The Politics Of Reversal: The Seventh Circuit Reins In A District Court Judge’S Wayward Employment Discrimination Decisions, Timothy Wright Sep 2007

The Politics Of Reversal: The Seventh Circuit Reins In A District Court Judge’S Wayward Employment Discrimination Decisions, Timothy Wright

Seventh Circuit Review

In the span of four months, the Seventh Circuit reversed the same district court judge, Judge Samuel Der-Yeghiayan, in three separate employment discrimination opinions. In all three cases, the district court had granted the employers’ motions for summary judgment in their entirety. However, the Seventh Circuit held that the majority of these rulings were improper due to the district judge’s inattention to critical details in the record and his misplaced reliance on minor technical rulings that sidestepped the cases’ glaring issues of credibility and contested fact. This Comment reviews the common themes in the Seventh Circuit’s criticisms of the district …

Easier Said Than Done? A Corporate Law Theory For Actualizing Social Responsibility Rhetoric, Lisa M. Fairfax Sep 2007

Easier Said Than Done? A Corporate Law Theory For Actualizing Social Responsibility Rhetoric, Lisa M. Fairfax

Faculty Scholarship

Post Enron has witnessed renewed concern regarding corporations’ failure to behave responsibly, both in terms of their ethical responsibility and in terms of their responsibilities to advance issues beyond financial matters, such as those that impact employees, customers, and the broader community. Many scholars, legislators, and members of the business community have struggled to find strategies for restoring corporate responsibility. This Article argues that a corporation’s own words or rhetoric may be useful in solving its behavioral defects. In fact, the vast majority of corporations issue statements or otherwise engage in rhetoric that suggest a commitment to issues and concerns …

How Do Word-Of-Mouth Reviews Affect Product Sales? Applying The Stock Market Analogy To Online Stores, Knowledge@Smu Sep 2007

How Do Word-Of-Mouth Reviews Affect Product Sales? Applying The Stock Market Analogy To Online Stores, Knowledge@Smu

Knowledge@SMU

Online word-of-mouth communication -- such as product reviews by consumers -- has become a major information source about product quality. Singapore Management University information systems professor Nan Hu and his team investigated both quantitative and qualitative aspects of online reviews using Amazon.com as their study base. They found that, besides review scores, consumers do pay attention to other contextual information such as a reviewer’s reputation and exposure. Hu’s research also showed that the longer an item is on the market, the smaller the impact of online reviews on sales.

A Research-Based Approach To Continuous Improvement In Business Education, Peter W. Hess, Julie Siciliano Sep 2007

A Research-Based Approach To Continuous Improvement In Business Education, Peter W. Hess, Julie Siciliano

Organization Management Journal

The growing emphasis on improving performance in business school programs relies on a continuous improvement model designed for manufacturing and business service organizations. However, the complexity of learning assessment and the lack of expertise in learning processes suggests that change is needed to adapt this model for application in higher education. We propose integrating a research basis into the current continuous improvement model that will result in educational and instructional processes shaped by scientific research. Issues associated with implementation are discussed.

Encountering One Another: Feminist Relationships In Organizational Research, Kristina A. Bourne Sep 2007

Encountering One Another: Feminist Relationships In Organizational Research, Kristina A. Bourne

Organization Management Journal

As a graduate student attempting to integrate feminist principles into my academic endeavors, I eagerly entered the research field to examine how women business owners who feel a conflict between feminism and capitalism enact their everyday lives. I chose participant observation, a common methodology in feminist research, with the aim of getting “inside” these women’s lives to better understand their experiences. However, as the fieldwork proceeded, my focus shifted to examining the space in which the realities of the feminist organizational researcher and of the feminist business owner encounter one another. This paper reflects upon how we made sense of …

Barriers To Serving The Vulnerable: Thoughts Of A Former Public Official, Christine Ferguson Sep 2007

Barriers To Serving The Vulnerable: Thoughts Of A Former Public Official, Christine Ferguson

Health Policy and Management Faculty Publications

In an environment of limited resources, the question of who is deserving and undeserving of assistance becomes critical. Policymakers’ biases about whether a health condition is self-inflicted, as well as their perceptions about whether treatments are truly effective, play a major role—often unstated—in the allocation of resources.

Collaboration: Advocacy For School Change, Cynthia Strong Sep 2007

Collaboration: Advocacy For School Change, Cynthia Strong

SPU Works

Adolescent literacy is a looming issue in secondary schools. Being able to read, comprehend, and write is imperative for students to understand the content of their classes and textbooks. According to Michael Kamil, professor of psychological studies in education and learning at Stanford University, "we almost need a trauma center to take care of this problem, it's that serious for kids that can't read...It's the number-one factor standing in the way of their graduating" (Manzo-Kennedy). Given the importance of literacy, this article provides a story of how a high school media specialist on the east coast sought to collaborate with …

Executive Compensation: Who'da Figured?, M. Todd Henderson Sep 2007

Executive Compensation: Who'da Figured?, M. Todd Henderson

The University of Chicago Law School Record

Professor Henderson takes issue with the argument that CEOs are being paid too much. He first explores the reasons why CEO compensation has risen so much in the past twenty years (and points out that only CEOs are being examined, even though salaries for others, such as baseball players and movie stars, have risen equally as dramatically). Professor Henderson then explains the pay structure under which most CEOs get paid, arguing that CEO payment is largely consistent with the rise and fall of the market; additionally, CEO tenure is down by half. In his own research, Professor Henderson found that …

Swosu Fact Book Fall 2007, Denisa Engelman

Fact Books

I am proud to introduce the sixteenth annual Southwestern Oklahoma State University Fact Book. The Fact Book provides a ready source of information to answer frequently asked questions about the University and its operations. Unless otherwise noted, the information in this Fact Book came from computer-generated reports that are printed following the tenth class day of each fall semester. Because of student fluctuations during the semester, numbers will not match other published enrollment numbers that may be based on enrollment at the end of a semester.

Shaping The Security Environment, Derek S. Reveron Sep 2007

Shaping The Security Environment, Derek S. Reveron

Newport Papers

Newport Paper No. 29, Shaping the Security Environment, edited by Derek S. Reveron, makes an important contribution to an unfolding debate on the global role of U.S. military forces in an era of transnational terrorism, failed or failing states, and globalization. Reveron, professor of national security decision making at the Naval War College, looks beyond the current conflicts in which the United States is involved to raise fundamental questions concerning the regional diplomatic roles of America’s combatant commanders (COCOMs) and, more generally, the entire array of non-warfighting functions that have become an increasingly important part of the day-to-day life of …
