Between Home And School, Laura A. Rosenbury
Between Home And School, Laura A. Rosenbury
UF Law Faculty Publications
This article challenges family law's traditional paradigm for allocating authority between parents, children and the state. Pursuant to that paradigm, parents enjoy almost complete authority over their children while at home; the state may require children to attend school and may regulate school curricula; and children must submit to the authority of either their parents or teachers. This settled equilibrium ignores a fundamental reality: children are not confined to home and school. Much of childhood takes place in spaces between home and school, at playgrounds, churches, sporting fields, music rooms and after-school clubs. Family law has been virtually silent about …

Communications Theory And World Public Order: The Anthropomorphic, Jurisprudential Foundations Of International Human Rights, Winston P. Nagan, Craig Hammer
UF Law Faculty Publications
This Article seeks to integrate different strains of knowledge and enlightenment from contradictory and often contentious jurisprudential perspectives. Our approach is to use elements of modern jurisprudence as tools and markers for a more adequate description and intellectual justification of the foundations of modern human rights law. This focus integrates existing literature that surveys law-making outside the context of the State, including the law of non-State groups, such as Jewish Law and Gypsy Law. It also examines the relevance of communications theory to law generated (in a functional sense) by individual interaction on a face-to-face basis (which Professor Harold Lasswell …

Numerical Computing And Graphics For The Power Method Transformation Using Mathematica, Todd C. Headrick, Yanyan Sheng, Flaviu-Adrian Hodis
Publications
This paper provides the requisite information and description of software that perform numerical computations and graphics for the power method polynomial transformation. The software developed is written in the Mathematica 5.2 package PowerMethod.m and is associated with fifth-order polynomials that are used for simulating univariate and multivariate non-normal distributions. The package is flexible enough to allow a user the choice to model theoretical pdfs, empirical data, or a user's own selected distribution(s). The primary functions perform the following (a) compute standardized cumulants and polynomial coefficients, (b) ensure that polynomial transformations yield valid pdfs, and (c) graph power method pdfs and …
Coping With Lasting Social Injustice, Jonathan R. Cohen
Coping With Lasting Social Injustice, Jonathan R. Cohen
UF Law Faculty Publications
Sometimes we experience poetry in human life -- a sense of joy and wonder, connectedness and meaning, and occasionally even transcendence. Sometimes we do not. This is, I believe, a general aspect of the human condition. Such generality notwithstanding, different persons face different obstacles to hearing that poetry. Some obstacles are internal, rooted in an individual's personality. Others are external, deriving from an individual's family, community, or society. This essay explores one distinctive and particularly difficult external obstacle to that poetic joy: lasting social subordination. How does lasting social subordination affect a subordinated person's ability to hear that poetry? What, …

Globalization And Gangs: The Evolution Of Central American, Patrick Beary '07
Honors Projects
The focus ofthis paper is beyond a critique of U.S. immigration law and the 4 regions' judicial systems, although their roles as they relate to gang activities in these areas will be assessed. Nor is this paper a comprehensive ethnographic account of gang life and gang structure in general. Instead the purpose of this study is to synthesize the theoretical literature of globalization and apply it to what we know about specific gangs such as MS-13 and M-18 in North and Central America.
A Welcome Attack On American Values : How The Doctrines Of Robert Owen Attracted American Society, Elizabeth Johnson
A Welcome Attack On American Values : How The Doctrines Of Robert Owen Attracted American Society, Elizabeth Johnson
Constructing the Past
In November 1824, Robert Owen came to the United States with the intention of putting his beliefs about society into practice. He had done so once before in the “new system of society” that he had created at New Lanark (the site of a textile factory he owned), in which he singled out individualism, competition and selfishness as the sources of social evil. The prescribed cure was an improvement of their environment and circumstances, which Owen believed to be the true determiners of a person’s character. The experiment was considered a great success, and served as an international model. This …

The Park Place Economist
Athletics are linked to increasing one’s development of discipline, confidence, motivation, ability to work in groups, competitive spirit, ability to accept constructive criticism, and social networking. Past research has shown that participation in athletics during adolescence has proven to be beneficial to students in multiple areas of human capital development. This study aims to determine the impact of participation in high school athletics on the future income and educational attainment of student athletes.

Genocide Studies and Prevention: An International Journal
Churchill described the atrocities committed by Nazi troops and police under the German attack on the Soviet Union as something unprecedented: ‘‘Since the Mongol invasions of Europe in the sixteenth century, there has never been methodical, merciless butchery on such a scale, or approaching such a scale. And this is but the beginning. . . .We are in the presence of a crime without a name.’’1 A few years later, at Nuremberg, because of the lack of international legislation on this very crime, Hermann Go¨ring and his cronies were not convicted of genocide against Europe’s Jews or against the Sinti …

Boys And Girls: Chinese Future Teachers' Expectations, Ginny Q. Zhan, Monika Stojek, Hong Qian
Faculty Articles
The current study examines the expectations of Chinese education majors for their future students in the areas of academic behavior, classroom behavior, academic performance, and general behavior. Of special interest to us was the question whether the future teachers would have very similar or different expectations for boys and girls. A group of 152 education majors at a medium-sized university in Shanghai participated in the study by filling out a survey questionnaire. The results indicate that both male and female education majors had similar expectations of their future students in the areas of academic behavior, classroom behavior, and general behavior; …

The “working poor” have increased in many South Dakota counties. Several of those counties have also made the list of U.S. counties that have changed most drastically in working poverty percentages between 1990 and 2000 (Anderson 2006).

Race And Wealth Disparity: The Role Of Law And The Legal System, Beverly Moran, Stephanie Wildman

In response to the prevalent view that American law and legal institutions are class and color blind, this Article provides examples of how legal institutions sometimes do create and maintain racialized wealth disparities. The Article offers examples of this phenomenon by examining a sequence of federal judicial decisions, the federal taxing statutes, the role of legal education, and access to legal services. These examples are instructive because they cut across a broad spectrum of components of the American legal system. By revisiting issues of race and wealth in different legal settings from the Constitution to federal cases, the tax system, …
The Internationalization Of Lay Legal Decision-Making: Jury Resurgence And Jury Research, Richard O. Lempert
The Internationalization Of Lay Legal Decision-Making: Jury Resurgence And Jury Research, Richard O. Lempert
Articles
When I first began to study the jury more than thirty years ago, the topic of this Journal issue, jury systems around the world, was unthinkable. The use of juries, especially in civil litigation, had long been in decline, to the point of near extinction in England, the land of their birth, and the live question was whether the jury system would endure in the United States. It seemed clear that juries would not continue in their classic form, as many U.S. states, with the Supreme Court's eventual approval, mandated juries of less than twelve people and allowed verdicts to …

Deep Ecology And Postmodernity: Making Space For Conversation, Chris Drinkwater
Deep Ecology And Postmodernity: Making Space For Conversation, Chris Drinkwater
Reconstruction: Studies in Contemporary Culture
[Fourth paragraph]
I begin with the fact of ecology's virtual exclusion from cultural studies. Cultural studies are centrally concerned with issues of meaning, subjectivity, objectivity and knowledge. They attempt to describe their production, conditions and complex structural effects. They are particularly interested in effects of inclusion and exclusion: for instance, "What is a legitimate object of attention within a particular discourse?" Why do cultural studies not attend to ecology? Why is negligible attention paid to a discourse and cultural movement, which are so challenging to dominant values and ways of life? I suggest that the omission is not accidental. Cultural …

Review Of Restoring The Connection To The Natural World: Essays On The African American Environmental Imagination, Uwe Küchler
Reconstruction: Studies in Contemporary Culture
[First paragraph]
In her introduction to The Ecocriticism Reader from 1995, a landmark in the short and dynamic development of this new field of knowledge, Cheryl Glotfelty anticipated that "Ecocriticism has been predominantly a white movement. It will become a multi-ethnic movement when stronger connections are made between the environment and issues of social justice, and when a diversity of voices are encouraged to contribute to the discussion" (Glotfelty 1996, xxv). The collection of essays reviewed here, published in 2003, fills this gap in ecocritical research. The nine contributors to Sylvia Mayer's edition have critically evaluated various aspects of African …
