Addicted To Fault: Why Divorce Reform Has Lagged In New York, J. Herbie Difonzo, Ruth C. Stern Jan 2007

Addicted To Fault: Why Divorce Reform Has Lagged In New York, J. Herbie Difonzo, Ruth C. Stern

Hofstra Law Faculty Scholarship

The authors "summarize New York's history of divorce legislation and analyze the forces that, for such a prolonged period, kept reform at bay. In Part I we describe the halting development of divorce law from the 18th to the end of the 19th century. Part II focuses on the first half of the 20th century and the continuing, mostly futile, efforts to liberalize divorce law. Part III examines the ways in which New Yorkers succeeded in dissolving their marriages on their own terms, despite the strictures of the law. In Part IV, we explore the social climate and chain …

At Home Among Strangers: The Acculturation Process Of Female African Refugees In The Upper Midwest, Lori J. Dewitt, Judy C. Pearson, Adam W. Tyma, Kelly E. Wolf, David H. Kahl Jr.

Iowa Journal of Communication

This report details an action research project initiated by a team of university researchers with area female African refugees. The goal was to determine the primary issues facing this population and to provide potential solutions. Through focus groups, five problems emerged. Upon identification of these problems, and in conjunction with the refugees and other citizens, the researchers proposed the formation of a community-wide coalition charged with specific objectives to meet the needs of this growing population. Subsequent to the project, an inter-agency coalition, which reports to the city's human rights commission, was established to ameliorate the problems of the refugees.

The Recovery Experience For Persons With A Myocardial Infarction And Their Spouses/Partners, Vicki Lynnette Bingham Jan 2007

The Recovery Experience For Persons With A Myocardial Infarction And Their Spouses/Partners, Vicki Lynnette Bingham

All ETDs from UAB

Coronary heart disease, the leading cause of death in Americans today, affects both genders in numerous ethnic populations. This life-threatening event causes both physical and emotional distress for persons with a myocardial infarction (MI), as well as for their spouses or partners and thus possibly forces them on a spiritual journey. The purpose of this study was to increase the understanding of the ways in which spirituality is defined and experienced by both persons with an MI and their spouses/partners during the recovery process. The method utilized in this study was a qualitative approach using interpretative phenomenology from a Heideggerian …

Multiple Roles: Benefits Or Strain? An Examination Of The Effects Of Work And Mothering On Health Lifestyle Behaviors For Women Living With Hiv/Aids, Mercy W. Mwaria Jan 2007

Multiple Roles: Benefits Or Strain? An Examination Of The Effects Of Work And Mothering On Health Lifestyle Behaviors For Women Living With Hiv/Aids, Mercy W. Mwaria

All ETDs from UAB

Does occupying multiple roles cause strain or does it lead to health lifestyle practices for women living with HIV/AIDS? Previous research has established a relationship between multiple role occupation and physical and mental wellbeing for women. Health lifestyle modifications for persons living with HIV/AIDS benefit health by slowing down disease progression and enhancing the body’s tolerance to drug therapies. This study extends these findings to a specific population of women living with HIV/AIDS and examines health lifestyle outcomes for this population. Using data from the HIV Cost and Services Utilization Study (HCSUS), the study draws on a subsample of women …

A Grounded Theory Study: Hispanic Adolescents' Experience Of Being Overweight, Wilma Powell Stuart Jan 2007

A Grounded Theory Study: Hispanic Adolescents' Experience Of Being Overweight, Wilma Powell Stuart

All ETDs from UAB

The number of overweight adolescents worldwide has continued to increase over the past several decades. Intervention studies for weight management with overweight adolescents are challenged by high rates of attrition and have failed to achieve sustained outcomes. Hispanic adolescents have a higher risk of being overweight than their African American and White peers do. However, Hispanic overweight adolescents have been poorly represented in intervention studies with overweight adolescents. The factors that influence the Hispanic overweight adolescents’ perceptions of weight and weight loss management are not known. This qualitative study used ground theory methodology to identify the factors that influence perceptions …

A Study Of Perceived Stress, Anxiety, Somatic Symptoms, And Spirituality In Practitioners Of The Martial Art Aikido, Howell E. Tapley

All ETDs from UAB

The purpose of this study was to examine relationships between physical, mental and spiritual health. An additional purpose was to determine if the practice of aikido was associated with measurable levels of somatic symptoms, perceived stress, anxiety and spirituality. Measurement instruments included Cohen’s 10-item Perceived Stress Scale (PSS), Spielberger’s 20-item Trait Anxiety Inventory (TAI), the Patient Health Questionnaire-15 (PHQ-15), and the 16-item Daily Spiritual Experiences Scale (DSES). A cross-sectional research design was utilized in this study to test the following hypotheses: 1) After controlling for demographic variables, daily spiritual experience will explain variability in perceived stress, anxiety and somatic symptoms, …

Depressive Symptomatology And Suicide Attempts In Adolescents With Mobility Limitations, Ann I. Alriksson-Schmidt

All ETDs from UAB

Adolescents with mobility limitations may be at increased risk of certain adverse outcomes because of unique or exacerbated pre-existing challenges. The current study examined the relationships among mobility limitations, depressive symptomatology, and suicidal behaviors. Moreover, it was examined if pain and perceived social support mod-erated the relationships between severity of mobility limitations and the three outcome variables, and whether depressive symptomatology mediated the relationships between mobility limitations and suicidal behaviors. Secondary analyses of the AddHealth data set were performed. The sample was 49.18% female, 16.02% African-American, 65.46% Caucasian, 12.20% Hispanic, and 6.33% coded as Other. The mean age was 15.96 …

The Conditional Influence Of Criminological Constructs On Juvenile Delinquency: An Examination Of The Moderating Effects Of Self-Control, Angela Yarbrough Jan 2007

The Conditional Influence Of Criminological Constructs On Juvenile Delinquency: An Examination Of The Moderating Effects Of Self-Control, Angela Yarbrough

USF Tampa Graduate Theses and Dissertations

Self-control and various elements comprising this construct have received much credit over the years as it has been able to account for a large amount of variance in delinquency rates. Some research has suggested that individual difference factors (e.g., self-control) can overwhelm external factors (e.g., neighborhoods; see Loeber & Wikström, 2000). Others have found that social influences (e.g., employment; see Wright, et al, 2001) have more pronounced effects for those most at-risk. Because of the equivocal nature of the empirical findings, this study seeks to replicate and extend previous efforts. Specifically, the influence of constructs derived from social learning, control, …

Recent Reforms To The Japanese Judiciary: Real Change Or Mere Appearance?, Daniel H. Foote Jan 2007

Recent Reforms To The Japanese Judiciary: Real Change Or Mere Appearance?, Daniel H. Foote

Articles

In June 2001, the Justice System Reform Council ("Reform Council" or "Council") issued its final report. The Council's recommendations included several proposed reforms to the judiciary, intended to insure the judiciary would "meet the expectations of the people." This essay examines a number of those recommendations and the resulting reforms.

The single reform to the judiciary that has received the most publicity is the introduction of the saiban'in system, through which ordinary citizens will participate directly in judging serious crim:inal cases and thus will have the opportunity to express their views directly in the deliberation of those cases. That system, …

An Answer To The Question: "What Is Poststructuralism?", Bernard E. Harcourt Jan 2007

An Answer To The Question: "What Is Poststructuralism?", Bernard E. Harcourt

Faculty Scholarship

What is poststructuralism? It has always struck me as odd that so many critical theorists are reluctant to offer an answer to this question. In this essay, I unpack the term and provide a synoptic answer. Poststructuralism, I suggest, is a style of critical reasoning that focuses on the moment of ambiguity in our systems of meaning, as a way to identify the ethical choices that we make when we overcome the ambiguity and move from indeterminacy to certainty of belief in our efforts to understand, interpret, and shape our environment. Post-structuralism concentrates on the moment when we impose meaning …

Model Uncertainty And The Deterrent Effect Of Capital Punishment, Ethan Cohen-Cole, Steven N. Durlauf, Jeffrey Fagan, Daniel Nagin Jan 2007

Model Uncertainty And The Deterrent Effect Of Capital Punishment, Ethan Cohen-Cole, Steven N. Durlauf, Jeffrey Fagan, Daniel Nagin

Faculty Scholarship

The reintroduction of capital punishment after the end of the Supreme Court moratorium has permitted researchers to employ state level heterogeneity in the use of capital punishment to study deterrent effects. However, no scholarly consensus exists as to their magnitude. A key reason this has occurred is that the use of alternative models across studies produces differing estimates of the deterrent effect. Because differences across models are not well motivated by theory, the deterrence literature is plagued by model uncertainty. We argue that the analysis of deterrent effects should explicitly recognize the presence of model uncertainty in drawing inferences. We …

The Influence Of Religiosity On Contraceptive Use And Abortion In The United States, Richard J. Fehring, Jennifer Ohlendorf Jan 2007

The Influence Of Religiosity On Contraceptive Use And Abortion In The United States, Richard J. Fehring, Jennifer Ohlendorf

College of Nursing Faculty Research and Publications

The CDC has conducted the National Survey of Family Growth (NSFG) every three to seven years between 1973 and 2002 to describe contraceptive use among women in the U.S. The data from these surveys are available to researchers to examine trends in contraceptive use and sexual behaviors. The purpose of this study was to examine data from the 2002 NSFG in order to determine the influence of religiosity on abortion and abortifacient contraceptive use, i.e., the use of the oral contraceptive pill (OC), the injected hormone Depoprovera (IC), the IUD, and hormonal emergency contraception (EC), among American women between the …

Teacher Success, Assessment, And Evaluation Practices In Service-Learning Composition Courses, Faith-Ann Abiola Mcgarrell Jan 2007

Teacher Success, Assessment, And Evaluation Practices In Service-Learning Composition Courses, Faith-Ann Abiola Mcgarrell

Dissertations

Problem. Over the last 15 years, service-learning in first-year composition has emerged as a critical area of study. Service-learning in composition places students in writing environments within the community, encourages reading and writing about social issues, and provides the opportunity for students to participate in community projects. A significant problem with this approach is the alignment between outcomes of the discipline and those of service. Practitioners feel that a clear understanding of compatibility between the two areas of study would result in better practice and further buy-in by those who do not teach from a service-learning perspective.

Method. In service-learning …

The Big One, Edward A. Parson Jan 2007

The Big One, Edward A. Parson

Reviews

Richard Posner's Catastrophe: Risk and Response (Oxford University Press, 2004) examines four risks whose worst cases could end advanced human civilization or worse: asteroid impacts, a catastrophic chain reaction initiated in high-energy particle accelerators, global climate change, and bioterrorism. He argues that these all warrant more thought and response than they are receiving, and that they can usefully be assessed using a simple analytic framework based on cost-benefit analysis. This essay reviews knowledge of these risks and critically examines Posner's claims for a consistent analytic approach. While the conclusions that each risk merits more thought and effort appear persuasive, these …

Review Of The Philosophy Of Positive Law: Foundations Of Jurisprudence, Howard Bromberg Jan 2007

Review Of The Philosophy Of Positive Law: Foundations Of Jurisprudence, Howard Bromberg

Reviews

This meticulously researched book addresses a central question of analytical and philosophical jurisprudence: What is positive law? Throughout his analysis, James Bernard Murphy, author of The Moral Economy of Labor: Aristotelian Themes in Economic Theory (New Haven: Yale University Press, 1993), contrasts positive law with the other two kinds of law that constitute the triad of legal concepts - natural law and customary law. Although they are treated at length in this work, Murphy states in the preface that he intends to write a companion volume on natural law and customary law, "thus completing the foundation of philosophical jurisprudence" (p. …

The Iron Age I Structure On Mount Ebal: Excavation And Interpretation, Ralph K. Hawkins Jan 2007

The Iron Age I Structure On Mount Ebal: Excavation And Interpretation, Ralph K. Hawkins

Dissertations

Problem. The Iron Age I site on Mt. Ebal, discovered in 1980 by Adam Zertal and excavated between 1982 and 1989, has remained largely unknown by both the scholarly community and the public. No scholarly congress or colloquium has ever been held regarding the Mt. Ebal excavations. The Mt. Ebal excavations, however, may have important implications for reconstructing Israelite origins. This present study investigates the Mt. Ebal excavationand its results.

Method. My study uses the comparative method and is divided into six chapters. Chapter 1 serves as in introduction, giving an overview of the investigation to be carried out in …
