Animal Experimentation: Lessons From Human Experimentation, Arthur Birmingham Lafrance
Animal Experimentation: Lessons From Human Experimentation, Arthur Birmingham Lafrance
Animal Law Review
This article is adapted from the author's presentation during the panel discussion Animals in Research: Pet Cloning, Patents, and Bioethics at the 14th Annual Animal Law Conference of Lewis & Clark Law School on October 14, 2006.
Conventional wisdom tells us that animal experimentation is a relevant precursor to human experimentation. The failings of human experimentation to be more reliable, however, casts substantial doubt on the necessity and appropriateness of experimentation on animals. The federal government and medical community, since World War II, has used the Nuremberg Code and the “common rule” to determine how to ethically conduct human experimentation. …
Subverting Justice: An Indictment Of The Animal Enterprise Terrorism Act, Kim Mccoy
Subverting Justice: An Indictment Of The Animal Enterprise Terrorism Act, Kim Mccoy
Animal Law Review
The Animal Enterprise Terrorism Act (AETA) creates yet another obstacle for the animal advocacy movement. This article explores the reasons behind the AETA’s enactment and its implications for those who advocate on behalf of animals. The author notes the AETA targets individuals based solely on their political ideology and can deter these individuals from exercising their right to free speech due to the threat of being permanently branded as a terrorist. It is this infringement on First Amendment rights, coupled with the AETA’s overbreadth and vagueness, that lead the author to conclude the AETA is unconstitutional. The author also notes …
Pets In The Eye Of The Storm: Hurricane Katrina Floods The Courts With Pet Custody Disputes, Megan Mcnabb
Pets In The Eye Of The Storm: Hurricane Katrina Floods The Courts With Pet Custody Disputes, Megan Mcnabb
Animal Law Review
The story of King Solomon includes the often-told tale of two women, both claiming ownership of one baby, who come before the king’s court in order to resolve their quarrel as to which of them is the true mother. This article recounts a modern-day King Solomon story: the “baby” is the animals left behind during Hurricane Katrina; the two mothers claiming ownership of the “baby” are the original owners of the animals and those who adopted the animals after the hurricane; and the role of King Solomon is played by judges in the custody dispute cases that arose after the …
At A Complex Crossroads: Animal Law In Indian Country, Rob Roy Smith
At A Complex Crossroads: Animal Law In Indian Country, Rob Roy Smith
Animal Law Review
Animals play an especially important role in Indian history and culture. The value of animals to the tribes is reflected in every aspect of their culture, from song and dance to land use and treaty terms. Tribes today are still dependent on fish and wildlife for ceremonies and everyday living. The tribes have translated their value for animals into creative ways to protect domestic animals and manage animal populations, including working with state and federal governments to co-manage fish and wildlife populations. This article begins with a discussion of criminal and civil jurisdiction within Indian Country. The article provides a …
A Uniform Domestic Partnership Act: Marrying Business Partnership And Family Law, Jennifer A. Drobac, Antony Page
A Uniform Domestic Partnership Act: Marrying Business Partnership And Family Law, Jennifer A. Drobac, Antony Page
Georgia Law Review
This Article contends that domestic partnership based upon business partnership law and associated fiduciary duties would better serve more couples, their families, and society as a whole than marriage law does now. Four problems-the rising divorce rate, the poverty of some "divorced" children and their custodians, the same-sex marriage controversy, and families that exist without a formal legal acknowledgment-have increased concerns about the viability of marriage as an institution that promotes domestic stability and economic security. As a response and solution, Professors Drobac and Page propose a Uniform Domestic Partnership Act, modeled after the Uniform Partnership Act (1914) for businesses. …
What Should We Celebrate On Constitution Day?, Alan E. Garfield
What Should We Celebrate On Constitution Day?, Alan E. Garfield
Georgia Law Review
Congress recently created a new national observance, Constitution Day, to be marked each year on September 17. This observance presents a valuable opportunity for the vastly diverse American populace to celebrate its shared values. But what, exactly, should Americans celebrate about the Constitution? The Constitution's text, after all, is hardly perfect, and judicial interpretations of the Constitution are similarly problematic. This Article sets out to identify the Constitution's core meaning for Americans. If first draws lessons from two contemporary Establishment Clause disputes (the teaching of intelligent design and the displaying of Ten Commandments monuments). These examples illustrate why the Constitution, and …
Big Entertainment Needs A Sequel To The Highly Anticipated Flop: Mgm V. Grokster, Anuj Desai
Big Entertainment Needs A Sequel To The Highly Anticipated Flop: Mgm V. Grokster, Anuj Desai
Georgia Law Review
The entertainmentindustry's attempts to police copyright infringement by targeting technologies that enable copying of protected works remain unworkable. More than twenty years ago, Hollywood initiated this strategy when it sued Sony, claiming users copied protected broadcast TV shows using Sony's Betamax, thus branding Sony a contributory infringer. The Supreme Court, however, rejected this argument in Sony Corp. of Am. v. Universal City Studios, Inc. and found that Sony was not liable as it had no knowledge of the infringement and its product was capable of substantialnoninfringing uses. The Sony doctrine was revived in the late 1990s when it was successfully …
A Tribute To Milner S. Ball, Edward D. Spurgeon
A Tribute To Milner S. Ball, Edward D. Spurgeon
Georgia Law Review
Milner's teaching and scholarly interests and pursuits have been an extension of his core values. It is not coincidence that Milner's teaching and scholarship have centered on law and theology, public interest law, constitutional law, environmental law and Indian law, and that his public service has involved to a significant extent work for and support for nonprofit organizations serving the needy. Through his teaching, scholarship, and service, he has deepened his own knowledge and understanding while giving voice to his values and views. Above I described Milner as "complex and multi-faceted." What do I mean? Milner is both a Southerner …
The Practice Of Law In The Peaceable Kingdom, Robert P. Burns
The Practice Of Law In The Peaceable Kingdom, Robert P. Burns
Georgia Law Review
Milner Ball would be the last person to claim to have constructed a system. After all, he writes in the essay form, one that is "tentative, reflective, suggestive, contradictory, and incomplete."' It is a style that suggests there is more afoot than any science or philosophy is likely to conceive and that much of what is most important has to be shown, not stated. Surely, the notion of a system, as in "the legal system," reflects many of the qualities that, as we will see, he is most at pains to criticize. However, there are definitely themes in his work …
Meeting Of The Minds, Part Ii: A Dark And Angry God Arises, Paul J. Heald
Meeting Of The Minds, Part Ii: A Dark And Angry God Arises, Paul J. Heald
Georgia Law Review
In 1988, Professor Heald found a lost manuscript of Steve Allen's groundbreaking television show, "A Meeting of the Minds."' In that episode, Oliver Wendell Holmes, Mark Kelman, Blaise Pascal, and Richard Posner discussed the nature of law.2 While completing renovation of a house, possibly visited by Allen, Heald recently found another manuscript jammed on top of an old water tank...
The Word And The Law, James B. White
The Word And The Law, James B. White
Georgia Law Review
The Word and the Law is an extraordinary combination of law, personal statement, literary criticism, and theology. In a sense its central question is whether it is possible to have a life in the law that is good, and the answer is yes-yes, though not at all easy. I have often suggested it as reading to students who are worried about the profession they have chosen, and they frequently return to me with deep thanks for the introduction. Milner's commitment throughout is not to abstraction or theory or generalization, but to particular realities. Partly for this reason he begins the …
A Penny For Your Thoughts: Private And Collective Contracting For Traditional Medicinal Knowledge Modeled On Bioprospecting Contracts In Costa Rica, Katie Bates
Georgia Law Review
For decades, pharmaceutical companies have prospected biologically diverse developing countries for plants and molecules that may form the foundations of groundbreaking medicines. In many cases, native populations have aided researchers by directing them to the plants used in their traditional medicines. Only recently, however, have native peoples pushed for compensation for this valuable contribution. The governments of developing countries, too, have begun to assert legal and physical control over their natural resources, making access to these resources by pharmaceutical companies more difficult and costly. Simultaneously, scientific developments have made drug discovery through alternative methods more feasible. Despite these changes, it …
Medical Tourism: Symptom Or Cure?, Kerrie S. Howze
Medical Tourism: Symptom Or Cure?, Kerrie S. Howze
Georgia Law Review
"Medical tourism" is the phrase used to describe the phenomenon whereby patients travel to a foreign country to consume medical services. This practice has gained momentum in recent years, largely due to accessibility and affordability issues plaguing the U.S. healthcare system. Notably, medical tourism has progressed from being only an option considered by uninsured or under-insured individuals to an option considered by employers as a means of reducing the cost of employee health benefits. This Note examines the medical tourism practice and discusses potential problems with the practice, specifically the lack of remedy in case of medical negligence. Although medical …
The Plan B For Plan B: The New Dual Over-The-Counter And Prescription Status Of Plan B And Its Impact Upon Pharmacists, Consumers, And Conscience Clauses, Brittany L. Grimes
The Plan B For Plan B: The New Dual Over-The-Counter And Prescription Status Of Plan B And Its Impact Upon Pharmacists, Consumers, And Conscience Clauses, Brittany L. Grimes
Georgia Law Review
On August 24,2006, the U.S. Food and Drug Administration decided to approve Plan B, the "morning-after"contraceptive pill, as an over-the-counter drug for women ages eighteen and older only. Individuals aged seventeen years and younger must still obtain a prescription in order to purchase Plan B, resulting in confusion and complications in implementing the age limitation. Additionally, the dual status of Plan B as both a prescription and over-the-counter drug might still be undermined by pharmacists choosing to refuse sale of contraceptives under various state protective conscience clauses. This Note explores the impact of the FDA's novel decision to create a …
A Mystery Of Motherhood: The Legal Consequences Of Insufficient Research On Postpartum Illness, Lindsey C. Perry
A Mystery Of Motherhood: The Legal Consequences Of Insufficient Research On Postpartum Illness, Lindsey C. Perry
Georgia Law Review
Postpartum illness is a real and serious affliction, suffered by many mothers throughout the country. For decades, courts have struggled with the issue of how postpartum illness fits into the current framework for legal insanity. Recent publicity of the Andrea Yates trial and her subsequent acquittal brought postpartum psychosis to the attention of the American public. This Note explores the background of postpartum psychosis and its treatment in U.S. courts. It discusses the possibilities for addressing postpartum psychosis in criminal proceedings and proposes that further research and understanding are necessary to provide justice for female defendants afflicted with postpartum psychosis. …

Contractual Expansion Of The Scope Of Patent Infringement Through Field-Of-Use Licensing, Mark R. Patterson
Contractual Expansion Of The Scope Of Patent Infringement Through Field-Of-Use Licensing, Mark R. Patterson
Faculty Scholarship
Patentees sometimes license their inventions through field-of-use licenses, which permit licensees to use the inventions, but only in specified ways. Field-of-use licensing is often procompetitive, because the ability to provide different licensing terms for different users can encourage broader licensing of inventions. But in recent United States cases, the Federal Circuit Court of Appeals and lower courts have upheld field-of-use licenses prohibiting activities that licensees would otherwise have been permitted by patent law, such as the repair and resale of patented products. The recent cases rely on the Federal Circuit's decision in Mallinckrodt, Inc. v. Medipart, Inc., where the court …

Property Outlaws, Eduardo Moises Peñalver, Sonia K. Katyal
Faculty Scholarship
Most people do not hold those who intentionally flout property laws in particularly high regard. The overridingly negative view of the property lawbreaker as a "wrongdoer" comports with the status of property rights within our characteristically individualist, capitalist, political culture. This reflexively dim view of property lawbreakers is also shared, to a large degree, by property theorists, many of whom regard property rights as a relatively fixed constellation of entitlements that collectively produce stability and efficiency through an orderly system of ownership. In this Article, Professors Peihalver and Katyal seek partially to rehabilitate the reviled character of the intentional property …
Tinkering With Torture In The Aftermath Of Hamdan: Testing The Relationship Between Internationalism And Constitutionalism , Catherine Powell
Tinkering With Torture In The Aftermath Of Hamdan: Testing The Relationship Between Internationalism And Constitutionalism , Catherine Powell
Faculty Scholarship
Bridging international and constitutional law scholarship, the author examines the question of torture in light of democratic values. The focus in this article is on the international prohibition on torture as this norm was addressed through the political process in the aftermath of Hamdan v. Rumsfeld. Responding to charges that the international torture prohibition -- and international law generally -- poses irreconcilable challenges for democracy and our constitutional framework, the author contends that by promoting respect for fundamental rights and for minorities and outsiders, international law actually facilitates a broad conception of democracy and constitutionalism. She takes on the question …
International Consensus As Persuasive Authority In The Eighth Amendment, Youngjae Lee
International Consensus As Persuasive Authority In The Eighth Amendment, Youngjae Lee
Faculty Scholarship
This Article is about the epistemic significance of international consensus on constitutional interpretation in the Eighth Amendment context. First, the Article examines whether meaningful conclusions about one's desert judgments can be reached through a process of interjurisdictional comparison that focuses on the existence of a consensus on the question of what punishment is appropriate for what crimes and criminals. Second, this Article examines the relevance of international consensus on penal practices by analogizing the consensus to three different types of consensus: scientific, aesthetic, and moral. This Article concludes from this discussion that so long as the Supreme Court stays with …
A Textual And Historical Case Against A Global Constitution, Andrew Kent
A Textual And Historical Case Against A Global Constitution, Andrew Kent
Faculty Scholarship
he emerging conventional wisdom in the legal academy is that individual rights under the U.S. Constitution should be extended to noncitizens outside the United States. This claim - called globalism in my article - has been advanced with increasing vigor in recent years, most notably in response to legal positions taken by the Bush administration during the war on terror. Against a Global Constitution challenges the textual and historical grounds advanced to support the globalist conventional wisdom and demonstrates that they have remarkably little support. At the same time, the article adduces textual and historical evidence that noncitizens were among …
Sleight Of Hand, Benjamin C. Zipursky
Sleight Of Hand, Benjamin C. Zipursky
Faculty Scholarship
Thanks to Richard Posner's classic 1972 article, A Theory of Negligence Law, the Hand formula of United States. v. Carroll Towing Co. is perhaps the most central idea of many first-year torts classes today. Students learn that the meaning of negligence should be understood in terms of Judge Learned Hand's formula comparing the costs of taking precautions with the product of the likelihood of injury without those precautions and the magnitude of such injury. There is more than a little irony, however, in the superstar status of the Hand formula in negligence law. Carroll Towing is not a negligence case …
The Influences Of Gender Identity On The Expectancies For Success And Perceived Task Value Of Three Different Activities, Chi Ching Chow
The Influences Of Gender Identity On The Expectancies For Success And Perceived Task Value Of Three Different Activities, Chi Ching Chow
Dissertations and Theses @ UNI
The purpose of the study was to investigate the influence of gender identity on expectancies for success and perceived task value. The Short form of the Bern Sex-Role Inventory (BSRI-SF) was used to identify four gender identities, androgynous, feminine, masculine, and undifferentiated. The Self- and Task- Perception Questionnaire measured expectancies and task values on three physical activities. One hundred thirty-three students (62 males and 71 females) at the University of Northern Iowa who were enrolled in the aerobic training session of the personal wellness class participated. The mean age of the participants was 20.2 years (SD= 1.9). AN OVA results …
Artist's Labor, Derek Whitehead
Artist's Labor, Derek Whitehead
Contemporary Aesthetics (Journal Archive)
This essay explores the relations between perception, phenomenology and art practice. The object of my inquiry is the kind of perceptual repertoire available to the artist in relation to his art, which extends beyond the technical means available to art making in its varying forms. I invoke an artist's innate perception as the source and locus of art's creation. This creation of art also has an outward or phenomenological dimension. In this respect, I investigate the ways in which phenomenological perception, via Maurice Merleau-Ponty's hermeneutic insights into artistic activity, might offer to contemporary arts practice a means of reappraising its …

Distance From Family, Years Of Life On Reservation/Village, Level Of Acculturation, Gender, And Acculturation Stress Of American Indian/Alaska Native Students At The University Of Montana, Michael Brian Trahan
Graduate Student Theses, Dissertations, & Professional Papers
Acculturation is a construct that supposes that two or more cultures interact and are in conflict with one another, and an individual can determine which qualities to adhere to from each culture. Acculturation stress is a product of the acculturation process, in which an individual experiences stress as a result of the interaction of the multiple cultures upon the individual. This study examined the effects of acculturation stress on 41 (14 male and 27 female) American Indian/Alaska Native (AI/AN) university students in an effort to determine whether this stress is related to level of acculturation, years lived on an Indian …

Do Sagebrush Density And Vegetation Condition Affect Demography Of Brewer's Sparrows Nesting In The Blackfoot Valley?, Masanori Abe
Graduate Student Theses, Dissertations, & Professional Papers
Vegetation condition can influence habitat quality by altering food abundance, predator abundance and species composition, and microclimate. In some habitats, livestock grazing alters vegetation condition in ways that affect the breeding success of passerines. Most sagebrush-dominated habitats have been heavily grazed by livestock, and the total area of sagebrush has declined substantially. Owing to this habitat loss and change, numbers of various sagebrush-obligate birds have declined, the Brewer's Sparrow among them. I examined the effects of cattle grazing on Brewer's Sparrow reproduction. Grazed plots, at the study-site scale, were characterized by higher potential nest-sagebrush density, and canopy cover, a higher …
Assisting Learning And Success In Adhd Children, Katie Burns
Assisting Learning And Success In Adhd Children, Katie Burns
International Christian Community of Teacher Educators Journal
Attention-Deficit/Hyperactivity Disorder (ADHD) has become the center of controversy as Americans diagnosis children with ADHD at an ever increasing rate. Yet it seems at times that little is actually known about the disease beyond the accepted truth that a distinct disorder marked by inattention and hyperactivity does, in fact, exist. This disorder causes numerous problems within the classroom including classroom management and jeopardizing the education of all children in the class. One option to overcome these challenges is to place all ADHD children in a separate classroom, however this only serves to isolate the child and entirely exhaust the teacher. …
