Accuracy Assessment Of Individually Calibrated Journey-To-Crime Geographic Profiling Models, Tania Pal
Accuracy Assessment Of Individually Calibrated Journey-To-Crime Geographic Profiling Models, Tania Pal
LSU Master's Theses
Technological advances are fundamental to the development of spatial analysis tools and methodologies available and used within the criminal investigative process. This research focuses on one such methodology for serial crime analysis: Journey-to-Crime (JTC) Geographic Profiling (GP). JTC or the study of the travel behavior between an offender’s residence to and from the crime scene has been a subject of study within criminology for many years. GP, based on such travel behavior, is a spatial analysis and decision support tool that is used by law enforcement agencies to determine or predict the likely location of a serial offender’s residence or …

"I Ain't Takin' No Plea": The Challenges In Counseling Young People Facing Serious Time, Abbe Smith
"I Ain't Takin' No Plea": The Challenges In Counseling Young People Facing Serious Time, Abbe Smith
Georgetown Law Faculty Publications and Other Works
Criminal defendants daily entrust their liberty to the skill of their lawyers. The consequences of the lawyer’s decisions fall squarely upon the defendant. There is nothing untoward in this circumstance. To the contrary, the lawyer as the defendant’s representative is at the core of our adversary process.
As practicing lawyers know, interviewing and counseling are at the heart of legal representation. This is what lawyers do, even trial lawyers: we talk with and advise clients. As criminal lawyers know, the decision whether to go to trial is “the most important single decision” a client faces, and requires wise counsel. …

Does Stare Decisis Apply In The Eighth Amendment Death Penalty Context, Meghan J. Ryan
Does Stare Decisis Apply In The Eighth Amendment Death Penalty Context, Meghan J. Ryan
Faculty Journal Articles and Book Chapters
Throughout the past few decades, the Supreme Court has steadily chipped away at the death penalty. It was only recently, however, that courts have confronted what role precedent plays in the Eighth Amendment death penalty context. Surprisingly, few scholars have yet explored this important and complicated issue. Precedent in this area is unique because the law of the Eighth Amendment is always changing and the Eighth Amendment has been interpreted to be applied more broadly in the death penalty context. This Article argues that precedent in the Eighth Amendment death penalty context does not apply in the typical fashion. Instead …

Merging Task-Centered Social Work And Motivational Interviewing In Outpatient Medication Assisted Substance Abuse Treatment: Model Development For Social Work Practice, Andreas Fassler
Theses and Dissertations
To advance social work practice and decrease the research practice gap, this dissertation followed a model development paradigm consisting of several phases. Based on the task-centered model of social work practice and motivational interviewing, a new combined model was construed. The two underlying models were analyzed and synthesized, using technical eclecticism as the integrative approach. The resulting combined model was described by guidelines and manualized. To test the combined model in an applied setting, a study was designed in collaboration with social workers at a substance abuse counseling center. There, the combined model intervention was implemented in an outpatient medication …

The Influence Of Childhood Factors On The Public Perceptions Of The Appropriate Consequences For Young Offender, Penny Hyde
Theses : Honours
With changes in policy relating to juvenile offenders being heavily influenced by the perceived public opinion of juvenile crime, the opinion of the public on the appropriate punishment for young offenders is important within contemporary society (Mukherjee, 1997). Public opinion research suggested that while society remains unsatisfied with current methods used to punish juvenile offenders, they believe a juvenile's punishment should be proportionate to the crime and that rehabilitation should be the main goal of juvenile punishment (Barber & Doon, 2004). This research further suggested that ignorance of both the juvenile's circumstances and the perceived prevalence of juvenile crime may …
Functional Neuroimaging And The Law: Trends And Directions For Future Scholarship, Stacey A. Tovino
Functional Neuroimaging And The Law: Trends And Directions For Future Scholarship, Stacey A. Tovino
Faculty Articles
Under the umbrella of the burgeoning neurotransdisciplines, scholars are using the principles and research methodologies of their primary and secondary fields to examine developments in neuroimaging, neuromodulation, and psychopharmacology. The path for advanced scholarship at the intersection of law and neuroscience may clear if work across the disciplines is collected and reviewed and outstanding and debated issues are identified and clarified. In this article, I organize, examine and refine a narrow class of burgeoning neurotransdiscipline scholarship; that is, scholarship at the interface of law and functional magnetic resonance imaging.

The Evolution Of Internet Legal Regulation In Addressing Crime And Terrorism, Murdoch Watney
The Evolution Of Internet Legal Regulation In Addressing Crime And Terrorism, Murdoch Watney
Journal of Digital Forensics, Security and Law
Internet regulation has evolved from self-regulation to the criminalization of conduct to state control of information available, accessed and submitted. Criticism has been leveled at the different forms of state control and the methods employed to enforce state control. After the terrorist attack on the USA on 11 September 2001, governments justify Internet state control as a law enforcement and national security tool against the abuse and misuse of the Internet for the commission of serious crimes, such as phishing, child pornography; terrorism and copyright infringement. Some Internet users and civil rights groups perceive state control as an abomination which …

An Analysis Of Gender Differences In Property Crime Arrest Rates, Chanika Renee Jones
An Analysis Of Gender Differences In Property Crime Arrest Rates, Chanika Renee Jones
LSU Doctoral Dissertations
This dissertation examined the relationship between employment conditions and property-crime arrest rates of working-aged individuals, using gender-specific state-level data from 1979-2001, complied from raw arrest data of the FBI's Uniform Crime Reports and the Census Bureau's annual March Current Population Survey. These data were analyzed using Ordinary Least Squares Regression. The data was disaggregated by gender and underemployment indicators such as percent unemployed, percent subunemployed, percent low wages, and percent low hours, were utilized to test the unemployment-crime relationship. Controls for race, age, and region were also included in this analysis, as they may influence the U-C relationship. The analysis …

Solving The ‘Initiatory Construction’ Puzzle (And Improving Direct Democracy) By Appropriate Refocusing On Sponsor Intent, Glenn Smith
Faculty Scholarship
This Article synthesizes and critiques a dozen years of scholarship about judicial construction of legislation passed by voter initiative. The Article then makes a comprehensive case for an alternative approach: an appropriately enhanced focus on the intent of initiative sponsors. More specifically, the Article validates, through analysis of recent California decisions, a longstanding scholarly consensus that the prevailing judicial search for "the intent of the voters" is seriously flawed. The Article provides the first synthesis to date of reform proposals offered by "initiatory-construction" scholars; the discussion contends that these proposals collectively fail four key evaluation criteria. Building on the 2003 …

Contributions Of Meaning By Service Professionals To The Phenomenon Of The Experience Of Coping For Women In The Spectrum Of Domestic Violence Abuse: A Leadership Perspective, Lisa Haeseler
Electronic Theses and Dissertations
Domestic violence abuse for women continues to be an urgent concern in American society. This perpetual problem has resulted in revitalization in improving delivery of care for women of abuse. Especially for service professionals who directly aid and council the women in the spectrum of abuse including whether they stay in, or leave, the leadership initiatives, perspectives, and unique leadership style approaches of service providers for enhancing services become vital. This qualitative, phenomenological case study of eight, non-abused service professionals working in four different agencies investigated the phenomenon of the experience of coping in the spectrum of domestic violence abuse …
The Physics Of Fourth Amendment Privacy Rights, Omar Saleem
The Physics Of Fourth Amendment Privacy Rights, Omar Saleem
Journal Publications
Einstein's esteem for theoretical physics and Dostoyevsky serve as a conduit for this article's discussion about the similarities between the evolution of theoretical physics and the criminal process related to Fourth Amendment privacy rights. Part I of this Article demonstrates that law and science share traits of rationality, a quest for universality, and theoretical evolution. Part II traces the parallel paths of Fourth Amendment privacy rights and theoretical physics. Part III illustrates the radical alterations in theoretical physics created by Einstein's relativity discoveries and the radical alterations in Fourth Amendment privacy rights created by the U.S. Supreme Court's decision in …

Cultural Convergence: Interest Convergence Theory Meets The Cultural Defense, Cynthia Lee
Cultural Convergence: Interest Convergence Theory Meets The Cultural Defense, Cynthia Lee
GW Law Faculty Publications & Other Works
Much has been written about the so-called cultural defense or, more accurately, the proffer of cultural evidence by a criminal defendant seeking to mitigate a charge or sentence. Many scholars support the admission of cultural evidence, but argue it should be limited to cases where such evidence is used to negate the mens rea element of the charged offense. Others feel that the admission of cultural evidence violates the principle of equal protection and favors immigrant and minority defendants over American defendants, and therefore the practice should be sharply circumscribed. Recently, a few legal scholars have issued calls for recognition …
Representation In Kenya, Its Diaspora, And Academia: Colonial Legacies In Constructions Of Knowledge About Kenya's Coast, Jesse Benjamin
Representation In Kenya, Its Diaspora, And Academia: Colonial Legacies In Constructions Of Knowledge About Kenya's Coast, Jesse Benjamin
Faculty Articles
This paper explores the construction of knowledge in Kenya in the context and aftermath of colonialism and underdevelopment. Those communities that were politically and economically marginalized in Coast Province over the past century were also displaced in terms of academic opportunities, resulting in fewer social science scholars from Mijikenda and other non-Swahili communities in both Kenyan and diaspora universities. Underdevelopment studies in Africa and Kenya are briefly reviewed, and the colonial history of asymmetric social relations at coastal Kenya is traced. Finally, key debates over identity and history are examined within this context and shown to be exacerbated by diasporic …
