This paper examines the relationship between security, surveillance, privacy and identity, both in the context of legislation such as the Anti-terrorism Act and the PATRIOT Act, and also in the light of ongoing changes in how that personal information is gathered, processed and used. It is argued that prevailing notions of privacy — and the legal frameworks that aim to protect privacy interests — are ill-suited to defending individuals from an increasingly sophisticated array of surveillance and data processing techniques, which enable information to be acquired and shared at almost zero-cost and which threaten to establish the ‘categorical identity’ as …

Hearing The Sexual Assault Complaints Of Women With Mental Disabilities: Consent, Capacity, And Mistaken Belief, Janine Benedet, Isabel Grant

Women with mental disabilities experience high rates of sexual assault. The authors trace the history of the criminal law's treatment of cases involving such acts in order to evaluate whether the substantive law of sexual assault is meeting the needs of this group of women. In particular, the authors focus on the legal issues of consent, capacity, and mistaken belief. The authors situate this discussion in the context of current debates in feminist and critical disability theory, grounding the theory in scholarly research on sexual assault of women with mental disabilities. Hearing The Sexual Assault Complaints Of Women With Mental Disabilities: Evidentiary And Procedural Issues, Janine Benedet

When a woman with a mental disability makes a complaint of sexual assault, she must confront a criminal trial process that was not designed in contemplation of her as a witness. The requirements of repeated testimony under oath and the ability to be cross-examined are not always well-suited to the particular needs and capacities of women with mental disabilities. These problems are magnified by the tendency to infantilize women with mental disabilities, thereby diminishing their credibility and depicting them as hypersexual when they engage in any sexual activity. Individualism And Collectivism In America: The Case Of Gun Ownership And Attitudes Toward Gun Control, Katarzyna Celinska

A number of sociologists and cultural psychologists claim that the United States is a predominantly individualistic country. This article uses a unidimensional index of individualism and collectivism to analyze one of the most debated sociopolitical issues in America: gun ownership and gun control. It tests the hypothesis that the widespread gun ownership in the United States and prevailing attitudes toward gun control represent competing individualistic and collectivistic cultural traditions, respectively. The findings indicate that the index is one of the predictors of gun ownership and of attitudes about gun permits.

The literature on public opinion about crime and justice has neglected the exploration of macro‐ or community‐level influences on individual‐level attitudes. A key macrofactor that may be related to individual level attitudes is the volume of violent crime. High crime rates can facilitate the development of a culture of “law and order,” a response that may be a practical or instrumental attempt to control crime. The present paper tests the hypothesis that persons residing in nations marked by a high volume of crime will be more likely to adhere to elements of a law and order culture. It employs data …

The work's central question is how technological designs affect the political power of individuals. This discussion supplements claims that more democratic control over the design and deployment of technology is necessary; it does so by showing how the general tendency toward parametric designs creates technological delegates: artifacts to which we inadvertently delegate our political powers. "Delegation" in this sense is the central theme. It is developed in the context of recent philosophy and sociology of technology, as well as ecofeminism and the existentialism of Gabriel Marcel and Martin Heidegger. This thesis reports on the findings of a qualitative research study that explored role changes experienced by female adolescents after the death of a parent, with special attention paid to birth order. Seventeen women were recruited by convenience sampling for this study: nine were eldest daughters, three were middle daughters, and five were youngest daughters. All of the women lost a parent when they were between the ages of 11 and 17, and all were living at home with both parents at the time of the death. This qualitative study focuses on the everyday realities and child placement experiences of 31 mothers of children placed in out-of-home care in south western Ontario. The stories used in this analysis were collected for the Partnerships for Children and Families Project, a multi-year research project that is committed to developing an understanding of the lives and experiences of families and children who are served by Children's Aid Societies and/or children's mental health services. Twenty six mothers in this study were interviewed on one occasion, ranging from one to two hours in duration. Five mothers in this study had multiple interviews. …

The purpose of this study is to use Capote’s In Cold Blood as a point of reflection on several ethical obligations of lawyers. In Part I, I focus on Capote’s accounts of the prosecution’s use of expert witnesses, and his suggestion that defense counsel were (i) unable or unwilling to deal with their personal conflicts of interest and (ii) incompetent, the latter of which became the subject of disciplinary investigations and federal court review. In terms of the duties of an advocate, Capote sees the prosecution as going too far, and the defense as failing to go far enough. In …

A 2001 study of 1,000 young women attending four-year colleges and universities across the United States conducted by Norval Glenn and Elizabeth Marquardt found that “dating” has all but disappeared from American college campuses. Only half of the women reported they had been asked on six or more dates during their entire college career. In fact, one-third of the women had two or fewer dates during the same four years. Instead of dating, college students now “hang out” in mixed groups in a variety of settings including apartments, dormitory rooms, student centers, pizza parlors, coffee shops, and bars. The purpose of this study was to evaluate the adult education technology program at a chartered alternative adult education center in Florida. The adult education center had a low rate of students passing the Florida Comprehensive Assessment Test (FCAT). This study examined the impact of the use of computer technology in an effort to improve student learning in mathematics, reading, and science. Computers at the institution were used by all students for tutorials to prepare them for the FCAT and to obtain a high school diploma. The research questions for this study were as follows:

From the Spanish arrival in Florida in 1565 to present-day America, immigration has been a continuous factor in the history of the United States, and it has repeatedly challenged notions of what it means to be American. Theodor W. Adorno, the towering twentieth century German intellectual figure and distinctive musical thinker, was legendary for being over-critical of jazz music. Through a consideration at his admiration for avant-garde chamber and symphonic music, I plan to develop a position that, surprisingly, points towards a theory of unacknowledged acceptance of jazz. The style of jazz that will be the newly constructed musical idiom of admiration for Adorno will be of the heterodox variety. Revisiting the American Gothic via Julia Kristeva's theory of "the abject" demonstrates how Gothic strategies expose the historical contradictions of race in works by Mark Twain, Charles W. Chesnutt, and Toni Morrison. As theorized by Kristeva in Powers of Horror, the archaic process in which the subject attempts to constitute itself as homogeneous by casting off or "abjecting" all that cannot be assimilated to the self-same necessarily opens the way to repeated returns of the abject(ed) and the "horror" it provokes. The argument is that corporate social responsibility, or CSR, is best understood as a collective moral practice that is a precondition for sustainable business. There are a number of theories and definitions of CSR in the contemporary business literature. This thesis is a broad survey of the uses of ambiguity in academic discourse. I note the uses of ambiguity in literary criticism, linking ambiguity with epistemic relativism. Then I pose the question, is the notion of "reframing" in psychotherapy analogous to the concept of "spin" in propaganda, advertising and public relations? In a consideration of theories that posit the social construction of reality, I examine articles by Judith Butler and Ian Hacking, noting the ambiguous reception of performativity and nominalism, respectively, within academia. This dissertation analyzes the travel writings of Isabella Bird Bishop, Mary Kingsley, Florence Douglas Dixie, and Isabel Savory. While away from England, these women writers participated in cultural exchanges which led to reevaluations of British womanhood. British women travel writers operated not only within the power structures of gender but also within the structures of empire, class, and race. White-Black disparities in disability in the older population are consistently reported in the literature, and are usually ascribed to differences in socio-economic, health, and cognitive status. However, the role of modifiable influences on disability, such as health and lifestyle behaviors or health care utilization on these differences is less clear. The project examines the effects of Internet use by the social movement organization (SMO) Dean for America/Democracy for America (DFA). This study describes the relationship between Internet usage and SMO beliefs, organization, causes, reasons for joining, strategies, reactions, and effects. Dean for America started out with few resources or supporters, and was seen as an unlikely contender for the 2004 presidential campaign. From its humble beginnings, it skyrocketed from being virtually unknown to frontrunner status in the span of a year. To what extent are Americans divided in terms of their liberal and conservative preferences? Have their opinions become more polarized over time? Much of the recent literature on voter polarization suggests that there are far fewer moderate voters in the United States today compared to in the recent past, and that the country is in the midst of a massive “culture war” between liberals and conservatives. The sexual exploitation of children is detrimental to the physical and emotional health and development of the children and undermines the development and growth of nations. Since 1989 the international community has taken serious legislative steps to attempt to eliminate child sex trafficking. However, despite nearly universal ratification of international conventions on the topic, the sexual exploitation of children continues. Reactions To Ostracism And Their Predictors, Kelly J. Sanderson '07

This study was conducted to examine how individual differences in personality predict variance in reactions to ostracism, and to explore the effects of re-inclusion on ostracism reactions. Participants completed five personality measures before the ostracism was delivered in a chat-room paradigm. The chat-room consisted of phases during which participants were included, excluded, and re-included in the discussion, and enjoyment and participation were measured after each chat-room phase. Enjoyment and participation decreased during exclusion and increased during re-inclusion. Throughout all phases of the chat-room, enjoyment and participation were positively correlated with social competence and negatively correlated with loneliness and social isolation. …
