Involuntary Commitment Of People With Mental Retardation: Ensuring All Of Georgia's Citizens Receive Adequate Procedural Due Process, Laura W. Harper Mar 2007

Involuntary Commitment Of People With Mental Retardation: Ensuring All Of Georgia's Citizens Receive Adequate Procedural Due Process, Laura W. Harper

Mercer Law Review

In the state of Georgia there are approximately three thousand citizens who are confined to segregated living institutions because of their disabilities. Many of these individuals are placed in institutions involuntarily through legal proceedings. Some of these individuals have mental retardation, a condition that occurs during a person's development and results in below normal intellectual functioning. Many disability advocates argue that segregation and institutionalization of people with mental retardation is not needed, although all do not agree. Despite strong advocacy for the rights of people with disabilities, many continue to be institutionalized, often because their families can find no other …

Lawyers And Prophetic Justice, Timothy Floyd Mar 2007

Lawyers And Prophetic Justice, Timothy Floyd

Mercer Law Review

The statue of Lady Justice, a blindfold over her eyes, holding scales in one hand and a sword in the other, is our traditional visual image of justice. The scales convey the idea of neutrality and the weighing of competing interests; they emphasize rationality and the application of neutral principles in decision making. The blindfold emphasizes equality before the law, that the law is dispassionate and objective, and that decision making is untainted by bias. The statue also implies the stability and permanence of the justice system.

In my experience with lawyers, justice is not a regular topic in our …

Beyond Hispanic/Latino: The Importance Of Gender/Ethnicity-Specific Earnings Analyses, Rosalie Torres Stone, Julia Mcquillan Mar 2007

Beyond Hispanic/Latino: The Importance Of Gender/Ethnicity-Specific Earnings Analyses, Rosalie Torres Stone, Julia Mcquillan

Bureau of Sociological Research: Faculty Publications

The effect of economic change on the Latino to non-Latino White earnings gap has been well documented; however much of this research has focused on Latinos as a general category with little focus on subgroup variations. Despite varied histories and demographic characteristics Mexicans, Puerto Ricans and Cubans, the largest Hispanic subgroups, have usually been combined in analyses of earnings gaps. Consequently, we know little about differential effects of the “new economy” on earnings by subgroup across labor markets. Using a sample consisting of Mexicans, Cubans, Puerto Ricans, and non-Hispanic Whites residing in 106 metropolitan statistical areas (MSA) from the 2000 …

2007 Symposium On The Future Of Legal Education, Nicholas S. Zeppos Mar 2007

2007 Symposium On The Future Of Legal Education, Nicholas S. Zeppos

Vanderbilt Law Review

Like the proverbial elephant, law school appears different when perceived from different perspectives. During my twenty years as a law professor, I saw law school as a professional training program, a legal research institute, and a wonderful group of academic colleagues. The articles in this Symposium on the Future of Legal Education, based on a conference held at Vanderbilt in spring of 2006, generally view law school from a similar perspective. Now that I'm a Provost, my perspective is different. This raises some new issues, but it also underscores the basic theme of the Symposium. Law schools, like business schools, …

A Lawyer's Lament: Law Schools And The "Profession" Of Law, Wayne S. Hyatt Mar 2007

A Lawyer's Lament: Law Schools And The "Profession" Of Law, Wayne S. Hyatt

Vanderbilt Law Review

Back in the mid-eighties, I offered a first year, second semester "un-elective" called American Legal Theory and American Legal Education. It scrunched together two history courses I had taught irregularly before. I liked the way the two topics fit together and still do, but with so many recalcitrant law students enrolled in it, the course was an unmitigated disaster. As is always the case with such attempts at offering perspective, amidst the shambles I had acquired at least a few devoted students. At the end of the last class one of them came up to the front to ask a …

Solving The Lawyer Problem In Criminal Cases, George C. Thomas Iii Feb 2007

Solving The Lawyer Problem In Criminal Cases, George C. Thomas Iii

Rutgers Law School (Newark) Faculty Papers

We are learning that the vaunted American adversarial system too often fails to protect innocent defendants. Part of the problem is that indigent criminal defenders, in many parts of the country, are overburdened to the point that they cannot always provide an adequate adversarial testing of the State’s case. Part of the problem is the emotional burn out that many defenders experience. A less well known part of the problem is that the very nature of the adversarial mentality too often causes prosecutors to cut corners and thus threaten innocent defendants. “Solving the Lawyer Problem in Criminal Cases,” a 9,000 …
