Ethnogenesis Of Metis, Cree And Chippewa In Twentieth Century Montana, Elizabeth Sperry

Graduate Student Theses, Dissertations, & Professional Papers

This thesis examines the history of Montana’s Metis, Cree and Chippewa people as “landless Indians” in a twentieth century context. Landlessness among the Metis, Cree and Chippewa became a defining aspect of their identity by the twentieth century that distinguished them from both Indian and white people in the state. This paper discusses the historical processes by which the Metis, Cree and Chippewa became landless, and examines the unique aspects of their social and economic lives as landless Indian people. This paper concludes with an examination of the ethnogenesis of Metis, Cree and Chippewa, which was based upon patterns of …

Examining The Variability In The Long Term Adjustment Of Child Sexual Abuse Victims, Heather Marie Ulrich Jan 2007

Examining The Variability In The Long Term Adjustment Of Child Sexual Abuse Victims, Heather Marie Ulrich

Graduate Student Theses, Dissertations, & Professional Papers

Two meta-analyses (Rind, Tromovitch & Bauserman, 1998; Ulrich, Randolph, & Acheson, 2006) have suggested that the long held belief about the inevitable pervasive negative effects of child sexual abuse does not hold for college populations. The meta-analyses suggest that there is other factors in sexual abuse victims' lives that interact with their abuse experience to produce the sometimes-observed minimal long-term effects on psychological adjustment. This research attempted to examine a potential model for explaining the variability in the long-term effects of child sexual abuse by examining both moderator variables and abuse characteristics within the same population. The study examined three …

Friends The Family You Choose (No Matter What: An Investigation Of Fictive Kin Relationships Amoung Young Adults., Kimberly Anne Clinger Jan 2007

Friends The Family You Choose (No Matter What: An Investigation Of Fictive Kin Relationships Amoung Young Adults., Kimberly Anne Clinger

Graduate Student Theses, Dissertations, & Professional Papers

Current research on fictive kin primarily focuses on the assignment of the fictive kin relationship, and does not focus on how acceptance of an individual as fictive kin is communicatively constructed. This research offers a look into how young adults communicate acceptance in their fictive kin relationships. Four focus groups and seven semi-structured interviews were conducted with young adults regarding their interactions that co-constructed meaning in their fictive kin relationships and how acceptance as fictive kin was communicatively constructed. A grounded theory constant comparison method is used to analyze the focus groups and interviews. The data were used to develop …

Integrated Modeling Of Long-Term Vegetation And Hydrologic Dynamics In Rocky Mountain Watersheds, Robert Steven Ahl Jan 2007

Integrated Modeling Of Long-Term Vegetation And Hydrologic Dynamics In Rocky Mountain Watersheds, Robert Steven Ahl

Graduate Student Theses, Dissertations, & Professional Papers

Changes in forest structure resulting from natural disturbances, or managed treatments, can have negative and long lasting impacts on water resources. To facilitate integrated management of forest and water resources, a System for Long-Term Integrated Management Modeling (SLIMM) was developed.

By combining two spatially explicit, continuous time models, vegetation patterns can be simulated forward in time based on management criteria. Output from the SIMPPLLE vegetation simulator are converted into landcover maps at every time-step and used to predict hydrologic watershed responses to time-series landcover change with the SWAT model. Long-term watershed responses to vegetation management scenarios can therefore be evaluated …

Impact Of Training On School Psychologists' Knowledge And Attitudes Regarding Children With Chronic Health Issues, Abby Baker Jan 2007

Impact Of Training On School Psychologists' Knowledge And Attitudes Regarding Children With Chronic Health Issues, Abby Baker

PCOM Psychology Dissertations

Children who have chronic medical illnesses must rely on their families and schools to create an environment that allows goals in the areas of development, of academic, social, familial and life-skills to be individualized to accommodate the capabilities of each child. School psychologists are an essential part of blending a child’s needs and academic fit. Although school psychologists receive some training in child psychopathology, they lack the necessary training in the areas of acute and chronic illness, in order to work with the health care system and to collaborate with pediatricians. The emergence of the field of Pediatric Psychology in …

Psychological Effects Of Not Having Equal Rights And Privileges In The Lesbian, Gay, Bisexual, Transgender Community: Activism As An Antidote?, David E. Baker Jan 2007

Psychological Effects Of Not Having Equal Rights And Privileges In The Lesbian, Gay, Bisexual, Transgender Community: Activism As An Antidote?, David E. Baker

PCOM Psychology Dissertations

Despite the prevalence of discrimination in American society, little is known about the effects of equal rights activism on mental health. Within the lesbian, gay, bisexual, transgender community, discrimination against marriage, adoption, employment, and other rights and privileges given to heterosexual individuals is still legal and socially accepted in most American communities. Previous research has suggested that these individuals have higher incidences of depression, anxiety, and substance use than the general population. The experience of discrimination and punishment responses learned from societal messages is believed to contribute to these clinical issues within this community. This qualitative study found that equal …

Clinical Treatment Provider Attitudes Toward Sexual Offender Management Within An Outpatient Treatment Center : Treatment Provider Attitude Survey, Dustan A. Barabas Jan 2007

Clinical Treatment Provider Attitudes Toward Sexual Offender Management Within An Outpatient Treatment Center : Treatment Provider Attitude Survey, Dustan A. Barabas

PCOM Psychology Dissertations

The present study's foundation is based on research suggesting that the attitudes of clinicians regarding their clients have profound effects on therapeutic alliances, empathy, and staff burnouts, which may contribute to treatment barriers. Because professionally appropriate behavior often conceals stigma, misconceptions, and negative feelings that clinicians may have toward sexual offenders, an anonymous survey of attitudes, job burnout, and empathy was conducted in an outpatient setting. The survey instruments tap into some latent factors concerning the attitudes of clinicians, their perceptions of burnout, and their abilities to empathize with their clients. This research focused on describing a population of clinicians …

Transportability Of Trauma-Focused Cognitive Behavioral Therapy : A Case Study With Adolescents In A Residential Treatment Setting, Susanna A. Carew

PCOM Psychology Dissertations

Because of the increase in the numbers of adolescents presenting in residential care, the challenge and difficulty posed to therapists in treating this age-group, and the prevalence of chronic stress and complex trauma symptoms found in this population, the research conducted was a clinical case study investigating the transportability and effectiveness of using Trauma-Focused Cognitive Behavioral Therapy (TF-CBT), a manualized treatment format, with adolescent clients in a residential treatment setting. A doctoral candidate was trained to engage each of three residential clients in 12 individual sessions of TF-CBT. The Behavior Assessment System for Children (BASC), Children’s Depression Inventory (CDI), Jesness …

The Rise And Fall Of School Vouchers: A Story Of Religion, Race, And Politics, James Forman Jr. Jan 2007

The Rise And Fall Of School Vouchers: A Story Of Religion, Race, And Politics, James Forman Jr.

Georgetown Law Faculty Publications and Other Works

This Article examines why school vouchers have failed to garner the support that so many assumed would follow the Court's decision in Zelman. The explanation, I suggest, concerns religion, race, and politics. The original rationale for vouchers was what I call the "values claim"-vouchers protected the right of parents to send their child to a school that reinforced their values. Originally promoted by Catholics, the values claim was adopted by evangelical Christians concerned about the secularization of public schools after the 1960s. Although the values claim was central for most of the history of the voucher movement, in the decade …

Why The Customer Isn’T Always Right: Producer-Based Limits On Rights Accretion In Trademark, Rebecca Tushnet Jan 2007

Why The Customer Isn’T Always Right: Producer-Based Limits On Rights Accretion In Trademark, Rebecca Tushnet

Georgetown Law Faculty Publications and Other Works

In this article the author responds to James Gibson’s article Risk Aversion and Rights Accretion in Intellectual Property Law, which offers valuable insights into the extra-judicial dynamics that have contributed to the seemingly unending expansion of copyright and trademark rights over the past few decades. Her response focuses on the trademark side of that expansion. The theoretical basis for granting trademark rights is that, if consumers perceive that a mark or other symbol indicates that a single source is responsible for a product or service—whether through physical production, licensing, sponsorship, or other approval—then the law should give effect to …

Guilty Pleas And Barristers' Incentives: Lessons From England, Peter W. Tague Jan 2007

Guilty Pleas And Barristers' Incentives: Lessons From England, Peter W. Tague

Georgetown Law Faculty Publications and Other Works

When considering the defendant's plea, barristers, like lawyers, have two overriding, selfish interests: maximizing remuneration and avoiding sanction. The tension between defendant and defender is most acute when the defendant is indigent and the defender has been chosen to represent him. It is their relationship that is addressed in this article.

The goal is to align the defender's selfish interests with the defendant's need for thoughtful advice over how to plead, so that, behind the guise of apparently disinterested advice, the advocate is not pursuing his interests at the defendant's expense. By contrast to most American practice, the method of …

Cyberspace As/And Space, Julie E. Cohen Jan 2007

Cyberspace As/And Space, Julie E. Cohen

Georgetown Law Faculty Publications and Other Works

The appropriate role of place- and space-based metaphors for the Internet and its constituent nodes and networks is hotly contested. This essay seeks to provoke critical reflection on the implications of place- and space-based theories of cyberspace for the ongoing production of networked space more generally. It argues, first, that adherents of the cyberspace metaphor have been insufficiently sensitive to the ways in which theories of cyberspace as space themselves function as acts of social construction. Specifically, the leading theories all have deployed the metaphoric construct of cyberspace to situate cyberspace, explicitly or implicitly, as separate space. This denies all …

Pursuing Accountability For Atrocities After Conflict: What Impact On Building The Rule Of Law?, Jane E. Stromseth Jan 2007

Pursuing Accountability For Atrocities After Conflict: What Impact On Building The Rule Of Law?, Jane E. Stromseth

Georgetown Law Faculty Publications and Other Works

In countries ravaged by widespread violence, the trauma does not end when the guns fall silent. On the contrary, atrocities have cast a long shadow in places such as the Balkans, where brutal massacres, mass rapes, and ethnic cleansing were regular features of war; in Rwanda, where a devastating genocide killed hundreds of thousands of people; and in Sierra Leone, where the civil war was marked by forced recruitment of child soldiers, rapes and murders, and the gruesome mutilation of civilians. In Afghanistan, Iraq, East Timor, and many other societies, severe abuses have also left deep pain and trauma in …

Pandemic Influenza: Ethics, Law, And The Public's Health, Lawrence O. Gostin, Benjamin E. Berkman Jan 2007

Pandemic Influenza: Ethics, Law, And The Public's Health, Lawrence O. Gostin, Benjamin E. Berkman

Georgetown Law Faculty Publications and Other Works

Highly pathogenic Influenza (HPAI) has captured the close attention of policy makers who regard pandemic influenza as a national security threat. Although the prevalence is currently very low, recent evidence that the 1918 pandemic was caused by an avian influenza virus lends credence to the theory that current outbreaks could have pandemic potential. If the threat becomes a reality, massive loss of life and economic disruption would ensue. Therapeutic countermeasures (e.g., vaccines and antiviral medications) and public health interventions (e.g., infection control, social separation, and quarantine) form the two principal strategies for prevention and response, both of which present formidable …

Neural Network Control Of Robot Formations Using Rise Feedback, Jagannathan Sarangapani, Travis Alan Dierks Jan 2007

Neural Network Control Of Robot Formations Using Rise Feedback, Jagannathan Sarangapani, Travis Alan Dierks

Electrical and Computer Engineering Faculty Research & Creative Works

In this paper, a combined kinematic/torque control law is developed for leader-follower based formation control using backstepping in order to accommodate the dynamics of the robots and the formation in contrast with kinematic-based formation controllers that are widely reported in the literature. A neural network (NN) is introduced along with robust integral of the sign of the error (RISE) feedback to approximate the dynamics of the follower as well as its leader using online weight tuning. It is shown using Lyapunov theory that the errors for the entire formation are asymptotically stable and the NN weights are bounded as opposed …

Law As A Tool To Facilitate Healthier Lifestyles And Prevent Obesity, Lawrence O. Gostin Jan 2007

Law As A Tool To Facilitate Healthier Lifestyles And Prevent Obesity, Lawrence O. Gostin

Georgetown Law Faculty Publications and Other Works

Public health agencies face considerable challenges trying to prevent overweight and obesity in society, primarily because a person's own behavior is often the root cause of the disease. Individuals make personal choices about their diet, exercise, and lifestyle, so disease is often thought of as a matter of personal, not governmental, responsibility. This Commentary shows how law can be used as a tool to prevent overweight and obesity (see Table).

The tools discussed in this article include:

- Disclosure - e.g., labels and consumer information

- Tort liability - e.g., inadequate disclosure of risks, misleading advertisements, and targeting children

- …

The "Tobacco Wars" - Global Litigation Strategies, Lawrence O. Gostin Jan 2007

The "Tobacco Wars" - Global Litigation Strategies, Lawrence O. Gostin

Georgetown Law Faculty Publications and Other Works

The Framework Convention on Tobacco Control (FCTC) identifies civil and criminal litigation as a public health strategy and promotes international cooperation (reporting, technical assistance, and information exchange). Holding the tobacco industry accountable through civil and criminal liability serves a number of public health objectives: punishes companies for hiding known health risks, manipulating nicotine content, and misleading the public; deters and preve nts future harmful behavior; compensates individuals and stake-holders for health care and other costs associated with smoking and exposure to environmental tobacco smoke (ETS); raises prices, resulting in lower tobacco consumption; increases disclosure of health risks, through labeling and …

Our Other Reproductive Choices: Equality In Sex Education, Contraceptive Access, And Work-Family Policy, Cornelia T. Pillard

Georgetown Law Faculty Publications and Other Works

Reproductive rights are traditionally understood to be protected by the privacy aspect of the due process liberty guarantee, but equal protection is also at the heart of the matter. Many of us intuitively know the close relationship between sex equality and abortion rights, and the law, too, is starting to reflect it. This Symposium broadens the focus of traditional abortion-rights jurisprudence to develop equality-based analyses of abortion rights. Widening the angle even further, this Article looks at sex equality and reproductive rights issues beyond the core right to abortion . . . To highlight some of the opportunities created by …

Trademark Law As Commercial Speech Regulations, Rebecca Tushnet Jan 2007

Trademark Law As Commercial Speech Regulations, Rebecca Tushnet

Georgetown Law Faculty Publications and Other Works

False advertising law has largely escaped constitutional scrutiny because courts consider false or misleading commercial speech outside the protection of the First Amendment. Even moderate First Amendment protection for truthful commercial speech, however, requires some constitutional policing of the line between truth and falsity. Current enforcement of false advertising law, whether administrative, as with the FDA's regulation of drug-related speech, or judicial, as with Lanham Act suits brought by private parties, is ill-equipped to deal with First Amendment doctrine's very different concerns, rules, and presumptions. This contribution to the symposium will explore some of the ways in which the First …

The Structure Function Relationship Of Silica Polyamine Composites, Mark Anthony Hughes Jan 2007

The Structure Function Relationship Of Silica Polyamine Composites, Mark Anthony Hughes

Graduate Student Theses, Dissertations, & Professional Papers

The goals of this thesis were to improve the performance of silica polyamine composites by manipulating the surface structure and to understand the relationship between, polymer structure and ligand modification of the grafted polyamine. Improvements in silica polyamine composite performance resulted from modifying silica gel with methyltrichlorosilane (MTCS) substituted for a molar fraction of reagent chloropropyltrichlorosilane (CPTCS), which has been traditionally employed. MTCS does not possess a terminal chloride group thus preventing the subsequent attachment of a polyamine to this moiety. MTCS has a smaller molecular volume than CPTCS and as a consequence greater coverage of the silica gel surface …

"This research study focuses on developing a framework that can be utilized by system architects to understand the emergent behavior of system architectures. The objective is to design a framework that is modular and flexible in providing different ways of modeling sub-systems of System of Systems. At the same time, the framework should capture the adaptive behavior of the system since evolution is one of the key characteristics of System of Systems. Another objective is to design the framework so that humans can be incorporated into the analysis. The framework should help system architects understand the behavior as well as …

Understanding Behavior Of System Of Systems Through Computational Intelligence Techniques, Nil H. Kilicay, Cihan H. Dagli Jan 2007

Understanding Behavior Of System Of Systems Through Computational Intelligence Techniques, Nil H. Kilicay, Cihan H. Dagli

Engineering Management and Systems Engineering Faculty Research & Creative Works

The world is facing an increasing level of systems integration leading towards systems of systems (SoS) that adapt to changing environmental conditions. The number of connections between components, the diversity of the components and the way the components are organized can lead to different emergent system behavior. Therefore, the need to focus on overall system behavior is becoming an unavoidable issue. The problem is to develop methodologies appropriate for better understanding behavior of system of systems before the design and implementation phase. This paper focuses on computational intelligence techniques used for analysis of complex adaptive systems with the aim of …

Adaptive Neural Network Based Stabilizing Controller Design For Single Machine Infinite Bus Power Systems, Wenxin Liu, Ganesh K. Venayagamoorthy, Donald C. Wunsch, David A. Cartes, Jagannathan Sarangapani, Mariesa Crow Jan 2007

Adaptive Neural Network Based Stabilizing Controller Design For Single Machine Infinite Bus Power Systems, Wenxin Liu, Ganesh K. Venayagamoorthy, Donald C. Wunsch, David A. Cartes, Jagannathan Sarangapani, Mariesa Crow

Engineering Management and Systems Engineering Faculty Research & Creative Works

Power system stabilizers are widely used to generate supplementary control signals for the excitation system in order to damp out the low frequency oscillations. In power system control literature, the performances of the proposed controllers were mostly demonstrated using simulation results without any rigorous stability analysis. This paper proposes a stabilizing neural network (NN) controller based on a sixth order single machine infinite bus power system model. The NN is used to approximate the complex nonlinear dynamics of power system. Unlike the other indirect adaptive NN control schemes, there is no offline training process and the NN can be directly …

The study uses the Wisconsin Breast Cancer study with nine attributes and one class.

Effective Use Of Process Capability Indices For Supplier Management, Elizabeth A. Cudney, David Drain Jan 2007

Effective Use Of Process Capability Indices For Supplier Management, Elizabeth A. Cudney, David Drain

Engineering Management and Systems Engineering Faculty Research & Creative Works

Process capability indices were originally invented to enable an organization to make economically sound decisions for process management. Process capability is a comparison of the voice of the process with the voice of the customer. Current practice is to use Cp and Cpk regardless of the validity of the underlying assumptions necessary for their use. Even if all necessary assumptions are satisfied, important problems can be missed if these indices are the sole process evaluation examined. Customer-supplier axioms are introduced to motivate more useful process evaluations and foster long-term harmonious relationships. This paper explores the alternative capability indices Cpm, Cpmk, …
