole, by permitting employers to sort among ex-cons and those lacking criminal records. In the absence of accurate criminal history information, employers concerned about keeping ex-offenders out of their workplace appear to hire too …

Asset Mapping: Community Geography Project

Making community development as democratic as possible has long been a challenge for urban planners and municipalities alike. A number of obstacles stand in the way of greater community participation in the planning process and consequently communities who are best served by their design. Visual Preference Surveys (VPS) are a tool planners can use to increase participation in the design process within the communities they serve. This can result in community plans that more accurately reflect the wants or needs of its members. Relying heavily on image driven content, VPS offers communities a straightforward methodology that asks participants to rate …

Kansas V. Marsh: A Thumb On The Scale Of Death?, Elizabeth Brandenburg Jul 2007

Kansas V. Marsh: A Thumb On The Scale Of Death?, Elizabeth Brandenburg

Mercer Law Review

In Kansas v. Marsh, the United States Supreme Court held that it is not unconstitutional for a state's death penalty statute to require a death sentence when a sentencing jury finds aggravating and mitigating factors to be in equipoise. Extending its previous decision in Walton v. Arizona, the Court explicitly determined that this type of sentencing met the requirements of Furman v. Georgia and Gregg v. Georgia, holding that no other constraint is imposed by the Constitution. While the repercussions of this decision may not be widely felt, they do indicate the direction the Court is heading …
