Civil Society Constitutionalism: The Power Of Contract Law, Marc Amstutz, Adreas Abegg, Vaios Karavas Jul 2007

Civil Society Constitutionalism: The Power Of Contract Law, Marc Amstutz, Adreas Abegg, Vaios Karavas

Indiana Journal of Global Legal Studies

This article argues that the vision of a social law of contract is exhibited in the judgment of the Swiss Federal Court in Post v. Verein gegen Tierfabriken ("VgT"). The judgment is one of a law of contract that interacts with a community of the subjects instead of the individual subjects of a community. This paper contends that law today has the task of providing for the areas of social autonomy from which "civil society" is built up and in which, at the same time, the increasing social fragmentation can be overcome piecemeal. The article argues that conceiving contract law …

Relational Contract And The Nature Of Private Ordering: A Comment On Vincent-Jones, David Campbell Jul 2007

Relational Contract And The Nature Of Private Ordering: A Comment On Vincent-Jones, David Campbell

Indiana Journal of Global Legal Studies

This paper focuses on the enormous growth of contract in the public sector over the last twenty years as part of the development of the "new public management." In the United Kingdom, the most penetrating assessment of the significance of this growth for the law of contract, its theory and its use, is Peter Vincent-Jones's The New Public Contracting, the thrust of which has been the basis of Vincent-Jones's contribution to this issue, The New Public Contracting: Public versus Private Ordering? In this paper, the author examines the welfarism of public sector contracting by means of a comment on Vincent-Jones's …

Building Math Esteem In Fifth Grade Students, Karen Schur Jul 2007

Building Math Esteem In Fifth Grade Students, Karen Schur

Department of Teaching, Learning, and Teacher Education: Master of Arts in Teaching, Summative Projects

In this action research study of my classroom of 5th grade mathematics, I investigate the levels of math esteem in each student and as a classroom. The definition of esteem on which I am basing my research is the judgment or estimation of the self-assurance of a student in math. I discovered that several of the students entered my classroom with a middle to low level of esteem in math, and about a third of the class already exhibited a positive, high esteem in math. After implementation of the research, and interpreting the data, I believe almost all the students …

Oil. Seeking Peace In The Niger Delta: Oil, Natural Gas, And Other Vital Resources, Darren Kew, David L. Phillips Jul 2007

Oil. Seeking Peace In The Niger Delta: Oil, Natural Gas, And Other Vital Resources, Darren Kew, David L. Phillips

New England Journal of Public Policy

Nigeria’s oil-rich Niger Delta region has seen little benefit from the billions of dollars earned from oil over the last four decades, prompting a growing but disorganized insurgency across the region. Irresponsible oil companies and government officials have reduced the Niger Delta to one of the most polluted environments on earth. Corrupt local and national politicians, many of whom came to power through rigged elections, have colluded to manipulate ethnic divisions amid poverty to loot the region’s wealth. Consequently, the people of the Niger Delta have no formal political voice in Nigeria’s nascent democratic system, increasing the appeal of militias …

The Voting Rights Act And The Election Of Nonwhite Officials, Pei-Te Lien, Dianne M. Pinderhughes, Carol Hardy-Fanta, Christine M. Sierra Jul 2007

The Voting Rights Act And The Election Of Nonwhite Officials, Pei-Te Lien, Dianne M. Pinderhughes, Carol Hardy-Fanta, Christine M. Sierra

Publications from the Center for Women in Politics and Public Policy

Voting Rights Act (VRA) is one of the most important—if not the most important—public policies developed over the last half century to increase access to the U.S. political system for people of color. The VRA also provides an important context for understanding the ascension of nonwhite groups into the elected leadership of the nation (Browning, Marshall, and Tabb 1984; Davidson and Grofman 1994; Menifield 2001; Mc-Clain and Stewart 2002; Segura and Bowler 2005; Bositis 2006). This essay assesses the present-day significance of the VRA for the political representation of communities of color by examining the implications of majority-minority districts and …

Is Interpersonal Trust A Necessary Condition For Organisational Learning?, Siu Loon Hoe Jul 2007

Is Interpersonal Trust A Necessary Condition For Organisational Learning?, Siu Loon Hoe

Research Collection School Of Computing and Information Systems

The organisational behaviour and management literature has devoted a lot attention on various factors affecting organisational learning. While there has been much work done to examine trust in promoting organisational learning, there is a lack of consensus on the specific type of trust involved. The purpose of this paper is to highlight the importance of interpersonal trust in promoting organisational learning and propose a research agenda to test the extent of interpersonal trust on organisational learning. This paper contributes to the existing organisational learning literature by specifying a specific form of trust, interpersonal trust, which promotes organisational learning and proposing …

Moral Judgment And Professional Legitimation, W. Bradley Wendel Jul 2007

Moral Judgment And Professional Legitimation, W. Bradley Wendel

Cornell Law Faculty Publications

In this essay I would like to consider the nature of the role of lawyers from the point of view of both jurisprudence and the sociology of professions. From this perspective it is apparent that the judgment characteristic of lawyers' expertise is not primarily the exercise of ethical discretion. Rather, it is the application of legal norms, which may incorporate moral principles by reference, but which are analytically distinct from morality. The task of legal education, and specifically of legal ethics education, might include training lawyers to be better at making moral judgments. In fact, there has been a fairly …

Racial Differences In The Relationship Between Infant Mortality And Socioeconomic Status, Kelly Stamper Balistreri, Edward G. Stockwell, Franklin W. Goza Jul 2007

Racial Differences In The Relationship Between Infant Mortality And Socioeconomic Status, Kelly Stamper Balistreri, Edward G. Stockwell, Franklin W. Goza

Sociology Faculty Publications

This study presents an ecological analysis of the relationship between infant mortality and economic status by race in metropolitan Ohio, using census data on mother's residence and economic status determined by the percentage of low-income families living in each area. The analysis updates previous studies as white-non-white comparisons for total infant mortality are examined for the US censuses of 1960, 1970, 1980, 1990 and 2000; and more detailed period- and broad cause-specific rates are presented for 2000. A pronounced inverse association is consistently found between income status and infant mortality for whites, while for non-whites this pattern first emerges in …

Memory, Tradition And Text: Uses Of The Past In Early Christianity - Edited By Alan Kirk And Tom Thatcher [Review Of The Book Memory, Tradition And Text: Uses Of The Past In Early Christianity, By A. Kirk & T. Thatcher, Ed.], Rubén R. Dupertuis

Religion Faculty Research

The aim of this collection of essays is, at least in part, to remedy the lack of attention that studies of early Christianity have paid to recent developments, in the fields of sociology and anthropology, in the study of memory. An excellent introductory survey by Alan Kirk of recent developments in memory studies is followed by eleven essays applying some aspect of the approach to various texts or problems in the study of early Christianity, and then by responses by Werner Kelber and Barry Schwartz. While the various contributions interact in different ways with the relevant theories and models, all …

The Place Of Criminology In The Study Of Terrorism: Implications For Homeland Security, Ihekwoaba D. Onwudiwe Jul 2007

The Place Of Criminology In The Study Of Terrorism: Implications For Homeland Security, Ihekwoaba D. Onwudiwe

African Journal of Criminology and Justice Studies

In this article, I intend to describe the history of terrorism, provide an explanation of some aspects of criminological theories related to the study of terrorism, and briefly articulate the link between criminology, terrorism, and homeland security. While criminology has made significant contributions in the understanding of crime in general, the literature on terrorism and homeland security by criminologists is still emerging. Arguably, this treatise calls for this void to be filled by criminologists, because terrorism and homeland security appropriately belong within the perimeters of criminology. This article employs the methodology of content analysis as used in social science research. …

Editor's Note, Padraig O'Malley

New England Journal of Public Policy

This issue of the New England Journal of Public Policy that deals with issues of climate change, oil, and water and the interconnection of the three with the future of the planet.

Initially our topic was conceived as “Oil & Water” only. We planned to present the proceedings of an Institute for Global Leadership symposium held at Tufts University in 2005. There was then still a debate about global warming, although the Kyoto Treaty was in place. But without the world’s preeminent manufacturer of greenhouse gas (GHG) emissions, the United States (20 percent of the total emissions with 5 percent …

A Reader’S Companion To Against Prediction: A Reply To Ariela Gross, Yoram Margalioth, And Yoav Sapir, Bernard E. Harcourt

Coase-Sandor Institute for Law & Economics Research Paper Series

From parole prediction instruments and violent sexual predator scores to racial profiling on the highways, instruments to predict future dangerousness, drug-courier profiles, and IRS computer algorithms to detect tax evaders, the rise of actuarial methods in the field of crime and punishment presents a number of challenging issues at the intersection of economic theory, sociology, history, race studies, criminology, social theory, and law. The three review essays of Against Prediction by Ariela Gross, Yoram Margalioth, and Yoav Sapir, raise these challenges in their very best light. Ranging from the heights of poststructuralist and critical race theory to the intricate details …

Specifying Children's Educational Expectations: The Potential Impact Of Institutions, William Elliott Iii Jul 2007

Specifying Children's Educational Expectations: The Potential Impact Of Institutions, William Elliott Iii

Center for Social Development Research

In this paper, we provide a conceptual framework for examining children’s educational expectations. The framework helps explain how both social and individual factors interact to form expectations about the utility of the education path for achieving desired goals. Further, we postulate that expectations are children’s internal representation of the educational institution. However, it is not until around fifth or sixth grade children begin to understand schools as impacting their capability for achieving desired goals. At this point, many minority and poor students begin to learn that effort and ability are not sufficient for academic success. Perceptions about what they can …

Assets Beyond Saving In Individual Development Accounts, Chang-Keun Han, Michal Grinstein-Weiss, Michael Sherraden Jul 2007

Assets Beyond Saving In Individual Development Accounts, Chang-Keun Han, Michal Grinstein-Weiss, Michael Sherraden

Center for Social Development Research

This study examines whether participation in Individual Development Accounts (IDAs) leads to a significant growth in assets beyond saving in the IDA accounts. Using a longitudinal experimental research design for low-income IDA participants, we test for impacts on five measures of assets: liquid assets, other financial assets, total financial assets, real assets, and total assets. Results show that, while there are no large differences in liquid and financial assets between the treatment group and the control group, IDA participants in the take-up group have more real assets and total assets than members of the control group. Results suggest that additional …

Attitudes Toward Institutional Features And Savings In Individual Development Accounts: Latent Class Analysis, Chang-Keun Han, Michael Sherraden

Center for Social Development Research

This exploratory study focuses on classifying attitudes toward institutional features of Individual Development Accounts (IDAs). This study also examines to what extent the attitudes change and how they are associated with savings in IDAs. While attitudes toward IDAs are generally positive, latent class analysis (LCA) found 3 groups, “highly positive," “moderately positive,” and “mixed opinion.” Race is significantly associated with the classification. This study found dynamic changes in attitudes at 18 months and 48 months after the baseline interview. While attitudes became somewhat more positive for 18% of participants, they became more negative for 26%. It was also found that …

"Sociological Legitimacy" In Supreme Court Opinions, Michael Wells Jul 2007

"Sociological Legitimacy" In Supreme Court Opinions, Michael Wells

Scholarly Works

Analysis of a Supreme Court opinion ordinarily begins from the premise that the opinion is a transparent window into the Court's thinking, such that the reasons offered by the Court are, or ought to be, the reasons that account for the holding. Scholars debate the strength of the Court's reasoning, question or defend the Court's candor, and propose alternative ways of justifying the ruling. This Article takes issue with the transparency premise, on both descriptive and normative grounds. Especially in controversial cases, the Court is at least as much concerned with presenting its holding in a way that will win …

Intimate Partner Homicide, Karitta A. Page Jul 2007

Intimate Partner Homicide, Karitta A. Page

Sociology & Criminal Justice Theses & Dissertations

Using data collected from the Chicago Women's Health Risk Study (Block 2000), this study looked at female perpetrated intimate partner homicide. The purpose of this study was to identify what factors, if any, differentiate between abused women who kill versus abused women who do not kill their intimate partners. Through conducting this study, several factors such as substance abuse, support networks and severe violence were compared between abused women who kill their intimate partner versus those who were abused women but did not kill. It was found that severe abuse, substance abuse by the abuser and the abused person were …
