Protecting The Least Of These: A New Approach To Child Pornography Pandering Provisions, Stephen T. Fairchild Oct 2007

Protecting The Least Of These: A New Approach To Child Pornography Pandering Provisions, Stephen T. Fairchild

Duke Law Journal

The pandering of child pornography - selling, distributing, or conveying the impression that one possesses sexually graphic images of children for sale or distribution - facilitates actual harm to children, such as molestation. Yet legislative attempts to curb pandering inevitably implicate concerns about panderers' First Amendment rights. This Note argues that in balancing the vulnerability of children against the power of the First Amendment, the law must shift to focus more on the subject of this grievous harm - children. This approach will appropriately extend protection to a subset of the population that is least able to protect itself.

Marketing As Constructive Engagement, Clifford J. Shultz Oct 2007

Marketing As Constructive Engagement, Clifford J. Shultz

School of Business: Faculty Publications and Other Works

The purpose of this essay is to provoke a more comprehensive, historically accurate, and meaningful definition of marketing. Toward that outcome, the author introduces a framework for marketing that argues for constructive engagement with a complex, conflicted, and increasingly interdependent world in which marketing can and should play an important role. The framework offers a new synthesis commensurate with ideals generally espoused in macromarketing. An illustration based on longitudinal study of Vietnam is shared, with implications for current global affairs and with new directions for meaningful marketing research and practice.

The Decline Of Palestinian Exceptionalism: Observation Of A Trend And Its Consequences For Refugee Studies In The Middle East, Michael Kagan Oct 2007

The Decline Of Palestinian Exceptionalism: Observation Of A Trend And Its Consequences For Refugee Studies In The Middle East, Michael Kagan

Faculty Journal Articles

There has historically been a great divide at the heart of refugee policy and scholarship in the Middle East, between Palestinian refugees and all others. This intellectual and policy divide runs throughout political discourse, governmental and United Nations administration, and civil society activism. It poses a challenge to the coherency of forced migration studies in the Middle East. There is now a significant and growing inter-disciplinary literature about refugees of many nationalities in the region, but the largest and most visible refugee group in the region has been traditionally treated as “a case apart,” to borrow a phrase used recently …

From Internal To International Displacement In Sudan, Agnes De Geoffroy Oct 2007

From Internal To International Displacement In Sudan, Agnes De Geoffroy

Faculty Journal Articles

In the field of forced migration and refugees studies, forced internal displacement cannot be excluded as an area of interest. Internal displacement is challenging for peace construction, urban development and stability in many countries. The growing number of displaced persons is the reverse side of the international community new strategy, consisting in preventing cross-border displacement, aiming to prevent the regional spreading of instability and reducing the number of refugees. The country with the greatest number of Internally Displaced Persons (IDPs) in the world is Sudan. It has more than 5 million IDPs, of which about 2 million were recently displaced …

Refugee Diet In A Context Of Urban Displacement Part Two: Selecting And Incorporating Food: Diet And Perceptions Of Risk Among Southern Sudanese Refugees Living In Cairo, Peroline Ainsworth

Faculty Journal Articles

The changes in diet and food consumption practices experienced after displacement can have serious implications for the physiological health of forced migrants and refugees, as noted in Part One.1 These changes can also express cultural loss and social dislocation; the exchange, sharing, preparation and consumption of foods carry important social and cultural values and significances that often reflect and reinforce the very modes of social organization and codes of conduct which become undermined and fractured during displacement (Counihan et al. 1997:3, see also Levi-Strauss 1978, Mead 1970, Appadurai 1981). Altering and reconstructing food consumption habits and feeding practices is therefore …

Refugee Diet In A Context Of Urban Displacement Part One: Some Notes On The Food Consumption Of Southern Sudanese Refugees Living In Cairo, Peroline Ainsworth

Faculty Journal Articles

The changes in food consumption practices experienced after displacement can have serious implications for the health of refugees. These changes can also reflect and express cultural loss and shifts in social structures and habits. Altering and reconstructing food consumption habits and feeding practices is integral to people’s adjustment to and experience of displacement. However, research on the nature and impacts of changing food consumption practices among displaced populations, particularly those living in urban areas in the developing world, is scarce. The following report describes the findings of a 12-month exploratory study that aimed to document changes in food consumption among …

Sending States’ Transnational Interventions In Politics, Culture, And Economics: The Historical Example Of Italy, Mark I. Choate Oct 2007

Sending States’ Transnational Interventions In Politics, Culture, And Economics: The Historical Example Of Italy, Mark I. Choate

Faculty Publications

This article uses archival evidence to study in depth the historical policies of Italy, as a classic sending state. Most of the mass migrations of a century ago came from multinational empires, but Italy was a recently formed independent state. Ambitious to benefit from emigration while assisting and protecting emigrants, Italy reached out to “Italians abroad” in several ways. For example, the state opened a low‐cost channel for remittances through a non‐profit bank; promoted Italian language education among Italian families abroad; supported Italian Chambers of Commerce Abroad; and subsidized religious missionary work among emigrants. Italy’s historical example of political innovation …

Counting Outsiders: A Critical Exploration Of Outsider Course Enrollment In Canadian Legal Education, Natasha Bakht, Kim Brooks, Gillian Calder, Jennifer Koshan, Sonia Lawrence, Carissima Mathen, Debra Parkes

Osgoode Hall Law Journal

In response to anecdotal concerns that student enrollment in "outsider" courses, and in particular feminist courses, is on the decline in Canadian law schools, the authors explore patterns of course enrollment at seven Canadian law schools. Articulating a definition of "outsider" that describes those who are members of groups historically lacking power in society, or traditionally outside the realms of fashioning, teaching, and adjudicating the law, the authors document the results of quantitative and qualitative surveys conducted at their respective schools to argue that outsider pedagogy remains a critical component of legal education. The article situates the numerical survey results …

Differentiating Knowledge Processes In Organisational Learning: A Case Of ‘Two Solitudes’, Siu Loon Hoe, Steven L. Mcshane Oct 2007

Differentiating Knowledge Processes In Organisational Learning: A Case Of ‘Two Solitudes’, Siu Loon Hoe, Steven L. Mcshane

Research Collection School Of Computing and Information Systems

The fields of organizational behaviour (OB)/strategy and marketing have taken different paths over the past two decades to understanding organisational learning. OB/strategy has been pre-occupied with theory development and case study illustrations, whereas marketing research has taken a highly quantitative path. Although relying on essentially the same foundation theory, these two solitudes have had minimal cross-fertilisation. Furthermore, both fields tend to blur or usually ignore the distinction between structural and informal knowledge processes. The marketing literature, in particular, relies on the MARKOR scale, which measures structural knowledge processes. Informal knowledge acquisition and dissemination processes are almost completely ignored. The purpose …

Student Resistance In Sociology Classrooms: Tools For Learning And Teaching, Helen A. Moore Oct 2007

Student Resistance In Sociology Classrooms: Tools For Learning And Teaching, Helen A. Moore

Department of Sociology: Faculty Publications

In this paper I focus on two arenas of student resistance that have come under closer sociological analysis. I do this to illustrate that teaching will always be difficult, but that we have more opportunities and challenges in these interesting times. One of those challenges just might be to expand our definitions of student resistance in order to further develop our own thinking about teaching and learning. The first form of student resistance I consider to be the “classic” form in which teachers focus on classroom disruptions and why their educational messages are not absorbed by students; the second is …

Developing The Whole Child: An Evaluation Of The Latino After‐School Initiative (Lasi), Virginia Diez Oct 2007

Developing The Whole Child: An Evaluation Of The Latino After‐School Initiative (Lasi), Virginia Diez

Gastón Institute Publications

This report presents findings from an evaluation of the Latino After-School Initiative (LASI), an umbrella organization that provides funding, educational guidelines, staff development, and networking opportunities to after-school programs in the Greater Boston area. LASI funds seven Latino-led after-school programs servicing children ages 7-14. The programs are located in Lynn, Cambridge, Roxbury, Jamaica Plain, and Chelsea. LASI was established in 2001 by the United Way of Massachusetts Bay as a five-year demonstration project to improve academic achievement—as measured by MCAS scores and high school retention rates—among Latino children.

The Protean Career: Exemplified By First World Foreign Residents In Western Europe?, Marian Crowley-Henry Oct 2007

The Protean Career: Exemplified By First World Foreign Residents In Western Europe?, Marian Crowley-Henry

Articles

This article presents findings from a qualitative study exploring the career-related motivations and experiences of a sample of 20 expatriates living and working on a permanent basis in the South of France (Sophia Antipolis) and in Germany (Munich). By virtue of their having established local links in the host country, either in having local working contracts or being installed in the area on a permanent basis (home owners; children born/being schooled in the host country), these expatriates could also be termed foreign residents in the host country. The study’s sample of highly educated workers originating from the United States of …

The Effects Of Collective Efficacy And Dissatisfaction With Law Enforcement On Neighborhood Crime Rates, Kelly E. Cobb Oct 2007

The Effects Of Collective Efficacy And Dissatisfaction With Law Enforcement On Neighborhood Crime Rates, Kelly E. Cobb

Sociology & Criminal Justice Theses & Dissertations

The purpose of this thesis was to examine the effects of collective efficacy and dissatisfaction with law enforcement on neighborhood crime rates. A data set was obtained from the Inter-University Consortium for Political and Social Research titled, Project on Human Development in Chicago Neighborhoods: Community Survey 1994-1995 (PHDCN). This is one of the only studies which ask specific questions concerning collective efficacy and dissatisfaction with law enforcement, accompanied with a large, diverse sample. This research is important because it looks at two concepts, collective efficacy and dissatisfaction with law enforcement and their combined effect on neighborhood crime rates; violent …

Radical Impact Of Change In Actions And Confidence Index On Reverse Decision Making An Application Based Study, Swatee Trimbak Paithankar

Engineering Management & Systems Engineering Theses & Dissertations

While making decisions under uncertainty, people are often unaware of the logical approach to form the decision process. It is assumed that collecting details, analyzing and evaluating data is enough to make 'proper' decisions. However, past research in the decision making arena has significantly validated that there exists a class of decision problems which is complex, ill-structured and not defined to the level where decision makers can draw logical conclusions based on existing traditional decision approaches. RDM (reverse decision making), one of the novel approaches of decision making under conditions of uncertainty, has shown potential towards addressing some of these …

Is The Market For Ceos Rational?, Charles M. Yablon Oct 2007

Is The Market For Ceos Rational?, Charles M. Yablon

Articles

The article challenges the arms-length bargaining model of CEO compensation, arguing that managerial power, social dynamics, and psychological factors significantly influence compensation decisions. It critiques both the managerial power thesis and the arms-length bargaining model, advocating for a more nuanced understanding that incorporates these non-economic influences. CEO compensation is not solely tied to performance but is shaped by boards' overconfidence, cognitive biases, and the cult of the CEO, leading to inefficient pay structures that often fail to align with shareholder interests.
