A Reevaluation Of The Trade Union Unity League, 1929-1934, Victor G. Devinatz Jan 2007

A Reevaluation Of The Trade Union Unity League, 1929-1934, Victor G. Devinatz

Faculty Publications – Management

The "Third Period" trade union activities of the Communist Party USA (CPUSA), especially the creation of independent "red" industrial unions as opposed to continuing to work within the craft-oriented American Federation of Labor (AFL) unions, has been widely criticized in the literature. The recent opening of the CPUSA archives has made it possible to reevaluate the Party's activities during this era. While the TUUL unions suffered major defeats and had difficulties in organizing in the heavy and mass production industries such as mining, textile, maritime and steel, these unions experienced considerable organizing success in light industries in New York City, …

A Home Of Its Own: The Role Of Poverty Law In Furthering Law Schools' Mission, Marie Failinger Jan 2007

A Home Of Its Own: The Role Of Poverty Law In Furthering Law Schools' Mission, Marie Failinger

Faculty Scholarship

This author argues that poverty advocates who are willing to carefully attend to their law school’s mission and vision, and to give careful thought to how poverty law may play an important role in achieving that vision, may win a more lasting place for poverty law in the curriculum than it has heretofore managed to achieve in most law schools. This article will argue that poverty law can be a key piece in the curriculum of law schools who define their mission, at least in part, as educating lawyers according to one of five paradigms: 1) lawyers as public citizens …

Fuzzy Logic And Corporate Governance Theories, Z. Jill Barclift Jan 2007

Fuzzy Logic And Corporate Governance Theories, Z. Jill Barclift

Faculty Scholarship

Fuzzy logic is a theory that categorizes concepts or things belonging to more than one group. A methodology that explains how things function in multiple groups (not fully in one group or another) offers advantages when one definition or membership in a group accounts for belonging to multiple groups. A principal/agent model of corporate governance has some characterizations of fuzzy logic theory. The purpose of this article it to evaluate other models of corporate governance that account for the multi-agent role of senior officers of public companies and assess the accountability to the corporation. Corporate governance theorists continue to debate …

Secrets And Lies: Intelligence Activities And The Rule Of Law In Times Of Crisis, Simon Chesterman Jan 2007

Secrets And Lies: Intelligence Activities And The Rule Of Law In Times Of Crisis, Simon Chesterman

Michigan Journal of International Law

This Article will consider generally the prospects for an approach to intelligence activities based on the rule of law, focusing on the problem of covertness. In particular, it will examine the debate over how law should deal with crises, epitomized by the "ticking time-bomb" hypothetical. On the one hand, some call for a pragmatic recognition that, in extremis, public officials may be required to act outside the law and should seek after-the-fact ratification of their "extra-legal measures." On the other hand, others argue that the embrace of "extra-legal measures" misconceives the rule of law, underestimates the capacity of a …

The Legal Problems Of Everyday Life: The Nature, Extent And Consequences Of Justiciable Problems Experienced By Canadians, Ab Currie Jan 2007

The Legal Problems Of Everyday Life: The Nature, Extent And Consequences Of Justiciable Problems Experienced By Canadians, Ab Currie

Canadian Forum on Civil Justice

The purpose of this project is to inform policy makers about the incidence of civil justice problems and the extent of unmet need for assistance that justiciable problems in civil matters might represent. The study assumes a broad view of civil justice problems and unmet need. The broad view looks at the problem of civil justice and access to justice in terms of the prevalence of civil justice problems in the population. This involves identifying, by means of a sample survey, civil justice problems people have experienced that meet some reasonable threshold of seriousness. The broad view contrasts with the …

American Indian Transportation Issues In South Dakota, Tracey Mcmahon Jan 2007

American Indian Transportation Issues In South Dakota, Tracey Mcmahon

The Journal of Undergraduate Research

This paper provides an overview of tribal transportation obstacles. My primary focus is on the quality of reservation roads and its relationship to funding and politics. The Indian reservation road system is one of the most underdeveloped transportation networks in the United States. A majority of these roads are dirt and gravel and, therefore, dangerous for traveling. Motor vehicle accidents are the leading cause of death for American Indians and Alaska Natives between ages one and 44 (Hamilton 2003). Because federal funds for tribal transportation fall short of transportation needs, tribes do not have enough money for either road construction …

The Effect Of Parental Education On Emotions And Behaviors, Chelsea Parkinson, Shivaram Poigai Arunachalam Jan 2007

The Effect Of Parental Education On Emotions And Behaviors, Chelsea Parkinson, Shivaram Poigai Arunachalam

The Journal of Undergraduate Research

Current literature suggests that emotions are learned through socialization. The following study was completed using results compiled by a survey done for the South Dakota State University (SDSU) Sociology of Rural America course (Soc 240). The authors wished to ask the question "Do the education levels of parents affect the emotions and behaviors of their children?" There were approximately 540 respondents to this survey, all college students at SDSU. Questions dealing with students' emotions were analyzed with respect to each respective student's parents' education level. The findings suggested that there is a connection between the parents' education levels and the …

Two-Faced Racism: Whites In The Backstage And Frontstage, Leslie H. Picca, Joe R. Feagin Jan 2007

Two-Faced Racism: Whites In The Backstage And Frontstage, Leslie H. Picca, Joe R. Feagin

Sociology, Anthropology, and Social Work Faculty Publications

Racial events that reveal the larger forces of racism in society are common and obvious in the sociospatial realm we term the backstage, especially in situations where whites interact with white friends and relatives. Backstage settings, where interactions typically take place among whites only, involve an array of complex interactions and performances. There we observe all dimensions of racial events-- indications of who is allowed and not allowed in the backstage, what racialized performances are tolerated or expected there, the sociospatial character of contexts, the impact of conventional racial framing, and the pervasive influence of the larger society. Here we …

An Analysis Of Situated Meaning In Direct-To-Consumer Pharmaceutical Advertising, Susan E Garcia Jan 2007

An Analysis Of Situated Meaning In Direct-To-Consumer Pharmaceutical Advertising, Susan E Garcia

UNLV Retrospective Theses & Dissertations

This thesis uses interpretive discourse analysis to critically examine the situated meaning of prescription drug Direct-To-Consumer Advertising (DTCA) as compared to the situated meaning of historical patent DTCA. Specifically, I apply James Paul Gee's theory of analysis to show how the DTCA, past and present, builds identity, connections, and sign systems and knowledge. My analysis demonstrates that the coverage and convergence of these building tasks in both prescription and patent DTCA indicate that today's pharmaceutical companies' situated meaning is not significantly different from the patent medicine advertising of the past. Despite pharmaceutical companies' claims that the prescription DTCA educates consumers, …

Probation Officer Prototypes: Perceptions Of Probationers With And Without Mental Illness, Paula M Emke-Francis Jan 2007

Probation Officer Prototypes: Perceptions Of Probationers With And Without Mental Illness, Paula M Emke-Francis

UNLV Retrospective Theses & Dissertations

In recent years the criminal justice system has managed large numbers of persons with mental illness, many of whom are supervised in the community on probation. Given that probation agencies are stretched to the maximum and have little extra time to take on additional challenges, probation officers (PO) may use typifications or "perceptual shorthand" as a means for efficiently managing their caseloads. Despite the role typifications may play in the processing of probationers, to date no research has attempted to characterize PO typifications; The reason for the dearth of literature in this area appears to be the result of many …

Bodily Poetics: The Rhetorical Politics Of The Self, Allison Renee Kaminsky Jan 2007

Bodily Poetics: The Rhetorical Politics Of The Self, Allison Renee Kaminsky

UNLV Retrospective Theses & Dissertations

This thesis will examine different ways people consciously manipulate their bodies in order to express selfhood, articulate identities, fulfill desires, and signal social and political commitments. The major premise of this research is that bodies are rhetorically constructed through a series of fundamental assumptions about selfhood, social ideals and acceptability, and political struggle. This paper argues that there are no a priori distinctions between the various practices and meanings of body modification. The way we think about body modification is based on a series of assumptions that define each practice. This project will look at three different groupings of modification …

Weblog Effects On Social Capital, Seyed Mohammad Reza Vaezi Jan 2007

Weblog Effects On Social Capital, Seyed Mohammad Reza Vaezi

UNLV Retrospective Theses & Dissertations

Weblog is the newest and clearly one of the most influential computer mediated communication (CMC) tools. Growing body of literature about the weblog effects on education, marketing, journalism, and human resource management is a sign of importance and significant effects of weblogs. This rapidly growing communication tool is expected to have significant impact on the work life of the individual and organization. However, there is little research evidence as to the nature and extent of this impact. Using a sample of 326, this research examines the effects of weblogs on social capital and its components: social connections, trust, and reciprocity. …

The New Middle School: Participatory Design And Outcomes, Tina Wichmann Jan 2007

The New Middle School: Participatory Design And Outcomes, Tina Wichmann

UNLV Retrospective Theses & Dissertations

Effective school design is a multi-faceted endeavor that involves an assessment of academic goals, an evaluation of architectural factors, a survey of current research and trends, and an understanding of past precedent. However, despite these efforts, the specific sociological needs of the occupants that use the school facilities are often overlooked. This thesis explores student and faculty opinions on the predominant trends in educational architecture as they pertain to the "social" spaces of the current CCSD middle school prototype; The primary purpose of this thesis is to explore the attitudes of students and faculty with respect to their current middle …

Preservice Teachers' Understanding Of *Evolution, The Nature Of Science, And Situations Of Chance, Louis Scott Nadelson Jan 2007

Preservice Teachers' Understanding Of *Evolution, The Nature Of Science, And Situations Of Chance, Louis Scott Nadelson

UNLV Retrospective Theses & Dissertations

The learning and teaching of biological evolution, the nature of science and situations of chance is conceptually challenging. Attempts to increase understanding in these domains has resulted in limited occurrences of success, and the identification of many related misconceptions. The alternative conceptions have been detected in teachers as well as students, which reflects the complexity of learning the content. Teachers' understanding of these concepts is critical to assuring they do not perpetuate misconceptions by teaching them to their students. The consistent detection of misconceptions in teachers suggests that new approaches to increasing understanding of these concepts need to be explored. …

Creating And Testing The Higher Education Leadership Competencies (Helc) Model: A Study Of Athletics Directors, Senior Student Affairs Officers, And Chief Academic Officers, Zachary A Smith Jan 2007

Creating And Testing The Higher Education Leadership Competencies (Helc) Model: A Study Of Athletics Directors, Senior Student Affairs Officers, And Chief Academic Officers, Zachary A Smith

UNLV Retrospective Theses & Dissertations

The purpose of this study was threefold: to extend existing knowledge of McDaniel's (2002) qualitative inquiry of higher education leadership competencies by testing her theory using quantitative methods; to either affirm or create a new, more refined model of higher education leadership competencies based on the results of the data analysis; and finally, to compare the similarities and differences of important competencies necessary for effective leadership between and within three groups of leaders in higher education: athletics directors (ADs), senior student affairs officers (SSAOs), and chief academic officers (CAOs); Goodness of fit results indicated McDaniel's 4-category model of higher education …
