I'Ve Got A Secret: Government Information Availability And Secrecy, Rhonda E. Fowler
I'Ve Got A Secret: Government Information Availability And Secrecy, Rhonda E. Fowler
Faculty Scholarship - University Library
Secrets and information, what do they have in common? A secret is something you don’t want anyone to know, something you keep to yourself or those you trust. “Knowledge obtained from investigation” is the definition of information, according to Webster’s Dictionary. As a new government documents librarian, my interest was piqued by the subject of secrecy. As I looked for information on this topic, I thought information that exposed the vulnerabilities of the United States to a terrorist attack or gave away our technology secrets would be classified. I didn’t know that something could be classified at first, declassified, and …

A Larger Sense Of Purpose: Dentistry And Society, David A. Nash
A Larger Sense Of Purpose: Dentistry And Society, David A. Nash
Oral Health Science Faculty Publications
Dentistry is undergoing a subtle shift away from being a profession to becoming a business. The two cultures of professionalism and business are contrasted. Among the forces driving this change are the emphasis on esthetics in dentistry and the increasing inability of a large class of patients to access dentistry on a business basis. The shift toward dentistry as a business entails the unhealthy transition toward regarding patients as means to satisfy the dentist's ends rather than patients' health being an end in itself. Dentists run the risk of "objectivifying" rather than "humanizing" patients. This trend must be overcome with …

An Analysis Of Development Impact Fees In Georgia, Jim Edge, Michael J. Eshman
An Analysis Of Development Impact Fees In Georgia, Jim Edge, Michael J. Eshman
Land Use Clinic
A development impact fee is defined as “payment of money imposed upon development as a condition to development approval to pay for a proportionate share of the cost of system improvements needed to serve growth and development.” Development impact fees are a relatively new idea in Georgia, but have been used in other jurisdictions for years. This paper analyzes the development of the Georgia Development Impact Fee Law. It also tracks use of impact fees in Georgia and makes recommendations for jurisdictions considering adopting impact fees.

The Place Of Criminology In The Study Of Terrorism: Implications For Homeland Security, Ihekwoaba D. Onwudiwe
The Place Of Criminology In The Study Of Terrorism: Implications For Homeland Security, Ihekwoaba D. Onwudiwe
African Journal of Criminology and Justice Studies
In this article, I intend to describe the history of terrorism, provide an explanation of some aspects of criminological theories related to the study of terrorism, and briefly articulate the link between criminology, terrorism, and homeland security. While criminology has made significant contributions in the understanding of crime in general, the literature on terrorism and homeland security by criminologists is still emerging. Arguably, this treatise calls for this void to be filled by criminologists, because terrorism and homeland security appropriately belong within the perimeters of criminology. This article employs the methodology of content analysis as used in social science research. …
“Dollars, Cpi, And Voter Empowerment": Public Act 94-976 And Its Impact On Local Government Tax Referenda, Shawn P. Flaherty
“Dollars, Cpi, And Voter Empowerment": Public Act 94-976 And Its Impact On Local Government Tax Referenda, Shawn P. Flaherty
Northern Illinois University Law Review
Units of local government in the State of Illinois are increasingly reliant upon the property tax to support operations. The Property Tax Extension Limitation Law (PTELL) has placed limits on the ability of local governmental units to raise property taxes, and has forced units subject to the PTELL to seek property tax increase referenda to increase tax rates. Public Act 94-976 markedly changed the manner in which property tax increase referenda are presented to the voting public and how successful local governmental units may levy and phase-in approved PTELL referenda increases. This article details the changes caused by this new …

Timing Rules And Legal Institutions, Eric A. Posner, Jacob Gersen
Timing Rules And Legal Institutions, Eric A. Posner, Jacob Gersen
Coase-Sandor Institute for Law & Economics Research Paper Series
Constitutional and legislative restrictions on the timing of legislation and regulation are ubiquitous but these "timing rules" have received little attention in the legal literature. Yet the timing of a law can be just as important as its content. The timing of a law determines whether its benefits are created sooner or later, and how the costs and benefits are spread across time, and hence to the advantage and disadvantage of different private groups, citizens, and elected officials. We argue that timing rules are, and should be, used to reduce agency problems within the legislature and between the legislature and …

Prison Boot Camps: Which Style Works Best?, Joshua M. Towey
Prison Boot Camps: Which Style Works Best?, Joshua M. Towey
Student Work
In 1983 Georgia and Oklahoma began implementing a new type of alternative sanction called prison boot camps. These alternative sanctions were an attempt to alleviate problems such a prison overcrowding, cost of long-term imprisonment, and high recidivism rates among offenders. As boot camps proliferated across the U.S., two distinct types of programs evolved, the military and the therapeutic styles. Given the extensive use of these types of boot camps across the country, it is important to determine which style is most effective at achieving their intended goals. For this research, I use data collected by MacKenzie and Souryal (1994) to …

Nebraska Serious And Violent Offender Re-Entry Program: An Evaluation Of Participants' Perception Of Program Effectiveness, Crystal H. Fuller
Student Work
In response to the three-fold increase in the number of returning inmates to America's communities over the last three decades, the Department of Justice's Serious and Violent Offender Re-entry Initiative provides funding for development of programming to reduce recidivism rates and improve community safety. However, evaluations of these re-entry programs have not addressed the attitudes and opinions of the program participants themselves. This study examined the perceptions of the re-entry participants to help assess the effectiveness of the programming they are receiving from the Nebraska Serious and Violent Offender Re-entry Pilot Program. Data was gathered from personalized re-entry plans for …
Without Limitation: 'Groundhog Day' For Incompetent Defendants, J. Amy Dillard
Without Limitation: 'Groundhog Day' For Incompetent Defendants, J. Amy Dillard
All Faculty Scholarship
This Article offers a brief overview of the standards for determining competency to stand trial. After examining the seminal case of Jackson v. Indiana, which held that the indefinite pre-trial detention of incompetent defendants violates due process, this Article argues that Virginia Code § 19.2-169.3, like statutes in twenty other states, violates a defendant's right to substantive due process, including the right to be free from forcible medication. This Article proposes legislation that will make the process constitutional, while addressing the concerns about the release of dangerous individuals held by the prosecutors and the community.
