Analyzing The Impact Of Coercion On Domestic Violence Victims: How Much Is Too Much?, Tamara L. Kuennen

Sturm College of Law: Faculty Scholarship

Part I of the essay reviews the work of activists and scholars who make the case that coercion is central to domestic violence, but notes that these scholars' conceptions of coercion are diverse. Part II describes the justice system's current responses to the impact of coercion on a victim's decision to drop a criminal or civil case. Part III exposes a number of challenges inherent in measuring the impact of a batterer's influence on a domestic violence victim's decision. Part IV describes the conceptual limitations of current judicial guidelines, and argues for a more nuanced conceptualization of coercion that accounts …

Death Is Not Different: The Transfer Of Juvenile Offenders To Adult Criminal Courts, Christopher A. Mallett

Social Work Faculty Publications

The US Supreme Court first reviewed a state's statutory procedure for juvenile transfer to adult criminal courts in Kent v. US 1 Morris Kent was a fourteen-year-old first convicted for purse snatching and house-breaking, placed on probation, and later charged at the age of sixteen with robbery and rape. 2 Kent was arrested, presumably admitted to involvement in these crimes after seven hours of interrogation, and placed in a receiving home for one week.

The Domestic Violence Experiences Of Women In Community Corrections, Rachel Bridges Whaley, Angela M. Moe, Mark Eddy, Jean Daugherty Jan 2007

The Domestic Violence Experiences Of Women In Community Corrections, Rachel Bridges Whaley, Angela M. Moe, Mark Eddy, Jean Daugherty

Sociology Faculty Publications

A variety of studies indicate high rates of domestic violence in the backgrounds of women offenders. We examine and extend this work through a qualitative study of women on probation or parole in a western U.S. county. In-depth interviews were conducted with 14 women who participated in a larger study in which only questionnaire data were collected. Participants completed a brief telephone interview about prior experiences of partner violence and then a face-to-face extensive in-person interview. In the analyses, several notable themes emerged regarding the women’s histories of child victimization, partner abuse, substance abuse, coercion into crime, and a lack …

A Psychological And Behavioral Analysis Of Child Sex Offenders: The Use Of Expert Search Warrants In The Criminal Investigation Of Acquaintance Molestation: The Use Of Expert Search Warrants In The Criminal Investigation Of Acquaintance Molestation, Joseph M. Deangelo

Regis University Student Publications (comprehensive collection)

The Use of Expert Search Warrants in the Criminal Investigation of Acquaintance Molestation Child sexual abuse is a critical social problem throughout the U.S. and the world. Often, a competent and thorough investigation can substantiate or discredit an allegation and notably support a subsequent prosecution of a substantiated case. A manual was created to assist law enforcement detectives who investigate allegations of child sex abuse. The investigative process includes: (a) forensic interviews of child victims, (b) collection of corroborative evidence, (c) analysis of offender characteristics and typologies, (d) offender interviews, and (e) search warrants to include expert search warrants.

Beneath The Surface: Juvenile Adjudication Disparity In A Rural County, Steven Patrick, Robert Marsh Jan 2007

Beneath The Surface: Juvenile Adjudication Disparity In A Rural County, Steven Patrick, Robert Marsh

Sociology Faculty Publications and Presentations

A rural county with a high Hispanic population showed small disproportionate minority contact (citation or arrest) in initial analysis of federally required Disproportionate Minority Confinement studies but closer examination of a random sample of all juveniles arrested in 2000 showed that a subtle but significant disparity still existed when a more detailed examination was conducted. While overt discrimination did not appear to be extreme, stereotypes still negatively influenced Hispanic/Law Enforcement relations at various levels and Hispanics were still over represented in contacts and confinement. Three areas were examined that may explain/inform these lingering disparity issues: Cultural, Economic and Structural factors.

A Case Study Of Disproportionality In Special Education: Inquiry In An Urban School District, Charlotte D. Ivey Jan 2007

A Case Study Of Disproportionality In Special Education: Inquiry In An Urban School District, Charlotte D. Ivey

ETD Archive

This case study examines the problem of disproportionality in special education in an urban school district in Northeast Ohio. Disproportionality occurs when the risk for being identified in a particular disability category is not proportional to the population being considered. The problem of disproportionate representation of racial groups in certain categories of special education is significant because it is only seen in the "judgemental" categories. That is, categories such as ED and SLD, where the determination for eligibility is subjective and based on professional judgement and inference, as opposed to non-judgemental categories such as OHI, blindness, deaf, orthapaedic and TBI, …

Attorney General’S Annual Report To Congress On U.S. Government Activities To Combat Trafficking In Persons Fiscal Year 2006, U. S. Department Of Justice

Human Trafficking: Data and Documents

Trafficking in persons (TIP), or human trafficking, is a regrettably widespread form of modern-day slavery. Traffickers often prey on individuals, predominantly women and children in certain countries, who are poor, frequently unemployed or underemployed, and who may lack access to social safety nets. Victims are often lured with false promises of good jobs and better lives, and then forced to work under brutal and inhuman conditions. It is difficult to accurately estimate the extent of victimization in this crime whose perpetrators go to great lengths to keep it hidden. Nonetheless, the United States has led the world in the fight …

Routine Crime In Exceptional Times: The Impact Of The 2002 Winter Olympics On Citizen Demand For Police Services, Scott H. Decker, Sean P. Varano, Jack R. Greene Jan 2007

Routine Crime In Exceptional Times: The Impact Of The 2002 Winter Olympics On Citizen Demand For Police Services, Scott H. Decker, Sean P. Varano, Jack R. Greene

Justice Studies Faculty Publications

Despite their rich theoretical and practical importance, criminologists have paid scant attention to the patterns of crime and the responses to crime during exceptional events. Throughout the world large-scale political, social, economic, cultural, and sporting events have become commonplace. Natural disasters such as blackouts, hurricanes, tornadoes, and tsunamis present similar opportunities. Such events often tax the capacities of jurisdictions to provide safety and security in response to the exceptional event, as well as to meet the “routine” public safety needs. This article examines “routine” crime as measured by calls for police service, official crime reports, and police arrests in Salt …

Gangs, Guns, And Drugs: Recidivism Among Serious, Young Offenders, Beth M. Huebner, Sean P. Varano, Timothy S. Bynum Jan 2007

Gangs, Guns, And Drugs: Recidivism Among Serious, Young Offenders, Beth M. Huebner, Sean P. Varano, Timothy S. Bynum

Justice Studies Faculty Publications

The primary goal of this study is to understand the factors that best explain recidivism among a sample of 322 young men aged 17 to 24 years released from prison in a Midwestern state. Specific attention is paid to the predictive validity of gang membership, gun use, and drug dependence on the timing of reconviction and the current research on desistance frames the analyses. Results from a series of proportional hazard models indicate that race, gang membership, drug dependence, and institutional behavior are critical factors in predicting the timing of reconviction. Contrary to expectations, gun use was not related to …
