Adding Colors To The Chameleon: Why The Supreme Court Should Adopt A New Compelling Governmental Interest Test For Race-Preference Student Assignment Plans, Leslie Yalof Garfield Apr 2007

Adding Colors To The Chameleon: Why The Supreme Court Should Adopt A New Compelling Governmental Interest Test For Race-Preference Student Assignment Plans, Leslie Yalof Garfield

Elisabeth Haub School of Law Faculty Publications

When the Supreme Court ordered the City of Birmingham to desegregate its schools in 1954, it failed to consider the long range implications of its mandate. School districts across the country responded to the Court’s order by adopting race-preference school assignment plans, created to designate the particular public elementary or secondary school a student should attend. Now that these plans have successfully achieved their goals of desegregating classrooms, the question has become whether the continuation of the very programs that helped achieve those goals remain legal? In other words, as Justice Ginsburg recently said in arguments before the Supreme Court, …

The Extent Of Homelessness In The Kenai Peninsula Borough, Meghan Wilson, Marie Lowe Apr 2007

The Extent Of Homelessness In The Kenai Peninsula Borough, Meghan Wilson, Marie Lowe

ISER Reports

In 2007, Love INC asked the Institute of Social and Economic Research (ISER) to conduct a study investigating the characteristics of the homeless population within the boundaries of the Kenai Peninsula Borough. Love INC is currently in the pre-development phase of creating a transitional housing facility on the Kenai Peninsula. ISER conducted phone interviews with relevant agencies serving the Kenai’s homeless population. These interviews yielded demographic information on the homeless population and provided both the current housing status of Kenai homeless and reasons for homelessness today. Men, women, and youth utilize homeless services on the Kenai Peninsula; they are between …

2007 Alaska's Construction Spending Forecast, Mary Killorin, Scott Goldsmith Apr 2007

2007 Alaska's Construction Spending Forecast, Mary Killorin, Scott Goldsmith

ISER Reports

Uncertainty in the forecast for 2007 comes from several sources. The decline in the crude oil price in recent months may cause some firms working in the oil patch to re-evaluate their capital budget decisions and slow their rate of investment in exploration and development. All sectors of the industry are continuing to experience rapid increases in construction material costs that will undoubtedly cause some projects to be canceled or postponed, as has been the case in the last several years.

Development Of A Biofidelic 'Legform' Impact Test Device, John Davis, Peter Schuster Apr 2007

Development Of A Biofidelic 'Legform' Impact Test Device, John Davis, Peter Schuster

Mechanical Engineering

Current EuroNCAP test specifications attempt to predict pedestrian lower limb injury in a lateral impact with a rigid legform test device developed by the UK's TRL (Transportation Research Lab). Research shows that the measurements taken from this device (knee bending angle, knee shear, and upper tibia acceleration) do not necessarily correspond to accurate injury prediction. Recent research suggests that the primary improvement to the current test device would be a flexible legform, or one that has more biofidelity (i.e., simulates actual human lower limb response).

The work presented in this paper first reviews current legforms developed for pedestrian impact testing, …

Abu-Madigam V. Israel Land Administration, Salim Joubran, Edna Arbel, Miriam Naor Apr 2007

Abu-Madigam V. Israel Land Administration, Salim Joubran, Edna Arbel, Miriam Naor

Translated Opinions

Facts: In response to large scale incursions onto state land in the Negev by Bedouins and their planting of agricultural crops on that land, the respondents decided to destroy the crops by spraying herbicide from the air. The petitioners challenged this policy on the grounds that the spraying of herbicide was done ultra vires and also endangered the health and dignity of Bedouins in the vicinity of the spraying. The respondents denied that the herbicide used presented any risks to health.

Held: (Justice Joubran) The respondents have no power under the law to spray herbicide in order to prevent incursions …
