Habitat And Distribution Of The Ruffed Lemur, "Varecia", North Of The Bay Of Antongil In Northeastern Madagascar, Evon R. Hekkala, Marius Rakotondratsima, Natalie Vasey
Anthropology Faculty Publications and Presentations
Here we present information on the conservation status of ruffed lemurs (Varecia) north of the Bay of Antongil in northeastern Madagascar. Two contiguous protected areas were recently established that traverse this region via blocks of forest connected by narrow forest corridors: the Masoala National Park, which expands further to the east, and the Makira Protected Area, which expands further to the west and northwest. The two extant ruffed lemurs, Varecia variegata and V. rubra, overlapped in this region historically and, on rare occasions, hybridized. As such, land north of the Bay of Antongil is a critical part …
The Spiritual World Of A Hakka Village, Sharon A. Carstens
The Spiritual World Of A Hakka Village, Sharon A. Carstens
Anthropology Faculty Publications and Presentations
This paper examines spiritual beliefs and practices in the Hakka Malaysian community of Pulai, focusing on the pantheon of deities and spirits worshipped and propitiated; the system of local beliefs in the power and efficacy of these deities; and the manner in which individuals and families have reproduced and altered these spiritual beliefs over time. Unlike my previous writings about religion in Pulai, which have emphasized the sociological components of local religion practices, my goal here is to explore the cosmological system, world view, and system of meanings conveyed through religious practices in this Hakka village.

Reservoir Characterization Of The Broom Creek Formation For Carbon Dioxide Sequestration, Justin J. Kringstad
Reservoir Characterization Of The Broom Creek Formation For Carbon Dioxide Sequestration, Justin J. Kringstad
Undergraduate Theses and Senior Projects
This engineering design is aimed at providing a thorough investigation on the potential of carbon dioxide (CO2) sequestration in the Williston Basin’s Broom Creek Formation. The objective of the design is to characterize the Broom Creek’s reservoir properties and provide detailed results of CO2 sequestration capacity, plume migration, and safety level. The methodology used to obtain results is an incorporation of geology, reservoir engineering, and injection operations. The reservoir simulation operations were conducted using Schlumberger’s ECLIPSE (Schlumberger, 2006).
An Examination Of The Chinese Immigrant Social Movements During The Chinese Exclusion Era, Alexander Lu
An Examination Of The Chinese Immigrant Social Movements During The Chinese Exclusion Era, Alexander Lu
LSU Master's Theses
This paper further develops a law-centered “political process” model of social movements by analyzing historical changes in American immigration law and the collective behavior of Chinese immigrants and Chinese Americans during the Chinese Exclusion Era. I present an interactive political process framework that considers not only how the broader political environment enables and constrains a movement, but also how challengers respond by actively reshaping the environment. I revisit the political process model’s core concept of “political opportunity structure” by examining legal rules and institutions, generally, and the indeterminacy of law, specifically. I apply this framework to the Chinese community’s initial …

All Faculty Publications
In the wake of the events of September 11th, the task of reconciling issues of security with a respect for fundamental human rights has emerged as one of the key challenges facing governments throughout the world. Although the issues raised by the rise of security have been the subject of considerable academic interest, to date much of the debate surrounding the impact of security on human rights has taken place within particular disciplinary confines. In contrast, this collection of essays from leading academics and practitioners in the fields of criminal justice, public law, international law, international relations and legal philosophy …

This report examines how courts in the UK and Europe respond when human rights and security appear to conflict. It compares cases from the United Kingdom, France, Germany, Spain, and the European Court of Human Rights (ECtHR). It examines how rights are applied and how courts use the concept of proportionality to mediate conflicts between rights and security. The report concludes that British courts are less consistent in their application of proportionality than countries with constitutional rights protections which tend to be more rigorous in their protections of rights than are countries, like the UK, that rely instead on the …

In British Columbia (Attorney General) v. Christie, 2007 SCC 21, [2007] 1 SCR 873, the unanimous full bench of the Supreme Court of Canada upheld a provincial sales tax ("PST") on legal services, rejecting a Charter challenge and overturning the lower courts' decisions that partially invalidated the tax. The taxpayer, a lawyer practising poverty law in British Columbia, challenged the validity of a provincial sales tax charging 7 percent on fees billed for legal services and payable on billing. The PST on legal services required lawyers and notaries public in private practice to add the tax onto their billings. The …
Three-Dimensional Quantitative Analysis Of The Trajectory Of The Foot While Running, Thomas J. Cunningham
Three-Dimensional Quantitative Analysis Of The Trajectory Of The Foot While Running, Thomas J. Cunningham
University of Kentucky Master's Theses
Exercising the leg in a manner similar to running is theorized to have the potential effect of increasing performance and reducing occurrence of injuries in running athletes. Development of an exercise device that can help facilitate this method of specificity training could be beneficial to the sports community and should be investigated. Understanding the trajectory of the foot during the running gait is primary to further pursue this concept. 26 running athletes of varying characteristics participated in this study. Each subjects sex, age, weight, height, leg length, activity level and participation amount in their respective sport was recorded. Retro-reflective cameras …

Lost Paternity In The Culture Of Motherhood, Jeffrey A. Parness

In her recent Columbia Law Review article, "Infant Safe Haven Laws: Legislating in the Culture of Life," Professor Carol Sanger shows that American safe haven laws, viewed within a larger political culture, promote the goal of the culture of life: the reversal of Roe v. Wade. Their effectiveness in that pursuit, she correctly notes, depends on whether judges and others recognize the strong differences between varying culture of life settings. Like Professor Sanger, I see differences between safe haven abandonment and abortion. Unfortunately, Professor Sanger fails to note that American safe haven laws, within a larger political culture, also significantly …

Safe Haven, Adoption And Birth Record Laws: Where Are The Daddies?, Jeffrey A. Parness, Therese A. Clarke Arado
Faculty Articles, Papers, and Other Scholarship
An earlier version of this paper was presented by Professor Parness at the Third Annual Wells Conference on Adoption Law under the title, "Safe Haven Laws: Where Are the Daddies?", at Capital University Law School on February 15, 2007. The paper explores the difficulties in American state safe haven, adoption and birth record laws, crystalized in the question: "Where are the daddies?" After briefly reviewing safe haven laws, the paper demonstrates how paternity interests are unreasonably, if not unconstitutionally, foreclosed when children are abandoned by their mothers. Comparable paternity losses due to maternal acts are then shown under adoption and …

Lincoln/Net (http://lincoln.lib.niu.edu), a product of the Abraham Lincoln Historical Digitization Project at Northern Illinois University Libraries, represents a new type of historically oriented digital library resource. Like many other digital libraries, it contains a large amount of searchable primary source materials. Like a number of other historically oriented online resources, project staff have organized Lincoln/Net around a specific topic, in this case Abraham Lincoln's life and times in antebellum Illinois. In addition to Lincoln's own papers, the project's databases contain resources shedding light on his context, including letters, diaries, and publications prepared by his peers. Unlike most historically oriented digital …

Emigration To Liberia From The Chattahoochee Valley Of Georgia And Alabama, 1853-1903, Matthew F. Mcdaniel
LSU Master's Theses
Between 1853 and 1903, approximately five hundred African-Americans left the Chattahoochee Valley of Georgia and Alabama to start new lives in the West African republic of Liberia. Most of the emigrants came from Columbus, Georgia, and Eufaula, Alabama, and departed for Liberia during the uncertainty of the post-Civil War years of 1867 and 1868. Most sought safety and escape from a still intact white supremacist society. The ready availability of land in Liberia also promised greater opportunities for prosperity there than in the South. Black nationalism and evangelical zeal motivated others. Liberia would be their “own†country and afford an …
Byron And "Scribbling Women": Lady Caroline Lamb, The Brontë Sisters, And George Eliot, Denise Tischler Millstein
Byron And "Scribbling Women": Lady Caroline Lamb, The Brontë Sisters, And George Eliot, Denise Tischler Millstein
LSU Doctoral Dissertations
Looking first at Byron’s canon, I trace the evolution of the Byronic heroes offered in his poetry, arguing that these heroes are the culmination of images of the poet as he interacted with and was interpreted by his female reading audience. Working with his readers, Byron fundamentally altered his poetic heroes to suit changing public opinions about himself. In later chapters, I show how this image continued to evolve as the Byronic hero was co-opted, adopted, and adapted in the novels of female authors across the nineteenth century, especially Lady Caroline Lamb in Glenarvon, Emily Brontë in Wuthering Heights, Anne …
Psychiatric Restraint And Seclusion: Resisting Legislative Solution, Stacey A. Tovino
Psychiatric Restraint And Seclusion: Resisting Legislative Solution, Stacey A. Tovino
Scholarly Works
The use of restraint and seclusion in the American psychiatric setting has a rich history—rich in medical, ethical, legal, and social controversy. For centuries, mental health care providers used movement restrictions and solitary confinement to manage psychiatric patients. Superintendents of eighteenth and early nineteenth century insane asylums and other institutions of confinement believed that strait-waistcoats, “tranquilizer chairs,” “maniac beds,” chains, shackles, and “quiet rooms” deescalated agitation and promoted self-control. Reforms beginning in the nineteenth century helped make some psychiatric institutions more humane, in part because staff members were trained to find ways to calm potentially violent patients without imposing holds …
Survival, Habitat Use, And Movements Of Female Mallards Wintering In Southwestern Louisiana, Paul Thomas Link
Survival, Habitat Use, And Movements Of Female Mallards Wintering In Southwestern Louisiana, Paul Thomas Link
LSU Master's Theses
Little information is available concerning survival, habitat use, and movements of mallards (Anas platyrhychos) wintering on the Gulf Coast Chenier Plain (GCCP). Quantitative data on these parameters would be useful in making effective management decisions by GCCP waterfowl managers. Accordingly, I radio-marked 135 female mallards during winters 2004-2005 and 2005-2006 in southwestern Louisiana. My estimated survival rate for both winters combined was 0.68 ± 0.06 and did not differ by female age. Hazard ratios indicated that radio-marked females were 21-24 times more likely to die during hunted time periods than during non-hunted time periods. Estimated hunting and non-hunting mortality rates …
Feral Swine Action Plan For Oregon, Mark Sytsma, Arick Christopher Rouhe
Feral Swine Action Plan For Oregon, Mark Sytsma, Arick Christopher Rouhe
Center for Lakes and Reservoirs Publications and Presentations
Feral swine are defined as free roaming animals of the genus Sus that are not being held under domestic management or confinement. Swine have spread from Europe and Russia to habitats around the world via human introduction. Currently, feral swine populations are established on every continent except Antarctica. Unlike other large mammal invaders, swine have a high reproductive capacity and are omnivorous, which allows for a quick assimilation into most habitats. Once a breeding population is established in an area, the population can quickly increase and negatively impact the ecosystem. A successful invasion of feral swine is difficult, and sometimes …
Predictors Of Adl Disability In Culturally Diverse Older Adults, Fernanda Holton
Predictors Of Adl Disability In Culturally Diverse Older Adults, Fernanda Holton
LSU Master's Theses
Almost 42% of adults over 65 years of age live with at least one disability. Further, people of lower socioeconomic status and Blacks have greater risks for disability than Whites and individuals at higher socioeconomic status. The consequences of disability include loss of independence, decreased quality of life, increased chances of depression, consumption of health care services, and institutionalization. The purpose of this study was to utilize the disablement process framework to examine the contribution of physical function, dyspnea, and pain to disability in activities-of-daily-living (ADL) in culturally diverse older adults (i.e., diverse according to race, income, and education). Participants …
Determinants Of The Onset Of Disability In Old Age, Kayla Fontenot
Determinants Of The Onset Of Disability In Old Age, Kayla Fontenot
LSU Master's Theses
With a rapidly aging population, maximizing independent living among the elderly is a growing concern. The inability to perform normal basic care activities interferes with an older individual's ability to live independently. In this study, I examine the onset of disability among elderly Americans using the 2002 and 2004 waves of the Health and Retirement Survey (HRS). In examining the explanatory power of both the life course perspective and the medical model, I find that the medical model is better able to explain onset of disability for males while the life course perspective prevails when explaining onset of disability among …
Revelations From "Cheesecake Manor": Agatha Christie, Detective Fiction, And Interwar England, Carron Stewart Fillingim
Revelations From "Cheesecake Manor": Agatha Christie, Detective Fiction, And Interwar England, Carron Stewart Fillingim
LSU Master's Theses
For too long standard interwar histories have portrayed the interwar years as a period marked by failure, instability, depression, and volatility. Instead, rising living standards, the narrowing of socioeconomic disparities, expanded avenues of social welfare, increased leisure time, and mass consumerism resulted in an altogether peaceful, healthier, stable, and increasingly affluent England. Out of these rising economic improvements emerged forms of mass entertainment, including popular fiction. Cheaper paper and printing methods, rising literacy, faster distribution methods, new forms of advertising, and the expansion of public libraries led to the creation of a mass readership across England. For the first time, …

The Search Interest In Contract, Joshua Fairfield
The Search Interest In Contract, Joshua Fairfield
Articles by Maurer Faculty
Parties often do not negotiate for contract terms. Instead, parties search for the products, terms, and contractual counterparties they desire. The traditional negotiation-centered view of contract leads courts to try to determine the meaning of the parties where no meaning was negotiated and to waste time determining the benefits of bargains that were never struck. Further, while courts have ample tools to validate specifically negotiated contract terms, they lack the tools to respond to searched-for terms. Although the law and literature have long recognized that there is a disconnect between the legal fictions of negotiation and the reality of contracting …
An Hedonic Analysis Of Southwestern Louisiana Wetland Prices Using Gis, Baifu Xu
An Hedonic Analysis Of Southwestern Louisiana Wetland Prices Using Gis, Baifu Xu
LSU Master's Theses
Louisiana is the beneficiary of more than 30% of the U.S. coastal wetlands, but the state’s wetland loss accounts for about 90% of the total throughout the continental United States. The Coastal Wetlands Planning, Protection and Restoration Act of 1990 and the $1.9 billion that has recently been dedicated by Congress for coastal restoration activities will certainly aid in restoration efforts. However, these dedicated funds are but a small fraction of the total monies that will be required to maintain/restore Louisiana’s degraded wetlands. Recent estimates suggest restoration activities will cost, at a minimum, about $14 billion. The research, based on …
Toward A History Of Children As Witnesses, David S. Tanenhaus, William Bush
Toward A History Of Children As Witnesses, David S. Tanenhaus, William Bush
Scholarly Works
This brief essay offers a selective overview of recent trends in the historical scholarship on American childhood from the origins of the American Revolution to the early years of the Cold War. This overview of the literature has two purposes. First, it highlights recent socio-cultural scholarship that presents substantive challenges to the conventional ways of understanding the history of children and the law. Second, in so doing, it points out that legal histories concerned solely with doctrinal matters can, and often do, present a limited and distorted window into the past. Instead, the essay argues that the place of children, …

Synaptic Boojums: Lewis Carroll, Linguistic Nonsense, And Cyberpunk, Jennifer Kelso Farrell
LSU Doctoral Dissertations
Tracing a line from Lewis Carroll to 20th-century science fiction and cyberpunk, this project establishes an alternate genealogy based on the use of linguistic nonsense. Science fiction, rather than being merely a genre defined by specific narrative devices or character traits, is instead a language in and of itself. And like any language, it must be learned in order to be understood. Carroll used nonsense as a means of subverting conventional 19th-century opinions of language and, and by extension, society. Carroll was so successful at this that in 1937 American psychiatrist Paul Schilder discussed the dangers to a child's mind …

Destructive Ambiguity: Enemy Nationals And The Legal Enabling Of Ethnic Conflict In The Middle East, Michael Kagan
Destructive Ambiguity: Enemy Nationals And The Legal Enabling Of Ethnic Conflict In The Middle East, Michael Kagan
Scholarly Works
In the course of the Middle East conflict since 1948, both the Arab states and Israel have tended to take harsh measures against civilians based on their national, ethnic, and religious origins. This practice has been partially legitimized by a norm in international law that permits states to infringe the liberty and property interests of enemy nationals during armed conflict. Middle Eastern governments have misused the logic behind this theoretically exceptional rule to justify far-reaching measures that undermine the “principle of distinction” between civilians and combatants and erode the principle of non-discrimination that lies at the center of human rights …

Nature, Nurture, Mythology: A Cultural History Of Dutch Orangism During The First Stadholderless Era, 1650-1672, Greg Alan Beaman
LSU Master's Theses
Through its military and political service to the United Provinces of the Netherlands during the course of the Dutch struggle for independence from Spain, the house of Orange came to occupy a special place in Dutch culture. The image of the house of Orange in Dutch political culture followed a trajectory of cultural assimilation from the sixteenth century to the early eighteenth century, whereby Orange's continued service linked it inextricably to certain aspects of Dutch culture. Having granted the house of Orange legitimacy as political leaders, the Dutch people went about incorporating Orange into the heart of their cultural spirit. …
