European Versus American Liberty: A Comparative Privacy Analysis Of Anti-Terrorism Data-Mining, Francesca Bignami Jan 2007

European Versus American Liberty: A Comparative Privacy Analysis Of Anti-Terrorism Data-Mining, Francesca Bignami

GW Law Faculty Publications & Other Works

The difference between European and American regulation of marketplace privacy is well-established: information privacy is protected more under European law than American law. Recently, with the revelation of a number of U.S. government, anti-terrorism programs, it has become clear that the transatlantic difference is not limited to the market. Also in the face of government action, Europeans protect information privacy more than Americans. This paper brings to light the legal differences between the two systems by considering the case - real in the United States, hypothetical in Europe - of a spy agency's database of call records, created for the …

The Uneasy Case For Patent Races Over Auctions, Michael B. Abramowicz Jan 2007

The Uneasy Case For Patent Races Over Auctions, Michael B. Abramowicz

GW Law Faculty Publications & Other Works

In advancing his prospect theory of patents, Edmund Kitch dismissed the possibility of distributing rights to particular inventions through auctions, arguing that the patent system avoids the need for governmental officials to define the boundaries of inventions that have not yet been created. Auctions for patent rights to entire inventive fields, however, might accentuate the benefits of a prospect approach, by allowing for earlier and broader patents. Auction designs that award the patent to the bidder that commits the most money to research and development or that agrees to charge the lowest price, meanwhile, can reduce the costs of the …

The Hidden Beauty Of The Quadratic Market Scoring Rule: A Uniform Liquidity Market Maker, With Variations, Michael B. Abramowicz Jan 2007

The Hidden Beauty Of The Quadratic Market Scoring Rule: A Uniform Liquidity Market Maker, With Variations, Michael B. Abramowicz

GW Law Faculty Publications & Other Works

The logarithmic market scoring rule has emerged as a standard automated market maker. The approach is particularly useful for combinatorial markets, but this article argues that for a variety of prediction market applications, the quadratic market scoring rule may be more sensible. With that rule, liquidity is uniform across the probability or prediction spectrum. Moreover, the rule can easily be adapted for contexts in which greater liquidity is desired for some portion of the probability or prediction spectrum. For each binary or linear outcome being predicted, two separate markets are used, so that a forecaster can always buy shares in …

Conflicts Of Interest And Corporate Governance Failures At Universal Banks During The Stock Market Boom Of The 1990s: The Cases Of Enron And Worldcom, Arthur E. Wilmarth Jr. Jan 2007

Conflicts Of Interest And Corporate Governance Failures At Universal Banks During The Stock Market Boom Of The 1990s: The Cases Of Enron And Worldcom, Arthur E. Wilmarth Jr.

GW Law Faculty Publications & Other Works

The re-entry of commercial banks into the securities business transformed U.S. financial markets during the 1990s. The Gramm-Leach-Bliley Act of 1999 (GLBA) removed most of the legal barriers that had separated commercial and investment banking since 1933. GLBA allows commercial banks to become universal banks by affiliating with securities firms and insurance companies. In large part, GLBA ratified the securities underwriting powers that commercial banks gained during the 1990s, based on a series of orders issued by federal regulators and federal courts.

By 2000, the top ten global underwriters of securities included three U.S. banks, three foreign banks, and four …

Comment Letter To The U.S. Treasury Department Concerning The Regulatory Structure For Financial Institutions, Arthur E. Wilmarth Jr. Jan 2007

Comment Letter To The U.S. Treasury Department Concerning The Regulatory Structure For Financial Institutions, Arthur E. Wilmarth Jr.

GW Law Faculty Publications & Other Works

This comment letter was submitted to the U.S. Treasury Department in connection with that Department's review of proposals for changes in the regulatory structure for financial institutions. The comment letter presents the following policy recommendations: (1) the thrift charter should be eliminated, existing thrifts should be required to convert into banks, and the Office of Thrift Supervision should be merged with the Office of the Comptroller of the Currency (OCC); (2) the dual banking system should be preserved and strengthened in order to promote innovation in banking regulation and to support the community bank sector; (3) at least one federal …

Wal-Mart And The Separation Of Banking And Commerce, Arthur E. Wilmarth Jr. Jan 2007

Wal-Mart And The Separation Of Banking And Commerce, Arthur E. Wilmarth Jr.

GW Law Faculty Publications & Other Works

During 2005-2006, Wal-Mart, Home Depot, and several other commercial firms applied to the Federal Deposit Insurance Corporation (FDIC) for permission to acquire FDIC-insured industrial loan companies (ILCs). Those applications were opposed by business groups, labor unions, community activists, and members of Congress. In January 2007, the FDIC imposed a one-year moratorium on all acquisitions of ILCs by commercial firms and asked Congress to determine whether such acquisitions should be prohibited.

As the FDIC noted, acquisitions of ILCs by commercial firms raise three important policy issues, which are addressed in this Article. First, commercial ownership of ILCs conflicts with the policy …

Towards A Right To Privacy In Transnational Intelligence Networks, Francesca Bignami Jan 2007

Towards A Right To Privacy In Transnational Intelligence Networks, Francesca Bignami

GW Law Faculty Publications & Other Works

Transnational intelligence networks have emerged as an essential tool for combating international terrorism and criminal activity. As with domestic intelligence-gathering, they raise a number of privacy concerns: the risk of false information, the danger that intelligence will be used for illegitimate purposes, and the burden placed on human dignity and individual autonomy by free-wheeling data gathering. Transnational networks, however, exacerbate these privacy problems due to the dispersed nature of government authority and the difficulty of ensuring compliance with privacy duties by each node in the network. This article illustrates the dangers of transnational intelligence sharing with the case of Maher …

Strict Liability In International Environmental Law, Dinah L. Shelton Jan 2007

Strict Liability In International Environmental Law, Dinah L. Shelton

GW Law Faculty Publications & Other Works

The principle that a State is responsible for causing environmental harm outside its territory in breach of an international obligation has been slow to evolve to address the allocation of loss due to accidents. In settling the well-known dispute between the United States and Canada concerning the activities of the Canadian smelter located in Trail, British Columbia, the arbitral tribunal asserted a general duty on the part of the State to protect other States from injurious acts by individuals (both state and non-state actors) within its jurisdictions. The tribunal, however, noted the difficulty determining what constitutes an injurious act, but …

China: Creating A Legal System For A Market Economy, Donald C. Clarke Jan 2007

China: Creating A Legal System For A Market Economy, Donald C. Clarke

GW Law Faculty Publications & Other Works

Since the early 1990s, China has come a long way in legislating the foundational rules for its reformed economy. Virtually all of the important areas-contracts, business organizations, securities, bankruptcy, and secured transactions, to name a few - are now covered by national legislation as well as lower-level regulations. Yet an important feature of a legal structure suited to a market economy is missing: the ability of the system to generate from below solutions to problems not adequately dealt with by existing legislation. The top-down model that has dominated Chinese law reform efforts to date can only do so much. What …

Autonomy To Choose What Constitutes Family: Oxymoron Or Basic Right?, Naomi R. Cahn, June Carbone Jan 2007

Autonomy To Choose What Constitutes Family: Oxymoron Or Basic Right?, Naomi R. Cahn, June Carbone

GW Law Faculty Publications & Other Works

Alasdair MacIntyre, Michael Sandel and other critics have argued that liberalism is living off the borrowed capital of Western civilization. That is, to the extent that liberalism requires neutrality among theories of the good, the state cannot ensure that the generation of values - of strong families, hard workers, honest people, engaged citizens, and devout church members - necessary to liberalism itself will occur. William Galston responded to this critique by arguing that liberalism does not require neutrality toward the creation of values central to liberalism itself. A liberal democratic state should be able to foster liberal virtues, and, indeed, …

This is the complete text of Daniel J. Solove's book, THE FUTURE OF REPUTATION: GOSSIP, RUMOR, AND PRIVACY ON THE INTERNET (Full Text) (Yale University Press, October 2007).

Teeming with chatrooms, online discussion groups, and blogs, the Internet offers previously unimagined opportunities for personal expression and communication. But there's a dark side to the story. A trail of information fragments about us is forever preserved on the Internet, instantly available in a Google search. A permanent chronicle of our private lives - often of dubious reliability and sometimes totally false - will follow us wherever we go, accessible to friends, …

Antibacterial Activity Of Apis Mellifera L. Propolis Collected In Three Regions Of Kenya, Elliud M. Muli, J. M. Maingi

All Peer-Reviewed Publications

The present study aimed at investigating the susceptibility of the microorganisms Pseudomonas aeruginosa, Salmonella typhi, Escherichia coli, Staphylococcus aureus, and Bacillus subtilis to ethanolic extracts of propolis (EEP) from three regions of Kenya (Taita, Tana and Samburu). Propolis was extracted using four different concentrations of ethanol: pure, 70%, 50%, and 30%. Ethanol (70%) and Streptomycin were used as controls. The agar diffusion method using filter paper disks was employed. Antibacterial activity was determined as an equivalent of the inhibition zones diameters (in millimeters) after incubation at 37°C for 24h. Significant differences in the antibacterial activities of propolis were observed among …

A study was carried out at Karima Village in the Mwea Rice Irrigation Scheme in Kenya to assess the impact of rice husbandry and associated land cover change for mosquito larval abundance. A multi-temporal, land use land cover (LULC) classification dataset incorporating distributions of Anopheles arabiensis aquatic larval habitats was produced in ERDAS Imagine version 8.7 using combined images from IKONOS at 4m spatial resolution from 2005 and Landsat Thematic Mapper (TM)™ classification data at 30-meters spatial resolution from 1988 for Karima. Of 207 larval habitats sampled, most were either canals (53.4%) or paddies (45.9%), and only one habitat was …

Mosquito Larval Habitats In A Semiarid Ecosystem In Eritrea: Impact Of Larval Habitat Management On Anopheles Arabiensis Population, Josephat Shililu, Charles Mbogo, Tewolde Ghebremeskel, John Githure, Robert Novak

All Peer-Reviewed Publications

This study investigated the impact of larval management and the temporal variation in larval productivity in Eritrea, a semiarid ecosystem. Results of this study show that mosquito breeding persists throughout the year mainly in stream bed pools. Anopheles arabiensis production in the ephemeral natural aquatic habitats such the streambed pools was high throughout the year and negatively associated with rainfall (r = -0.288, P = 0.047). High densities of An. arabiensis larvae were also recorded from canals and drainage channels at wells and communal water supply points. The numerous water supply locations and wells help sustain malaria transmission by serving …

The Singapore Model Of Housing And The Welfare State, Sock Yong Phang Jan 2007

The Singapore Model Of Housing And The Welfare State, Sock Yong Phang

Research Collection School Of Economics

While Singapore is not generally regarded as a welfare state, the provision of housing welfare on a large scale has been a defining feature of its welfare system. The extensive housing system has played a useful role in raising savings and homeownership rates as well as contributing to sustained economic growth in general and development of the housing sector in particular. Few would dispute the description of Singapore’s housing policies as 'phenomenally successful' (Ramesh, 2003). Singapore’s economic growth record in the past four decades has brought it from third world to first world status (Lee, 2000), with homeownership widespread at …

Fatigue's Influence On Workload, Situation Awareness, And Performance In A Military Simulation Of Combat, Carlotta M. Boone Jan 2007

Fatigue's Influence On Workload, Situation Awareness, And Performance In A Military Simulation Of Combat, Carlotta M. Boone

Psychology Theses & Dissertations

Military operations routinely require military personnel to consistently perform their duties over several hours or days. Tasks that require prolonged work can lead to mental fatigue and decreased performance. The transactional model proposes that individuals cope with changes in the environment and maintain performance. This ability to cope is determined by factors of the environment and the individual's personality. One environmental factor that can influence coping is extended task performance. This study examined the effect of extended task performance and its interaction with task difficulty. Participants interacted with the military simulation game Command and Conquer: Generals™ for three hours. They …

When an individual loses their website and a backup can-not be found, they can download and run Warrick, a web-repository crawler which will recover their lost website by crawling the holdings of the Internet Archive and several search engine caches. Running Warrick locally requires some technical know-how, so we have created an on-line queueing system called Brass which simplifies the task of recovering lost websites. We discuss the technical aspects of recon-structing websites and the implementation of Brass. Our newly developed system allows anyone to recover a lost web-site with a few mouse clicks and allows us to track which …
