HIV and AIDS

In 2004, World Vision Rwanda (WVR), in collaboration with Tulane University and the Rwanda School of Public Health, implemented a program to provide support through regular visits by an adult mentor to youth living without adult care. After completion of baseline quantitative and qualitative research, WVR implemented the program in two areas of a province in southwestern Rwanda. Over an 18-month period, 156 trained adult mentors visited and supported 441 youth-headed households. The mentor training covered key aspects of child development and skills for addressing key psychosocial issues that were identified through the baseline research. Specifically, the training addressed how …

Preserving The Seeds Of Gender Fluidity: Tribal Courts And The Berdache Tradition, Andrew Gilden Jan 2007

Preserving The Seeds Of Gender Fluidity: Tribal Courts And The Berdache Tradition, Andrew Gilden

Michigan Journal of Gender & Law

This Article outlines the particular cultural characteristics giving rise to traditional berdachism, the means by which American policies fostered their decline, and the Navajo tribal courts' re-infusion of these characteristics into contemporary jurisprudence. By tracking the interplay between the traditional values of child autonomy, gender equality, and tribal collectivism, the rise, fall and potential reemergence of the berdache tradition can be analyzed as resulting from shifts in its determinative cultural elements.

The Revitalization Of Ake: A Capital Defendant’S Right To Expert Assistance, Cara H. Drinan Jan 2007

The Revitalization Of Ake: A Capital Defendant’S Right To Expert Assistance, Cara H. Drinan

Scholarly Articles

Under Ake v. Oklahoma, indigent capital defendants are entitled to a wide array of expert assistance at both the conviction and sentencing phases of trial. Historically, the Ake entitlement has been under-utilized for both structural and normative reasons. However, today Ake is in the process of being revitalized. Recent Supreme Court decisions and the revised American Bar Association (ABA) Guidelines for the Appointment and Performance of Defense Counsel in Death Penalty Cases offer the hope that the theoretical entitlement of Ake will be fully realized. Moreover, if that occurs, one of two outcomes is likely to ensue at the state …

Ending The Silence: Thai H-2a Workers, Recruitment Fees, And The Fair Labor Standards Act, Andrea L. Schmitt Jan 2007

Ending The Silence: Thai H-2a Workers, Recruitment Fees, And The Fair Labor Standards Act, Andrea L. Schmitt

Washington International Law Journal

Increasing numbers of Thai workers are coming to the United States using “H-2A” temporary agricultural worker visas. Compared with their Latin American counterparts, Thai H-2A workers are more vulnerable to poor working conditions and other abusive employment practices for two reasons. First, the workers often pay large recruitment fees to labor recruiters in Thailand, and they therefore arrive with a much weightier debt burden. This debt, combined with conditions inherent in the H-2A system, puts intense pressure on workers to remain silent. Second, Thai workers are more culturally and linguistically isolated in rural U.S. communities than their Latin American counterparts. …

The Lisbon Compromise: A Synthesis Between Community Method And Union Acquis, Jacqueline Dutheil De La Rochère Jan 2007

The Lisbon Compromise: A Synthesis Between Community Method And Union Acquis, Jacqueline Dutheil De La Rochère

Fordham International Law Journal

Lisbon is a return to the community method: the word "Constitution" has disappeared along with the goal of drafting a self-sufficient document. A new treaty is proposed for ratification by Member States modifying on one side the Treaty on European Union ("TEU") and on the other side the Treaty establishing the European Community ("EC Treaty"); this last part of the modifying treaty is designated as the Treaty on the Functioning of the European Union ("TFEU"). Nothing has improved as regards clarity and simplification: the amendments cover 152 pages and prove very difficult to read in the absence of consolidation, not …

The Lisbon Treaty: A Brief Outline, Giorgio Maganza Jan 2007

The Lisbon Treaty: A Brief Outline, Giorgio Maganza

Fordham International Law Journal

The story of the Lisbon Treaty cannot be told--nor can a brief outline thereof be sketched--without going back to the Constitutional Treaty, which represents the background to the Lisbon Treaty and against which the Lisbon Treaty ought to be assessed. That is why the present outline will first refer to the Constitutional Treaty, before addressing the structure and the content of the Lisbon Treaty.

Fordham International Law Journal

We are very pleased, very honored, to end this conference, this academic workshop, with a panel of present and former judges, who have kindly agreed to talk informally and frankly about some interesting issues that concern the European Court of Justice. We have two judges who are current judges: John Murray, the Chief Justice of the Supreme Court of Ireland; and we have Richard Lauwaars, who is a member of the Dutch Council of State, the supreme administrative court. And then we have Francis Jacobs, who has recently retired as Advocate General at the Court of Justice after three terms …

Printing Industry Offshoring: Perspectives From U.S. Based Printing, Sandra Rothenberg, Ron Hira, Zhi Tang Jan 2007

Printing Industry Offshoring: Perspectives From U.S. Based Printing, Sandra Rothenberg, Ron Hira, Zhi Tang

Books

Offshoring and offshore outsourcing, the movement of work and tasks to low-cost countries, has been increasing in scale and scope. Offshoring in the manufacturing sector has been an ongoing phenomenon for more than forty years. More recently, examples of offshoring in services industries such as software, once considered non-tradeable and therefore immune to offshoring, have emerged. The concurrent effects of very rapid growth of the Indian and Chinese economies and dramatically lower international cross-border transaction costs have the potential to change the structure of many industries. Some have called this as historic an economic transformation as the Industrial Revolution (Blinder, …

Transnational Consumer Law: Co-Regulation Of B2c-E-Commerce, Gralf-Peter Calliess Jan 2007

Transnational Consumer Law: Co-Regulation Of B2c-E-Commerce, Gralf-Peter Calliess

Comparative Research in Law & Political Economy

The nation states provide workable contract enforcement institutions for domestic commerce. Due to a lack of international cooperation the same does not hold true when it comes to cross-border situations. Thus, the institutional organization of international commerce is characterized by its reliance on private ordering or private legal services. Many believe that the emergence of a New Law Merchant can be observed in international commercial arbitration. This trend towards the privatization of commercial law, however, is believed to be limited to the sphere of corporate actors or merchants. When it comes to the protection of weaker contract parties like consumers, …

Too Long Neglected: Expanding Curricular Support For Public Interest Lawyering, Louis S. Rulli Jan 2007

Too Long Neglected: Expanding Curricular Support For Public Interest Lawyering, Louis S. Rulli

Cleveland State Law Review

In short, as the academy sends more students than ever to corporate law firms, law schools need to do more to cultivate, nourish, and prepare the next generation of public interest lawyers. By making public interest lawyering more prominent in the curriculum, and offering students greater opportunity to work with faculty and students of similar interest on public interest issues, the academy can take an important step forward toward helping students overcome feelings of isolation and survive the formidable obstacles that discourage public interest careers. This article describes one such course, Lawyering in the Public Interest, which is offered as …

Silver Threads Among The Gold . . . 50 Years Of The Free Movement Of Goods, Laurence W. Gormley Jan 2007

Silver Threads Among The Gold . . . 50 Years Of The Free Movement Of Goods, Laurence W. Gormley

Fordham International Law Journal

The European Community (“EC”) is 50 years old this year, albeit having undergone a change of name and, just to confuse everyone, the articles of the Treaty establishing the European Community (“EC Treaty”) underwent a change in numbering. If the Treaty of Lisbon comes into force, the European Community itself will disappear, being absorbed into the European Union (“EU”), and the present EC Treaty will become the Treaty on the Functioning of the European Union (“FEU”). It is thus appropriate that this issue of the Fordham International Law Journal be devoted to the Golden Anniversary of the European (Economic) Community, …

To Disclose Or Not To Disclose. That Is The Question For The Corporate Fiduciary Who Is Also A Pension Plan Fiduciary Under Erisa: Resolving The Conflict Of Duty, Shelby D. Green

Elisabeth Haub School of Law Faculty Publications

This Article examines the seeming irreconcilable conflict faced by the pension plan fiduciary, who is a corporate insider, to disclose or not to disclose material, inside information to plan participants, who would use the information to divest investments in company stock, without disclosing the same information to persons on the other side of these trades. The Article begins with a general discussion of the regulation of trade in securities and the history of the insider trading laws under the Securities Exchange Act of 1934. Part III discusses the soundness of the prohibition against insider trading. Part IV explains the duties …

Client Responsibility For Lawyer Conduct: Examining The Agency Nature Of The Lawyer-Client Relationship., Grace M. Giesel Jan 2007

Client Responsibility For Lawyer Conduct: Examining The Agency Nature Of The Lawyer-Client Relationship., Grace M. Giesel

Faculty and Staff Scholarship

In the 1962 decision of Link v. Wabash Railroad Co., the United States Supreme Court reviewed a district court's sua sponte dismissal of a diversity negligence action. Six years after the plaintiff filed the matter, the district court scheduled a pretrial conference and gave counsel two weeks notice of the scheduled conference. On the day of the conference, plaintiffs counsel called the court to say that he would be unable to attend the conference, giving the impolitic reason that he was busy preparing some documents for the state supreme court. The attorney did not attend the conference, and the district …
