Getting Permission, Philip A. Hamburger
Getting Permission, Philip A. Hamburger
Faculty Scholarship
Institutional Review Boards ("IRBs") are the instruments of a system of licensing – a system under which scholars, students, and other researchers must get permission to do research on human subjects. Although the system was established as a means of regulating research, it regulates research by licensing speech and the press. It is, in fact, so sweeping a system of licensing speech and the press that it is reminiscent of the seventeenth century, when Galileo Galilei had to submit to licensing and John Milton protested against it. Accordingly, it is necessary to examine the constitutionality of IRB licensing and, more …
International Antitrust Negotiations And The False Hope Of The Wto, Anu Bradford
International Antitrust Negotiations And The False Hope Of The Wto, Anu Bradford

Multinational corporations ("MNCs") operate today in an increasingly open global trade environment. While tariff barriers have collapsed dramatically, several states and numerous scholars have raised concerns that the benefits of trade liberalization are undermined by various non-tariff barriers ("NTBs") to trade, including the anticompetitive business practices of private enterprise. As a result, demands to link trade and antitrust policies more closely by extending the coverage of the World Trade Organization ("WTO") to incorporate antitrust law have gathered momentum over the last decade.
Most advocates of a WTO antitrust agreement base their normative claims on largely intuitive assumptions about the necessity …
Judge Richard Posner On Civil Liberties: Pragmatic Authoritarian Libertarian, Bernard Harcourt
Judge Richard Posner On Civil Liberties: Pragmatic Authoritarian Libertarian, Bernard Harcourt
Faculty Scholarship
How do you reconcile an opinion like Edmond v Goldsmith with the anti-civil-libertarian positions that Richard Posner advocates in his book Not a Suicide Pact: The Constitution in a Time of National Emergency? The book itself is self-consciously directed against a civil libertarian framework. "The sharpest challenge to the approach that I am sketching," Posner knowingly anticipates, "will come from civil libertarians," by which he means those "adherents to the especially capacious view of civil liberties that is often advanced in litigation and lobbying by the American Civil Liberties Union." In his book, Richard Posner argues in defense of the …

Fine Particle Classification Using Dilute Fluidized Beds, Rajasekharan Pillai Annapoorneswari
Masters Theses
"The main objective of this project is to classify spherical soda-lime glass particles based on their size using a dilute fluidized bed system. The influence of inclined plates in the column, plate separation, plate inclination, and number of plates on the overall separation efficiency of particles will be investigated. The effect of column shape on the classification efficiency will also be assessed"--Introduction, page 3.
Applications Of Solar Energy To Power Stand-Alone Area And Street Lighting, Joshua David Bollinger
Applications Of Solar Energy To Power Stand-Alone Area And Street Lighting, Joshua David Bollinger
Masters Theses
"A stand-alone solar-powered street or area lighting system is designed and operated completely independent of the power grid. The equipment and maintenance costs associated with a stand-alone solar-powered system are compared with the cost of using electricity to run grid connected street lights. The project focused on the viability of using solar energy to power the lights in the area surrounding St. Louis, Missouri. The results had to be consistent to warrant converting new areas to independent solar powered lighting. A prototype system is constructed from equipment available on the market for the purpose of gathering data on different lighting …

Turkish Journal of Medical Sciences
Aim: Lower urinary tract symptoms (LUTS) are a common problem in ageing men. The aim of this study was to estimate the prevalence of LUTS, as measured by the International Prostate Symptom Score (IPSS), and to establish the relationship between the IPSS and quality of life (QoL) in different age groups of men over 40 years old living in Samsun city center in northern Turkey. Materials and Methods: In all, 1860 men aged over 40 years were included in this cross-sectional study. The Turkish version of the IPSS was applied to all participants using face-to-face interview. Results: The median IPSS …
Judging Untried Cases, Daniel C. Richman
Judging Untried Cases, Daniel C. Richman

That federal criminal trials are an endangered species is clear. During fiscal year 2004, only 4% (3346) of the 83,391 federal defendants in terminated cases went to trial. And, trends that Professor Ronald Wright highlights in his insightful article have continued past the end point of his data. In 1994, 4639 defendants obtained verdicts from juries and 1050 from judges; in 2003, just 2909 and 615, respectively, did so. Every time one thinks that the system has hit an equilibrium at some “natural” distribution, the trial rate goes down a bit more.
The Presidential Signing Statements Controversy, Ronald A. Cass, Peter L. Strauss
The Presidential Signing Statements Controversy, Ronald A. Cass, Peter L. Strauss
Faculty Scholarship
Presidential signing statements have come out of obscurity and into the headlines. Along with salutary attention to an interesting issue, the new public visibility of signing statements has generated much overblown commentary. The desire to make these little-known documents interesting to the public – and to score points in the inevitable political battles over any practice engaged in by a sitting President – has produced a lot of discussion that misleads the public and has tended to obscure the significant issues surrounding the use of signing statements. Reflection may help put the discussion in a more useful perspective. We offer …
Leo Strine's Third Way: Responding To Agency Capitalism, Ronald J. Gilson
Leo Strine's Third Way: Responding To Agency Capitalism, Ronald J. Gilson
Faculty Scholarship
Ten years ago, Tony Blair's "New Labour" government sought an agenda that replaced ideology with a pragmatic focus on both the creation of wealth and its distribution. Not surprisingly, part of this effort involved proposals to bridge the gap between capital and labor through refraining corporate governance. A "third way" as it was then styled, would walk a fine line between privileging markets and allocational efficiency at the cost of social justice on the one hand, and accepting less for everyone as long as the distribution was fair on the other. Motivated by changes in how we save for retirement …
Eliminative Materialism And The Distinction Between Common Sense And Science, Nada Gligorov
Eliminative Materialism And The Distinction Between Common Sense And Science, Nada Gligorov
Dissertations, Theses, and Capstone Projects
It is one of the premises of eliminative materialism that commonsense psychology constitutes a theory. There is agreement that mental states can be construed as posited entities for the explanation and prediction of behavior, and that the nature of those states is dependent on the theory that features them. Disputes arise when it comes to the range of the commonsense theory of mental states. In chapter one, I review major arguments concerning the span and nature of folk psychology. In chapter two, relying on arguments by Quine and Sellars, I argue that the precise scope of commonsense psychology cannot be …

Reconfiguring Industrial Policy: A Framework With An Application To South Africa, Ricardo Hausmann, Dani Rodrik, Charles F. Sabel
Faculty Scholarship
The main purpose of industrial policy is to speed up the process of structural change towards higher productivity activities. This paper builds on our earlier writings to present an overall design for the conduct of industrial policy in a low- to middle-income country. It is stimulated by the specific problems faced by South Africa and by our discussions with business and government officials in that country. We present specific recommendations for the South African government in the penultimate section of the paper.

Developing Markets In Baby-Making: In The Matter Of Baby M, Carol Sanger

In this Essay, I want to explore the Baby M case from a different, less philosophical perspective. The question I pose is simply this: how did the Sterns and the Whiteheads find one another in the first place? After all, apart from their New Jersey location (and a shared fondness for Bruce Springsteen), the two couples had little in common. Mary Beth was a high school dropout; Betsy had a Ph.D. and M.D. from the University of Michigan. Rick was a Vietnam vet fighting an ongoing battle with unemployment and alcoholism; Bill led what close friends called "a quiet, industrious …

The Effect Of Nutrition Information On Menu Selection When Eating Food Away From Home, Rebecca Foster Hochradel
Theses and Dissertations in Business Administration
As the number of Americans diagnosed with heart disease, diabetes, and excessive weight continues to increase, providing information to allow consumers to choose healthier foods becomes imperative. The number of consumers eating food away from home (EFAH) is rising. Although nutrition information is required on food products purchased for home use, it is not required when EFAH. How can a consumer know what is healthy if nutrition information is not provided? Policy makers and restaurateurs are in conflict regarding the provision of nutrition information on the menu. Policy makers want this information to be provided while restaurateurs say providing this …
Edward Durell Stone: Perception And Criticism, Mary Anne Hunting
Edward Durell Stone: Perception And Criticism, Mary Anne Hunting
Dissertations, Theses, and Capstone Projects
The work of the New York City-based architect Edward Durell Stone (1902-1978) has been subject to ongoing critical controversy. Stone achieved phenomenal success, beginning in the 1950s as an architect in the period of the Cold War, with buildings on four continents, in thirteen foreign countries, and in thirty-two states. But an examination of his stylistic progression reveals that Stone increasingly fell out of critical favor as he shifted modernism from the International Style to a more "romantic" modern aesthetic that incorporated decoration along with aspects of monumentality, regionalism, historicism, and fantasy—a progression that can be traced in six of …
Family Temporal Organization And Children's Affect Regulation: A Quantitative And Qualitative Study Of First Generation Dominican Families, Alba Cabral
Dissertations, Theses, and Capstone Projects
This study examined the hypothesis that temporal organization of family life is associated with children's affect regulation in first generation Dominican families. Eighteen families with children between ages one and half and five participated in this study, completing questionnaires about family time and routines, children's affect regulation, and child behavior problems. The families participated in interviews that inquired into family routines, family time and children's affect regulation according to the parent. Four of these families were selected for qualitative analysis of themes that illuminated the hypotheses tested. Correlational analysis confirmed the main hypothesis tested, namely, the existence of a relationship …
Behavior And Ecology Of The Mona Monkey In The Seasonally Dry Lama Forest, Republic Of Bénin, Reiko Matsuda Goodwin
Behavior And Ecology Of The Mona Monkey In The Seasonally Dry Lama Forest, Republic Of Bénin, Reiko Matsuda Goodwin
Dissertations, Theses, and Capstone Projects
I investigated the behavior and ecology of the mona monkey (Cercopithecus mona Schreber, 1774) in the Lama Forest for 17 months, and estimated the population density and biomass of the anthropoid species in the forest.
I found that Cercopithecus mona forms mixed-sex groups and all-male groups. Multiple males in mixed-sex groups interacted amicably, but males belonging to different groups behaved aggressively towards each other during intergroup encounters. Male-male relationships in C. mona appear to differ from those reported in some other arboreal guenons (e.g., C. diana, C. mitis).
Fruits and legume seeds and arils were the most important …
Beyond "Vectors Of Transmission" Through Commercial Sex: Exploring Models Of Sexual Risk Taking With Clients And Casual Partners Among Internet Based Male Sex Workers, David S. Bimbi
Dissertations, Theses, and Capstone Projects
Male sex workers (MSWs) have often been portrayed as vectors of disease although most published studies have reported high rates of condom use with clients in this population. Regardless, social psychological models of sexual behavior that have been widely utilized to examine sexual risk taking in the gay and bisexual male community have not been applied to research with MSWs. Further, sexual behaviors with casual sex partners among MSWs has been absent in most reported research. More recently, the rise of barebacking (unprotected anal sex) in the gay male community has challenged assumptions that most gay and bisexual men want …

Manual For The Identification Of Grass Stemborers And Associated Parasitoids In Kenya, Alberto T. Barrion, Robert S. Copeland, Zeyaur R. Khan
icipe Manuals
Foreword
This manual illustrates many of the stemborers and associated insects of grasses in Kenya, and provides keys for their identification. It can be used together with icipe’s booklet A Primer on Grass Identification and Their Uses in Kenya, which provides diagnostic and pictorial information on grass species that abound in and around agricultural lands in Kenya.
It is of paramount importance to identify stemborers and their natural enemies associated with grasses to implement ways of using native grasses to manage insect pests in farmers’ fields. Wild grasses may act to repel or physically block pests of cereal crops, …

Fruit and vegetable production is one of the fastest-growing agricultural sectors in Africa, providing both income and employment to growers and exporters alike. The range of fruits and vegetables grown is diverse. Mangoes, citrus, apple, papaya, passion, guava, avocado, cucumber, pumpkin and watermelon are among the most common fruits and vegetables grown for domestic urban markets and for export to major outlets in Europe, the Middle East, Japan and USA. This growth is changing the dietary patterns leading to increased consumption of fruits and vegetables. However, different types of insect pests afflict production in Africa, and perhaps none have gained …

Comparative Predictive Value Of Three Prognostic Markers--S-Phase Fraction, Pcna And Mitotic Count On Axillary Lymph Node Metastasis In Carcinoma Breast, Shahid Pervez, Muhammad Nadeem Khan, Muhammad Israr Nasir
Department of Pathology and Laboratory Medicine
Background: Axillary lymph node metastasis is the single most important prognostic factor in carcinoma of the breast. Therefore, prognostic markers that may reliably predict probability of lymph node (LN) metastases are of great value. This study was conducted to compare the predictive value of two novel prognostic / proliferative markers i.e. S-phase fraction (SPF) and proliferating cell nuclear antigen (PCNA) in parallel with mitotic index.
Methods: Data of consecutive cases of infiltrating ductal carcinoma (IDC) breast diagnosed from July 2003 to July 2004 at the section of the Histopathology, The Aga Khan University Hospital, Karachi, were reviewed. A total of …
