Sucking Salt: Caribbean Women Writers, Migration, And Survival By Meredith M. Gadsby (Book Review), Daryl Cumber Dance Jan 2007

Sucking Salt: Caribbean Women Writers, Migration, And Survival By Meredith M. Gadsby (Book Review), Daryl Cumber Dance

English Faculty Publications

The folk will tell you that salt can either save you or destroy you. Toni Cade Bambara's Velma of The Salteaters realized that her survival depended on learning "the difference between eating salt as an antidote to snakebite and turning into salt, succumbing to the serpent." The lesson of similar folk wisdom is the subject of Meredith M. Gasby's Sucking Salt, where she propses as a new framework for the examination of Caribbean women's writing the survival techiniques implied in "sucking salt," techiniques suggested in her aunt's reflections on people she knew. Tantie expounded: "Little salt won't kill …

Preserving The Seeds Of Gender Fluidity: Tribal Courts And The Berdache Tradition, Andrew Gilden Jan 2007

Preserving The Seeds Of Gender Fluidity: Tribal Courts And The Berdache Tradition, Andrew Gilden

Michigan Journal of Gender & Law

This Article outlines the particular cultural characteristics giving rise to traditional berdachism, the means by which American policies fostered their decline, and the Navajo tribal courts' re-infusion of these characteristics into contemporary jurisprudence. By tracking the interplay between the traditional values of child autonomy, gender equality, and tribal collectivism, the rise, fall and potential reemergence of the berdache tradition can be analyzed as resulting from shifts in its determinative cultural elements.

Ending The Silence: Thai H-2a Workers, Recruitment Fees, And The Fair Labor Standards Act, Andrea L. Schmitt Jan 2007

Ending The Silence: Thai H-2a Workers, Recruitment Fees, And The Fair Labor Standards Act, Andrea L. Schmitt

Washington International Law Journal

Increasing numbers of Thai workers are coming to the United States using “H-2A” temporary agricultural worker visas. Compared with their Latin American counterparts, Thai H-2A workers are more vulnerable to poor working conditions and other abusive employment practices for two reasons. First, the workers often pay large recruitment fees to labor recruiters in Thailand, and they therefore arrive with a much weightier debt burden. This debt, combined with conditions inherent in the H-2A system, puts intense pressure on workers to remain silent. Second, Thai workers are more culturally and linguistically isolated in rural U.S. communities than their Latin American counterparts. …

Islamic Finance In A Global Context: Opportunities And Challenges, Theodore Karasik, Frederic Wehrey, Steven Strom Jan 2007

Islamic Finance In A Global Context: Opportunities And Challenges, Theodore Karasik, Frederic Wehrey, Steven Strom

Chicago Journal of International Law

Despite this scope and imprint on the global economy, Islamic finance remains poorly understood at both the theoretical and practical level. Moreover, despite a number of recent optimistic trends, Islamic finance faces several ideological and structural challenges to full integration in the globalized economy. This Article aims to illuminate these challenges and provide a general overview of contemporary Islamic financial theories and practices. The first section concentrates on the size of the world's Muslim population, the size of Muslim economies, and concepts of Islamic finance itself. The second section examines Muslim beliefs related to contemporary corporate finance. The third section …

Judges As Humans: Interdisciplinary Research And The Problems Of Institutional Design, Chad M. Oldfather Jan 2007

Judges As Humans: Interdisciplinary Research And The Problems Of Institutional Design, Chad M. Oldfather

Faculty Publications

The article takes up the question of how best to put the increasing amount of interdisciplinary scholarship on courts and judges to work in service of institutional design and reform. The analysis focuses on the analysis from a recent book, Judges and Their Audiences: A Perspective on Judicial Behavior, by Lawrence Baum. The book provides an appropriate vehicle for this analysis because of what might be called its multi-interdisciplinarity. In it, Baum, a political scientist, draws on social psychology to critique political science models of judicial behavior.

I argue that analyses such as Baum's are important not only for their …

From Muse To Poet: Paratextual Practices Of Women Poets In Cuba At The End Of The Nineteenth-Century, Catharina Vallejo Jan 2007

From Muse To Poet: Paratextual Practices Of Women Poets In Cuba At The End Of The Nineteenth-Century, Catharina Vallejo

Decimonónica

One of the foundations of Western thought is the structure of binary oppositions based in abstract conceptualizations. This process includes the expression of generic qualities as universalized notions. With respect to women, these qualities are generally contracted into “Woman.” Luce Irigaray describes this “Woman” as “having been misinterpreted, forgotten, variously frozen in show-cases, rolled up in metaphors, buried beneath carefully stylized figures, raised up in different realities . . . ” (144). Women and writing have often been symbolic of each other as objects of the process of conceptualization. Aníbal González proposes that in many nineteenth-century texts the struggle for …

A Tendency To Incite: Applying Kenneth Burke's Pentad To Cohen V. California, Corinne Griffiths Jan 2007

A Tendency To Incite: Applying Kenneth Burke's Pentad To Cohen V. California, Corinne Griffiths

Student Work

Paul Robert Cohen was arrested and sentenced to 30 days imprisonment in 1968 for wearing a jacket which read "Fuck the Draft" into a California courthouse. Appealing to the United States Supreme Court, Cohen claimed that his First Amendment rights to freedom of expression had been violated. In a landmark decision, the Court found that states cannot universally criminalize the use of expletives in public, with five justices in the majority opinion and four justices dissenting. This paper examines the link between communication theory and jurisprudence by using Kenneth Burke's dramatistic pentad to compare the two opinions as competing dramas.

Purity Lost: The Paradoxical Face Of The New Transnational Legal Body, Oren Perez Jan 2007

Purity Lost: The Paradoxical Face Of The New Transnational Legal Body, Oren Perez

Comparative Research in Law & Political Economy

Modern international law seems to be in disarray. The classic doctrines of international law, with their focus on sovereignty, state consent, custom and treaty, do not provide a satisfactory explanation for many of the practices and institutional structures that fill the global legal universe. The contemporary legal terrain is characterized by overlapping jurisdictions, inconsistent doctrinal interpretations and competing worldviews. But what are the social implications of the deepening fragmentation and increasing complexity of the global legal system? Some observers see these phenomena as a new global risk, which requires urgent collective response. Global constitutionalisation is put forward in this context …

F1 And Center Of Gravity Interplay In The Maintenance Of Phonological Height Within A Statistical Model Of A Communal Grammar: The Case Of Foodo [Atr] Acoustics, Colleen G. Anderson

UTA Working Papers in Linguistics - Archive

This paper presents the notion of an idealized or communal grammar as a statistical model of mode, mean or median as emerging from a representative number of a population, rather than in individual speech, per se. Like other languages with a 9-vowel Cross Height Vowel Harmony (CHVH) system, the most reliable correlate of ATR is F1; [+ATR] vowels have lower F1 values than their [-ATR] counterparts, while F2 differences show considerable variation across speakers. F1, however, fails to maintain phonological height differences as the [+ATR] mid vowels of level 3 overlap in acoustic space with the [-ATR] high vowels of …
