A mere five years ago, the Food and Drug Administration (the "FDA") began, for the first time in its 100-year history, to take the position that its prescription drug labeling regulations defeated the ability of injured plaintiffs to pursue common law tort claims based on the adequacy of the labeling. This position, radical to many and rational to others, places federal preemption of prescription drug labeling actions directly in the center of the debate over the proper roles of federal regulation and state tort laws in promoting product safety. This essay examines the question of how state and local government officials should consider federal tax law principles, like the commerciality doctrine, when they challenge state and local property tax exemptions that rely, at least in part, on tax-exempt charitable status for federal income tax purposes. In particular, this essay uses the example of continuing care retirement communities to consider tax-exempt law’s commerciality doctrine in an attempt to discern distinctions between “homes for the aged” that are “charitable,” and thus entitled to exemption, and those that are too commercial, and thus not entitled to exemption. This paper presents latest results from the combined use of SAR (Synthetic Aperture Radar) remote sensing and GIS providing detailed insights into recent volcanic activity under Vatnajökull ice cap (Iceland). Glaciers atop active volcanoes pose a constant potential danger to adjacent inhabited regions and infrastructure. Besides the usual volcanic hazards (lava flows, pyroclastic clouds, tephra falls, etc.), the volcano-ice interaction leads to enormous meltwater torrents (icelandic: jökulhlaup), devastating large areas in the surroundings of the affected glacier. This article is a story about boundaries and exclusion and about how - or whether - there is a community based right to exclude nonresidents. The right of the individual to own property, to defend that property and to exclude others from entering that property are sticks in the bundle of rights enshrined in US property law. Wireless Power Transmission To A Buried Sensor In Concrete, Khan M.Z. Shams, Mohammod Ali

The feasibility of sending wireless power to a buried sensor antenna within concrete was studied. a receive patch rectenna with 75.8% conversion efficiency was designed for operation at 5.7 GHz. The received DC power at the rectenna was measured within dry and wet concrete samples with various cover thicknesses and air-gaps. For the rectenna buried within 30 mm of the concrete, the received DC power was 10.37 mW, which was, about 70% of the received DC power in free-space.

Contributory Disparate Impacts In Employment Discrimination Law, Peter Siegelman

An employer who adopts a facially neutral employment practice that disqualifies a larger proportion of protected-class applicants than others is liable under a disparate impact theory. Defendants can escape liability if they show that the practice is justified by business necessity. But demonstrating business necessity requires costly validation studies that themselves impose a significant burden on defendants-upwards of $100,000 according to some estimates. This Article argues that an employer should have a defense against disparate impact liability if it can show that protected-class applicants failed to make reasonable efforts to train or prepare for a job related test. This Article proceeds in five parts. In part one, I review the scholarly skepticism as to how far international law is law in the "hard" sense and show that this skepticism has always permeated the discipline. In part two, I go on to examine what has prompted contemporary scholarship to credit the WTO with helping international law grow out of the "thin" normativity often attributed to it. Part I of this comment will examine the history and application of freedom of expression in Japanese case law and the evolution of the public welfare concept and its circumscribing effect on individual freedoms. Part II will explore the recent local regulatory efforts and the historical underpinnings for these laws that place restrictions on materials to children.
