Bar Mental Fitness Questions: Perpetuating The Stigma, Sara Josselyn Jan 2007

Bar Mental Fitness Questions: Perpetuating The Stigma, Sara Josselyn

Dalhousie Journal of Legal Studies

In order to be admitted to the practice of law, all applicants to provincial Barristers’ Societies must respond to a series of questions aimed at ensuring that they are of good character and are generally “fit” to practice. Some applicants must also demonstrate their medical fitness by responding to various mental disability-related questions. This article examines whether the medical fitness questions currently asked of Bar applicants in many provinces are discriminatory and whether they serve to perpetuate the stigma associated with mental illness. The author will evaluate the propriety of broadly worded mental fitness questions in order to show that …

Resolving The Intergenerational Conflicts Of Real Property Law: Preserving Free Markets And Personal Autonomy For Future Generations, Gerald Korngold Jan 2007

Resolving The Intergenerational Conflicts Of Real Property Law: Preserving Free Markets And Personal Autonomy For Future Generations, Gerald Korngold

American University Law Review

This article argues that land allocation agreements (e.g., deeds, mortgages, covenants, easements, etc.) made today will have a profound and perhaps negative effect on owners in future generations. It shows that the current architecture of the land transaction system and related rules unduly favor current owners over successors, causing a negative impact on land markets and choices of future players. Moreover, the article demonstrates that current doctrine and theory do not provide adequate flexibility for future generations to deal with outmoded land allocation agreements, leading to inefficiencies and frustration of the personal autonomy of future owners. The article suggests a …

Dueling Federalists: Supreme Court Decisions With Multiple Opinions Citing The Federalist, 1986-2007, Matthew J. Festa Jan 2007

Dueling Federalists: Supreme Court Decisions With Multiple Opinions Citing The Federalist, 1986-2007, Matthew J. Festa

Seattle University Law Review

This Article examines the use of history in legal interpretation through an empirical analysis of one of the most prominent examples of historical evidence in law: citations to The Federalist in Supreme Court Justices' published opinions. In particular, the Article examines a phenomenon that has occurred frequently over the last two decades, but has thus far been virtually ignored: the citation by different Justices to the same historical source (such as The Federalist) to support divergent or opposing historical interpretations of legal meaning. Although the use of historical evidence in constitutional interpretation is itself much debated, The Federalist continues …

Effects Of Letter Transposition In Subliminal Primes On Perceived Content Of Abstract Images, C.S. Bailey, Amanda K. Harsin, Suzie Heffernan Jan 2007

Effects Of Letter Transposition In Subliminal Primes On Perceived Content Of Abstract Images, C.S. Bailey, Amanda K. Harsin, Suzie Heffernan

The Journal of Undergraduate Research

Subliminal presentation of a stimulus can influence responses to later stimuli. This effect is known as priming. The current study used Microsoft PowerPoint as a novel, low-cost paradigm to present experimental stimuli. Thirty-one undergraduate participants viewed a PowerPoint presentation that contained conditions with no, with unscrambled, and with center-scrambled sexually-themed messages. The effects of gender, counterbalancing, and type of message on perceived sexual content in experimenter-made inkblots was assessed. The current study failed to find any significant differences or interaction effects between any of the variables. A post-hoc analysis revealed a significant priming effect. Possible confounding variables and suggestions for …

The Effect Of Parental Education On Emotions And Behaviors, Chelsea Parkinson, Shivaram Poigai Arunachalam Jan 2007

The Effect Of Parental Education On Emotions And Behaviors, Chelsea Parkinson, Shivaram Poigai Arunachalam

The Journal of Undergraduate Research

Current literature suggests that emotions are learned through socialization. The following study was completed using results compiled by a survey done for the South Dakota State University (SDSU) Sociology of Rural America course (Soc 240). The authors wished to ask the question "Do the education levels of parents affect the emotions and behaviors of their children?" There were approximately 540 respondents to this survey, all college students at SDSU. Questions dealing with students' emotions were analyzed with respect to each respective student's parents' education level. The findings suggested that there is a connection between the parents' education levels and the …

Significance Of "Atypia" Found On Needle Biopsy Of The Breast: Correlation With Surgical Outcome, Anika Nina Watson Jan 2007

Significance Of "Atypia" Found On Needle Biopsy Of The Breast: Correlation With Surgical Outcome, Anika Nina Watson

Yale Medicine Thesis Digital Library

Although core needle biopsy has been shown to be effective in diagnosing both benign and malignant mammographically detected lesions in the breast, it has also been shown to underestimate cancer most likely due to sampling error. Since a diagnosis of atypical hyperplasia versus malignancy is based on quantitative factors (which could be affected by an error in sampling), the current recommendation is surgical excision for atypical hyperplasia diagnosed on core biopsy. The purpose of the study was to determine if a subset of patients with atypia diagnosed by core biopsy fit the Breast Imaging Reporting and Data Systems (BI-RADS) Category …

Instead Of Erklären And Verstehen: William James On Human Understanding, David E. Leary Jan 2007

Instead Of Erklären And Verstehen: William James On Human Understanding, David E. Leary

Psychology Faculty Publications

Perhaps more than any other American psychologist and philosopher, William James (1842-1910) was intimately familiar with contemporary European thought and debate, including the discussion of Erklären and Verstehen advanced by Wilhelm Dilthey (1833-1911) and others around the turn of the twentieth century. Even before this discussion was initiated, James had been dealing with related issues, pondering alternative solutions, and formulating his own original views on human understanding. These views coalesced in a distinctive approach to cognition. Fundamental to this approach was a belief in possibility and probability as innate features of the physical as well as mental manifestations of the …

The Medieval Influences Of Shakespeare’S Richard Iii: Morality Plays, Miracle Plays, And The Chronicles, Elizabeth Jane Shelley Jan 2007

The Medieval Influences Of Shakespeare’S Richard Iii: Morality Plays, Miracle Plays, And The Chronicles, Elizabeth Jane Shelley

Masters Theses

There are many striking similarities between Shakespeare’s The Tragedy of King Richard III and several types of medieval works. The morality play genre is most distinctly represented by Richard’s representation as the Vice, a popular figure first characterized as the devil’s helper who eventually eclipsed the devil and became the sole figure of evil. Riehard also shares characteristics with the miracle or mystery play figures of Cain and Herod, figures who commit evil deeds and are rightly punished by God. Shakespeare was also strongly influenced by the chronicle accounts of Raphael Holinshed and Edward Hall, who base their accounts of …

Damages In Tort Litigation: Thoughts On Race And Remedies, 1865-2007, Jennifer Wriggins Jan 2007

Damages In Tort Litigation: Thoughts On Race And Remedies, 1865-2007, Jennifer Wriggins

Faculty Publications

The relationship between remedies and race in U.S. tort law merits attention. This essay first challenges the boundary between civil rights and tort remedies by highlighting a stunning but previously overlooked 1959 Fifth Circuit case where an individual tort remedy served as a significant civil rights remedy in the integration of public transportation throughout the South. Second, the essay focuses on the relationship between race and damages from 1865 to the present. It argues that the torts system provided access to indigent plaintiffs of all races during periods when poor people were otherwise denied legal representation in every other context. …

Two-Faced Racism: Whites In The Backstage And Frontstage, Leslie H. Picca, Joe R. Feagin Jan 2007

Two-Faced Racism: Whites In The Backstage And Frontstage, Leslie H. Picca, Joe R. Feagin

Sociology, Anthropology, and Social Work Faculty Publications

Racial events that reveal the larger forces of racism in society are common and obvious in the sociospatial realm we term the backstage, especially in situations where whites interact with white friends and relatives. Backstage settings, where interactions typically take place among whites only, involve an array of complex interactions and performances. There we observe all dimensions of racial events-- indications of who is allowed and not allowed in the backstage, what racialized performances are tolerated or expected there, the sociospatial character of contexts, the impact of conventional racial framing, and the pervasive influence of the larger society. Here we …

Faith, Hope, And Love Through Doubt In Tennyson's In Memoriam, David Settle Jan 2007

Faith, Hope, And Love Through Doubt In Tennyson's In Memoriam, David Settle

Masters Theses

In Memoriam is a poem expressing the journey of Christian faith Alfred Tennyson experiences after the death of his friend, Arthur Hallam. Although Tennyson is submerged in deep sorrow and confronted with questions and challenges to his spiritual beliefs, he becomes a stronger Christian who is filled with faith in a God of love who will reunite him with his departed friend. A careful reading of the poem in comparison with Biblical texts reveals that Tennyson underwent a spiritual transformation that deepened his belief in Christ and the hope of a life after death where he will enjoy the companionship …

Prostate Volume Delineation And Seed Localization Using A 3-T Magnetic Resonance Spectrometer, Jason Eric Davis Jan 2007

Prostate Volume Delineation And Seed Localization Using A 3-T Magnetic Resonance Spectrometer, Jason Eric Davis

UNLV Retrospective Theses & Dissertations

With approximately one in six men affected by prostate cancer at some point in their lives, effective treatment of the disease remains a focus of oncology research. Effective treatment using radiation requires the delivery of a significant dose to the prostate volume while sparing surrounding sensitive structures. Treatment success can then be determined by localization of the seeds following implantation and the calculation of a dose distribution across the target volume. Magnetic Resonance Imaging (MRI) yields images with soft tissue contrast that is superior to CT or ultrasound, but has been under-appreciated as a dosimetric tool due to the difficulty …

Impact Of The Firefighter Academy On Recruits' General Well-Being And Distress, Alyssa Maria Demos Jan 2007

Impact Of The Firefighter Academy On Recruits' General Well-Being And Distress, Alyssa Maria Demos

UNLV Retrospective Theses & Dissertations

Coronary heart disease has consistently been shown to be the leading cause of fatalities among professional firefighters. Chronic psychosocial stressors, particularly occupational stress, have been investigated in relation to cardiovascular disease and associated risk factors. Epidemiologic evidence suggests that the elevated occupational prevalence of adverse health outcomes among fire service personnel is due to their work-related stressors. Fire academy instructors have the responsibility of improving the minds and bodies of recruits; therefore, this research evaluated the self-perceived general well-being and distress among firefighter recruits in the southwestern United States. The results were used to assess the need for stress management …

Overlapping Themes In Treating Infidelity: Is Sex Therapy Integrated Into Treatment?, Jerri Gallegos-Carr

UNLV Retrospective Theses & Dissertations

Infidelity is a frequent treatment issue in couples treatment and poses a number of challenges for clinicians who treat cases of infidelity. Research and literature on the treatment of infidelity is often scattered, inconsistent from author to author, and, in general, can be difficult for clinicians to grasp and comprehend. The present study will add to existing literature on infidelity treatment with sexual/intimacy components; The present study investigated the integration of sex therapy techniques/philosophy into the treatment of infidelity and attempted to identify the degree to which practitioners are integrating sex therapy into their infidelity treatment. Clinicians participated in a …
