Guns And Gay Sex: Some Notes On Firearms, The Second Amendment, And 'Reasonable Regulation', Glenn Harlan Reynolds

In light of the Supreme Court's grant of certiorari in Heller v. District of Columbia, this Essay contains some thoughts inspired by Adam Winkler's "Scrutinizing the Second Amendment," 105 Mich. L. Rev. 683 (2007). Winkler argues, correctly, that judicial acceptance of an individual-rights interpretation of the Second Amendment would not end all firearms regulation. However, Winkler's understanding of what constitutes "reasonable regulation" is excessively broad. In "Guns and Gay Sex," I look at two overlapping lines of Tennessee cases on the right to arms and the right to privacy and conclude that even a "reasonable regulation" model of the right …

This document was developed to promote protection of Alaska’ wildlife from nonnative rodents, especially rats. If constitutes a statewide invasive rodent management plan, which is part of a multi-agency effort to minimize the impact of invasive species in Alaska. A literature search and interviews were conducted, and reviews were obtained from experts in Alaska and elsewhere. The plan summarizes resisting information relevant to Alaska and recommends a collaborative structure for undertaking strategic actions, the Alaska Rodent Action Team. It also identifies dozens of strategic actions that are needed to prevent and eradicate invasive rodents. These fall into six categories: legal …

This document is an environmental assessment (EA) of the proposal to modify A.V. Watkins Dam under the Safety of Dams (SOD) Act of 1978 (Public Law 95-578, as amended). The proposed SOD modifications would correct safety deficiencies of the dam without affecting the purpose or benefits of the dam. Specifically, the embankment and foundation of the dam need to be repaired. The repairs are needed to restore the reservoir to full function and to incorporate state-of-the-art defensive measures of controlling seepage within the foundation and embankment. Policing The Police: Democracy And Effective Methods Of Accountability In Post-Apartheid South Africa, Alaina Varvaloucas

Independent Study Project (ISP) Collection

This study seeks to explore the extent and effectiveness of systems of criminal accountability of the police force in South Africa. More specifically, it explores the pros and cons of existing organizations mandated to deter police from acting criminally and punish them when they do, and the need to strengthen them. The study first takes a look at such organizations as the Independent Complaints Directorate (ICD)—which is an independent civilian oversight body—and the South African Police Service’s (SAPS) internal disciplinary system and assesses their strengths and limitations in providing a culture of accountability. The study then focuses on police culture …

On March 28, 2007, the William Monroe Trotter Institute held a roundtable on crime in predominantly black neighborhoods. More than fifty individuals who represented a broad array of perspectives and experiences took part in the roundtable. Participants included religious leaders, elected officials, educators, academics, law enforcement officials, social services providers, youth workers and youths, and community activists. Participants were eager to examine, discuss, and contribute to the understanding of: What accounts for the high rate of violent crime in Boston’s predominantly black neighborhoods? A new industry is developing in Canada due to recent studies indicating that demand for liquefied natural gas (LNG) supply in Canada and the U.S. is on the rise. As a result, the construction stage has begun for a number of proposed LNG receiving terminals in and around Atlantic Canada. The authors provide an overview of the current issues facing these LNG projects, such as their impact on fisheries, the environment, and Aboriginal rights. While criminologists have for some time examined state and corporate crime as separate entities, the concept of state-corporate crime highlighting joint government and private corporate action causing criminal harm is a recent area of study with relatively few published case studies (Matthews and Kauzlarich, 2000). This paper focuses on state-corporate crime at the Paducah Gaseous Diffusion Plant (PGDP) in Paducah, Kentucky, and contributes to the study of state-corporate crime in three ways: (1) it adds a new case study to a field in which there are few published accounts, (2) it assesses the utility of Kauzlarich and Kramer’s (1998) integrated …

"It Is Much Easier To Find Fault With Others, Than To Be Faultless Ourselves": Contributory Negligence As A Bar To A Claim For Breach Of The Implied Warranty Of Merchantability, William B. L. Little

To better understand the policy underpinnings of the statutory bar of certain implied warranty merchantability claims, this Article first reviews the origins and the continued vibrancy of the doctrine of contributory negligence in North Carolina. The doctrine is then examined in the context of North Carolina's enactment of the Products Liability Act and the doctrine's applicability to the implied warranty of merchantability.

Reforming, Reclaiming Or Reframing Womanhood: Reflections On Advocacy For Women In Custody, Brenda V. Smith

Project on Addressing Prison Rape - Articles

Brenda V. Smith was asked to present one of the keynote addresses for the symposium, Behind Bars: The Impact of Incarceration on Women and Their Families, sponsored by the Women's Rights Law Reporter at Rutgers University School of Law in Newark. She then wrote the introductory essay for the publication which arose from that symposium. This essay addresses why it is imperative to reclaim the discourse about women in prison and discusses how the other papers that appear in this issue aid in that project.
