Elder Research: Filling An Important Gap In Psychology And Law, Eve M. Brank
Elder Research: Filling An Important Gap In Psychology And Law, Eve M. Brank
Department of Psychology: Faculty Publications
In the past few decades, psychology-law as a discipline has made great strides in understanding and guiding public policies on issues related to eyewitnesses, confessions, juries, judges, juveniles, the mentally ill, and many others. As a field, we have largely neglected the oldest subset of the population, with only a few scholars focusing specifically on elder issues or systematically including elders in their studies. The current article is a call to research. It first outlines why elders should be considered as a specific subset of the population even though they have not been an area of focus in the field. …

The Hague Convention On The Civil Aspects Of International Childhood Abduction: Where Are We, And Where Do We Go From Here, Dan Beth Finkey
The Hague Convention On The Civil Aspects Of International Childhood Abduction: Where Are We, And Where Do We Go From Here, Dan Beth Finkey
UC Law SF International Law Review
Each year, hundreds innocent children are abducted from their homes and taken to foreign countries - victims of international parental abduction. In 1980, the U.N. developed The Hague Convention on Civil Aspects of International Childhood Abduction in order to protect children from wrongful international abduction, and to ensure that abducted children are safely returned to their homes. Although scholars laud the Convention as being generally effective, perverse results sometimes arise in the U.S., where courts are struggling to interpret the Convention's provisions so that they do not harm victims of domestic violence. This note suggests a novel way to improve …

Reliability Lost, False Confessions Discovered, Mark A. Godsey
Faculty Articles and Other Publications
The advent of post-conviction DNA testing in the past twenty years has spawned an Innocence Revolution, in which hundreds of Americans imprisoned or on death row for serious crimes like murder and rape have been conclusively proven innocent and released. From studying the cases of wrongful convictions, we now know that eyewitness identification is not nearly as reliable as once believed. We also know that hundreds of innocent people have been convicted through the use of junk science, such as bite mark analysis or microscopic hair comparison, which DNA testing has proven to be wildly inaccurate. Most importantly for my …
Testing Deterrence Theory With Offenders: Assessing The Effects Of Personal And Vicarious Experience With Punishment And Punishm, Alicia Sitren
Testing Deterrence Theory With Offenders: Assessing The Effects Of Personal And Vicarious Experience With Punishment And Punishm, Alicia Sitren
Electronic Theses and Dissertations
Stafford and Warr (1993) reconceptualized general and specific deterrence into a single theory in which individuals' propensities to engage in criminal behavior are based on some combination of personal experiences with being punished and avoiding punishment and vicarious (or indirect) experiences with being punished and avoiding punishment. The researchers make a substantial contribution to the deterrence literature by accounting for the effect of punishment avoidance when assessing deterrence theory. Despite the theoretical appeal of this restatement, few studies have tested its empirical merit. The current study tests the applicability of Stafford and Warr's model but also addresses several key limitations …

Granny, (Don’T) Get Your Gun: Competency Issues In Gun Ownership By Older Adults, Edith Greene, Brian H. Bornstein, Hannah Dietrich
Department of Psychology: Faculty Publications
This article explores the possible risks associated with gun ownership by older adults. We summarize existing regulations on who may own firearms, especially with respect to age. We then present data on older gun owners and violence committed by older adults in general, followed by a discussion of gun violence perpetrated by gun owners whose functional and cognitive abilities have declined, perhaps as a result of dementia. For comparison purposes, we review regulations on driving among older adults, drawing parallels to gun ownership. The paper concludes with recommendations for ensuring the safety of older gun owners and others, balanced against …

The Life And Times Of Young People On Remand: Recommendations For Future Policy In Ireland, Sinead Freeman
The Life And Times Of Young People On Remand: Recommendations For Future Policy In Ireland, Sinead Freeman
Conference papers
The remand population of children and young people continues to rise in Ireland. Despite this growth, little is known about their experiences on remand. This paper focuses on such experiences from the perspective of the young prisoners. It is based on 62 semi-structured interviews conducted with young males and females aged 16 to 21 years on remand in St. Patrick’s Institution, Cloverhill Remand Prison and the Dόchas Centre, Mountjoy Prison. The paper highlights how young people who have yet to be found guilty are frequently detained for long periods in prison and are exposed to punitive conditions. The findings have …
