An Agument For Original Intent: Restoring Rule 801 (D) (1) (A) To Protect Domestic Violence Victims In A Post-Crawford World., Andrew King-Ries

Prosecution of domestic violence is extremely difficult, largely due to the fact that defendants are successfully pressuring victims to refuse to testify or to recant their testimony at trial. With its decision in Crawford, the Supreme Court eliminated the ability of prosecutors to use hearsay exceptions to place the domestic violence victim's statements before the jury for their substantive consideration. The Supreme Court also closed this avenue to combat defendants' efforts to avoid liability through coercive pressure on victims. Therefore, the Court's change in the Confrontation Clause law limits the prosecution's arsenal for combating witness intimidation and, at the same …

Politics And The Glass Ceiling In American Law Enforcement: Why Not More Women Chiefs Of Police?, Madeline G. Meistrich Edd

Law enforcement is one of the last male-dominated occupations. Out of 18,000 police departments in the United States, only 200 to 250 have women chiefs. Such under-representation reflects the "glass ceiling" effect of a gender-based metaphorical barrier that prevents women from rising to the top of an organization, regardless of qualifications. The research examined three questions: what are the issues and problems articulated by women officers attempting to move upwards; what strategies were employed as they attempted to advance; and what strategies could help other women reach the top? The purpose of this study was to examine the leadership practices of high school principals and parental involvement and to examine to what extent those practices differed between principals and how they related to parental involvement. The study revealed major issues surrounding parental involvement such as how principals defined parental involvement, how principals communicated the importance of parental involvement; what parental involvement activities impact student achievement; what common leadership practices influenced parental involvement; and what are some common experiences of high school principals regarding parental involvement. It seems improbable that the theoretical and doctrinal framework of criminal procedure, developed mostly through a binary model of the individual and the state, would fit without modification in the tripartite model of the state, the firm, and the individual that characterizes the investigation and sanctioning of criminal conduct within legal entities. This intuition—which has been underexplored in spite of heated public debate about the state’s practices in this area—proves correct. I develop some components of a framework for understanding procedure for individual cases of criminal wrongdoing within firms and generating insights to guide reform. Despite evidence suggesting that the numbers of women in correctional institutions is increasing (U.S. Department of Justice, 1999) and that over 2/3 of women released from prison will return (U.S. Department of Justice, 2002), few studies have examined the influence of various risk and resiliency factors in predicting recidivism rates among incarcerated women. Data for the current study were collected from 234 incarcerated women serving in a northeastern state correctional facility between 1997 and 1999 as part of a larger project examining the discharge planning process (see Quina, 2001). The focus of this project was on the development of a software tool for analysis of crime data at the West Virginia State Police Forensics Laboratory (WVSPFL). The tool enables users to conduct statistical analysis on criminal activity; in addition, data mining methods are implemented to identify possible crime patterns. A Crime database was implemented; it contains information on incidents submitted to WVSPFL over the last fifteen years. The WVSPFL database was integrated with a hypothetical conviction database. Such integration enables law enforcement agencies to track crime from occurrences to conviction. It is anticipated that data mining methods will assist …

An Emerging International Criminal Law Tradition: Gaps In Applicable Law And Transnational Common Laws, Benjamin Perrin

This thesis critically examines the origins and development of international criminal lave to identify the defining features of this emerging legal tradition. It critically evaluates the experimental approach taken in Article 21 of the Rome Statute of the International Criminal Court, which attempts to codify an untested normative super-structure to guide this legal tradition. International criminal law is a hybrid tradition which seeks legitimacy and answers to difficult questions by drawing on other established legal traditions. Its development at the confluence of public international law, international humanitarian law, international human rights law and national criminal laws has resulted in gaps …

The current study was a chart review that examined 31 female sex offenders (FSO), 31 male sex offenders (MSO), 31 female violent offenders (FO), and 31 male violent offenders (MO) using a 2 (female/male) by 2 (sex/violent offender) design. This is the first study to include three comparison groups when researching female sex offenders. Several variables appeared to relate to gender. Having a co-perpetrator during the crime and being a passive participant in the crime was related to being a female. There was a main effect of gender on the Social Introversion Scale of the MMPI-2 indicating that the male …

Diversity and Teamwork are currently some of the trendiest human resources strategies of boosting team performance and ultimately, organizational performance. This study analyzes the impact of gender, racial, age and employment status diversity on teamwork, and is one of the first studies on diversity and teamwork in the mature phase of Japanese transplants. The theoretical framework includes elements of the symbolic interactionist theory, Kanter.s theory on tokenism, revised contact hypothesis and perspectives on cultural diversity (Ely and Thomas, 2001). This Article addresses four questions:
Why hasn't the Court left capital punishment unregulated, as it has other areas of substantive criminal law? The Court is compelled to decide the death penalty's constitutionality by the peculiar responsibility it bears for this form of state violence.
Why didn't the Court abolish the death penalty in Furman v. Georgia after finding every capital statute and verdict unconstitutional? The Cruel and Unusual Punishment Clause was too opaque to reveal whether the death penalty was unlawful for some or all crimes and, if not, whether there were law-bound ways to administer it. China's Internet revolution has set off a furious debate in the West. Optimists from Thomas Friedman to Bill Clinton have predicted the crumbling of the Chinese Party-state ("Party-state"), while pessimists suggest even greater state control. But a far less discussed and researched subject is the effect of China's Internet revolution on its domestic institutions. This Article, the product of extensive interviews across China, asks a new and different question. What has China's Internet revolution meant for its legal system? What does cheaper, if not free, speech mean for Chinese judges?

What effect has Professor Henkin's work had upon your own thoughts or scholarship in the human rights field?
My scholarly work spans the fields of international human rights and U.S. foreign relations law. I am particularly interested in the process by which human rights norms are implemented into domestic legal systems, the role the United States plays in promoting the internalization of human rights norms by other states, and the mechanisms by which the values of the international human rights regime are incorporated into the United States domestic legal system.

From parole prediction instruments and violent sexual predator scores to racial profiling on the highways, instruments to predict future dangerousness, drug-courier profiles, and IRS computer algorithms to detect tax evaders, the rise of actuarial methods in the field of crime and punishment presents a number of challenging issues at the intersection of economic theory, sociology, history, race studies, criminology, social theory, and law. Risk And Protective Factors For Drug Use Among Polydrug-Using Urban Youth And Young Adults, Gary J. Burkholder, Jean J. Schensul, Raul Pino

The purpose of the study was to examine the influence of traditional risk and protective factors for drug use on six different popular drugs on a population that is primarily Black and Latino between the ages of 16 and 24. Multiple regression analysis was used to test the relative importance of risk and protective indexes, and their interaction, in predicting drug use. Findings suggested: (a) traditional risk and protective factors, as well as situationally specific factors such as gang involvement, predicted drug use; and
(b) the relative contribution of risk and protective factors toward explained variances differs substantially among the …
