Judging Untried Cases, Daniel C. Richman Jan 2007

Judging Untried Cases, Daniel C. Richman

Faculty Scholarship

That federal criminal trials are an endangered species is clear. During fiscal year 2004, only 4% (3346) of the 83,391 federal defendants in terminated cases went to trial. And, trends that Professor Ronald Wright highlights in his insightful article have continued past the end point of his data. In 1994, 4639 defendants obtained verdicts from juries and 1050 from judges; in 2003, just 2909 and 615, respectively, did so. Every time one thinks that the system has hit an equilibrium at some “natural” distribution, the trial rate goes down a bit more.

The Presidential Signing Statements Controversy, Ronald A. Cass, Peter L. Strauss Jan 2007

The Presidential Signing Statements Controversy, Ronald A. Cass, Peter L. Strauss

Faculty Scholarship

Presidential signing statements have come out of obscurity and into the headlines. Along with salutary attention to an interesting issue, the new public visibility of signing statements has generated much overblown commentary. The desire to make these little-known documents interesting to the public – and to score points in the inevitable political battles over any practice engaged in by a sitting President – has produced a lot of discussion that misleads the public and has tended to obscure the significant issues surrounding the use of signing statements. Reflection may help put the discussion in a more useful perspective. We offer …

Leo Strine's Third Way: Responding To Agency Capitalism, Ronald J. Gilson Jan 2007

Leo Strine's Third Way: Responding To Agency Capitalism, Ronald J. Gilson

Faculty Scholarship

Ten years ago, Tony Blair's "New Labour" government sought an agenda that replaced ideology with a pragmatic focus on both the creation of wealth and its distribution. Not surprisingly, part of this effort involved proposals to bridge the gap between capital and labor through refraining corporate governance. A "third way" as it was then styled, would walk a fine line between privileging markets and allocational efficiency at the cost of social justice on the one hand, and accepting less for everyone as long as the distribution was fair on the other. Motivated by changes in how we save for retirement …

Eliminative Materialism And The Distinction Between Common Sense And Science, Nada Gligorov Jan 2007

Eliminative Materialism And The Distinction Between Common Sense And Science, Nada Gligorov

Dissertations, Theses, and Capstone Projects

It is one of the premises of eliminative materialism that commonsense psychology constitutes a theory. There is agreement that mental states can be construed as posited entities for the explanation and prediction of behavior, and that the nature of those states is dependent on the theory that features them. Disputes arise when it comes to the range of the commonsense theory of mental states. In chapter one, I review major arguments concerning the span and nature of folk psychology. In chapter two, relying on arguments by Quine and Sellars, I argue that the precise scope of commonsense psychology cannot be …

Reconfiguring Industrial Policy: A Framework With An Application To South Africa, Ricardo Hausmann, Dani Rodrik, Charles F. Sabel Jan 2007

Reconfiguring Industrial Policy: A Framework With An Application To South Africa, Ricardo Hausmann, Dani Rodrik, Charles F. Sabel

Faculty Scholarship

The main purpose of industrial policy is to speed up the process of structural change towards higher productivity activities. This paper builds on our earlier writings to present an overall design for the conduct of industrial policy in a low- to middle-income country. It is stimulated by the specific problems faced by South Africa and by our discussions with business and government officials in that country. We present specific recommendations for the South African government in the penultimate section of the paper.

Developing Markets In Baby-Making: In The Matter Of Baby M, Carol Sanger Jan 2007

Developing Markets In Baby-Making: In The Matter Of Baby M, Carol Sanger

Faculty Scholarship

In this Essay, I want to explore the Baby M case from a different, less philosophical perspective. The question I pose is simply this: how did the Sterns and the Whiteheads find one another in the first place? After all, apart from their New Jersey location (and a shared fondness for Bruce Springsteen), the two couples had little in common. Mary Beth was a high school dropout; Betsy had a Ph.D. and M.D. from the University of Michigan. Rick was a Vietnam vet fighting an ongoing battle with unemployment and alcoholism; Bill led what close friends called "a quiet, industrious …

The Effect Of Nutrition Information On Menu Selection When Eating Food Away From Home, Rebecca Foster Hochradel Jan 2007

The Effect Of Nutrition Information On Menu Selection When Eating Food Away From Home, Rebecca Foster Hochradel

Theses and Dissertations in Business Administration

As the number of Americans diagnosed with heart disease, diabetes, and excessive weight continues to increase, providing information to allow consumers to choose healthier foods becomes imperative. The number of consumers eating food away from home (EFAH) is rising. Although nutrition information is required on food products purchased for home use, it is not required when EFAH. How can a consumer know what is healthy if nutrition information is not provided? Policy makers and restaurateurs are in conflict regarding the provision of nutrition information on the menu. Policy makers want this information to be provided while restaurateurs say providing this …

Edward Durell Stone: Perception And Criticism, Mary Anne Hunting Jan 2007

Edward Durell Stone: Perception And Criticism, Mary Anne Hunting

Dissertations, Theses, and Capstone Projects

The work of the New York City-based architect Edward Durell Stone (1902-1978) has been subject to ongoing critical controversy. Stone achieved phenomenal success, beginning in the 1950s as an architect in the period of the Cold War, with buildings on four continents, in thirteen foreign countries, and in thirty-two states. But an examination of his stylistic progression reveals that Stone increasingly fell out of critical favor as he shifted modernism from the International Style to a more "romantic" modern aesthetic that incorporated decoration along with aspects of monumentality, regionalism, historicism, and fantasy—a progression that can be traced in six of …

Family Temporal Organization And Children's Affect Regulation: A Quantitative And Qualitative Study Of First Generation Dominican Families, Alba Cabral Jan 2007

Family Temporal Organization And Children's Affect Regulation: A Quantitative And Qualitative Study Of First Generation Dominican Families, Alba Cabral

Dissertations, Theses, and Capstone Projects

This study examined the hypothesis that temporal organization of family life is associated with children's affect regulation in first generation Dominican families. Eighteen families with children between ages one and half and five participated in this study, completing questionnaires about family time and routines, children's affect regulation, and child behavior problems. The families participated in interviews that inquired into family routines, family time and children's affect regulation according to the parent. Four of these families were selected for qualitative analysis of themes that illuminated the hypotheses tested. Correlational analysis confirmed the main hypothesis tested, namely, the existence of a relationship …

Behavior And Ecology Of The Mona Monkey In The Seasonally Dry Lama Forest, Republic Of Bénin, Reiko Matsuda Goodwin Jan 2007

Behavior And Ecology Of The Mona Monkey In The Seasonally Dry Lama Forest, Republic Of Bénin, Reiko Matsuda Goodwin

Dissertations, Theses, and Capstone Projects

I investigated the behavior and ecology of the mona monkey (Cercopithecus mona Schreber, 1774) in the Lama Forest for 17 months, and estimated the population density and biomass of the anthropoid species in the forest.

I found that Cercopithecus mona forms mixed-sex groups and all-male groups. Multiple males in mixed-sex groups interacted amicably, but males belonging to different groups behaved aggressively towards each other during intergroup encounters. Male-male relationships in C. mona appear to differ from those reported in some other arboreal guenons (e.g., C. diana, C. mitis).

Fruits and legume seeds and arils were the most important …

Beyond "Vectors Of Transmission" Through Commercial Sex: Exploring Models Of Sexual Risk Taking With Clients And Casual Partners Among Internet Based Male Sex Workers, David S. Bimbi Jan 2007

Beyond "Vectors Of Transmission" Through Commercial Sex: Exploring Models Of Sexual Risk Taking With Clients And Casual Partners Among Internet Based Male Sex Workers, David S. Bimbi

Dissertations, Theses, and Capstone Projects

Male sex workers (MSWs) have often been portrayed as vectors of disease although most published studies have reported high rates of condom use with clients in this population. Regardless, social psychological models of sexual behavior that have been widely utilized to examine sexual risk taking in the gay and bisexual male community have not been applied to research with MSWs. Further, sexual behaviors with casual sex partners among MSWs has been absent in most reported research. More recently, the rise of barebacking (unprotected anal sex) in the gay male community has challenged assumptions that most gay and bisexual men want …

Manual For The Identification Of Grass Stemborers And Associated Parasitoids In Kenya, Alberto T. Barrion, Robert S. Copeland, Zeyaur R. Khan

icipe Manuals

Foreword

This manual illustrates many of the stemborers and associated insects of grasses in Kenya, and provides keys for their identification. It can be used together with icipe’s booklet A Primer on Grass Identification and Their Uses in Kenya, which provides diagnostic and pictorial information on grass species that abound in and around agricultural lands in Kenya.

It is of paramount importance to identify stemborers and their natural enemies associated with grasses to implement ways of using native grasses to manage insect pests in farmers’ fields. Wild grasses may act to repel or physically block pests of cereal crops, …

A Field Guide To The Management Of Economically Important Tephritid Fruit Flies In Africa, Second Edition, S. Ekesi, M. K. Billah

icipe Manuals

Fruit and vegetable production is one of the fastest-growing agricultural sectors in Africa, providing both income and employment to growers and exporters alike. The range of fruits and vegetables grown is diverse. Mangoes, citrus, apple, papaya, passion, guava, avocado, cucumber, pumpkin and watermelon are among the most common fruits and vegetables grown for domestic urban markets and for export to major outlets in Europe, the Middle East, Japan and USA. This growth is changing the dietary patterns leading to increased consumption of fruits and vegetables. However, different types of insect pests afflict production in Africa, and perhaps none have gained …

A Quantitative Study Of Gene Identification Techniques Based On Evolutionary Rationales, Cyriac Kandoth Jan 2007

A Quantitative Study Of Gene Identification Techniques Based On Evolutionary Rationales, Cyriac Kandoth

Masters Theses

"Current gene identification (GI) techniques typically rely on matching biological or chemical properties of specific genes, specific species, specific ecotypes, etc...In this thesis, a new automated GI technique is proposed, and compared against another computer-based technique proposed earlier. Both methods utilize EST data available from NCBI databases to discover previously unknown genes. The newly proposed method identifies one gene family at a time and is based on a distinctive negative selection pattern (NSP) of differences, which is seen between the coding regions of gene family members. The other technique, called ESTminer, attempts genome-wide gene family identification for any organism, by …

An Interview With Fred Wilson, Mark Graham Jan 2007

An Interview With Fred Wilson, Mark Graham

Faculty Publications

Abstract The medium of artist Fred Wilson is the museum. He delves deep into museum collections to expose unexamined assumptions about power, place, privilege, and history. His installations include wall labels, educational materials, lighting, and non-traditional pairings of objects. His work is not only about the objects on display, but about how the whole museum environment can generate meaningful questions about art, history, and the role of the museum in its community. In this interview, Fred Wilson discusses how he works with the objects, places, and people that are part of the museum environment.

This Is The Right Place: Community-Based Art Education At Utah's Springville Museum Of Art, Mark Graham, Sharon R. Gray

Faculty Publications

The human condition in the post-modern world is increasingly nomadic. A sense of displacement and alienation is pervasive. Schools emphasize abstracted knowledge removed from the experience of students. Many people feel detached from the places where they live and have no particular sense of belonging or responsibility toward their communities. Museums can counter this pervasive restlessness and be a powerful source of community renewal. This article draws connections between place-based education theory and the educational mission of the art museum, as illustrated by the Springville Museum of Art. The small town of Springville, Utah enjoys an unparalleled connection with its …

Contemporary Art, Science, Ecology, And A Critical Pedagogy Of Place, Mark Graham Jan 2007

Contemporary Art, Science, Ecology, And A Critical Pedagogy Of Place, Mark Graham

Faculty Publications

In contemporary life and education, the local is marginalized in favor of large-scale economies of consumption that are indifferent to ecological concerns. The consequences of neglecting local human and natural communities include a degraded habitat, loss of wilderness, alienation, rootlessness, and lack of connection to communities. Place-based education responds to this indifference to local ecological concerns by grounding student learning in the experiences of their own lives, communities, and regions. Critical place-based pedagogy broadens the scope of place-based learning by incorporating critical theory into the curriculum of the local. This article describes a critical pedagogy of place as a prelude …

Foraging Ecology Of Black-Crowned Night-Herons (Nycticorax Nycticorax) In The New York City Area, Andrew James Bernick Jan 2007

Foraging Ecology Of Black-Crowned Night-Herons (Nycticorax Nycticorax) In The New York City Area, Andrew James Bernick

Dissertations, Theses, and Capstone Projects

Over 1,700 pairs of colonial wading birds (i.e., herons, egrets, and ibis) breed and forage in the industrialized ecosystem of metropolitan New York City (NYC). Wading bird colonies are located on 7 islands that lie between western Staten Island and Long Island Sound. The Black-crowned Night-Heron (BCNH), a mainly nocturnal forager, is the numerically dominant breeding heron in these colonies, and has been undergoing population declines both locally and region-wide since the mid-1990s. My objective was to determine how BCNHs forage in NYC's urban estuarine, freshwater, and terrestrial environments. From March-September 2002-2004, I conducted weekly night surveys on Staten Island, …

Solving Ramanujan's Differential Equations For Eisenstein Series Via A First Order Riccati Equation, James M. Hill, Bruce C. Berndt, Timothy Huber Jan 2007

Solving Ramanujan's Differential Equations For Eisenstein Series Via A First Order Riccati Equation, James M. Hill, Bruce C. Berndt, Timothy Huber

School of Mathematical & Statistical Sciences Faculty Publications

In this paper we prove that Ramanujan's differential equations for the Eisenstein series P, Q, and R are invariant under a simple one-parameter stretching group of transformations. Using this, we show that the three differential equations may be reduced to a first order Riccati differential equation, the solution of which may be represented in terms of hypergeometric functions. The resulting formulas allow for the derivation of parametric representations of P, Q, and R, analogous to representations in Ramanujan's second notebook. In contrast, in the classical approach, one first needs to derive the fundamental formula connecting theta functions with elliptic integrals. …
